[00:03:32] Who were the targets of this? [00:03:34] Donald Trump's campaign, the RNC, the Conservative Partnership Institute, Save America PAC, America First Policy Institute, and even MyPillow. [00:03:45] Because God knows we have a national security threat from rogue pillows threatening our country. [00:03:52] Watergate broke into an office. [00:03:56] Arctic Frost reached into the private lives of thousands of Americans. [00:04:03] Meanwhile, conservative leaders found themselves equally violated. [00:04:07] The Biden administration sought the phone records of nearly 20% of the Republicans in the Senate, including multiple members of the committee, including myself. [00:04:18] Without our knowledge, the FBI took the cell phone data of nearly 20% of the Republicans in the Senate, including information about with whom we were talking, how long we were talking, and from where we were calling. [00:04:33] Toll records are not trivial. [00:04:35] They are a map of your life, giving insight into your relationships, your movements, your patterns. [00:04:42] Such invasive subpoenas were granted by Judge Boesberg, a Democrat-appointed judge, on the premise that any one of us, or to be clear, all of us, as duly elected United States senators, would destroy evidence, tamper with witnesses, or obstruct justice. [00:05:04] These hearings the other day were amazing. [00:05:06] Mike Lindell, you were one of the stars of it. [00:05:08] Why was that, sir? [00:05:09] What did they try to do to you? [00:05:12] Well, it started in January of 2022, and this is right on the heels of lawfare sued by machine companies. [00:09:03] Meta says it plans to appeal after a New Mexico jury found it liable for failing to protect children from sexual predators and misleading users about the dangers of its platforms. [00:09:15] The jury ordered the tech giant to pay $375 million in damages. [00:09:21] New Mexico's Attorney General, who filed the suit, called it a historic victory, saying, quote, Meta executives knew their products harmed children, disregarded warnings from their own employees, and lied to the public about what they knew. [00:09:34] CNN Tech reporter Claire Duffy joining me now. [00:09:36] This is breathtakingly big because is this the first time that Meta has been sort of put in a position where the jury's telling you are accountable for this? [00:09:48] Yeah, sir, it's huge. [00:09:49] I mean, for years, we have heard these concerns from parents, from lawmakers, from advocates about the risks to children on Meta's platforms. [00:09:56] And this is the first time that we're seeing a jury hold the company accountable for that. [00:10:00] And this decision came after less than a day of jury deliberations following this seven-week trial. [00:10:06] The jury finding Meta liable on all counts in this lawsuit for violating New Mexico consumer protection law, including for willfully engaging in deceptive and unconscionable trade practices. [00:10:17] And as you said, putting children at risk. [00:10:19] They have ordered Meta to pay $375 million in damages. [00:10:23] And this is just the first phase of this trial. [00:10:25] In the next phase, this case will be presented directly to the judge. [00:10:29] And we could see Meta ordered to pay additional financial damages and also to make changes to its platforms. [00:10:35] And I think this really gives you a sense of where sort of the American public, where a jury is standing on this company, on this issue right now. [00:10:42] Take a listen to what one of the jurors said following this decision yesterday. [00:10:47] Social media has really become Men as Meta as a company itself and what it has come to represent and should be trying to represent better and in just protecting teens and people that are going to be on those platforms. [00:11:01] It ultimately swung that way because the majority of the 12 people agreed that there was willful violation. [00:11:10] So Meta does plan to appeal this decision. [00:11:13] And I'll read to you what a spokesperson told me yesterday following the decision. [00:11:16] They said, quote, we respectfully disagree with the verdict and will appeal. [00:11:20] We work hard to keep people safe on our platforms and are clear about the challenges of identifying and removing bad actors or harmful content. [00:11:27] But again, Sarah, I think this is such a significant moment in terms of setting a precedent that other states might end up following. [00:11:33] Yeah, it's huge in the fact that the Congress has not managed to do any reining in of any of the social media platforms. [00:11:42] This is the first time that a jury is now saying, hey, you guys have to do something or you're going to pay for it. [00:11:47] Claire Duffy, this is big. [00:11:48] I know you'll be following it. [00:11:49] I know Meta is appealing this. [00:11:51] We'll see where this case goes from here. [00:11:55] Okay, Joe Allen, this is big. [00:11:57] It's bigger than the $345 million fine. [00:12:00] This shows you their vulnerability, and they are panicked. [00:12:03] This is code red moment for them, particularly since Zuckerberg testified, and they just came back and said, you're a liar. [00:12:11] And here's what we're going to find. [00:12:12] Here's what we're going to do. [00:12:13] And you're right. [00:12:13] Congress has not done anything. [00:12:14] This is why you're dedicating your life to this right now. [00:12:16] Joe Allen, let's take this piece of it. [00:12:19] How big a deal is this? [00:12:21] Well, it's enormous, Steve. [00:12:23] This is the first real instance where a state has held a big tech corporation liable. [00:12:29] Right now, it's happening with the background of the White House National Policy Framework on AI, which calls for a degree, a large degree of shielding from liability, pretty much total shielding from liability for the big tech companies. [00:12:44] And if you hear David Sachs speaking, incidentally, as this ruling was announced, you had David Sachs speaking at his Hill and Valley forum, talking about how it really is the responsibility of parents to deal with these issues. [00:13:01] If your child is being groomed online or if they are descending into AI psychosis, if they've become best friends with an AI chatbot, if they are talking to the chatbot about committing suicide and the chatbot is responding, yes, you should. [00:13:15] This, according to David Sachs, is the responsibility of parents to deal with and not the tech companies. [00:13:22] The tech companies should. [00:13:23] They are directed by the framework. [00:13:25] They should provide tools for this problem. [00:13:29] But of course, we have yet another instance of an industry seeking to regulate itself, an industry, in this case, big tech, which has created the problem. [00:13:39] And now they are claiming that they will provide the proper tools to fix the problem. [00:13:44] And I would say, Steve, that even if I think that it's good to provide parents with these tools, I think it's good to provide parents with the information they need to guide their kids through an insane online world. [00:13:54] But the reality is most parents are not going to be able to use these tools. [00:14:00] Most parents are not going to have the knowledge themselves to guide their children through this. [00:14:05] So I think it's a minimal ask that when you have a platform like Meta, which allowed predators by the millions to exploit children, then the platform itself should bear the brunt of the liability. [00:14:20] They had 17 outs. [00:14:22] Only the 17th time did a predator get thrown out. [00:14:25] Is that correct? [00:14:26] We go over 30 seconds. [00:14:29] I don't know if 17 is the exact number, but almost never. [00:14:35] Almost never. [00:14:37] Joe Allen, we're going to go Hill and Valley next with David Sachs. [00:15:17] Like, wait, of course, parents have a duty, a responsibility of taking care for their kids. [00:15:22] That's what it means to be a parent. [00:15:24] A New Mexico jury reached a verdict in a landmark social media trial ruling that Meta misled teenagers about the safety of Facebook and Instagram. [00:15:33] Laura Jarrett is here now live for us. [00:15:35] And Laura, this is a massive blow to Mark Zuckerberg and his massive company. [00:15:38] It is, and the jury came back very quickly after just a day of deliberations, awarding $375 million in damages to the state of New Mexico, which had accused Meta, the social media giant, of creating a breeding ground for predators looking to exploit kids and teens online. [00:15:55] Now, the jury heard Zuckerberg say that they had added more safety features. [00:15:59] Who do you want to have the duty of care? [00:16:01] Do you want the government to be deciding what kids see? [00:16:04] Of course, parents should be empowered to make that decision, not the government. [00:16:08] Do you believe that Meta bears any responsibilities for these horrific crimes? [00:16:15] I think that our responsibility is to develop tools that can help identify people like this and prevent these things from happening. [00:16:24] The company's saying tonight that it plans to appeal, Tom, but this really is a watershed moment. [00:16:28] This is the first time we have seen a company be held liable for something like this. [00:16:32] Just to underscore the problem, we have 1,200 different bills going through state legislatures right now to regulate AI. [00:16:41] Some of those regulations are okay. [00:16:42] A lot of them are knee-jerk and aren't really thought through. [00:16:46] These crimes are done by these criminals who are sex offenders. [00:16:51] And I just think if you're serving billions of people, the unfortunate reality is that some very small percent of them are going to be criminals. [00:16:59] That is it, the government that's going to set screen time limits and decide what apps my kid is allowed to use, whether they're allowed to use ChatGPT and how much. [00:17:08] And we should work as hard as we can to stop that activity from happening. [00:17:12] But at the end of the day, I think it's those criminals that need to be brought to justice. [00:17:16] And our job is to make it as difficult as possible. [00:17:19] I mean, what exactly are we talking about here? [00:17:21] So I think that, you know, I hear criticism like that, and I actually think that we're on the right track here because it's just so nonsensical, what their alternative approach is. [00:18:07] Those young men and women in harm's way in the North Arabian Sea and Gulf of Oman tried to get it there. [00:18:15] They had no restrictions. [00:18:16] They don't want any restriction. [00:18:17] They're accelerationist and they're dangerous. [00:18:20] They're dangerous to this nation. [00:18:22] They're dangerous to citizens of this country, of this republic, and they're dangerous to Homo sapiens. [00:18:31] Dangerous. [00:18:32] This is not even close. [00:18:34] And they're going to give you all this hoo-ha and everything, 100 thing. [00:18:37] Dude, if you hadn't tried to jam in an amnesty bill, you wouldn't even have had all this revolt at the state level. [00:18:46] People are not going to let you destroy their children and destroy their families with it. [00:18:53] When you hear these stories, by the way, when this happens, they get captured. [00:18:59] The whole center of their lives are around this. [00:19:03] Think about this. [00:19:04] All your life is around this of how the kids getting destroyed and suicide or become transient. [00:19:09] All of it. [00:19:11] It's the destruction of the American family. [00:19:13] Why do you think Schilling and these guys are American Principal Suppressors' whole thing is the American family? [00:19:20] Why did they sign up for the Alliance? [00:20:23] I've spent a lot of time with experts who have studied this problem for years. [00:20:27] I don't think that anyone in their right mind would possibly buy David Sachs' argument that the proper response to having kids who are committing suicide is all documented in court filings. [00:20:42] Kids who are being groomed by the millions through these platforms, with the platforms themselves lying about the danger that is posed, lying to the Senate, lying to Congress in sworn depositions about the danger their platforms depose their platforms pose to children. [00:21:03] And then you have David Sachs coming in saying that the duty of care is, of course, on the parents rather than the duty of care being on the technology companies who are creating the problem to begin with. [00:21:17] You see the same sort of play run by Big Pharma. [00:21:20] You see the same sort of play run by the food industry, which has literally poisoned Americans for decades. [00:21:28] And then say it's up to parents to decide what their children should and should not eat. [00:21:32] Yes, of course, it's up to parents. [00:21:35] It's up to parents to make the proper decision. [00:21:37] But we know that in an environment saturated by wall-to-wall propaganda, in an environment where children and parents themselves are becoming completely immersed in these worlds of digital delusion, that we don't have the kind of cultural bedrock that would allow for every parent in America to make the proper decisions. [00:21:59] You already have kids who are raised by social media. [00:22:02] You already now have kids who are being raised by AI. [00:22:06] As this begins to develop, as this moves through the elementary schools, the high schools, the colleges, the entry-level jobs, and you see a society that has offloaded its brains and even its moral codes to the machine, what we are going to end up with is a global village of the damned. [00:22:26] What we're going to end up with are kids who are not able to make any decision, let alone a proper decision, without talking to their machine. [00:22:35] So, yeah, as David Sachs also says that we have to do this to compete with China, he's arguing that we need to feed more chips to China. [00:22:43] As he's arguing, we have nothing to worry about with artificial general intelligence or artificial superintelligence. [00:22:49] He spends his energy defending those tech corporations whose primary goal is to create artificial general and superintelligence. [00:22:57] If David Sachs would like to discuss this in public, he has a platform, the all-in podcast. [00:23:03] Well, I'm all in. [00:23:47] But I think the big question here is, you know, there's two paths that the administration can take on this. [00:23:53] And we're hoping that they take the path that is protecting kids in a major way. [00:23:59] And, you know, I'll say, Steve, you know, I have my disagreements with Mr. Sachs. [00:24:04] But the duty of care question, you know, we don't really apply the same logic to other issues. [00:24:10] If a hospital performs a surgery wrongly on your kid, you know, the duty of care, we're not going to say that's the parents' fault. [00:24:17] That's obviously on the hospital. [00:24:19] If a school transes your kid without you knowing, that's on the school. [00:24:23] You should be able to sue them. [00:24:24] And so I think certainly here when you're dealing with kids killing themselves, sadly, because of, you know, an interaction with a chat bot, or you're talking about them being exposed to sexualized content or predators or whatever, obviously there does have to be some sort of duty of care with the companies themselves. [00:24:44] John, you guys have been behind the scenes. [00:24:47] I said this the other day. [00:24:48] The alliance has been fighting with us behind the scenes and doing amazing work. [00:24:52] Why was it important now for you guys to step forward and say, hey, look, we're going to be one of the leads, we're going to be the tip of the spear and one of the big spears? [00:25:00] Because the coalition that you guys brought together is, you know, like a who's who that have fought for the family in so many various areas. [00:25:08] Why did you think now was the time that you guys had to step forward as an alliance, as a cohesive group with really the biggest names in the protecting the family to come forward at this moment, sir? [00:25:21] Well, we have a lot of different groups, as you mentioned, with different strategies, different red lines that I would say when it comes to getting a national framework passed. [00:25:30] But ultimately, I think we all care about getting something done to protect kids online. [00:25:35] We recognize that it's become a really dangerous place, especially, you know, for parents who want to be able to not only direct the health care of their kids, the education of their kids, but also the online experience. [00:25:48] And so I think it's really, really important that we come together on that. [00:25:52] And so a lot of the folks in the groups, we've been partners for a long time in the fight for age verification, which I think we started maybe eight, nine years ago. [00:26:01] Now we're finally getting real movement where almost half the states in the union have passed age verification. [00:26:07] And I think we might get that done at the federal level too. [00:26:10] But, you know, that has to be a part of this. [00:26:12] Ultimately, if we're going to, you know, do this moratorium, which we've talked about now twice, as you mentioned, the one big beautiful bill on the NDAA, if we're going to do something, it has to be a federal framework that provides these protections for families. [00:30:00] What was happening was that the Biden administration was pressuring social media to take down content that they didn't like, content they would call malinformation or misinformation or disinformation, which is just bogus lines that they came up with. [00:30:34] And one is the parties agree that modern technology does not alter the government's obligation to abide by the strictures of the First Amendment. [00:30:51] The other thing is the government cannot take actions, formal or informal, directly or indirectly to threaten social media companies with some form of punishment unless they delete, remove, suppress, or reduce content containing protected free speech. [00:31:06] So they shouldn't be doing that anymore. [00:31:09] You know what's amazing too is what we found out during this investigation was that nearly every department in the U.S. government has their own censorship group that's working with inside that department. [00:31:25] You know, Health and Human Services and the Pentagon and all of these places had these Groups inside their organizations that would flag content and send it off to Facebook and have them take it down. [00:31:43] So they can't do that anymore. [00:31:45] And they never should have been able to do that. [00:31:47] It seems pretty simple, doesn't it? [00:31:50] But so we won yesterday.
