Supreme Court: 17 States Support Texas; 26 States Oppose; Michigan Audits Results | Facts Matter

Good evening.
The legal battle lines in this country are currently being drawn as 17 states side with Texas in their Supreme Court election lawsuit.
Even President Trump himself has jumped into the case.
Now, over in Nevada, the court there rejected President Trump's appeal to overturn the election results.
Does he have any more options?
Over in Michigan, they are conducting a zero margin risk limiting audit.
But what does that even really mean?
And Hunter Biden is now having his business dealings with China investigated by the Department of Justice.
Let's go through these stories together.
This is your 2020 election update, and I'm your host, Roman from the Epoch Times.
Now, to start with, I want to revisit this censorship notice from YouTube that came out yesterday.
Now, I spoke with someone from our legal department, and listen to this.
This is from the bottom of one of the paragraphs that's at the very top of the statement.
And it says, News coverage and commentary on these issues, meaning election issues, can remain in our sight if there is sufficient education, documentary, scientific, or artistic context.
Okay.
Well, let me ask you this.
Who's going to be the one deciding whether there is sufficient education, documentation, scientific, or artistic context?
Who has the power to judge that for all of America?
Well, because it's YouTube, it's probably going to be some 22-year-old kid living in Silicon Valley whose job it is to drink espresso, watch videos, and determine whether they are sufficiently educational, scientific, or artistic enough to have them shared out to all of America, or whether he should go ahead and delete them.
Fun times we live in.
Regardless, we've thought about it and we decided that this show will continue on as is.
We're going to continue sticking to the facts.
We will give you all of our sources in the description box below this video so that you can research them for yourself.
And let's see where that takes us.
Now, let's talk about Texas.
So as of today, 17 other states are urging the Supreme Court to take up the Texas case and allow them to challenge the election results in Pennsylvania, Georgia, Michigan, and Wisconsin.
So yesterday, those 17 other states filed what's known as a Friend of the Court brief, where they pushed the Supreme Court to hear the case because they said that, for one, it was of great importance to the public, and two, it presents important constitutional issues under the Elector's Clause.
What issues are those?
Well, under the U.S. Constitution, the times, places, and manner of holding elections may only be prescribed by the state legislature and Congress.
And they wrote in their brief to the Supreme Court that encroachments on the authority of state legislatures by other state actors, and in this case, by the way, they're probably referring to people like bureaucrats, governors, secretaries of state, and judges, violated the separation of powers and threatened individual liberties.
Now yesterday, I also mentioned that this case might be getting a little bit more interesting.
And it did.
Yesterday, President Trump's lawyer officially filed a motion to intervene and allowed the president to join this Texas lawsuit.
In terms of the next steps, we're awaiting a formal response from the four defendant states in this case by 3 p.m.
today, Eastern Time.
And as soon as they file it, we'll let you know what they say.
All right, since we filmed the in-studio portion of today's episode, quite a few developments have come about.
Let's go through some of them together.
So the first one is that the Pennsylvania Attorney General did get back to the Supreme Court by the 3 p.m.
deadline, and he basically completely denounced the Texas lawsuit.
He wrote that it was merely an attempt at, quote, disenfranchising large swathes of voters and undermining the legitimacy of the election.
So I actually have not had enough time to fully dig through the brief, but it doesn't seem like he answered the constitutional question that was being asked, which is how come Pennsylvania's officials were superseding the Constitution with certain laws and regulations that they passed?
But we haven't had enough time to really dig and comb through it, so by tomorrow's episode, we'll definitely do that.
But he seriously denounced this lawsuit.
The Attorney General further argued that Texas has not suffered harm simply because it dislikes the result of the election.
And he said, and this is very keen here, Nothing in the text, history, or structure of the Constitution supports the view that Texas can dictate the manner in which four other states run their election.
So that's a pretty strong denunciation of this lawsuit, but the news gets bigger because, take a look at this, 22 other states.
Basically, every single state in the nation that has a Democrat as its Attorney General filed a brief with the Supreme Court requesting that the Supreme Court basically...
Throw out this Texas lawsuit.
They wrote, quote, The people have chosen, but Texas, supported by 17 other states, asks this court to overturn that choice.
Do you see what's happening here?
22 states have sided with Georgia, Pennsylvania, Michigan and Wisconsin, while 17 states have sided with Texas.
It's really the case that battle lines are being drawn in this legal civil war.
And furthermore, six states went further in their support with Texas.
Missouri, Arkansas, Louisiana, Mississippi, South Carolina, and Utah as the Supreme Court earlier today to actually let them intervene and join this lawsuit.
They filed a brief arguing that they have an interest in the question of play and that their interests may be harmed if they are not adequately represented in this action.
So this is getting pretty big and I'm just really glad that this legal civil war is being played out in the courtroom rather than on the field of battle.
So we'll keep you abreast of any developments as they're going to be coming about.

Now, let's move on over to Nevada.
Now, two days ago, the Nevada Supreme Court rejected President Trump's appeal to overturn the results of the election in Nevada.
And that decision came just a week after a district court in Nevada ruled that the Trump campaign was not able to prove allegations of errors in voting machines or that the election was somehow manipulated.
And for your reference, this Trump lawsuit originally said that more than 60,000 people voted twice in Nevada, and some were not Nevada residents at all.
Some witnesses even allege that they saw USB drives change the election vote tallies overnight.
But regardless, the Nevada Supreme Court agreed with the lower court's decision and rejected the appeal, writing that the Republican Party had not met the burden of proof, even if a lesser standard was applied.
So at the moment, it's not clear if President Trump's team is going to appeal this Nevada Supreme Court's ruling in the U.S. Supreme Court.
We actually reached out to the Trump team for comment to see what they're up to, but I've yet to hear back.

Now, let's move on over to Arizona.
Now, we had a phone interview with Sidney Powell's co-counsel, and he told us that his team is planning to fast track their Arizona case to the U.S. Supreme Court, and they'll be filing a petition for appeal in the next few days.
Now, if you don't remember, that Arizona case was filed by Sidney Powell about a week ago, and it alleged that manipulation of election software and other fraud in the state resulted in violations of both the U.S. Constitution as well as state election laws.
Specifically, among other things, the lawsuit claimed that over 412 votes were cast illegally and that the Dominion Voting System's machines were connected to the Internet, which was illegal in Arizona.
Now, just yesterday, this case was thrown out of court by the judge, who said that the allegations are sorely wanting of relevant or reliable evidence.
The judge also wrote that the remedy that Sidney Powell was seeking in this lawsuit was excessive.
She wrote that if it was actually granted, millions of Arizonians who exercised their individual right to vote in the 2020 general election would be utterly disenfranchised.
So now, I guess we'll just have to wait and see whether the Supreme Court will take up the case once that briefing is filed.

Now, let's move on over to Michigan.
Now, yesterday, the Michigan Bureau of Elections announced that it will conduct a zero-margin, risk-limiting audit in Antrim County, which is in Michigan, as part of what they're calling the most comprehensive post-election audit in its history.
And by the way, for your reference, Antrim County is where, about a month ago, about 6,000 votes were switched from President Trump over to Joe Biden in what was described as a clerical error.
Now, what exactly is a zero-margin, risk-limiting audit all about?
Well, the state described this as essentially a hand-tally of every ballot, which can then be compared with the machine-tabulated results.
Okay, well, that's pretty interesting.
Now one question that I still have is, how does this audit that they're saying they're going to be conducting relate to the forensic examination that was conducted on these Dominion voting machines in Antrim County a few days ago on Sunday?
Because if you remember, last week we did an episode on how the Trump team will be doing a forensic exam on these machines and the results will be available in a day or two.
However, now it's been about four or five days from that examination, and we're still waiting for the results.

So we actually reached out to the local officials in Antrim County, But I've yet to hear back.
And as soon as we hear any updates on either this audit or the forensic exam, we'll let you know right away.

Now, let's move on over to China.
China?
That's right, China.
As reported by the Associated Press yesterday, the Department of Justice's investigation of Hunter Biden's finances includes a probe into his business dealings with China.
Now, this probe was actually launched back in 2018, a year before Joe Biden, who is, of course, Hunter Biden's father, announced his run for the president.
Now, according to this story by the Associated Press, authorities served the subpoena to Hunter Biden two days ago.
Now, the Department of Justice supposedly did not contact Hunter Biden earlier because they, and this really made me laugh when I first read it, because they apparently have a practice against taking overt investigative actions in the run-up to an election.
Which if you know anything about the FBI's crossfire hurricane investigation into the Trump campaign in 2016, you might have a little bit of doubt about that practice of whether that's congruent with reality.
But anyway, you might have not actually heard a lot about this Hunter Biden story because it was extremely heavily surprised by both the legacy media as well as social media.
But basically, Hunter Biden's business dealings should have become a major national topic about two months ago.
That was when a former business partner of Hunter Biden emerged and shared a treasure trove of text messages and emails, some of which revealed how close of a relationship Hunter Biden had with a Chinese billionaire.
Other messages suggested that Joe Biden was aware of his son's business dealings as well.
In one of these emails, for instance, Hunter Biden was assigned a portion of an equity share, about 10%, which he would have to hold for the big guy.
And according to Hunter Biden's business partner, Joe Biden was the big guy.
And last year, a profile on Hunter Biden in The New Yorker magazine detailed some of his dealings in China, including how he accompanied his father, Joe Biden, on a trip to Beijing, where he met with a business associate.
And that was when Joe Biden was still vice president.
And there is a ton more to this story, by the way, this story with Hunter Biden, some of which is not safe for kids' ears.
And the fact that it was suppressed by the legacy media outlets as well as social media in the lead up to the election is, in my opinion, a travesty.
There was a post-election survey that found that 10 percent of voters who actually voted for Joe Biden would have changed their votes if they knew about this Hunter Biden story before the election.
I mean, that just shows you the power of the media and the power of censorship.

Now, let's head on over to Washington DC. The US Senate will be holding a hearing next week on irregularities that took place during the 2020 election.
Now the significance here is that this is the first federal hearing of this type.
Before, all of those hearings that you were seeing were from state to state, not at the federal level.
Now the reason for this hearing, though, is fairly obvious.
According to Ron Johnson, who is the chairman of the committee which will be holding this hearing, the fact remains that a large percentage of the American public does not view the 2020 election result as legitimate because of apparent irregularities that have not been fully examined.
And he went on to say that the only way to resolve suspicions is with full transparency and public awareness.
That will be the goal of this hearing.
So let's see if it's actually able to achieve that.
And let's also see if YouTube deems this as being sufficiently, what was it, educational, scientific, or artistic enough to be live-streamed on their platform.
The hearing will be held next Wednesday, which is about a week from now, so let's see what comes of it.
