[00:02:35] This time about a picture of seashells on a North Carolina beach a year ago. [00:02:41] And this won't be the end of it. [00:02:44] But nothing has changed with me. [00:02:45] I'm still innocent. [00:02:47] I'm still not afraid. [00:02:49] And I still believe in the independent federal judiciary. [00:02:52] So let's go. [00:02:54] But it's really important that all of us remember this is not who we are as a country. [00:03:00] This is not how the Department of Justice is supposed to be. [00:03:21] And I want to know what you said back when this initially came out in 2025. [00:03:25] You said at first you didn't think Comey meant. [00:03:28] Kill him and you interpret it as getting him out of office. [00:03:31] That's that was very, very generous of you. [00:03:34] But then you heard Tulsi Gabbard talk about how he actually may have violated the law, and you kind of changed course. [00:03:43] You said that he has spent his career prosecuting the mob, he knows exactly what '86. [00:03:49] Well, that's the way I remember it. [00:03:51] I remember at first saying '86, real, um, because I believe '86 it came from uh, something in New York. [00:04:00] I'm pulling this way out of my butt. [00:04:02] Somebody in New York during Prohibition. [00:04:07] And one street address on one side was like 125th. [00:04:11] And on the other side of the block, it was like 86. [00:04:14] And it meant get out of that door. [00:04:16] Go 86 it. [00:04:17] So go through the 86 exit because the cops are coming in to the other exit. [00:04:22] And so I interpreted it more like that. [00:04:24] But then I remember hearing Tulsi Gabbard talk about it. [00:04:26] And she talked about him with the mob and how the mob uses 86. [00:04:32] That is the order to kill. [00:04:34] And so I. [00:04:36] I adjusted and was like, well, no, he's not more of a historian. [00:04:40] He's more of a prosecutor with the mob. [00:04:44] He would know exactly what that means. [00:04:46] Okay, so I'm still there. [00:04:49] He knew what that meant. [00:04:50] This whole innocent bull crap. [00:04:52] Okay. [00:04:53] But now let's look at what he was indicted on. [00:04:57] Here are the charges count one, threatening the president, a violation of U.S. Code 188718. [00:05:04] I'm not going to read all these codes. [00:05:06] Um, It makes it a crime to knowingly and willfully make a threat to take the life of or inflict bodily harm on the President of the United States. [00:05:19] Is that what he did? [00:05:21] Is that what he did? [00:05:23] You got to go back to the Vietnam War. [00:05:25] The Supreme Court, there was a kid, Jonathan Turley pointed this out the other day. [00:05:30] There was a kid in the Vietnam War who said, if they give me a rifle to fight and I have the opportunity, the first one I'll shoot is LBJ. [00:05:42] Okay. [00:05:42] And the Supreme Court said that wasn't a violation. [00:05:47] If that wasn't a violation, certainly seashells is not. [00:05:52] And I'm not saying that's right or wrong. [00:05:53] I'm just saying that's where the court decided with LBJ. [00:05:58] And we were living in exactly the same kind of thing. [00:06:01] People had been killed, et cetera, et cetera. [00:06:04] Count two transmitting a threat in interstate foreign commerce. [00:06:08] I love this one. [00:06:09] This prohibits knowingly transmitting via Instagram, which Crosses state lines, a communication containing a threat to injure or kill another person. [00:06:18] The indictment uses similar reasonable recipient language as above. [00:06:24] Maximum penalty is up to 10 years, five years for each count. [00:06:30] Now. [00:06:40] It's not going to make me popular with you today, but that's okay. [00:06:43] My job is to tell you what I think and how I'm looking at it, and I'm not here to convince you of anything. [00:06:51] I'm just here to tell you this is what I think. [00:06:54] And this is not going to be popular with people who are sick and tired, because I am too, sick and tired of these people getting away with anything. [00:07:05] And you know what? [00:07:05] You could make a case to me that going after Al Capone for income tax was the right thing to do. [00:07:12] But I wish we could get people on. [00:07:14] Actual things that they did and not income tax. [00:07:19] But I don't think this is income tax. [00:07:21] I don't think you can prove anything. [00:07:24] Now, let me say this. [00:07:26] Jason, what did I say earlier this morning when I first came in? [00:07:29] We first talked about this. [00:07:31] It's important that I preface it, and I didn't. [00:07:35] So let me do it now. [00:07:35] It is important that I preface it with what we know right now. [00:07:43] For them to file this. [00:07:45] Indictment with the seashell picture seems pretty light. [00:07:52] You know what I mean? [00:07:53] That seems like anybody in the office would go, Yeah, that's not going to work. [00:08:00] That's not going to hold. [00:08:00] That'll be rejected immediately. [00:08:03] So, with what we. [00:08:06] Other things that are in the indictment that we don't know of. [00:08:14] And is there any indication of that, Jason? [00:08:16] A little bit. [00:08:17] The acting attorney general did say that it's up to the government to prove this basically through receipts. [00:08:22] So he acknowledged that this is, you know. [00:08:25] There are receipts coming. [00:08:27] That's what it sounded like that there's more to come. [00:08:30] Okay. [00:08:32] So here's my feeling on this. [00:08:34] If there's more to come, there's really nothing to debate. [00:08:37] We shouldn't be arguing with each other about this right now. [00:08:39] We should watch and see what's coming. [00:08:42] Why borrow trouble? [00:08:43] Why argue with each other? [00:08:45] Why call each other traitor names and you're just against this or you're just for this? [00:08:50] Stop. [00:08:50] We don't have all of the facts yet. [00:08:52] Let's see this play out. [00:08:55] My initial take, if this is all they have, is two one, it won't hold up constitutionally. [00:09:02] And two,. [00:09:12] I'm not a fan of Pam Bondi. [00:09:28] What did she do? [00:09:30] Now, we have this new acting attorney general who's coming in, and all of a sudden, we're starting to see things. [00:09:37] We're starting to see action. [00:09:38] Okay. [00:09:39] I want to see real action. [00:09:42] I don't want. [00:09:46] It doesn't help us make the case that these guys are bad by going after these kinds of things, okay? [00:09:55] The shells. [00:09:56] I want, if this is the best the FBI has on Comey, we're in trouble. [00:10:02] That means nobody's done anything. [00:10:05] If this is what you're like, we can get him on this, what do you say we try this one? [00:10:10] We're in trouble, okay? [00:10:11] They haven't done jack. [00:10:15] This could be an attorney general. [00:10:19] That are a guy who's acting as attorney general and wants the job saying, Oh, I'm gonna throw everything at them. [00:10:27] I'll throw everything. [00:10:28] And I'm for throwing everything at them and seeing what sticks. [00:10:32] But I wouldn't have started with this. [00:10:34] I would have added this on top of all the other things. [00:10:37] You know what I mean? [00:10:37] I wouldn't have started with, and now we got you. [00:10:40] Now we got the real heavy guns out. [00:10:42] We're gonna start with the seashells. [00:10:45] So that bothers me. [00:10:47] Can I pose a theory? [00:10:48] Yeah. [00:10:49] Do you remember when they threw everything at Trump administration officials? [00:10:53] Yes. [00:10:54] While they didn't get them on real crimes, they got them on some easy things and they got people to talk and squirm. [00:11:01] Brennan is under investigation right now. [00:11:05] Do you think it's possible they're using this as a way to get Comey to talk and pit him against Brennan? [00:11:13] I don't think Brennan, I mean, I don't think there's a true legal scholar that would look at this and say, I don't know, that's real trouble. [00:11:25] I think there are legal scholars out there that might go, I don't know, you can give it a whirl. [00:11:30] But there's nobody that says that's trouble. [00:11:31] And you're not going to get anybody to flip unless they think you're serious. [00:11:35] I've got you. [00:11:37] That's the difference between this and what happened with Fauci yesterday. [00:11:41] Explain what happened with Fauci's cohort yesterday. [00:11:45] Fauci's right hand man basically was, it looks like he's caught red handed in his FOIA communications, saying that, you know, basically, Doing exactly what they need to do, looking like they need to do exactly what they need to do to avoid any kind of scrutiny or get around FOIA. [00:12:02] So, whatever we want to talk about that could be damaging to our narrative, we got ways to talk about it. [00:12:10] So, that one to me is, oh, I'm coming for you. [00:12:16] The federal government has you saying these things. [00:12:19] That would scare the living bat crap out of me. [00:12:24] If I'm James Comey and I see the seashell thing, I'm like, okay, go ahead. [00:12:28] Go ahead. [00:12:28] It's going to make my life a pain in the ass, but I'm not going to prison on that. [00:12:32] If I am Fauci's number two guy, I look at that and go, I could be going to jail for a very long time. [00:12:38] And they're going after him because they're saying to him, I can guarantee you, they're saying to him, we have you dead to rights. [00:12:46] You're going away for a very, very long time. [00:12:50] Now, there is something we can do to lessen that. [00:12:54] You could start giving us more dirt on people. [00:12:58] You can give us. [00:12:59] Access to these things because you obviously know how the whole thing is. [00:13:04] They're trying to get him to flip. [00:13:06] I can't imagine. [00:13:07] I'm sure they would want to get Comey to flip, but I don't think they're going to get him to flip, especially on this. [00:13:15] Now, let me add one more story into the mix. [00:13:19] Jason, what happened yesterday in Minnesota? [00:13:23] So they had about 20 plus raids, you know, pertaining to the leering center type organizations. [00:13:32] That's just not the perfect thing, too, the leering. [00:13:35] They're leering. [00:13:37] Okay. [00:13:37] But yeah, it seems to be the start of this anti fraud task force actually getting down and doing something about it. [00:13:44] That is really good. [00:13:46] And that's led by this new attorney general as well. [00:13:51] I'm telling you, I could be wrong on this. [00:13:54] But if I'm President Trump, look at what he did as soon as this war started. [00:13:59] Hey, Marco, you come on over with me. [00:14:01] We're working on the war thing. [00:14:03] Okay. [00:14:58] They will not forgive you for not paying attention to them. === Moral Licenses and Subsidies (13:25) === [00:15:02] If they feel this administration has abandoned them and is no longer responding to them, it's just all about oil and the gas and all of this stuff, they are not going to have any patience for it at all. [00:15:14] Donald Trump has taken and said to JD Vance, go get the fraud. [00:15:21] Go get them in Minnesota. [00:15:22] More importantly, go get it in California. [00:15:26] You get that fraud and you start nailing that. [00:15:29] You start putting people away. [00:15:31] A, you're going to start feeling good about the government's doing stuff and putting bad guys away. [00:15:35] You're also going to go, hey, thank God somebody is looking out for the little guy and not giving all of our money away to all these fraudsters. [00:15:43] And the guy who's doing it is going to be running for president of the United States. [00:15:48] It's a brilliant move. [00:15:49] I think that's what he's doing. [00:15:51] So, fraud in Minnesota, great move from our assistant attorney general, our acting attorney general yesterday. [00:15:57] The Comey thing, let's just watch to see if they have anything else. [00:16:02] And the other FCC, we just covered that and told you exactly what has to happen there. [00:16:10] I think that clears all of this up and lets people who are MAGA, people who believe in Donald Trump, keep their values. [00:16:19] Keep their principles, not be somebody who's out for blood and just headhunting, but demanding actual justice using actual law. [00:16:28] I think that's a win. [00:17:25] I'm so sick of all of this stuff, but I want to make sure we're not violating the principles that we all hold dear. [00:17:33] So. [00:17:34] I said yesterday that if I worked at ABC, if I were running ABC, I'd fire Jimmy Kimmel in a heartbeat because of standards. [00:17:41] It's just, it's reprehensible what he has done. [00:17:46] And I would send a message to the country, we're not for that. [00:17:49] Okay. [00:17:50] And if I would have said something like that about Barack Obama at Fox, I would have expected to be fired. [00:17:57] However, with that being said, I don't see the FCC move here. [00:18:03] And if there is an FCC move, I'd prefer the president, although I do prefer that he's out in the open, unlike Joe Biden, where they're hiding it. [00:18:11] I prefer that it's not directed by the president. [00:18:14] I prefer that it is something that is just the FCC takes care of because it's a clear violation. [00:18:30] First, the moral obligations, then the regulatory obligations. [00:18:35] And then, what I find most important is the obligations of our movement in order to establish barriers and to have instructive moments. [00:18:43] And I think this is one, certainly. [00:18:45] The moral obligation. [00:18:46] Glenn, you had a hit show on Fox for how many years? [00:18:49] A decade. [00:18:50] You were the number one rated broadcast in the world on cable news for how long? [00:18:56] I don't know. [00:18:56] Two years. [00:18:58] Okay. [00:18:59] Either way, it was must see TV. [00:19:01] You made the chalkboard. [00:19:03] You probably sold more. [00:19:03] You're probably the biggest chalkboard salesman in the history of the world. [00:19:39] If you had said, Michelle Obama deserves to be a widow, and not only that, a glowing widow. [00:19:44] Meaning she would like for her husband to die, then you wouldn't have been pulled from the show, right? [00:19:50] You wouldn't. [00:19:52] And I would have deserved it. [00:20:51] So, first off, there is no moral ground for Jimmy Kimmel to stand on. [00:20:54] If Jimmy Kimmel himself had said this about Jill Biden and used the same rationale, because Jill Biden is significantly younger than Joe, like by, I think, 15 years, and he said, well, Melania is younger than Trump. [00:21:04] That's why she's an expectant widow. [00:21:06] It wouldn't apply to Jill Biden. [00:21:07] If he had said, Jill Biden is an expectant widow, Joe Biden has terminal cancer, he'd be ripped off air, too. [00:21:12] Same thing about Hillary Clinton. [00:21:13] Hillary is younger than Bill, and Bill's not in good shape. [00:21:16] But he wouldn't be able to get away with that. [00:21:18] We all know what's going on. [00:21:19] It's permissible to celebrate and to fetishize the death of Republicans. [00:21:23] And that's what they're signaling here. [00:21:25] And so I want to just establish that morally, you wouldn't be able to get away with it any other way. [00:21:30] And the fact that they're letting them get away with it. [00:21:31] I 100% agree. [00:21:33] Yeah. [00:21:33] On this. [00:21:34] And then with that BS rationale, of course, that, oh, she's younger, so I can say something like this. [00:21:39] How about this, Glenn? [00:21:41] I was raised in Chewyville, Iowa. [00:21:43] This is a town of 412 people. [00:21:46] There is one gas station that's also the town bar and also the town pizzeria and also the town VHS rental shop. [00:21:52] That's where I grew up. [00:21:53] If you were to walk into that bar on a Friday night and you normally could and find a couple of old timers sitting there with their wives and they're both having a light beer. [00:22:00] Right. [00:22:00] And that's how they unwind on a Friday night at the gas station bar, pizzeria, video rental shop. [00:22:06] And if you were to walk up to that farmer and say, Your wife looks like an expectant widow, what do you think would happen? [00:22:15] I get my ass kicked. [00:22:17] I get my ass kicked across the street and into the soybean field. [00:22:20] That's what would happen in Chewheeville, Iowa, where I'm from. [00:22:22] Probably where you're from too, I would assume. [00:22:24] Right. [00:22:26] Nobody would ever, like, in no universe is Jimmy Kimmel's explanation of this. [00:22:33] Not with other first ladies, not with your wife, not with anyone's wife. [00:22:37] So, on every level, this should be knocked down. [00:22:40] And the FCC is going to. [00:22:43] The FCC took action against ABC News and their own station yesterday. [00:22:46] And I want to talk through why this is different than what we could say on this program or what we could say anywhere else, because you are free to say that. [00:22:55] You are free. [00:22:56] I would be free to walk into that bar and suffer the consequences of the farmer punching me in the mouth. [00:23:01] Jimmy Kimmel is free to stand on a street corner, pick up a. [00:23:05] Cardboard box, scribble on it, and yell whatever he wants. [00:23:09] He's gone to no Kings protests. [00:23:11] He's done this. [00:23:12] I'm not saying Jimmy Kimmel shouldn't do this. [00:23:14] I'm not against Jimmy Kimmel's free speech. [00:23:15] That's free speech. [00:23:17] What I am against is taxpayer subsidized calls to assassination, which is what we are doing right now with Jimmy Kimmel. [00:23:24] Let me explain. [00:23:25] Jimmy Kimmel operates on a federal broadcast license. [00:23:28] This is from the FCC. [00:23:30] These are authorities that were granted to specific networks in 1923. [00:23:36] These specific networks have an option. [00:23:39] To operate on an electromagnetic spectrum that is considered a scarce public resource, the FCC manages and licenses specifically to prevent interference between stations so that they can have licensures and broadcasts in times of emergency. [00:23:55] These broadcasters must serve in the public interest and convenience and necessity and have core legal standards and obligations under the 1924 Communications Acts. [00:24:05] These licensees do not own the spectrum. [00:24:08] The government owns the spectrum. [00:24:09] The government gives them a temporary. [00:24:12] Privilege to use that spectrum. [00:24:14] This applies to some AM, FM radio stations. [00:24:16] It applies to all major public broadcasters. [00:24:19] That would be PBS, ABC, NBC, and CBS. [00:24:22] They have to exist under a fair time, equal time in the public interest broadcast viewers, and they can be penalized or have their licenses stripped. [00:24:33] If they are found to be broadcasting profanity, pornography, if they are found to be broadcasting untruths, things that they know are verifiable lies, if they are found to be operating outside of the public interest, which is a broad legal descriptor of what your broadcast should be. [00:24:50] And I would argue, Glenn, that since Jimmy Kimmel is using this billion, if not trillions of dollars of infrastructure that was built by the government, that's maintained by the taxpayers, that has been serviced by our Federal dollars that he should have to apply for these standards. [00:25:09] And these standards do not cover him making fun of Charlie Kirk's assassination, calling for the assassination of a duly elected president. [00:25:18] In no universe should that be allowed. [00:25:21] So that is impermissible under the operations of Jimmy Kimmel's and ABC News' lavish privileges that they get from the federal taxpayer dollars. [00:25:30] Jimmy Kimmel can do what every other bum does and get on a street corner with a cardboard sign. [00:25:36] He can start a YouTube. [00:25:37] He can go on Spotify. [00:25:38] Jimmy Kimmel can do whatever the hell he wants. [00:25:40] He can do smoke signals up in the mountains. [00:25:42] That's also free speech. [00:25:44] But Jimmy Kimmel shouldn't be able to use my tax dollars at force, which is what's going on, because if you don't pay taxes and I don't pay taxes to Jimmy Kimmel, we go to prison. [00:25:52] So that's force. [00:25:54] With that force and with that privilege comes standards. [00:25:57] Therefore, Jimmy Kimmel should be ripped off air and the FCC should do a full investigation of ABC and their broadcast licenses. [00:26:04] And sure as shooting, Glenn, that's exactly what they're doing right now. [00:26:09] So, tell me about the taxpayer funding. [00:26:12] Go a little deeper on that for me, Benny, and then let's talk about the movement because you said it was moral. [00:26:18] I think you've made the case on that. [00:26:20] Regulatory, I'm not sure. [00:26:22] And then what it means for the movement. [00:26:24] So, let's go back to the funding. [00:26:28] So, this electromagnetic spectrum is maintained by transistors, it is maintained by towers, and those towers are incredibly important to the broadcast capacity. [00:26:40] They're incredible. [00:26:42] All paid for by the local stations or the corporations, not the federal government. [00:26:48] None of that is federal government money. [00:26:51] Of course, but what those licenses allow is for federal deductions. [00:26:57] It allows for operations to be maintained throughout this system. [00:27:03] The corporations that own these licenses have these lavish privileges in order to broadcast directly into every single home. [00:27:12] How much more valuable would my program be if every TV came? [00:27:16] With the Benny show, uh, loaded in and locked in, and it's just a channel you click on and you don't have to pay for. [00:27:22] Again, like there are federal subsidies that go into that. [00:27:27] And Glenn, you've been around this business enough to know that these kind of things become massive write offs, these kind of things have huge loopholes, and one way or another, the taxpayer ends up paying for it. [00:27:40] I can't go there with you, but I can see your point, but I can't go there with you. [00:27:43] I mean, it's because that's a business expense, and it's just don't let me do your taxes. [00:27:50] I know ABC broadcast is worth much less than a cable network is now. [00:27:57] And both of them are going to hell in a handbasket because of the internet. [00:28:01] So, you know, it's not like it was 20 years ago. [00:28:05] But go ahead. [00:28:07] How much more valuable would my program be if every single TV in the country for the last 100 years had my program automatically loaded into it for $0? [00:28:18] That is a massive gift to every broadcaster that gets those precious licenses. [00:28:24] It is a gift, but it is a diminishing gift. [00:28:26] But I get it. === The Movement That Killed Him (03:57) === [00:28:27] I get it. [00:28:27] All right, go ahead. [00:28:28] But doesn't the American tax through the FCC and through the use of that bandwidth and through the giving of that bandwidth and then the maintenance, even if that maintenance comes directly from the FCC and their own staff and the licensures and the phalanx of lawyers that it takes to run the FCC and to monitor all this, isn't that prima facie a gift from the taxpayer? [00:28:52] Actually, it's a curse on the taxpayer. [00:28:54] I'd like to see all of it abolished myself. [00:28:56] Thank you. [00:28:58] But, you know. [00:29:00] Now we're talking. [00:29:28] Saw what Jimmy Kimmel did to my dear friend in the hours, the mere hours after his death, which is, of course, to lie about the nature of the shooting, to lie in favor of the assassin, to lie about who the assassin was and why they killed Charlie. [00:29:48] To call him MAGA is to say that Charlie deserved that death because Charlie would have been a MAGA movement president in the coming years. [00:29:55] He would have been probably 49 or 50. [00:29:58] And so to say that his shooter was MAGA is to say that. [00:30:02] Charlie created the movement that killed him, which is, of course, the opposite of what happened. [00:30:06] Jimmy Kimmel refused to talk about motive. [00:30:09] He did the same thing, by the way, in his non apology to Melania Trump last night. [00:30:13] He refused to talk about the gunman's motive in Washington, D.C. [00:30:18] This alone is, of course, lying by omission. [00:30:20] They know damn well why these people are murdering Republicans, Trump, or trying to murder Trump and murdering Charlie. [00:30:26] And so when I saw Jimmy Kimmel do that, I said, of course, this is abhorrent. [00:30:30] And we led the charge on social media. [00:30:32] To say this is totally wrong and people need to call their local broadcast affiliates to get Jimmy Kimmel ripped off air. [00:30:39] And sure enough, Jimmy Kimmel got taken off air for a week or two. [00:30:45] But what happened afterward repulsed me and made me so angry because what happened afterwards was we got woke scolded by our own side, by people on our own side. [00:30:55] Ben Shapiro, Ted Cruz, used this as an opportunity to get a little doggy treat and a pat on the head by the left and to say, In this moment where I'm simply trying to defend the legacy of Charlie and say this is discussing, which by the way, Erica agrees with me. [00:31:10] All of the individuals at Turning Point that currently operate and built Charlie's show with him, they all agree with me. [00:31:15] They were all repulsed and sickened by this. [00:31:18] So was I. [00:31:20] We had attacks from the right telling us, which is what always happens, which is, well, could you imagine if it was on the other side? [00:31:28] No, I couldn't because I don't have a federal broadcast license because the taxpayers don't subsidize my programming. [00:31:35] I am making the case. [00:31:36] I'm not making a free speech case. [00:31:38] I personally believe that my side is benefited, and certainly my channels are benefited, every time Jimmy Kimmel says something stupid. [00:31:46] Okay, I want Jimmy Kimmel to speak as much as possible. [00:31:48] I don't want to pay for it, I don't want to subsidize it. [00:31:50] And there are standards that come with that subsidy. [00:31:53] And so that was the point I was making. [00:31:55] The American taxpayer shouldn't be forced to listen to this. [00:31:58] And multiple stations like Nexstar and Sinclair said, no, we agree with you, they shouldn't. [00:32:03] And they shut Jimmy Kimmel down. [00:32:05] By preempting his show. [00:32:07] And so that is the thing that is instructive for the movement. [00:32:11] When the left gets an opportunity to exercise power over us, they take it and they wield it with an iron fist.
