So, first of all, I want to just talk a little bit about Kamala Harris again.
Denver, if you can cue that ad, I want to go through that one more time and then we'll do the Carvel thing.
When you're ready, let me know.
But the thing about Kamala Harris is that she's a creature.
of California politics.
And California politics, other than, say, maybe a city council
race in a small town, that's not what we call retail politics.
It's not a kind of environment, California, where you can go out, walk door to door, walk precincts,
shake hands, show up at malls and shake hands, go to rotary clubs and do all that kind of stuff.
I'm well familiar with how that works.
When I ran for mayor back in 1992 in San Diego, I walked a good part of that.
It's a big city, but I walked a good part of a lot of precincts there.
You can do that.
You can't do that, though, in California once you go to, for example, the state assembly, state senate, congressional districts, and then lieutenant governor, governor, attorney general, secretary of state.
It's strictly a money game.
The only way you win in California is by raising a ton of money.
So you either got to be independently wealthy or you got to get it from special interests and the special interests where the money is in California are all bad guys.
They all want stuff that's contrary to the interests of the people of California.
Silicon Valley is a big, big money pot these days, but you got the big developers that have ruined cities like Los Angeles with overdevelopment.
And so Kamala's rise And I think I'm better equipped to describe this than a lot of people because I was in California as she rose, and it was inexplicable to me at one level until I thought a little bit about it.
So she starts with her connection with Willie Brown, and I'm not going into the sex stuff, okay?
That's kind of irrelevant.
That stuff happens.
The problem With the Willie Brown connection with Kamala Harris, is that in order for her to move up the political ladder as she did,
When she got to be in law enforcement as a government official was that Willie would come to her and say, hey, go soft on these folks or in some cases go hard on these folks.
Right.
And when Kamala was going soft on folks for Willie Brown, it was people who were well-heeled, who
gave Willie Brown a lot of money so he could maintain his power structure.
And they got their money by ripping off the poor people of California.
That's the fruit of the poisonous Kamala Harris treaty.
You understand this?
She's a young, attractive, rising star, person of color.
Willie latches onto her.
Joy's all the fruits of her labor, but most importantly uses her as a pawn in his game to raise money, not just for himself in the assembly, but so he could pay for other races and then they would be beholden to him and he can maintain his speakership, okay?
And Willie Brown did tremendous, tremendous damage to the state of California.
Just a thorn in the side of whoever tried to govern California.
And Kamala was his B word.
I mean, let's be honest about that.
So as she moves up the ladder, Attorney General is the state office.
The only way you win those races is by spending And that's a ton of money on TV ads, okay?
But during her rise, during most of her rise, social media wasn't like an expenditure, right?
It was radio and TV ads blanketing the state.
And we're talking, we're talking like, like tens and tens and tens of millions of dollars that you had to spend even for something like Attorney General, right?
Two things there become quickly evident.
One is she's used to sucking on the teat of special interests to get that money, serving essentially the whims and wishes of the Silicon Valley interests, the big developers, whoever are screwing up the state.
Even as she's making her bones as a prosecutor, putting young, proud black men in prison for selling nickel bags of pot, right?
So, I mean, there's no public interest there.
She goes soft on real criminals.
Big criminals so that she gets the money she needs to advance up the ladder.
And so I was she she she wasn't on my radar screen when she was attorney general, frankly.
But when it came time for a Senate candidate, I was just like amazed.
It's like she was the anointed child.
It's like there was no question that Kamala Harris I mean, the election was a foregone conclusion.
Nobody even really challenged her in the primary.
And once you win the primary in California as a Democrat, you win the election.

So this is Kamala's schtick, right?
She raises a bunch of money.
She positions herself so that she's the chosen one.
She doesn't have to go out and debate anybody.
So she's never developed those skills.
And everything that comes out of her mouth is canned.
And she's good because she's in the land of Hollywood and running really slick commercials.
And so this is exactly what we're seeing now.
This is unprecedented, where the presidential candidate nominee for a major political party did not receive a single vote in the primary.
She just got coronated, anointed, And it was a Barack Michelle Obama op.
On Monday, we showed you a clip, and maybe we can get that back up, too, at some point, if you can find it, of how Obama, like, openly boasts in an interview how, well, I don't need a third term.
All I need to do is pick up a phone and tell who's ever in the Oval what to do.
And that's clearly the vision here, because remember, For Kamala to secure the nomination after Biden got his legs cut out from under him by Kamala and the press, it wasn't a sure thing that Kamala would get the nomination.
But Barack came in and put the knife in Joe's heart and gave the thumbs up, as Michelle did, to Kamala.
And that deal was done.
And so she's there.
As the anointed child, once again, like in California, she, you know, last time she ran for president, she had to drop out.
She had 3% polling numbers.
And here we go again.
And look, you have to laugh at the kinds of... I think this is like a stupid mistake.
I mean, everybody knows now that the CNN interview having Tim Walz there, the vice president, the older guy, is simply a lifeline hand-holding experience.
So she doesn't screw up.
It's like, Timmy, Timmy, save me in case I say something stupid, or in case I get asked a tough question.
You watch.
Tim will jump in.
He'll jump in, and you watch, too, that the moderators won't call that.
I'm calling CNN out right now.
If Tim Walz tries to save Kamala's sorry ass from saying something stupid, you damn well better jump in, CNN, or we're going to be all over your ass, and more importantly, the American public's going to be all over your ass.
And the drinking game I proposed, As the homage to, you know, Jack.
Remember that old drinking game?
It's like Jack Bauer.
This is every time Tim Waltz comes in to save Kamala's sorry ass from saying something stupid, you gotta chug a bottle of Chinese rice wine.
And I suspect that by the end of that, X million or so watching will be two sheets to the wind and laughing their ass off at this drinking game.
So that's Kamala Harris in a nutshell.
And it's sad that the media is allowing her to pull this off.
It's going to be a slick media campaign.
She's going to hide.

Phil, it's not uncommon for a prosecutor to do this.
It's actually a smart move with the trouble that he's having with the now former, but as of an hour ago, current indictment.
He now supersedes, he streamlines, and he tries to take that indictment Further, I mean, it really is a smart move on Jack Smith's part.
Whether it'll survive is unclear right now, but it is a slick move.
Instead, the very first words of this are not Donald Trump was the 45th president of the United States, but it now says Donald Trump was a candidate for president in 2020.
And it frames it in all of these instances as a candidate for office as opposed to a president engaging in official conduct.
I think it's clearly an effort to try to do more election interference from Jack Smith.
He should be ashamed of himself, and it's one of the reasons why we have to win, because he should not be anywhere near power.

Gambit, which CNN seems to think is a, quote, smart move, a slick move.
You know, not not smart or slick.
At all in my judgment.
We have Jeff Clark in and Jeff Clark, interestingly, plays a role.
I guess I guess, Jeff, you're the dog that didn't bark, at least in in Jack Smith's mind, meaning that for somehow you've been taken out of the indictment so that they can do this ruse about how it was campaigning and not official because you were in the government at the time.
Break this one down for me Jeff and on a scale of one to ten how surprised

Look, quick word about what you just referred to about me, but I want to put the focus on this, you know, new dastardly act against President Trump to try to stop him from getting reelected by Jack Smith.
But look, I was unindicted co-conspirator number four in this original indictment, and then I've been dropped out.
And so that's caused a lot of speculation in the ex-verse, the Twitter-verse.
Oh, well now I must be cooperating with Jack Smith.
So let me just say and set the record straight.
I don't think anybody in the war room posse or you thought that that was the case.
But look, I am not cooperating with Jack Smith.
I would not do that.
I have resisted the January 6th committee.
The House Oversight Committee, the Senate Judiciary Committee, Fannie Willis, you name it, I've resisted.
I'm not going in a different direction now.
President Trump did nothing wrong.

Let me help clear this up for you.

Sure.

You were in the government at the time.
jeffrey clark
Yes.
peter navarro
Right?
And what was your position?
jeffrey clark
I was an assistant attorney general of two different divisions out of the seven at Maine Justice and the U.S.
Justice Department.
peter navarro
Okay, so what Jack Smith is doing by taking you out of the loop is eliminating the argument that whatever President Trump was alleged to be doing Had nothing to do with official business because you were part of the official team.
So it never even occurred to me that somehow this was you cooperating with him.
That would never happen with Jeff Clark.
So this was simply taking you out of the loop so that they could do this ruse about how somehow the president of the United States On January 6th, still 14 or 15 days out before he would turn the reins of power over.
Was somehow not president on that stage that day.
Somehow it was candidate Trump.
I mean, it's ludicrous on its face.
It's a clear end run around the Supreme Court.
It'd be interesting to see what the Supreme Court thinks about this kind of ruse.
But what's disturbing to me, Jeff, about this, besides the fact that it's just kind of in your face, is that it's clear it's election interference to me.
So tell me, tell the audience, What his legal theory is and whether you think he's committed election interference, which would expose him to prosecution when President Trump gets elected.

Sure, so first, Peter, a word on the surprise question you asked me.
Look, I actually was surprised by this because he told the world, he told Judge Chutkan that he was consulting inside the Justice Department and that's why he needed some extra time.
What he was really doing was he was, and grand jury processes are inherently secret, he was running a secret grand jury process.
And what's amazing about that is, you know the media, they watch the courthouse like hawks.
They did not report at all that there was any possible new grand jury proceeding going on.
So they allowed this idea of, well, he's just doing internal consultations to go forward.
And then they surprised us with this thunderbolt yesterday of a new indictment.
The new indictment doesn't surprise me as a tactic.
I think that he would almost have to do that.
But what surprises me is that he did not tell the judge in advance that I'm opening a new grand jury and I'm going to be pursuing a superseding indictment and please put things on hold for that.

How do we know he didn't tell Chetkin?
jeffrey clark
It's possible he told her behind the scenes, but that would be an ex parte contact, and prosecutors shouldn't be doing that, Peter.
He might have told the parties.
peter navarro
You don't think he cares about that, do you think Chetkin knew?
I mean, let's suppose Chetkin knew about this, right?
Could she be a co-conspirator?
jeffrey clark
It's hard for me to imagine.
peter navarro
Is he committing a crime?
Is he committing a crime?
I would argue that this is a case of election interference, even though election day is November 5th, which is more than 60 days out.
It's also true that early voting starts within about less than 20 days.
And by the time 60 days are over, the election is probably going to be decided because, I don't know, 60-70% of the votes will have been cast.
Clearly it's election interference.
He's interfering with every vote that's going to be taken.
Over the next 60 days.
So is there any grounds to prosecute him here using any of the arguments that he's used to prosecute folks like Donald Trump and others?
jeffrey clark
So Peter, it's absolutely election interference.
I think that it's contrary to the spirit of the Justice Department policy that you don't bring a case like this this close to an election.
And you're right that now that we don't have a single election day in America anymore, and I think we should get back to that, we have all this, you know, high lead time mail-in voting.
It's clear that he's interfering with people who are engaged in that early voting and, you know, that's just unconscionable for somebody to do.
And why does he do it?
He does it because he's been given only one target.
Only President Trump is his target.
He's not weighing anything else like an ordinary prosecutor would.
We have many eminent prosecutors over time who've explained that the prosecutor can't just go after one man.
He has to actually be looking at a crime and then try to find the culprits and this is turning that system on its head.
Now, you asked the question of, could he face legal consequences?
He could, but if they were brought against him, no doubt, ironically, a huge irony would be he would assert that he is immune, that he has absolute prosecutorial immunity.
He wanted to deny that to President Trump, who is the chief prosecutor of the United States, after all, when he was president.
But he would then, you know, seek that as his blanket to protect himself.
So, interestingly, Peter, this now 11th Circuit appeal that's going on about the case coming out of Judge Cannon's court down in Florida will be very interesting because if he has no authority because he is an improperly appointed official because he was not Senate confirmed, then he may lose the protections of that immunity defense.

When is that case likely to be settled?
jeffrey clark
Uh, the briefing is going to occur through the fall, and I think probably an oral argument, you know, maybe at the earliest in December or something like that.
It depends on how fast the 11th Circuit decides to proceed.
peter navarro
Now with respect to this new indictment, is it going to tie up more resources of the president?
Is he going to have to be reporting to court and get arraigned and all that stuff again?
How is this going to unfold?
jeffrey clark
I saw a cover filing that Jack Smith made yesterday, Peter.
And in the cover filing, he said that, you know, he would agree to waive arraignment.
I think there's going to be a whole heck of a lot of motions practice about this because he's framed a new indictment.
I think, you know, President Trump is entitled to his lawyers will file a new motion to dismiss the indictment that will get responded to and replied to.
And then Judge Chutkan will have an oral argument.
None of that really requires President Trump's presence.
And then whatever she does, whether she says, oh, he, you know, I have to strip out parts of even this new indictment or no, we're just going to go forward with this new indictment.
