[00:03:10] I'll be honest with you, they talk about a lot of different issues and if I tried to cover them all, I'd be here all day. [00:03:16] So I'm only going to cover one. [00:03:18] Maybe in future videos, I'll pick up some more issues and I'll decide who is right and wrong. [00:03:22] Again, I am the lead attorney, practiced law down here in Atlanta over 20 years. [00:03:27] I've handled countless criminal cases, so I've got a perspective on this. [00:03:31] Now, Lackluster and Officer Tatum are arguing back and forth about numerous issues, but I'm only going to pick up one today. [00:03:38] Today, we are only going to talk about the rain issue. [00:03:42] Was the officer correct in pulling over the driver because he didn't have his headlights on? [00:03:49] Yeah, absolutely. [00:03:49] There's a reason why I'm pulling you over. [00:03:51] For one thing, Inclement Weather, you don't have the lights on. [00:03:54] Now it needs to be said that the officer had a couple of more reasons why he pulled the driver over. [00:03:59] But we are just going to focus on the headlight issue and the rain issue. [00:04:03] Was the cop stopped him for the rain issue? [00:04:06] Yeah, he said you don't have your headlamps on during inclement weather. [00:04:10] I don't see any inclement weather. [00:04:12] Yeah. [00:04:13] Yeah. [00:04:13] He says you don't have your headlamps on during inclement weather. [00:04:17] I do not see inclement weather. [00:04:19] So that cop pretty much put his foot in his mouth already. [00:04:22] Yeah. [00:04:22] They also found out that he had a suspended license. [00:04:25] Yeah. [00:04:25] And his registration was expired. [00:04:27] But that was only learned after they investigated and after they did the stop. [00:04:32] So they'll stop him for no headlamps. [00:04:34] Yeah, but they stopped him from no headlamps. [00:04:35] So if he, if it, if he followed the law appropriately, the cop, then the stop is good. [00:04:41] But if he did something wrong and he didn't stop that dude rightfully, then the stop is bad. [00:04:48] And everything you learn from that traffic stop is, what you call it? [00:04:52] I forget the legal term, but everything's thrown out. [00:04:54] Everything's thrown out. [00:04:56] But the cop said you don't have your headlamps on during inclement weather. [00:05:01] I don't see any inclement weather. [00:05:03] Yeah, but this attorney's going to break it down from the law standpoint. [00:05:07] Not any bias is Republican or Democrat from the law perspective, which is the way we all should see this. [00:05:14] The driver required to have his headlights on because of the rain. [00:06:07] By the end of this video, you will know decisively who is right and who is wrong in this debate. [00:06:13] And it's very important for me to tell you that you're not going to know who's right or wrong just because I told you. [00:06:18] You are going to know who's right and who's wrong because you critically thought for yourself. [00:06:22] So here's what we're going to do. [00:06:24] It is your first day in law school. [00:06:27] You are sitting in my criminal law class. [00:06:30] I am your professor, Professor Lee. [00:06:32] Today, we're going to talk about this case and whether the officer was allowed to pull the driver over because he didn't have his headlights on. [00:06:41] Again, there are a lot of other issues that we can talk about, but I don't want to make this video too long. [00:06:45] So was the officer allowed to pull the driver over because the officer saw that he didn't have his headlights on? [00:06:53] That's the question that I'm asking you. [00:06:55] And you, it's your first day of law school. [00:06:57] You say, well, I don't know. [00:06:58] How am I supposed to figure it out? [00:07:00] Well, I'll tell you, young student, if you have a question about the legality of something, the first place you go to is the law. [00:07:08] You go to the state statute. [00:07:09] All right, here is the state statute right here, the Florida Senate, the Florida statutes, when lighted lamps are required. [00:07:17] All right, this is going to explain to us when you have to have your headlights on. [00:07:22] If the officer saw that the driver did not have his headlights on when required, then the officer was correct in pulling him over for this violation. [00:07:31] Let's read it. [00:07:32] It says, every vehicle operated on a highway within the state shall display lighted lamps and illuminated devices as herein respectively required. [00:07:43] Okay. [00:07:44] Number one, at any time from sunset to sunrise. [00:07:47] So basically at nighttime in the twilight hours. [00:07:51] Here is where we get into the thick of things. [00:07:54] You are required to have your headlights on during any rain, smoke or fog. [00:08:00] So if I ask you, young student of mine, when in Florida are you required to have your headlights on? [00:08:06] Uh, relevant to this specific case, the answer is during any rain, smoke or fog. [00:08:13] You got that rain, smoke or fog. [00:08:16] That's it. [00:08:17] Now you guys may say wow, being a lawyer is pretty easy. [00:08:20] I know what rain means, I know what smoke means, and I know what fog means, right? [00:08:25] Well, I got you. [00:08:26] The most important word when we analyze this particular situation is not rain, is not smoke, and it's not fog. [00:08:33] What's the most important word? [00:08:35] It's during. [00:08:36] You see here, guys, this during here, this is the operative word. [00:08:40] This state statute honestly is very specific. [00:08:44] It doesn't say before it's raining. [00:08:46] It doesn't say after it's raining. [00:08:48] It says during the rain. [00:08:50] So what does that mean? [00:08:51] It means that the officer has to initiate the traffic stop during the rain. [00:08:57] The officer has to pull this driver over while it's raining. [00:09:01] The pulling over of the driver and the rain needs to occur simultaneously. [00:09:07] Is that clear to you? [00:09:08] And since you're a first-year law student, it's your first day of class. [00:09:11] You might say, well, that's not really what they meant, right? [00:09:13] They didn't mean during. [00:09:15] No. [00:09:15] The United States Supreme Court, all the way down to all the lower courts, have always said that the legislature means exactly what they've said. [00:09:25] If the legislature would have wanted to write this law to say, you know, before the rain, then the legislature could have done that. [00:09:32] If the legislature wanted to say 30 minutes after the rain or an hour after the rain, the legislator could have wrote that in the statute. [00:09:40] The legislature did neither, however, the legislature said during. [00:09:44] These state legislators are all adults. [00:09:47] Probably half of them are attorneys. [00:09:49] So they know how to use their words well. [00:09:51] And they all said during. [00:09:54] What does during mean in this context? [00:09:56] It means two events occurring simultaneously. [00:10:00] The pulling over of the driver and the rain. [00:10:03] We got that? [00:10:04] We're on the same page. [00:10:05] Now you know how to analyze this case legally. [00:10:09] Now, let's go to the facts of this case. [00:10:11] Was it raining? [00:10:13] Here we have the driver's car and we can clearly see water droplets. [00:10:18] Now, let me ask you, law student, thinking critically, if there are water droplets on a car, does it necessarily mean that it's raining? [00:10:26] This is easy for you, even though it's your first day. [00:10:28] Obviously, the answer is no. [00:10:30] Water droplets can be on a car for numerous reasons. [00:10:34] Water droplets could be on a car because it rained 15 minutes ago. [00:10:37] Water can be on a car because the car got washed. [00:10:40] Water could be on the car because the car rolled over a puddle and water splashed on the car. [00:10:46] So I hate to stop him right there, but the road looks dry to me. [00:10:53] Yeah. [00:10:53] I don't think it rained a lot. [00:10:55] And plus, when you see the actual footage from the traffic stop, the cops show up with no headlamps and you see cars coming up and down the road with no headlamps on. [00:11:02] And to be honest, how many cops pull people over while it's raining and people don't have their headlamps on? [00:11:08] Yeah. [00:11:09] If I'm a cop, I'm not writing that ticket. [00:11:11] I'm going to get all wet. [00:11:11] What's the point of doing that? [00:11:12] Standing in rain, pulling someone over because they don't have the headlamps on. [00:11:16] I don't think I've ever turned my headlamps on during the day while it's raining because, you know, it didn't, it didn't come to my, it didn't come to me as, hey, I got to turn my headlights on. [00:11:26] I can still see it's still raining. [00:11:27] I was actually, I think our cars, the lights come on automatically. [00:11:31] Automatically, yeah. [00:11:32] I think, I think this is an older car. [00:11:33] It's like, I actually didn't know about this law. [00:11:36] It's pretty, it said like when it's raining so hard where I got to turn my damn lights on, yeah, I pull over to the side of the road until it stops raining personally. [00:11:42] Right. [00:11:43] Right. [00:11:44] Just because there are water droplets on the car does not mean that it's raining. [00:11:54] And what I want you to look at, young student, I want you to see if there are any new droplets that you see forming on the car as the video plays. [00:12:09] If you see new water droplets, then we can assume that that's rain. [00:12:13] If we see no new water droplets, then what does that mean? [00:12:16] All right, let's play the video. [00:12:25] I'll be honest with you. [00:12:26] I'm looking at the glass. [00:12:28] I'm looking at the molding. [00:12:30] I'm looking at the door. [00:12:31] I see no new water droplets. [00:12:34] Do you guys see any new water droplets? [00:12:37] No, I saw one. [00:12:38] I don't see one. [00:12:43] We're just letting it play here. [00:12:45] There's another one. [00:13:00] But if I'm honest with you, I saw no new water droplets forming on that car. [00:13:06] So, young student of mine, this is the question for you. [00:13:09] All right, you ready? [00:13:10] During the time that the body cam video was taken, was it raining? [00:13:14] That's your question. [00:13:16] Now, I do need to point out that it is technically possible for the officer to have pulled the driver over, and then five, ten, twenty seconds when the officer gets up there, it stops raining. [00:13:28] So that it was raining when the officer pulled the driver over, but it's not raining 20 seconds into the video. [00:13:35] That is a possibility technically, but just going on the video as we see it, I believe it is not currently raining. === The Reality of Police Immunity (05:10) === [00:13:42] What did we say about the law? [00:13:43] We said, young law student, that every vehicle operated upon a highway, every driver is required to have their headlights on during any rain, smoke, or fog. [00:13:55] So, was this driver required to have his headlights on? [00:13:59] If the officer pulled the driver over during the rain, then yes. [00:14:04] But if the officer pulled the driver over when it was not raining, then no. [00:14:09] Now, when you hear all these content creators, these YouTubers talking about this issue, and you don't know who's right. [00:14:15] Now, you know how to think for yourself. [00:14:17] Now, you know how to legally analyze whether this driver was required to have his headlights on or not. [00:14:23] Now, law student of mine, I'm going to give you a quick pop quiz. [00:14:28] I am going to have you analyze some of the comments of the regular people, the people who are not in law school like you are. [00:14:35] And I want to see if you can identify any issues with how these laymen are thinking about this case. [00:14:42] All right, I've seen enough. [00:14:44] Um, Lackluster, that's the point of view he came from from this attorney's point of view. [00:14:49] Yeah, yeah, I thought that's the law. [00:14:52] If the cops stopped have their rightful uh reason to stop you, all the evidence gathered during that stop, they can use it in a court of law. [00:14:59] I believe personally, they made a bad stop, it wasn't rated raining. [00:15:03] They had no right to pull them over, and all evidence they obtained during that traffic stop, like his registration being expired, or no insurance, the Rambo knife, the Rambo knife, um, having a suspended driver's license, all that is thrown out in court. [00:15:18] Even if they found a dead body in that car, that is thrown out because the stop was illegal. [00:15:24] We have constitutional rights now. [00:15:26] That guy, I forget his name, but he's already played guilty. [00:15:30] Probably because they found that knife and they say, if you don't plead guilty, we're gonna um coerce him to um plead guilty because of that knife, yeah, totally. [00:15:44] I've never been a cop, but when you look at this from a legal standpoint, just in my personal opinion, I think the stop was bad. [00:15:51] I think the force was excessive.
