David Galbadone faces first-degree murder charges after fatally stabbing passenger Raymond Cohen during an Albuquerque bus altercation sparked by a dispute over punctuality. While Cohen initiated the violence by throwing the first punch, Galbadone pursued him outside the vehicle and stabbed him at least twice before police arrived. Commentators debate whether this constitutes premeditated murder or a crime of passion, noting that Galbadone's pursuit strengthens the prosecution's case despite his clean background check. Ultimately, the tragedy highlights the volatile consequences of escalating conflicts in public transit spaces. [Automatically generated summary]

Bus Driver Faces Murder Charges00:10:21
A shocking video tonight shows a passenger starting a fight with the City of Albuquerque bus driver.
But it ends with the driver facing murder charges.
We have to warn you, the video is graphic and may be hard to watch.
Research team's Gabe Chavez shows you how it all unfolded in just two minutes.
A violent start to a July morning in northwest Albuquerque, one that quickly turned deadly.
The city bus driven by 41-year-old David Galbadone was making its rounds around 6.30.
He picked up two passengers along Coors, but one had something to say about his punctuality.
The taxi will get you there on title.
The older passenger continues griping out Galbadone, who fires back.
We ain't leaving nowhere, guys, till this guy gets off the bus.
He stopped the bus near Coors in Hanover and demanded the older man get out or he's not moving.
Passengers were annoyed.
Raymond Cohen steps into the argument.
When you're saying the rest of us here, said that we shut up, yeah, that's not the best didn't say.
So what do you want me to say?
It goes south fast, with Cohen throwing the first punch.
Yeah, got a new show for y'all.
Got a damn good show.
Before we get to today's video, I want to tell you about my new giveaways.

I'm on the bus driver's side.
That bus driver's a jerk.
Yeah, but the customer came in and called him out.
You always late.
Well, what happens on public transportation, I get it.
But then the bus driver's talking condescending to him like he's got all this money to get a taxi.
Won't you get a taxi?
Get you there faster.
People that's on the bus, they're flat broke.
He knows it.
The bus driver knows it.
So he said, I know how to get him.
I'll be kind of saying, won't you just get you a taxi?
Get your lot there.
Get your lot.
Get you there a lot quicker.
I mean, beggars can't be, you know, choosers.
But exotic, if you're taking public transportation, you can't be like being condescending and patronizing to the bus driver either.
I think both of them are in the wrong.
Both of them are idiots.
I'm with the bus driver.
Okay, let's see if you see.
I'm with the bus driver.
Okay, let's see if you stick.
You don't like it?
You can go shoot videos with somebody else.
How about that?
All right.
Let's watch this.
I'm going to see if you stick with yourself fast with Cohen throwing the first punch.
Galbadone grabs Pepper Spray.
The two eventually separate.
Cohen goes to the back and Galbadone leaves the bus in anger.
Video cameras on the bus show Cohen.
So he gets off the bus.
He said, I had enough of this.
Why is he getting off the bus?
I guess he got, I guess he's trying to get some fresh air.
I don't know.
What do you think he's getting off the bus?
He got some purple spray in his face.
He's trying to get some fresh air.
He shouldn't have got off the bus.
Why?
He should just go.
Oh, I see what you're saying.
Cohen watching the bus driver.
Cohen then exits from the back of the bus where the fight then continues outside.
Galbadone can be seen reaching back.
Look at this crazy dude getting off the bus.
Public reputation is like a minimal asylum.
It is.
Every inner city.
Look at the dude getting off the bus.
They got a senses.
Yeah.
Hold on.
I want to see him get off the bus.
Continues outside.
Gobbledone can be seen reaching back and grabbing what appears to be a knife.
You can see him stab Cohen at least twice on camera.
Cohen is seen backing away, cursing, and Galbadone goes after him again.
You still with the bus driver?
Yeah, I'm still with the bus driver.
He's stabbing him twice.
Well, he threw the first punch, right?
What the hell's wrong with you?
We mean what the hell's wrong with me?
He got off the bus.
The dude that got off the bus in the back, back of the bus that he was fighting with, he pursued him.
I know.
I'm with the bus driver.
You didn't see how he's the bus driver after he stabbed him twice, he follows him?
Yeah, that was wrong.
But with the two stabbings, I'm cool with that.
Okay, but this part right here, backing away, cursing, and Gobadon goes after him again.
You admit that's crazy, right?
No, well, he's been fighting with this dude.
He lost his cool.
Well, he just being human.
Keith, I'm with the bus driver.
He shouldn't have pursued him after the fact.
Okay.
But he was getting off the bus to get him some fresh air.
All right?
The other guy pursued him, tried to swing some more.
So Chubby's crazy.
Yeah, that's self-defense, though.
Okay.
I think.
Again, even as Cohen tries to leave, according to court documents, the two end up in front of a gas station and kept fighting.
Cohen eventually.
That's crazy.
The bus driver pursued him.
Right.
And he kept fighting.
You still think the bus driver's in the right?
Not now, no.
No.
But he had the right to defend himself.
Yeah, he has the right to defend himself, but he doesn't have to pursue him to another place and continue the fight.
Well, maybe he still thinks he's a threat.
Hey, Kev, that's...
What's wrong with you?
That dude died.
He did?
Well, Keith, I don't know this.
You already saw the dude.
You didn't hear that at the beginning of the video.
He died.
Oh, I didn't hear that part.
Sorry.
Yeah, that ain't funny.
She goes down.
Officers arrive minutes later.
Cohen is taken to UNMH, but does not survive.
Gobladon is arrested.
Gabe Chavez, K-R-Q-E, News 13.
Double Dawn is facing first-degree murder.
A judge ordered that he be held in jail until his trial.
A grand jury indicted him today.
You didn't know he died, huh?
That's why he's laughing.
No, I missed that part.
But no, it's not funny.
You crazy getting stabbed.
That's life or death.
Yeah, no.
I thought he, like, cut him.
No, he died.
Hey, Keith, but I mean...
Oh, I don't think that's first degree.
I don't think it's first degree.
He didn't plan to kill that dude.
He lost his school.
No, he didn't plan to kill him.
I think it's.
Yeah.
When you stab somebody, what you think you're doing?
Hey, Keith, he's on the bus.
That other dude, the dude that ended up dying, he threw the first punch.
I totally understand that.
He effed around and found out.
I understand that.
But once he got off the bus, he's getting off the bus.
Why are you getting off the bus re-escalating the situation?
I don't think he got off the bus to re-escalate.
I think you're trying to get him some fresh air.
I'm going to give him the benefit of the doubt.
He's a city worker.
That dude's a nut.
Yeah, and the other dude's a nut too.
Nuts die all the time.
Yeah, but he deserved first degree.
I don't think he pursued him after the fight's over.
After he's poked him twice, he walks away and they get in the fight again.
Why?
If it's first, okay, I'll go to the job, get in your bus and leave.
Yeah, I know, but maybe he needed some fresh air.
Maybe he's got asthma.
I don't know.
But the other guy pursued him at first when they both got off the bus.
Now, the bus driver messed up when he pursued him.
When did he, um, what was the fatal blow?
The fatal, the fatal blow.
It probably looked like forensic files over here.
You think I got access to all the case files?
Yeah.
Now, this is what I'm trying to say, and this is why I brought that up.
If the fatal blow was after the fact when he was pursuing him, when that dude was trying to walk away after he didn't stab him, I would say that's that's definitely more than likely what happened.
It's definitely murder.
That's definitely what happened.
Yeah, but I don't think it's first degree.
What do you think it is?
Third degree crime of passion, like second degree murder.
Because Keith, he's the bus driver.
That dude threw the first punch.
He sucked him real good in the face.
Honestly.
And that dude's, man, how many times you get sucked in the face?
You gonna sit there and stay calm?
You think I'm behaving like this dude right here?
You think I'm behaving like him?
First of all, you think I'm talking, I'm on public transportation.
There's a bunch of nuts getting on my bus every day.
You think I'm gonna talk condescending to these people?
Anything will set them up?
They already broke.
They ain't got no money.
They ain't got no money for a car.
I'm gonna talk down to them.
You think I'm doing that?
Calm down.
Calm down.
You think I'm gonna do that?
He drives the same route.
He knows every last one of these nut jobs.
He knows all of them.
He bets you, and I guarantee you, there's some back and forth been going on for quite some time.
And it escalated.
Well, he's a nut.
Yeah.
He's the biggest nut.
This dude is.
I think the dude that ended up losing his life, he's the bigger nut.
Because he instigated everything.
No, he's the biggest nut.
He takes.
He uses a knife killer.
That's nutty.
Yeah.
But I don't think it's first degree.
Crime of patch, second degree.
Yeah, you'll make it.
Who cares?
What bus driver gets on a bus and say, I'm going to try to, I'm going to take someone's life today?
I get that.
You putting all the onus on the bus driver.
The dude is human.
No, see.
You know how much crap that dude puts up everybody.
A chief comes up with the ponytail, starts sock in your face.
Every day you're getting belittled.
You're getting trash talked to you.
And it just culminated into this.
That dude trying to calm down.
He walks off the bus, gets the fresh eye, trying to calm down.
He's probably shaking.
That was a crazy fistfight.
And he lost his school.
It's a crime of passion.
I don't think it's first degree.
And I very seriously doubt they convict him of first degree.
You ain't no true Republican.
Huh?
You ain't no Republican.
We're tough on crime.
I'm a judge.
I'm a prosecutor.
I'm going for first degree.
You know what?
I ain't giving you no bail as a judge.
Nah, man, that dude's a city worker.
He passed a background check.
The dude's obviously a decent guy.
This is Albuquerque, New Mexico.
It's a blue state.
Right.
You think they actually do background checks on city workers in Albuquerque?
That blue state?
Are you crazy?
Just because the blue state don't mean it.
Hold on back.
Oh, big states are.
They gained 10 points during the last election.
They still crazy out there.
Ain't that where that judge was helping that illegal immigrant?
