News out of Kyiv.
President Zelensky and European leaders are calling for a 30-day truce with Russia starting Monday.
We've also just learned of a ceasefire between Pakistan and India.
It is something that, even before this country was founded, it was incredibly important in England and then in the United States to have this ability to go to court to say, Produce the body.
That if you have been improperly charged, improperly seized, that you had ability to go to court and say under a writ of habeas corpus, a judge has to determine that it was valid for the state to do this to you.
It is such a fundamental part of our freedoms.
That is why what Stephen Miller is saying is both not going to happen, but to Michael's point, is incredibly dangerous.
For anyone who is a lawyer, it has to be the most fundamental right in terms of freedom in any...
Any country that thinks of itself as a rule of law country.
And now we learn half an hour ago from Donald Trump on Truth Social, President Donald Trump announcing that his negotiators, Marco Rubio, we knew was involved here, have been working through the night and have agreed a full and immediate ceasefire.
President Trump offers his congratulations to both sides.
Look, I've been getting some sense of the back channel diplomacy that's been going on from my sources over the past couple of days.
Yesterday they were saying, look, we're pausing for diplomacy.
But when India hit Pakistan in the early hours of the morning, it appeared that that window had shut and Pakistan had this massive response firing back.
And it seems that that diplomacy continued to play out.
The Saudis playing a role, the Turkish playing a role as well.
Marco Rubio talking to his opposite number in India, his opposite number here in Pakistan, of course.
And this sense that has been in the background that Pakistan didn't want to engage against what it was feeling.
It was provocation coming from India over the last few days while its "friends" were trying to help.
It didn't want its "friends"- the United States, Saudi, the Turks here- to get caught in the middle.
And it does appear that this has been worked out to a degree.
How it works out at the front lines, we don't know.
And I think the other big question has to be, what do they do about the issue of water that's existential for Pakistan?
This concern that India has said that it will shut this vital water, has shut this vital water.
Three major rivers coming into Pakistan.
How that gets resolved, that's existential for Pakistan, not clear.
But, sense of relief here right now.
As we're looking at this big budget bill, there's now this idea, coming from the White House, that Donald Trump could be open.
To raising taxes on the wealthy, as well as potentially closing the carried interest loophole.
If you're not familiar with it, it is basically a giveaway to the private equity industry that year after year, lawmakers on both sides of the aisle say, God, that's ridiculous.
We're going to get rid of it.
Yet it never goes anywhere.
Do you believe there is truth to this, that Donald Trump does actually want?
To increase taxes on the rich and close this carried interest loophole?
Do you believe this?
Because guess what?
He does need to find a way to get this budget passed.
I don't know that Donald Trump wants to do that.
I don't think he has any particular philosophy of that.
I think Steve Bannon does.
Do you know what I mean?
It feels like the disembodied hand of Steve Bannon reaching in, right?
So I think that's true.
I think they have to find the money somewhere, theoretically.
It's not enough.
I mean, they carried interest to the surrounding area in the federal budget.
And what he's talking about wouldn't get you there.
And taxing the rich, they're talking about people who earn.
Over $2.5 million a year.
That is 0.1% of the population.
That's another number that won't get you there.
Right, it's like the wealth tax has not touched you.
The fact that this is where their head is going, right, which is that we are going to take away people's right to due process and we are going to deport them.
Maybe we'll deport them to their home country.
Maybe we'll put them in the jail four hours north of me in Louisiana and make them sit there for a month.
There was a young woman in Georgia the other day who was brought here when she was four, was stopped at a traffic stop.
She got sent to some ICE detention center three hours away, shackled, put into a prison.
Who knows?
They're floating, sending people to Libya.
We already know that they're putting people in the El Salvador prison.
This is absolutely fundamental.
And this is a threat to every American.
Obviously, people that are here on a green card or on a visa, they're at more threat if you're not a U.S. citizen.
But if these guys on the White House lawn are going to say...
We're going to continue this.
This is our objective.
We are going to take people, and we don't care what the court says, we don't care what the law says, and we're going to throw them in a foreign prison, or throw them in a war-torn African country, or throw them in a jail across the country.
That is a deep, scary, fundamental threat, and it must be rejected, and it must be pushed back against aggressively, and that's why I appreciate what the mayor and others are doing in New Jersey.

It's Saturday, 10 May, year of our Lord, 2025.
Absolute avalanche of massive news from late yesterday afternoon until we came on, it's still coming on.
We didn't even get a chance to mention that the Chinese negotiators seemed to get up and walk out of the meeting with Secretary of Treasury Scott Besson and Jamison Greer, the trade rep.
In Switzerland, but then they came back in a little while and they said, oh, we're just taking a break.
So intense negotiations going on there.
Overnight, it looks like President Trump has been able to broker at least some sort of ceasefire or step down between Pakistan and India.
Jerusalem Post is reporting that President Trump is going to announce a two-state, a Palestinian state as a solution or part of a solution.
I guess a non-Hamas-run Palestinian state.
Witkoff, under incredible pressure, getting hit from every side by the neocons.
Matt Ball, an incredible interview with Witkoff being attacked by everyone that is a neocon, saying Witkoff's not up to it as he's trying to negotiate with the Russians in this temporary ceasefire in Ukraine.
Of course, the last 72 hours have had Xi.
And Putin rubbing up on each other, buddy-buddy, in Moscow for the Russians' version of Victory in Europe Day, or Victory in the War, the part of the war they cared about, which was the European War.
Not just that, you've got so many things happening in the courts, and of course a radical judge in San Francisco is taking us down another mile marker to the constitutional crisis, which I predict...
Will happen in mid-June, mid to late June.

I know you've got family matters you're dealing with today.
But thanks for joining us.
I want to start with the judge in San Francisco.
President Trump's Article 2 powers of letting people go, slashing budgets, shutting down agencies.
I think there's 21 agencies.

We have a San Francisco Clinton judge, Susan Ilston.
You've never heard of her before today, but she just issued a so-called temporary restraining order, ordering that the President of the United States cannot carry out reductions in force or other reorganizations of the executive branch.
For like 20 agencies.
This is clearly a lawless order.
Again, the president ran, campaigned on the fact that he's going to hire Elon Musk, he's going to set up the Department of Government Efficiency, or DOGE, and he's going to cut waste, fraud, and abuse in our government.
And not only does he have the right to do this, the constitutional right to do this, he has a constitutional duty.
He has a constitutional duty to take care that our laws are faithfully executed.
And when we have waste, fraud, and abuse in our executive branch, he has a duty to make sure that that is eliminated.
And the president's executive orders are very clear.
He's doing what he's allowed to do within the statutory framework that Congress has provided.
He's not violating any statute when he does this.
In this case, we have labor unions, nonprofits, and local governments running to a San Francisco Democrat activist judge and getting a so-called temporary restraining order that the president can't continue with these reductions in force and this reorganization of the executive branch.
What makes this really illegal is under Rule 65C.
Of the federal rules of civil procedure, posting security or a bond is required when you get an injunction like this.
And so this judge just wrote in an order, no big deal, you don't have to have a bond.
That's a direct violation of the law because guess what?
A higher court says that the president can do what he's doing.
The federal government's going to be out a lot of money, tens of millions of dollars to have to pay people, pay people and pay contractors that he otherwise wouldn't be paying but for this Democrat operative judge's unlawful order, unconstitutional, illegal.
And so, here we are.
Another activist judge is not performing judicial review.
Another Democrat activist judge...
Trump is performing judicial sabotage, and it's really judicial sabotage of the American people, because the American people elected the President of the United States to do what the President is doing.
Regardless if his name is Trump or whatever his name is, take Trump out of the picture.
Take Trump derangement out of the picture.
This is judicial sabotage of our democracy that these Democrats are pretending that they protect.

They know what works, though.
I mean, this is the one parlor trick.
We're going to get into the arresting the mayor of Newark and other things, habeas corpus and the D.C. attorney situation, but this is what they know works.
They know going to these radical judges, which they pre-shop, to go in and have these TROs, which are nationwide, and her lecture and her opinion was, he's got to work.
With the legislative branch, with the Article I people.
Well, he is.
This whole budget takes all these down.
He's doing this at the beginning of this.
So he is working with Congress.
He's not avoiding Congress on this.
He's put forward a budget.
These things are getting taken down.
And there'll be rescissions.
So I don't understand what her logic is.
But it's working.
I mean, to delay is to deny.
This is another delay tactic.
Because you have to go to appellate court.
And, you know, that'll be a week or two.
And then maybe the Supreme Court on this.
So this seems to be working.
And it doesn't look like Congress is stepping in to cut budgets or to be an enforcer here, Mike.
Am I missing that?

No, you're exactly right, Steve.
And I would say, remember, if you are a fired federal employee, you have recourse.
You go to the Merit Systems Protection Board and you file a claim there.
If you are a fired...
You have recourse.
You go to the Court of Federal Claims and you file a lawsuit there.
But this idea that you can go to an activist judge in San Francisco, you can just randomly pick any of these 670 district court judges around the country and go to their courtroom whenever you feel like it.
And get a temporary restraining order that's not temporary without posting a bond.
And it's going to cost the taxpayers tens of millions of dollars.
Part of a temporary restraining order is you have exigent circumstances.
Here we are.
We are on May 10th, right?
These executive orders came out months ago.
So why did they wait until May 10th to May 9th to bring this complaint with this activist judge in San Francisco?
They're clearly judge shopping.
This is clearly a coordinated effort by these Democrat plaintiffs going to these Democrat judges.
And again, this is judicial sabotage.
President Trump has four years.
We are going off of a cliff.
We are going off the fiscal cliff.
We're not going to come back for this.
We have so much...
We have so much debt that it's unsustainable.
If you don't start cutting the size of our bloated, wasteful executive branch, you're never going to get this under control.

We have to drain the swamp, but guess what?
The reptiles are not going to drain the swamp.

We need to gird ourselves to what is coming.
Look, you've got Stephen Miller on the lawn of the White House.
Right?
Telling America, oh yeah, we're looking at ways to suspend habeas corpus.
Right?
That, you know, the supreme law of the land, the constitution, yeah, we can do what we want with it to violate what is very clear in the law and in the constitution that they cannot do.
That the president just can't willy-nilly suspend habeas corpus.
I mean, think about in the middle of a friggin' civil war.
Abraham Lincoln caught a whole lot of hell for attempting and, in fact, suspending habeas corpus and paid a price politically for that.
So, look, there's no invasion here.
And they're using language to sort of dumb down the seriousness of what they're doing to us.
And I think this moment, to your point, Simone, is a seminal moment in the changeover.
To the eradication of the rights of everyone.
The migrants, immigrants, that's just the sidebar.
The real core is every one of us that are left.
And I think we need to be mindful of that and be prepared to stand up against it.

Okay, we're going to get into this, the habeas corpus and what happened with the Newark mayor.
But Mike, just because we're hurtling towards a constitutional crisis on many fronts, I mean, what's going to happen here?
They went to San Francisco because the casual observers like myself say, oh, they're going to get the appellate in the most radical appellate court, the 9th, right?
And they'll get a stamp of approval there, and then this thing will go to the Supreme Court with a lot of backing.
Your thoughts on timing, seriousness of this, what's going to happen at the 9th, and when is this going to get to the Supreme Court, and what is Roberts going to have to do?

So fortunately, in President Trump's first term, there was like, I think it was like an 11-seat advantage on the 29-member Ninth Circuit for Democrats.
And I think President Trump got down to only a three-seat advantage for Democrats.
And President Trump appointed rock-solid constitutionalists to the Ninth Circuit, like Lawrence Van Dyke and Patrick Boumette and many, many others.
And so I would say that, you know, the Ninth Circuit is still...
Leans Democrat, but it's not the judicial hellhole that it once was eight years ago.
So that's number one.
Where I think this should go is that the government's going to seek an emergency stay in the Ninth Circuit of this whack-job San Francisco Democrat judge's ruling.
And then if the Ninth Circuit doesn't issue a stay...
Of the temporary restraining order, this needs to go to the Supreme Court on the emergency docket.
And I would say this, again, I say this to the Chief Justice, John Roberts, who I like personally.
I clerked for Justice Gorsuch.
He's a good man personally, and I like him.
But he is doing, if you could write a playbook on how to destroy the federal judiciary's legitimacy with the American people and therefore with Congress and therefore with affecting its jurisdiction and funding, I think John Roberts is running that playbook.
Unintentionally, of course, because he thinks he's a mastermind.
I mean, I can't think of anything more destructive to the judiciary than these dozens of Democrat activist judges around the country trying to sabotage the American people.
In their election of the President of the United States.
This is a judicial coup.
This is a judicial assault on American democracy that these Democrats pretend to protect.
And it's unacceptable.
We are getting to the red line when the president of the United States is getting an order like we saw in San Francisco where he can't lay off federal workers.
He can't reorganize executive branch agencies.
He's allowed to do this.
And to say that he can't do this, to say...
To say that you're going to put an order on the president that he can't do this, that you're not going to make these plaintiffs go through the regular channels like the Merit System Protection Board and the Court of Federal Claims and posting a bond under Rule 65C that's mandatory, this is lawlessness.
This is judicial activism.
This is judicial sabotage.
It's unacceptable.
And if the courts are going to do this, I say this as someone who clerked on the Supreme Court, who clerks on an appellate court, who was the chief counsel for nominations on the Senate Judiciary Committee with the oversight portfolio of the federal judiciary.
If this is what our judiciary stands for, is this.
We need to start gutting these courts.
We need to start eliminating these judgeships.
We need to start playing hardball because this is unacceptable.
For these judges to sabotage the American people like this.

As his Article II power as Commander-in-Chief in Newark, the mayor was arrested, but there was a major incident that led ICE to do this.
Walk us through that.
Now you've got brazen, just absolute brazen, you know, political, these radicals that are contesting President Trump's actual powers as Commander-in-Chief, sir.

Yeah, so the president campaigned on the facts.
He's going to secure our border.
He's going to deport illegal aliens, all of whom are criminals.
Every single one of them are criminals under our federal criminal statutes.
And President Trump's going to focus first on Trendy Aragua.
And MS-13 terrorists and gangbangers, right?
And the American people liked what they heard.
They gave him a broad electoral mandate, 312 electoral votes, all seven swing states, the popular vote.
This is like an 80-20 issue, right?
And the president is doing what he promised voters he would do, cutting waste, fraud, and abuse, and securing our border and getting these illegal aliens, violent, dangerous terrorists the hell out of our country.
And if you have these operatives, these Democrat politicians...
Trying to sabotage that, exposing these ICE operations, interfering in these ICE operations.
These are very serious federal crimes.
You're talking about obstruction.
You're talking about conspiracy.
You're talking about trespass.
You're talking about assault on federal officers.
I promise you, knowing what I know about my friend Alina Haba, President Trump's U.S. attorney in New Jersey.
She's not going to turn a blind eye to this.
She's going to prosecute these people, and she absolutely should, whether it's the mayor who needs to be prosecuted under our federal laws and also these members of Congress.
Members of Congress generally have speech and debate immunity under our Constitution where they can't be arrested for performing their official duties.
But I don't think trespassing, obstructing federal law enforcement, assaulting federal officers, conspiring to do all this, I don't think that's part of your official duty.
So I think the Trump Justice Department should move forward and indict these members of Congress as well.

We've talked about it now for years, about President Lincoln, what President Lincoln had to do with his wartime powers in the Civil War.
This is an invasion.
In fact, it's a worse invasion than in the Civil War.
There's 10 million illegal alien invaders in this country.
President Trump, as commander-in-chief, has said he's going to remove them all, starting with the worst of the worst.
Your thoughts on, because I know you've been very, hey, we've got to really think this through.
Your thoughts on this whole, given where we are, given where these political demonstrations by these politicians are going to continue, your thoughts on suspension of habeas corpus?
mike davis
Well, I would say this to the Chief Justice and his, you know, Commanding General John Roberts and his six Lieutenant Generals who still have an unconstitutional, illegal injunction on the President of the United States starting on Good Friday where the President of the United States cannot repel a foreign invasion of Trendy, Aragua and MS-13.
That is the President's highest constitutional duty as the Commander-in-Chief.
Let alone he has that power under the Alien Enemies Act, but the Supreme Court seems to think that they're generals now and they're going to tell the president he can't conduct military operations.
I would say this.
If these judges actually think that foreign terrorists who have invaded our country are entitled to years of court proceedings in due process to get them hell out, then we need to suspend the writ of habeas corpus because this is an invasion.
Joe Biden working with these NGOs to let in over 10 million illegal aliens, including the most dangerous people in the Western Hemisphere, Trende, Aragua, and MS-13.
And that's okay for these globalists to leave because they don't have to deal with them and their wealthy enclaves.
They want these illegal aliens to go rape, kidnap, torture, murder.
The Lake and Riley's of the world, they want them in Aurora, Colorado.
They don't want to have to deal with these illegal aliens, but they want the cheap labor.
And so they want their serfs, their illegal alien serfs.
Over 10 million of them, and they don't care if that means we're letting in vicious murderers, rapists, robbers, terrorists from Truende Aragua.
So if the courts are not going to allow the President of the United States, if the courts are going to say that these terrorists have habeas rights, which they don't, if that's what the courts are going to say, then the President has a constitutional duty to suspend the writ of habeas corpus and repel this invasion.

Yeah, I think that's about right, because these Supreme Court justices go on their two-month siesta.
After the term ends in June.
And so I imagine that they're going to, I think your timing's spot on, Steve.
And I would say to these justices, they need to wake the hell up, right?
I know that they are in their little cocoons right now.
And, you know, the Chevy Chase, they go between the Chevy Chase Country Club and then to the Supreme Court where they're sycophants.
Treat them like gods.
But their decisions have real consequences right now.
And you're going to learn about the legitimacy of the federal judiciary if they think that illegal aliens are staying in our country.

As people know, had cancer, was fighting cancer in the 16 campaign.
She never missed an episode of her show on Saturday night while undergoing chemo.
She is a hero, a patriot, and a fighter like you cannot believe.
If you know her, if you have the pleasure to know her personally, she is a fighter beyond all.
I mean, not just for Trump, the country, but she's one of Trump's fiercest defenders.
Did not miss an episode while going through Chemo for cancer.
In fact, she would keep a bucket on the thing because she was sick.
As you know, the people who have chemo are ill, nauseous, because of the brutality of the regimen to get you better.
That's what type of hero she is.
Never missed a show.
She is a warrior.
She will be absolutely amazing as the U.S. Attorney for the District of Columbia.
And she will hit this place like a flamethrower, like it needs to be hit.
But we should have never given up on Ed Martin.

Now, Ed's going over for a great job over in Maine Justice, this weaponization task force and head of pardons, which is very important.
You know, Peter Navarro, myself and Jared and others are working very closely with the Bureau of Prison guys to make sure the major reforms are at the Bureau of Prisons.
So having Ed over on the pardons side is brilliant.
To have him heading up the working group on weaponization is fantastic because I know they're so overwhelmed over there with what they're doing.
That this can only help.
But Judge Jeanine in this position is perfect, but we are sending the wrong signal to the Tillises of the world, and now they came up with five other names or six other names.
Fine, put their names up.

I mean, we have a constitutional crisis right now.

Because these judges, we now have judicial supremacy.
That's not in the Constitution.
The founders of the nation.
We'd have never done that.
They talked about the Supreme Court in the Constitution, but didn't get it in any specific details.
That was all done later when they set up the federal judiciary, which was quite controversial in the first decades of the founding of the Republic.

And we had the head of Bloomberg here, the author of...
The book, Saliha Motion for a Full Hour, Paper Soldiers, remember about a week ago.
She was not as concerned by the scale of what the market for dollars is in the world, but then there's a report out of Bloomberg this morning by one of her colleagues that, and by the way, she's one of the smartest reporters in this imperial capital.
Particularly covering economics.
She said, yeah, people are coming after it, but it's still the basics of the world's system.
With President Trump, the post-war international rules-based order, President Trump is trying to massively structure that because the trade deals were upside down on every commercial relationship and trade deal.
He's trying to rewire that.
At the same time, really confront the economic warfare the Chinese Communist Party has been engaged.
Against the United States in.
One of the foundations of this is going to be the US dollar as the prime reserve currency.
Now, obviously, it's currently the prime reserve currency and will be for a while.
There are tremendous benefits of being the prime reserve currency.
One of the benefits is you can, you know, finance your debt out of this because people have to essentially buy it because they need dollars.
And you're not like Argentina or not like the UK when Liz Truss got turfed out because they don't need to take pounds.
So the bond market is much more in control of you.
But there's reports out of Asia that leading up to the Rio reset that countries in Asia right now are thinking through, and these are even countries that are going to sign up on these trade deals with us of ways they can get away from the total control that Washington has over...
Economic warfare, sanctions, all of that.
And also, they're dropping the purchasing power of the dollar.
So this is ongoing.
This is why we're making such a big effort about the Rio reset.
And you saw, I'm just telling you, they couldn't have been cozier.
They were like teenagers on a first date.
If you saw Xi and Putin giggling and laughing and looking at the parades and talking to some of the old veterans.
Somebody said, Bruce J. Stengel said, well, you know, the world condemns Russia.
I said, condemned.
He said, the G20.
I said, dude, they had Lula of the Brazil and Xi of China.
They had two of the biggest nations in the G20 and two of the two biggest outside of India in the BRICS sitting up on their stage with him.

Because here's what's going to happen if you think about it.
I talk about the convergence of these crises.
And remember, the three crises, the three things that President Trump had on top of his page was, number one, stopping the kinetic part of the Third World War.
And he's getting ready next week to go to the Middle East, Riyadh, the UAE, Qatar, to talk about...
Investments and other types of maybe expanding the Abraham Accords, but essentially trying to tap down this war in Gaza for metastasizing and the situation with the Houthis, which supposedly we have some sort of interim agreement with us, so they're not going to be shelling our two carrier battle groups anymore.
But the Rio reset is important.
It's going to come at the same time as the end of June.
It's going to come on the 6th of July right at the time when the Supreme Court's going to have to make some decisions here about the President of the United States and the Office of the Presidency.
It's got to happen.
We can't delay this anymore.
They're going to try to delay it to the end of their term.
The term ends the last day of June.
So that's going to get sorted at the same time they're meeting in Rio.
And they're not going to shift off the dollar immediately, but they're looking for all these mechanisms that they can begin to shift away.
We have to have a national conversation of do we want to be the prime reserve currency?
Is it worth the responsibilities and the obligations?
And the lords of easy money are going to have to jump in here and we're going to have to have a debate.
This is why right now they just released the 28 pages.
I'm trying to go through it.
Because there's not a lot of substance there.
But look, let me just cut to the chase.
We like to just make it basic without all the people running around with their hair on fire.
We have the federal spendings out of control, and the political class cannot cut it.
They were hoping, this is why they were rubbing up on Elon.
They hoped Elon came in here with the magic wand and gave him a trillion dollars of fraud.
That didn't happen, as we told you wasn't going to happen.
So now we're here, we're having, now we're in reality.
And the cuts are not there.
The $163 billion are not even a beginning of what has to happen.
And you hear the going over the top on this because you haven't touched defense.
And you're going to have to do something smart, not take a meat axe to Medicaid.
If you look at making the taxes, the tax cuts permanent for the middle and working class.
Not just extend the 2017, but make sure we never have to address it again.
You're going to have to find some money.
I'm telling you now, they haven't put out the revenue side or the side because I'm telling you right now, with what they're talking about as cuts, and don't give me the 10-year.
I don't want to hear about a 10-year.
I do not want to hear about a 10-year.
It doesn't matter.
I want to hear about this coming fiscal year, 26. Right now, it's a $2.5 trillion deficit.
Not 25. 25 is going to be over a $2 trillion deficit.
And Scott Bessent just told us, oh, by the way, when he's getting on the plane to Switzerland, hey, I've done the calculation now, and we hit the debt ceiling, I don't know, let's say August.
Well, the big, beautiful bill ain't going to be done by August.
Not the way they're going now.
So he got the debt ceiling.
And we're going to see what they're going to ask for in the relief of debt ceiling.
This audience is going to have to do a gut check.
Because it's going to be upon your shoulders to try to sort all this out.
Because I will tell you, we've done a great job of changing the electorate in the Republican Party.
That's where President Trump had the massive victory.
That people gravitate to him as a leader in his positions as a populist nationalist.
But we haven't changed the elected officials.
We haven't changed the formal Republican Party.
They're still here with this insane Republican orthodoxy that's not sustainable.
If it's sustainable, I'm all in.
Show me how sustainable.
It's not.
So we're hurtling towards a financial crisis.
You've got the kinetic part of the Third World War, which is expanding now to Pakistan and India.
