[00:02:34] There is news today that OSHA has now, at least temporarily, sidelined this plan of vax mandates pending circuit court judgments that have fully put a stop to it, at least for the time being. [00:02:46] So we're going to keep monitoring that. [00:02:48] Dave Morgan, thank you so much for joining us. [00:02:50] Captain Sherry Walker, thank you so much for joining us. [00:02:53] Tell us a little bit about what you guys have been going through. [00:02:56] The floor is yours. [00:02:56] I've got some tape, by the way, that we can play at some point in the segment of the CEO of United. [00:03:02] I know you're not speaking on behalf of United here, but I do have, I think it's, I think it's pertinent to what we're discussing. [00:03:07] So I do want to get to that, but tell us what you've been going through. [00:03:10] Tell us a little bit about your background. [00:03:12] Are you guys getting paid right now? [00:03:14] I went on unpaid leave a week ago on Friday. [00:03:18] I'm a pilot for United Airlines. [00:03:20] I was hired in Continental Airlines in 1998. [00:03:23] So I've been here 23 and a half years. [00:03:26] We span many years out in the island of Guam for Micronesia. [00:03:30] And three years ago, just before the pandemic, we moved from Guam to the great state of Arizona. [00:03:37] And I'm on a seven, I fly 787 out of San Francisco. [00:03:42] Pandemic came down the pipe, and we pressed on. [00:03:45] We are the front lines that were willing to do whatever it took. [00:03:52] We are a team of many, many people. [00:03:55] And I'm just representing, I'm a voice representing thousands who I wish also could have this opportunity to speak. [00:04:02] But we, we worked through this thing and with a really can do cooperative spirit of let's get through this. [00:04:13] Because I, you know, I was also a pilot during 9-11. [00:04:16] I remember that vividly. [00:04:18] We worked through that. [00:04:20] And then suddenly on the back side of this, here comes this vaccine mandate. [00:04:25] And those of us who pressed on and made the wheels turn, the airplanes fly, the people who were able to fly for point A to we were there to get them there. [00:04:39] And all of a sudden, Scott Kirby says, we're not safe anymore. [00:04:44] You're done. [00:04:45] So as of last Friday, I've been placed on unpaid leave and they've basically cut my cord. [00:04:52] I have no insurance, no benefits. [00:04:55] I can't retire. [00:04:56] I have no access to anything. [00:04:58] They have shut me down. [00:05:00] And to make it worse, I can't pass travel. [00:05:04] I can't even jump seat on other airline jump seats. [00:05:09] So I'm scrambling right now to see what I'm going to do with insurance. [00:05:12] I have three boys, 12, 16, and 18. [00:05:14] Yeah, I saw the pictures of your family, Dave. [00:05:16] And it was, I mean, you have a beautiful family. [00:05:18] They're young. [00:05:19] I mean, it's, I mean, what are they going to do when their breadwinner of the family is unable to collect a paycheck for the company he's served for 23 years? [00:05:27] I think it's criminal, frankly. [00:05:28] And Captain Sherry Walker, I want to get to you as well. [00:05:32] So you're the co-founder of this group. [00:05:34] Who do you represent? [00:05:36] I see on your website here that there's a religious liberty aspect to what you guys are doing, you know, religious exemptions, things like that. [00:05:44] Talk us through what you guys are working on. [00:05:46] Who's part of this group and how did it come to be? [00:05:49] Hi, Andrew, and thank you. [00:05:50] Yes, I am a co-founder along with Laura Cox of Airline Employees for Health Freedom. [00:05:55] We're approximately or approaching 4,000 members across the airline industry. [00:06:00] Yes, we have members from Hawaiian Airlines. [00:06:03] We have members from Southwest Airlines, but we've actually taken it across the transportation industry with now members from Amtrak and the trucking industry as well. [00:06:13] So on August 6th, when our CEO announced the vaccine mandate, we realized that it was his right. [00:06:22] A business has a right to set its work rules. [00:06:24] However, they are obligated under Title VII to follow the established laws. [00:06:30] So throughout the process, which was discriminatory and retaliatory, and Dave's story kind of tells us a lot about it. [00:06:36] He's one of thousands. [00:06:38] We grew very quickly into an organization to help people reach out to the company, get their religious exemptions and medical ADA exemptions in place. [00:06:50] The unfortunate part is, as you'll show in your video, it appears that the decks were stacked against us. [00:06:56] And as deadlines came and went, as Dave said, on the 27th, we all flew airplanes. [00:07:01] On the 28th of September, we were all unsafe to fly airplanes because we didn't have a jab. [00:07:06] So together, the 2,000 United employees that are in our organization started a class action lawsuit against our employer to force them to follow Title VII. [00:07:18] We do not believe that unpaid, indefinite leave is a reasonable accommodation. [00:07:23] We believe that the models like Delta Airlines doing their testing and others would be more than appropriate. [00:07:30] And unfortunately, we're worried about how this is going to play out in this busy travel season. [00:07:35] Well, of course. [00:07:36] I mean, all we're hearing about is there's a labor supply issue, especially with the airlines. [00:07:41] I mean, you guys ramped up. [00:07:42] You guys got you ramped down during the pandemic and then you ramped right back up. [00:07:46] There was some of those employees were no longer employees. [00:07:49] You had to restaff. [00:07:50] You had to retrain. [00:07:52] There's been a massive amount of delays. [00:07:54] I mean, so now all of a sudden, despite all of those challenges, United Airlines is going to double down and they're going to say, you guys are no longer fit to fly 787 International 767 as you do, Sherry. [00:08:05] So, you know, and if it's okay, I mean, I don't want to interrupt your story because it's important to hear directly from you guys, but I want to play a couple pieces of sound here. [00:08:15] Cut 71. [00:08:16] This is United Airlines CEO Scott Kirby asks whether employees who obtain an exemption will be placed on unpaid lead. [00:08:22] I want to hear the question and then I'm going to play his answer. [00:08:24] Cut 71. [00:08:26] We do have a couple questions with respect to vaccine. [00:08:31] One of them is from Anonymous here. [00:08:33] It says, I've been told by management pilot that pilots who get the approval to use the wrap for medical or religious reasons to avoid the COVID vaccine, they would still be on the United seniority list. [00:08:46] However, they will stay home and not be paid. [00:08:49] Is this really how United plans on handling this very sensitive issue? [00:08:54] Okay. [00:08:54] Now, stick with me here. [00:08:56] Let's play his answer. [00:08:58] And I have to say, Dave, you sent me this this morning. [00:09:01] I was drop jawed at his tone. [00:09:04] I would say it was tone deaf. [00:09:06] It was remarkably tone deaf. [00:09:08] So let's go ahead and play it for the audience. [00:09:10] 72, Cut 72. [00:09:12] I don't think so. [00:09:14] I don't know. [00:09:15] You got that. [00:09:16] That is a question. [00:09:17] I don't know. [00:09:18] Although I don't think that's the case. [00:09:20] By the way, there are going to be very few people that get through the medical and religious exemption. [00:09:25] There's some pretty strict rules about that. [00:09:28] So I would encourage any pilot that's decided they all of a sudden, or any employee that's all of a sudden decided I'm really religious and I'm going to say I'm going to get, you know, you're putting your job on the line. [00:09:40] You better be very careful about that. [00:09:42] So Sherry, Dave, did some pilots suddenly find religion or is that just the most offensive thing I've ever heard? [00:09:50] Let me preface that video with the fact that the entire video was played in the preliminary injunction hearing, 23 minutes of audio. [00:09:59] And it appeared that our Your Honor, Judge Pittman, wasn't as, didn't take kindly to those words as well. [00:10:07] So yes, it appears that while Scott Kirby has couched his claims on this vaccine mandate in safety, there perhaps might be some other underlying reasons. [00:10:20] And in fact, it was pointed out in the judge's ruling that United's presentation was basically pretextual. [00:10:27] In other words, it was hidden in safety, but it really was a marketing ploy. [00:10:30] So the fact that our boss said upfront before the vaccine mandate, reasonable accommodation deadline, that he was not going to honor majority of our religious beliefs and our medical issues. [00:10:42] Yeah, that's the basis for our case. [00:10:45] My goodness. [00:10:46] Well, and you mentioned that you're incorporating all of the transportation industry. [00:10:50] You know, I've got a cut here. [00:10:51] I'm not going to play it. [00:10:52] This is the CEO of the American Trucking Association, says that 37% of us of drivers not only said no, but hell no to getting the vaccine. [00:10:59] So we've got a supply chain shortage or supply chain crisis. [00:11:03] We've got a labor shortage. [00:11:05] And they are running full steam ahead on this, even though OSHA just suspended their own mandate. [00:11:11] Dave, where does this leave folks like you? [00:11:14] I mean, I got the pleasure to meet you in Phoenix yesterday. [00:11:18] Are you taking like a vacation? [00:11:21] I mean, what's the next steps for you guys? [00:11:23] I mean, how do we get to, how do we find a resolution? [00:11:25] What's the next step? [00:11:26] My step is to trust the Lord. [00:11:28] He is driving me right now, walking by faith. [00:11:31] So you didn't just suddenly find religion, Dave? [00:11:34] I mean, what an offensive comment from the CEO of United. [00:11:37] I can't believe he said that. [00:11:39] He is not concerned one bit about my health or any of my co-workers' health. [00:11:43] And he's certainly not encouraging us to pursue the freedoms allotted to us by the Constitution of our great and free country. [00:11:53] Well, and I want to open this. [00:11:55] I want to open this up to both of you. [00:11:56] So Biden is on the record publicly stating that United went from 59% of their employees to 99% of their employees getting vaccinated in two months after implementing the requirement. [00:12:08] So are you guys part of the 1% or is this complete hogwash? [00:12:13] Well, actually, there was about 40% of the company that was unvaccinated at the time of the mandate. [00:12:19] Now, through coercion, strong arming, basic threatening. [00:12:24] Yeah, we've had a lot of folks acquiesce. [00:12:26] Unfortunately, we've had a lot of folks acquiesce that have also found themselves harmed. [00:12:31] And we could go on for hours about stories of people who cannot get the vaccine, but yet the company threatened their job. [00:12:37] This week is Termination Week. [00:12:39] So the phones are ringing off the hook trying to help people. [00:12:42] You're talking about adverse events from the COVID vaccine, which is absolutely true. [00:13:10] So I don't know what the end game for these folks are, but they're certainly not paying attention to the science. [00:13:15] And I think it's really disappointing that a company like United would be putting good employees that have dedicated decades of their lives to that company through such a traumatic experience. [00:15:21] And I mean, in a very practical sense, what are the next couple of weeks looking like? [00:15:24] Is United Airlines going to be canceling flights? [00:17:18] Well, the key thing here is our case will be a precedent setting. [00:17:22] So right now, started in the fifth and they moved it to the sixth based on the lottery. [00:17:27] The OSHA mandate, which is a constitutional question that was going to force Southwest and all the rest of the airlines to have to implement this mandate, has been put on pause. [00:17:39] So there are choices out there. [00:17:42] Now, our employer has chosen to hold the line, so to speak, or take this foolishly to destroy the lives of some of its most experienced and valued workers. [00:17:54] We can get into the years and years of experience. [00:17:57] I mean, at some point, when you're looking at a 74-year-old flight attendant who's 50 years at the company and she's no longer valued because of her faith, that becomes criminal. [00:18:07] Well, yeah. [00:18:07] And I can't believe that. [00:18:10] I mean, I know I keep saying it, but the fact that he would say, oh, they found religion just recently, I mean, it's just preposterous and it's so offensive to so many people that have faith and sincerely held beliefs and don't want to be told what they do with their body. [00:19:55] It's out of South Lake, Texas. [00:19:57] Federal investigators, this is per NBC News, launched civil rights probe into South Lake, Texas schools. [00:20:02] Now, you will remember that South Lake became one of the hotbeds in this CRT school board battle that has been raging across the country with concerned parents. [00:20:12] Now, yesterday, Charlie did an amazing job covering Memo Gate, as we are thus dubbing it, where it has now become clear that despite Merrick Garland's claims that there was no FBI surveilling of parents, that is indeed the case. [00:20:30] A whistleblower has come forth. [00:20:32] Some of our favorite representatives like Jim Jordan out of Ohio have been leading on this issue. [00:20:39] Actually, we have Jim Jordan. [00:20:48] So Jim Jordan's been out front on Memo Gate. [00:20:51] Now we find out that there's something brewing, and I don't love the direction. [00:20:59] There's two simultaneous concurrent streams that are running counter to what we all thought we learned after Virginia, after even New Jersey was too close to call on election night, after Republicans swept races all across the country, even in Seattle. [00:21:19] What were the messages that we thought we learned? [00:21:22] Well, that CRT is dumb and that parents don't like it and that it's a losing issue for Democrats. [00:21:28] And that Republicans get rewarded when they fight things like CRT, when they don't take a neutral stance in the public square, but fight it with everything they've got. [00:21:38] And they say, listen, I'm going to exercise state power and not cop out on some, you know, we believe in small government, which we do, but these are not mutually exclusive things. [00:21:50] The government, as constituted in the United States of America, is designed fundamentally to protect the rights of its citizens and to protect the rights of parents. [00:22:02] And what conservatives too often do is they hide behind that as an excuse to do nothing, to fight for nothing, to stand for nothing, and to be neutral. [00:22:13] Now, this report out of NBC, and I'm going to circle back to that. [00:22:17] Pardon the Jen Sakiism there. [00:22:20] Report out of hot air, a la pundit, Glenn Young, I won't stop local governments that want to impose COVID mandates. [00:22:26] Now, he ran on banning CRT on day one in office across the state. [00:22:34] Now, we liked that. === Defending Raycons Against CRT Bans (02:45) === [00:22:36] He got rewarded for that. [00:22:38] He got elected governor of Virginia for that type of stance. [00:22:44] And here we have him moving backwards. [00:22:49] And as a la Pundit put it, and I tend to agree, I don't think Ale Pundit is necessarily on board with this, but I agree with this. [00:22:55] Land speed record for traveling from populist hero to rhino sellout. [00:23:03] It's well put. [00:23:06] Now, I'm not going against Yunkin at this point. [00:23:10] I think he ran a smart race. [00:23:11] I think he embraced the populist energy in the conservative movement. [00:23:15] I thought he did a good job there. [00:23:17] I hope he follows through on banning CRT, but to move back on a mask mandate and vax mandates for our children and for the rest of society, he's not going to impose that on local governments. [00:23:32] So, do you see the issue here? [00:23:36] Where on the one hand, we get rewarded for doing something right and courageous and strong and fighting back with some teeth and some willpower. [00:23:44] And then, on the very next move, after getting rewarded and told you're on the right track, he steps back and he says, I'm not going to impose that locally. [00:23:53] It's not what us conservatives do. [00:23:58] No matter what the government says, the holidays are coming, and I hope you'll be spending it with friends and family. [00:25:28] On a political level, it's a real threat, one strategist told Insider. [00:25:32] But strategists say they shouldn't lose sight of economic issues as a top priority. [00:25:37] Okay. [00:25:37] A little bit of back and forth, even in the header in the subhead. [00:25:42] They called it a racist dog whistle and a lie, but those messages haven't helped Democrats tamp down on the uproar Republicans are fueling over critical race theory, now a misused catch-all term for teaching on race and diversity in K through 12 schools that's firing up protests at school board meetings around the country. [00:26:00] In Virginia, Republican governor-elect Glenn Young exploited the term. [00:26:04] Interesting word choice, exploited, exploited the term and pledged to ban it in classrooms on his first day as governor. [00:26:12] And even though critical race theory, an academic approach to examining racial bias, that's very nice. [00:26:18] An academic approach to, it's white racism. [00:26:21] It's anti-white racism, pure and simple. [00:26:23] It's resegregation. [00:26:24] It's backwards. [00:26:25] It's the most regressive ideology that you will ever encounter. [00:26:29] It's cultural Marxism, but under the guise of racialism, of racial justice. [00:26:35] Okay? [00:26:36] That word justice. [00:26:37] It's the word that left claims. [00:26:40] And they don't have any idea of who gets to define what justice is. [00:26:44] It's basically their topic du jour, their morality du jour that continually moves. [00:26:51] It's not rooted in anything eternal. [00:26:52] It's not rooted in any type of faith, tradition that is eternal or long lasting, that has tradition behind it. [00:27:02] It's whatever they think justice is that day. [00:27:04] But they'll use the term, and then you are the person that they're going to contend with to get the justice that they deserve. [00:27:12] You conservative, you Republican, you racist parents all across the nation. [00:27:20] So they go and say that it's just CRT is just examining our history of racial bias and as it was most often taught in law schools. [00:27:27] Well, that was true until George Floyd and Floyd Apalooza. [00:27:33] Democrat strategists say the party should hit back harder against divisive GOP claims while not losing sight of the priority of voters and the economy. [00:27:41] Well, okay, at least they want to talk about the economy that they're running into the ground. [00:27:44] On a political level, it's a real threat that is allowing Republicans to claw back the inroads the Democrats have made in the suburbs over the last couple of election cycles, said Jim Manley, a longtime aide to former Senate Minority Leader Harry Reid. [00:27:57] Democrats haven't yet pushed back on this issue enough. [00:28:00] But the good news is the party's response is effective. [00:28:03] They just need to make the case relentlessly. [00:28:06] Voters run from the Republicans when Democrats peel back the onion on what these claims really mean. [00:28:11] And he basically goes on to say that the truth is on our side, that we're just examining the racial history of America. [00:28:19] And by the way, I hope they double down. [00:28:22] I hope they triple down on this awful, terrible, no-good idea, because it's what fueled these Republican gains all across the country, these conservative gains all across the country. [00:28:34] Now, there's this big push. [00:28:37] Conservatives get wins on the board. [00:28:39] Democrats say we're going to push back harder. [00:28:41] We're going to double down on CRT. [00:28:44] And we're going to just say it's just examining racial bias in our. [00:28:47] It's nothing. [00:28:48] Nothing to see here folks, and all across the nation Republicans recalled communist school board members, because that's basically what they are cultural Marxist, socialist sympathizers and they put conservatives in place. [00:29:01] This was an issue that had been left alone by conservatives for far too long, and meanwhile the left insidiously creeped in and started controlling our kids' education. [00:29:10] This is what we see in Scottsdale Arizona, where a 24 year old, childless basement dwelling miscreant compiles a dossier about parents that were concerned about what the schools were teaching their children in Scottsdale, no kids no, nothing. [00:29:24] Just wanted to run for any office, total socialist. [00:29:27] So in South Lake, Texas and this is the full circle moment they did something about it. [00:29:33] Friend of the show, Dana Lash, has been out front on this in South Lake. [00:29:37] She's a resident of South Lake, she was part of fighting back and they made incredible gains. [00:29:41] They took back the school board. [00:29:44] And now guess what? [00:29:45] MSNBC NBC, the kings and queens of the of the Kenosha Hearing, as it were, today that have now been banned from the courthouse. [00:29:55] Well, they have a new report out of South Lake, the U.S. Education Department's civil rights enforcement arm. [00:30:00] And, by the way, just a small note, whenever you give away your power to these federal bureaucracies that actually have the rule of law and the force of law behind them, which happened after the 60s, this is what you get. [00:30:11] The people of Southlake stood up, it took back their power and now the FED is coming in, the enforcement arm of the Civil Rights Division. [00:30:20] The Department official for civil rights notified the suburban school districts officials last week that it had opened three investigations into complaints about discrimination against students based on their race, gender and gender and national origin. [00:30:31] The agency declined to provide details on the allegation and doesn't comment on pending investigations. [00:30:37] The report goes on to say that the The fact that these investigations have been launched basically means they have really good reason to believe that they're going to take action. [00:30:47] Now, these investigations can take quite a long time. [00:30:51] They can take many, many months, even years. [00:30:56] So, I'm going to play the cut that just kind of plays this all, tells you it lays the story out, cut 76, play cut 76. [00:31:05] In South Lake, Texas, the U.S. Department of Education has launched three civil rights investigations at the Carroll School District over unspecified allegations of discrimination based on race, nationality, and gender. [00:31:16] Volunteers spent almost two years developing a school diversity plan, but some parents pushed back, launching a lawsuit that effectively killed the plan. [00:31:24] There will be no home for this toxic ideology here in South Lake. [00:31:28] So the federal investigations come three years after leaders in Carroll's school system, 30 miles northwest of Dallas, promised and ultimately failed to make these sweeping changes to address racism in the district following the release of a video of a white high school student chanting the N-word. [00:31:43] Okay? [00:31:43] This is what happens. [00:31:45] There's one incident. [00:31:47] The mainstream news media parrots it, trumpets it all over the place. [00:31:52] It then becomes this movement issue where helps fuel the riots, all this stuff. [00:31:58] So it was one incident that they claim. [00:32:00] Now they're investigating three. [00:32:03] Meanwhile, the parents rose up and took back control of Southlake, of the school board. [00:32:08] And guess what they did? [00:32:10] Just like the Democrat strategists told us they were going to do in the pages of Business Insider, they said, we're going to push back twice as hard. [00:32:17] We're going to double down because this is just racial bias in our country. [00:32:21] Folks, we have not seen the last of the CRT battles in this country. [00:32:24] We have only seen the beginning because these people, this is their religion. [00:32:29] This is where they get their purpose and value and meaning out of life is to fight the man and fight for justice, whatever that is today. [00:32:37] And they're coming for parents.
