You ready to dive in?
We got a big one today.
We're talking Bureau of Prisons, the First Step Act.
And some pretty serious accusations being thrown around.
A lot of you requested this deep dive based on a piece by Peter Navarro, a former White House official, and someone who's actually been on the inside.
Yeah, and that's key here.
This isn't just some theoretical debate for him.
His experience gives him a whole different perspective on, well...
On the problems and potentially, you know, the corruption that might be going on.
Right. For sure. And just as a refresher, the First Step Act, that was the bipartisan criminal justice reform bill from back in 2018.
It was supposed to tackle things like reducing those crazy long sentences and making it easier for people to actually reintegrate back into society.
But Navarro is arguing that the Bureau of Prisons, the BOP, is dragging their feet on purpose.
And he says it's costing taxpayers a fortune.
Yeah, he doesn't hold back either.
He actually calls the BOP director, get this, the biggest criminal out there, says it's all because of this financial waste he's alleging.
And then it makes you wonder, if these issues aren't addressed, could they actually sway something as big as a presidential election?
Whoa, he's connecting this to the election now.
That's a whole other conversation.
How does he make that link?
He's suggesting that families who are directly affected by these delays, families who feel like the First Step Act has been sidelined, They might be more likely to vote for whoever they see as a champion of that bill, someone like Trump, and against those they see as responsible for the lack of action.
So this could become a voting issue, especially for families who feel like the system's failed them.
It's definitely a possibility.
I mean, think about it. We've seen how even smaller niche issues, things that don't always make the headlines, they can really energize certain voters, especially when they feel like their concerns aren't being heard.

We're talking prisons today.
What you just heard is something I want to talk a lot more about with Joe Allen on Wednesday when I'm back.
That was a pair of robots.
I fed a script Into an AI software.
And that's what it spit out in about three minutes.

But two things are interesting.
I mean, that's like what AI is going to be doing.
You can imagine a few years from now...
TV stations not needing reporters anymore.
As long as they got people like me, maybe, to write scripts, although AI can maybe do that as well, there it is.
So that's a little frightening.
I don't know if you thought about that.
It was pretty interesting.
They did a pretty good job.
It's a little woke story.
But what I really want to talk about today is this issue because Steve's been in prison for almost four months now.
I went to prison for four months.
And in both our cases, the Bureau of Prisons broke the law by keeping us 25% longer than the law requires.
And when I was in there, let me tell you about it.
I call it wasting away in a Bureau of Prisons hell.
And little did I know when I went to prison in defense of our Constitution that I would moonlight as an investigative reporter and uncover a $5 billion waste of taxpayer money.
Three months after my prison release, neither the Bureau of Prisons nor the U.S. Congress Has yet to do a damn thing about this monumental government failure.
To the contrary, with a stunning announcement on October 8th, the Bureau of Prisons has moved in the opposite direction, effectively institutionalizing the problem.
Meanwhile, the House Judiciary Committee is doing what it has done for most of the last two years.
We've been watching them closely in the war room.
Absolutely nothing but bloviating.
Here's the backstory. During my prison stay, I discovered that the Bureau of Prisons has steadfastly refused to enforce the 2018 First Step Act, which was passed through the leadership and smart on crime vision of Donald Trump.
I was there in the Oval when it was signed.
The FSA, the First Step Act, is designed to address a chronic problem of over-sentencing that arose in the 1990s in response to a crack cocaine crisis and broader drug epidemic.
In supporting the First Step Act, Donald Trump clearly understood...
Listen carefully. When you keep prisoners behind bars longer than necessary, longer than necessary to properly punish them and deter future criminal actions, you not only get taxpayer waste, you also increase the rate of recidivism, particularly with first-time nonviolent offenders, and thereby you get more crime.
Are you paying attention, Ann Coulter, you bitch?
President Trump put this Smart on Crime First Step Act in place precisely to address this problem and it reduces time served of inmates through a system of earned good behavior and training credits and also accelerates inmate placement into either halfway houses or home confinement to ease their transition back into society.
That's what Steve and I should have been released 25% earlier.
We weren't. And here's the catch.
Because the Bureau of Prisons under Democrat leadership steadfastly refuses to fully implement Trump's First Step Act, more than 60,000 FSA eligible inmates will spend anywhere from, get this, three months, okay, not too long, to two years longer in the prison system than the FSA mandates.
For me, this is indeed personal.
During my Miami prison stay, I met many inmates along with their families who now continue to get the very short end of the BOP stick.
A poster child now in his 80s.
Guy who was in the bunk next to me in the dorm, Del Gowing.
He should have been released.
Get this. You ready? April.
April 2023.

Armand Aboyan, should have been released to a halfway house in August.
Others behind the halfway house curve include...
Remember, there are 200 people in the whole place, okay?
I'm going to name a bunch of them.
Jerome Potter, James Medard, Elliot Smerling, Michael McNew, Brent Borland, Taylor Stotts, Jose Gonzalez, Roberto Robo, Perez II, Daniel Markovitz, Mark Thompson, Junior John Baptiste, Weslo Capley, Raymond Ramirez, Joshua Grauer, and Ronald Lubetzky.
Cumulably, the cost of such BOP online neglect directly cost taxpayers up to $3 billion.
That's a direct cost for the more than 60,000 FSA eligible inmates.
That's to keep them there. Add to this the indirect cost of up to $1 billion in foregone tax revenues from keeping inmates in prison who could otherwise be working and paying taxes.
And then... And my fiancée and I saw a lot of this when she came for visiting hours.
There's up to $1 billion more in tax expenditures providing food stamps, housing subsidies, and other forms of welfare to the struggling wives and children.
These are the people we met in that visitor's room of the inmates deprived of the timely return of spouses who could otherwise help support them.
That adds up to a colossal $5 billion in Of taxpayer waste.
Never mind the human misery associated with over 30,000 years of unnecessary incarceration for the 60,000 FSA eligible inmates.
What's going on here?
The root of this problem is a prison industrial complex that profits by keeping as many Americans behind bars as possible.
This group of vested interests consists of the BOP administrators, guards, case managers, unit managers, and other staff who work directly for the government and garner faster promotions and moreover time, pay the fuller the prisons are.
The presence.
Better they are. Add to this the private contractors who serve the prison system, along with the privatized portion of our prison system, and you have a very formidable roadblock to FSA implementation.
Note, almost 10% of the prison population is held in private facilities, while nearly half of the halfway house and home confinement services, where much of the bottlenecks lie, are privatized.
Only the U.S. Congress can now break the logjam.
The BOP is not going to do a damn thing.
It can do so by forcing two simple solutions.
First, too many inmates are being held in prisons because of lack of adequate halfway house capacity.
The very easy solution here, which judges have begun to do with habeas petitions, is to require the BOP to send any inmate to home confinement if that inmate is being held simply because of lack of halfway house capacity.
Perfect example, Judge Joseph LaPlante and Levitt v.
Warden did just that.
This one simple step, which the House Judiciary Committee could force the BOP to take in one hearing, would result in the immediate release of thousands of nonviolent first-time offenders into home confinement and thereby save taxpayers hundreds of millions of dollars.
Second, the BOP must accurately forecast the release dates using the long-promised but as yet undelivered maximum conditional FTC calculator.
If the BOP simply obeyed the First Step Act law and its own policies...
By the way, Director Collette Peters is now the biggest criminal in the BOP system based on the amount of taxpayer waste she's created.
Thousands more inmates could see freedom, regain full employment, and reunite with their families.
This is a bipartisan issue that both sides of the aisle are failing on.

This is also a presidential election.
Tens of thousands of family members of inmates across the battleground states may well vote for Donald Trump because he led passage of the FSA. That's why I'm doing this monologue today.
It's election season.
This is an election issue.
These unique swing voters will vote against Kamala Harris Precisely because of the BOP's failure to implement the First Step Act and because Harris falsely promised to release non-violent offenders, particularly those jailed for marijuana-related offenses.
I think she did that when she was smoking a bone there.
With less than 30 days to go in this election, this is an issue.
This is an issue.
That could indeed determine the election.
Remember here, in the battleground states, these elections probably are going to be decided not by millions of votes, not even by hundreds of thousands of votes in the individual states, but by 10,000 votes, 5,000 votes, 20,000 votes.
And I'm telling you, these families of inmates, they're pissed.
They should be pissed.
Because they know that the First Step Act and the related Second Chance Act should have got their family breadwinner home earlier.
And for those of you, you're going to let them go and they commit crime?
They're getting out eventually.
And if you keep them longer, they have a higher chance of committing crime.
That's the whole smart on crime thing about this.

Because the only time I ever raised this on TV, she jumps in and...

The state of Arizona, which I think will be most welcomed in MAGA land.

Yeah, so Peter, really exciting stuff.
And by the way, I shared this article with Steve, and he's very excited about it.
He was like, you got to get on War Room first thing Monday morning to talk about it.
So that's why I'm here.
So Steve is very jacked up about this.
But the fact is that I spend a lot of time talking to the Turning Point Action folks.
These are the folks led by Charlie Kirk and Tyler Boyer out in Arizona.
And they have hundreds of ballot chasers that are working full-time positions in Arizona, and they've identified A universe of about 350,000 likely Republican voters who haven't been voting in the last several elections.
And for whatever reason, either they weren't registered or they didn't wanna vote or they just didn't vote or whatever.
But the point is that they are, now that voter registration is closed, they have gotten these people registered and they are working to get them to vote in this election.
If they get even half Of that universe of folks to vote, 175,000 people.
150,000 people is about 5% added on to the total of the votes in the end, right?
So you're looking at a universe of around just north of 3 million people are gonna vote in Arizona this year.
So you need about 1.5 million, a little bit north of that, to win in Arizona.
And so 150,000 people is 5%, right?
So if you can add 5% to your total on either side, that's the ballgame.
That's bigger than the margin of cheating, if you will, right?
And so the fact is that what the Turning Point Action folks have done is they've identified these people, how to get the votes, and They're going out there and actually getting the votes, right?
Like, so there's a lot of good happening out there, and it feels like, based off of these numbers, the way Tyler Boyer puts it, he calls it the money ball strategy, right?
Like, so if you go back to Major League Baseball back in the, you know, Early 2000s, right?
Like the Oakland A's went on that historic winning streak because they did the money ball strategy.
And now everybody in baseball uses Sabre metrics, which is statistics focused stuff.
But that started there.
And that very similar type of a thing here.
But again, they still have to execute, right?
It's not like you can just find the statistics and then cite them and walk away.

Let me ask you a question.
Do they have early voting in Arizona?
Are they already banking some of these people?
matthew boyle
Yes. So that is underway right now.
Or it's beginning soon.
peter navarro
Because that's testable.
I mean, they should be able to know how many they've banked.

And they ran a test project of exactly this in the primary, by the way.
And they're very excited about that.
And they were able to, and that was one of the things we talked about, is that they were able to juice the numbers in several precincts in the Maricopa County area in ways that they are confident they're going to be able to deliver that extra 150,000 votes to the Republican ticket and to Trump in this election.
The Turning Point Action guys are.
And every sign is pointing to that they're right.

What's your read on the broader race Now, Matt, what are you hearing, seeing?

What are you covering? So the biggest story that happened this weekend is the NBC News poll.
Donald Trump has taken a one-point lead nationally, if you include the full field, over Kamala Harris, if it's just head-to-head, they're tied.
But the bigger number in that is the swing, right?
So it's a net 7% swing in three weeks towards Trump, away from Kamala Harris.
So Kamala Harris is sinking and Trump is rising at the key moment, you know, in the home stretch here.
And we're seeing similar stuff across the board in the battleground states.
You know, we were just talking about Arizona.
New York Times had a poll. Late last week or this weekend.
They had Donald Trump up six in Arizona.
We're seeing a new poll today out of Georgia.
Donald Trump leads by three.
Everything's looking strong in the early voting and in the polling out of North Carolina.
And then Pennsylvania as well.
The New York Times published a poll over the weekend out of Pennsylvania as having Kamala up four.
But they admit their own poll is flawed in that they didn't wait it to the recall vote.
And they argue that they don't want to do that.
But the recall vote they have in their poll is Biden plus 8.
Biden did not win Pennsylvania by 8 in 2020.
So if they actually did wait it to the recall vote, Donald Trump would actually be in the lead in the New York Times poll.
And they admit this in their own write-up of their own poll that Donald Trump would be in the lead by 2.
We've seen other polling out of Michigan and Wisconsin.
Donald Trump leads in those places.
So across the battleground states, Donald Trump has the energy.
He has the edge. Kamala Harris is fading.
And then what we're seeing is the panic begin to set in on the Democrat side on the left.
Barack Obama last week, this is arguably the biggest story of the week last week, which is that Barack Obama going out there into Pennsylvania to lecture young black men and attack them for not voting for Kamala Harris.
So frankly, I thought that that was a very big moment.
And then in addition to that, I think that you're seeing the Biden camp and the Harris camp fighting with each other, arguing with each other.
And the media across the board are panicking at this point.
So, that being said, it's all about ground game.
I've talked to Steve at length about this the last couple of months while he's been on the inside.
You know, you have to email via this whole janky email system, which I know you're familiar with, Peter, as well.

Yes, I am well familiar with you.

Yeah. Yeah, I have to talk to him that way, but he is very focused on ground game.
He keeps asking me about that.
That is what everybody needs to be focused on.
Because now it's not about this poll or that message or this ad or that ad.
It's about execution, execution, execution.
And so is the right going to do it?
It looks good, but we've got to finish and we've got to follow through.

Well, I'm hoping you'll go out on the road with him.
When he gets out, he has no intention of spending all his time sitting behind a desk like this.
My understanding is he's going to be out there on the stump, and it would be great to cover.

And did J.D. Vance's debate with Walls mark the turning point?

I mean, look, it was a great night for J.D. Vance and Donald Trump, the VP debate, and a bad night for Kamala and Walls.
I don't know if there's any one particular thing, right?
Like, it's kind of like a combination of all of the above.
Yes, Trump is closing strong, as he always does, right?
Like, you look at the efforts that he's got out there.
I mean, his speech in Arizona yesterday, just absolutely amazing, right?
Like, the Border Patrol agent plan, the union came out and endorsed him.
The event at Coachella this weekend has been strong.
I mean, every single thing that Trump is doing right now is just, he's on point.
The VP debate was strong.
And Kamala Harris is making lots of mistakes.
You know, you look at the media interview tour, it's almost like a football team that's losing at the end of the game.
You know, they're down a couple scores, maybe 17 points, right?
And then they, you know, they start throwing the ball a little bit more, right?
They start chucking it down the field.
And that's what opens you up to an interception.
And that's what Kamala Harris is doing right now.
She's throwing interceptions, right?
Like this, the Howard Stern interview, the View interview last week, just terrible mistakes on her part.
And I think that those are backfiring in a bad way.

The issue here, they've got five congressional districts and electoral votes, I guess, are allocated by congressional districts.
One of them is in jeopardy in the big city, Omaha, where you have some of the liberals and Hanging out there.
Don Bacon, a long-time congressman, is at risk.
Eric, the floor is yours.
Tell us what we need to do here on The War Room to help you out.

Well, everything now is about getting out the vote, as you know, across the country there.
In this congressional district, Don Bacon has been our representative for the last five cycles there, and the Democrats have tried everything they can, including the same candidates against him.
We have to make sure that for Nebraska to keep that one vote there, he has to win that race.
We have to have President Trump also win that race.
They kind of go lockstep to gear.
So President Trump winning Congressional District True will ensure that you have one more electoral vote.
Because the way our state statutes have aligned, our congressional districts are separate based upon who wins the presidential vote in each congressional district.
The other two seats are the Senate race electoral votes.
Those are gonna go statewide. So we have to win CD2 or we won't be getting that one vote for President Trump.
And when you look at those electoral maps there, this is a very, very close number between 270 and 268.
If we win with this one, it would be 269 to 269.

If we change this, our local races wouldn't win any more.
We're sitting over $15 million going into this one district.
This isn't statewide.
This is what's so unique about it.
This isn't a Senate single race there.
And we've got our Senate race for Senator Deb Fischer having millions of dollars being dumped into the state because we haven't changed our electoral college vote allocation to winner take all.
Had we done that earlier this year, we would have had so much less money come in.
Democrat money, dark money, George Soros.
I just looked at the FEC filing by the Democratic Party.
George Soros, Steven Katzenberg, Seth MacFarlane.
I mean, it's just list after list after list.
And that's not even the dark money.

All right. We're going to wind shift here, and we're going to do polling.
Give me a little cold open air.

Hit me with that. Steve, boy, this is a big one.
Yeah, Kristen, I mean, the numbers say it.
It is a tie game here weeks before the election, and it's that shift.
Our last poll taken in the wake of that September debate, Harris had opened up that advantage over Trump.
Gone in our new poll.
What goes into that?
What's behind that? I think this one is revealing.
This is the basic perception voters have of these candidates.
Is it positive? Is it negative?
Now, These are not great numbers for either one.
Trump 43 positive, 51 negative.
He's eight points underwater, you might say.
But look at Harris. Exact same positive score and that negative number almost in the exact same place.
And this is it. The last time we polled this question after that debate, Harris had really made up ground in this area.
Look, she had a positive.
Wow. Rating, 48 to 45.
So that advantage has all in the last few weeks in our poll washed away for her.
Then there's some issues, some characteristics here.
These are advantages in red here that you see for Trump now versus September.
On the immigration and the border, we ask voters who would be better on this.
In September, Trump had a big advantage.
It's gotten bigger. On inflation and the cost of living, Trump's advantage now hits double digits.
And on the question of who represents change, Harris had the advantage in September.
She still does, but lower.

I want to bring Mark Mitchell in.
And Brother Mark, what's the chessboard look like to you?
There seems to be a consensus forming that Trump's rising and Kamala Harris is falling.

Isn't it miraculous?
And this is exactly what I predicted would happen.
So I wanna take a bit of a victory lap here.
Before I do, don't forget to remind me about Pennsylvania.
We have new numbers out today that I'm gonna break on your show exclusive.
But we laid this out in the war room back in July.
And we said, listen, Harris is a little bit better of a candidate than Biden.
Trump was up about five over Biden.
thought the race was gonna tighten to about two points.
Fast forward for the next two months and everybody's seen our daily numbers coming out and the race did indeed tighten, but it's been locked in at two points.
But what I predicted is, we all know that this is a referendum on the Biden administration.
We all know that there's zero substance to Kamala Harris's campaign.
And I never thought that the media was going to be able to pull her all the way out of August, all the way to election day, without her being exposed.
As this inauthentic creature of the media, and I basically called it the loser narrative because I thought at some point the media, any of them with a shred of credibility left, are gonna have to start preparing their viewers for what appears to be right now, barring nine trucks full of a million ballots each, An inevitable Trump win, and I can tell you from a polling perspective, Scott Adams called this too, the great pollster true-up.
And it all started, this whole thing came together last Monday when you started to see CNN with headlines like warning signs for the Kamala Harris campaign.
And now poll after poll being dropped on real-fair politics right now are more and more favorable to Trump.
Well, I can tell you on a national level, the race Really hasn't changed.
But you see NBC News, who had Harris up five, just dropped a poll that showed the national popular vote tie.
That's a Trump win.
You see ABC News, Ipsos has Harris plus two.
They had Harris, I think, all the way out at Harris plus six.
CBS News, Harris plus three.

Yeah. Let me ask you something important here, though, because I want to make sure this is not the red wave redux from 2022 that never materialized.
How does the polling you're reporting now compare with what we were seeing in the few days leading up to the 2022 race when everybody thought Republicans were going to just stylize?
mark mitchell
So, in my opinion, after the Dobbs decision, the polling didn't necessarily support a red wave.
I will say that our polling was too far to the right.
It was about a point and a half, if you measure and average everything that we polled in September and October.
The numbers were kind of all over the place.
We had Republicans plus one all the way up to Republicans plus seven.
I think our final average is about plus four.
The final was about 2.8.
The thing is, though, is that You can't poll every single congressional district, and it did show a positive setting for the Republicans, but nothing like it did right after the crisis in Afghanistan when everybody was seeing Republicans plus 10 or Republicans plus 13 in the polls.
I will say the polling all tightened up, and it came down to, essentially, Trump wasn't on the ballot.
So Republicans didn't outperform their polling like they did in 2016 and 2020 when Trump was on the ballot.
Now, before we get into states, though, I will just say from a national perspective, when you have Quinnipiac, Yahoo News, NBC News, and New York Times-Siena, basically, I think they're going to move right to- When you have all lefties saying that the national popular vote is essentially a tie, when four years ago Clinton was up seven or eight years ago, and four years ago Biden was up nine, Harris is only up 1.7 now.
But the problem is I don't think you've seen the full cycle of them all correcting to the right because the writing is on the wall.
If you look at Pennsylvania on RealClearPolitics, the writing is on the wall.
They need to steal Pennsylvania or they lose, in my opinion.

And I just had a poll. That's your segue.
That is your segue, brother.
You got breaking news for the posse.
Tell us. Yeah. Pennsylvania.

I'd love to get into this. So in September, we polled Pennsylvania.
We had a tied race.
That was probably a bad time to poll for Trump.
It was right after the debate.
And it did seem that there was some kind of response bias.
Our poll back then was flooded with lefties.
I was never really happy with that sample.
But looking at it now today, as of last night, we have Donald Trump up 50 to 47 by three points, just at the margin of error in Pennsylvania.
And we have McCormick down, I think this is about a one and a half rounds to two, and Republicans up three points on the generic ballot.
And that is right in the strike zone of where everybody's coming out now.
Hill Emerson, they lean a tiny bit left, I think.
They have Trump up one. Insider Advantage, Trump up two.
Trafalgar, Trump up three.
Atlas Intel, Trump up three.
We got Trump up three now, too.
I mean, this is really starting to look like a solid— Did you do anything with Scott Perry?

Did you do anything with Scott Perry in the state?
No, I didn't. He's in a dogfight.
mark mitchell
Okay. Yeah, well, ultimately what it comes down to, I think most of the people answering these polls, everybody knows who Trump and Harris are.
That's who's driving, like how they decide.
I think the straight ticket is going to help a lot of these Senate races and other races a lot more than the polling suggests currently.
But again, this is an incontrovertible Trump win in the polls.
He's never been up in Pennsylvania in the polls.
I mean, it's insane when you look at this point eight years ago, Hillary Clinton was favored by eight and she lost by one.
And Biden was up by seven and he won by one.
So there's an eight point and a six point polling miss there for you.
If there's any polling, this we're talking about massive like and again, like nobody's saying a red wave here.
The media narrative is Trump is tied because they needed to say that Trump is tied.
But in the betting markets, and right now looking at this on Real Clear Politics, Trump is up in Pennsylvania.
New York Times, the number one...
