As we were saying mean things about Biden and the FBI and DOJ, and he was whining and crying and wanted to stop it. | ||
President Trump just came back. | ||
Tell us, where do we stand on the gag order? | ||
They're trying to shut down President Trump in every way possible. | ||

So this late night, Friday night, holiday weekend motion to modify Donald Trump's release conditions in the Southern Florida case, this is a direct result, Steve, of my Not my discovery, but what I posted on Tuesday when those motions were filed, it disclosed that in the operation order for the Mar-a-Lago raid, the government included use of lethal force guidance in that order. | ||
So, and of course, I went on your show right away after those motions were posted, and I was one who broke the news, and this has caused chaos everywhere, including in my own In my own life for the past week, who would have thought that? | ||
But at any rate, this is a direct result of that reporting. | ||
Jeff Smith using the legal process to refute what certainly could have been a potentially dangerous situation for the former president and his family. | ||
We saw Tuesday night, FBI Director Christopher Wray came out with a rare statement downplaying what I had reported and what was included in those motions. | ||
Merrick Garland addressed it the next day. | ||
So this is all spin, Steve. | ||
This has nothing to do with respectfully using the legal and court process to advance this case in the classified documents case in Southern Florida. | ||
This is a coordinated spin because it has been so damaging To this case, to the DOJ, to the FBI, Jack Smith. | ||
And so this was his asking for Judge Cannon, of course you won't, Judge Cannon to prohibit Trump from making false and inflammatory public statements about law enforcement involved in the case. | ||
Not law enforcement involved in the raid, because of course all those names are automatically redacted in the filing. | ||
We want to prohibit, ban him from saying anything about law enforcement. | ||
What does that mean? | ||
He can't say anything about Jack Smith? | ||
We know that Jack Smith, in his gag order, proposed gag order in Washington, asked Judge Chutkan to prohibit Donald Trump from saying mean things about Jack Smith. | ||
And so this was a very broad order. | ||
Has nothing to do with protecting law enforcement. | ||
Has to do with protecting Jack Smith and the DOJ and FBI's hide. | ||
And we are learning more about this dirty, unprecedented, and potentially dangerous raid at Mar-a-Lago in August of 2022. | ||

What's the takeaway from that? | ||

Yes, so Donald Trump's lawyers filed a motion last night, Monday night, and not only asked, obviously, for Judge Cannon not to grant Jess Smith's motion, but also to hold the special counsel's team in contempt because they did not allow for meaningful conferral on a proposed motion, and this is a local rule in Florida courts. | ||
And I will tell you, Judge Cannon is such a stickler for the rules. | ||
I have watched her upgrade both the government and defense team for not properly formatting their briefs. | ||
She wants them double-spaced. | ||
She wants them in a certain count, in a certain font. | ||
So she is a real stickler for the rules, and especially the idea of each side conferring with the other before they file a motion. | ||
Well, what came out in Donald Trump's reply motion last night is that, of course, they waited until Friday night around 530 before a holiday weekend. | ||
Keep in mind, one of the attorneys in the Florida documents case for Donald Trump is also one of his attorneys in the Manhattan case. | ||
So as soon as Jay Bratt, who I call the degenerate little midget who has been running the show from the very beginning, as soon as they emailed Donald Trump's team, and they came back and said, look, you know, we've got this going on right now. | ||
It's a holiday weekend. | ||
Can we discuss this on Monday? | ||
Went back and forth for a couple of hours. | ||
Jay Bratt, Justice League prosecutor said, no, this is too urgent. | ||
We're filing this motion anyway. | ||
And I think it hit the docket around nine o'clock on Friday night. | ||
So this will not be taken well by Judge Kannon, not just the process that was violated, but also the allegations. | ||
Donald Trump, either your, you know, his postings about an assassination attempt, locked and loaded, or any other media coverage about a potential assassination, that threatens the lives of law enforcement. | ||
She has already called Jack Smith out for making those big, broad allegations. | ||
The media is after Alito and Thomas to recuse themselves on immunity in the Fisher case. | ||
They're also, all weekend, they're saying she's incompetent, she's got to go, I think the 11th Circuit's got to remove her. | ||
Can you give us a minute on that before you bounce? | ||
I do, and I've got a piece up on my subject declassified with Julie Kelly that speaks specifically to why they're going after Justice Alito because of the 1512 C2 ruling that's pending and also the immunity question that's pending. | ||
In both oral arguments, he indicated that he was going to vote against the government. | ||

And so moving forward now, I'm expecting something from Judge Cannon in the next few days, how she will respond to this. | ||
If she, this is why Jack Smith is also dumb. | ||
Open can of worms, because there is a lot of documentation, Steve, about this raid, including grand jury testimony by Secret Service agents and FBI. | ||
She ordered that sealed pending additional litigation, which is exactly what Jack Smith just opened the door for. | ||
If she holds an evidentiary hearing, if she permits the unsealing of other records related to this raid, we are going to find out More dirty details and the people who defended this, especially on our side, former federal prosecutors, former FBI agents who said this is standard operating procedure, they are going to eat those words because there's a lot more to learn about this raid. | ||

President Trump is allowed to have under the Presidential Records Act, and there's no criminal | ||
component to the Presidential Records Act. | ||
If there's a dispute between the Justice Department and the librarians at the National Archives | ||
and the former president, that's handled through mediation and negotiation, and at best, civil | ||
litigation. | ||
It's not handled through an unprecedented, unnecessary, and unlawful raid on the office | ||

And with this FBI raid, it's very clear that President Biden, through Jonathan Suh, his | ||
deputy White House counsel, orchestrated this raid. | ||
Garland personally signed off on it, and they all knew that this FBI raid was an armed raid with shoot-to-kill orders, if necessary. | ||

They encouraged these illegal obstruction of justice campaigns against The Supreme Court justices from the Biden White House, Press Secretary and the Biden Justice Department, Merrick Garland, even after the 1 a.m. | ||

And just a couple of blocks from here, a jury found him liable for sexual abuse. | ||
Somehow he even got self-styled patriots to support a man who called for terminating the | ||
Constitution and on January 6th rallied an angry mob to threaten democracy, | ||
leaving death and destruction in its wake. | ||
That's why I needed to be involved and wanted to be involved in the new Biden-Harris ad. | ||
Because it shows the violence of Trump. | ||
And reminds us that he'll use violence against anyone who stands in the way of his megalomania and greed. | ||
But it's a coward's violence. | ||

I have unreleased numbers we haven't put out yet that, again, in a two-way, Donald Trump is up 10 points over Biden. | ||
But there's just a lot of tears, because I think that they really did put all the chips on lawfare, and it looks like it's not going to work out for them. | ||
And unfortunately, Joe Biden is not a popular president. | ||
He's losing to Donald Trump, and he's a drain on the ticket. | ||
Since the last time we talked polling, we came out with generic ballot numbers, and we have the Republicans up 5, but Donald Trump up 10. | ||
Biden's not even getting above 40, but the Democrats get to 42% in the generic ballot. | ||
So he's a drain on the ticket, and I think they're starting to realize that, and they're really starting to panic. | ||
Let's talk about lawfare. | ||
You've done some work on what American people think about who's actually in back of this and who benefits from it. | ||
Because I think the American people now are working through this, even if this jury aren't patriots and can stand up for the rule of law, if they crumble. | ||
Because the White House's entire messaging, they've already said that they're going to do a press conference from the White House. | ||
Convicted felon, convicted felon, convicted felon. | ||
That's all they're going to do. | ||
Have this vermin like De Niro out there in the Hollywood machine just repeat, repeat, repeat. | ||
But you're saying the American people may be on to him here, sir? | ||

Throughout our polling history, the FBI had about a 60% low 60s favorability rating. | ||
The very first thing that for the first time put the FBI favorability underwater, 45% to 49%, was the rate on Mar-a-Lago. | ||
And that's the same question set that we showed that a majority of Americans, 53%, said the FBI was acting as Joe Biden's personal Gestapo. | ||
Unfortunately, I don't have the numbers yet, but we're going to refresh that set tomorrow and also go after the use of deadly force. | ||
But then 64% of American voters say the FBI has been politically weaponized starting at the top in D.C. | ||
And, you know, now a plurality of Americans basically think the Republic has fallen and a strong majority of Americans are concerned that we're living in a police state. | ||
So that's Biden's America. | ||
That's what they've had to do in order to stay on top. | ||
And, you know, I think that that's why. | ||
People are fleeing Biden. | ||
And there's, I don't think, you know, James Carville, I don't think there's really anything that they can do at this point. | ||
We've been going after this, but they lost the Hispanic vote. | ||
They're losing the 18- to 39-year-old vote. | ||
And even the black vote doesn't look like a shoo-in. | ||
A month ago, in our two-way matchup, we had 61 percent of the black vote going to Joe Biden, 21 percent going to Donald Trump. | ||
Now, it's a smaller subsample. | ||
It's going to swing back and forth. | ||
But believe it or not, in this latest set, I have Trump winning a two-way matchup against Biden by one point among black voters. | ||
And these numbers are less than three days old. | ||

And, you know, it's not just the Texas House and the Speaker's race that you're just talking about, but we have congressional races going on, in particular, obviously, Texas 23, where you've got Brandon Herrera, who represents kind of an insurgency of change. | ||
Wanted to take on the status quo against Tony Gonzalez, who represents essentially just more of the big government appropriations that have been messing up Washington for far too long. | ||
He voted for the FISA reauthorization. | ||
He voted against the warrant protections. | ||
He was the only member of the Texas delegation who did not sign on to the Texas border plan that formed the basis of H.R. 2. | ||
He called by HR 29 bill which requires that we detain or turn away, quote, unchristian. | ||
He has referred to conservative members of the House and the Freedom Caucus or otherwise as effectively members of the Klan. | ||
He did that on national TV and has doubled down on that. | ||
He's voted for massive spending bills, voted for gun control. | ||
When we needed leadership to stand up against gun control, as you saw, I had a hearing last week with the ATF director. | ||
They're now using the legislation that Tony supported. | ||
To try to make sure that they're going to go after law-abiding citizens and make it to where I don't even know if I need a license to sell a gun. | ||
So just go down the list of things. | ||
It's more of the same. | ||
Today is the day to try to change that in Texas. | ||
He also called you, Gates, others anarchists, that you don't know how to run the House. | ||
You're just a bunch of anarchists. | ||

They're the people that have been messing up America for far too long. | ||
It's why the approval for Congress is always about 15 to 18 percent. | ||

It's so bad that Arizona has two different systems, a state system where they pass legislation to require citizenship and then a federal system where they're prohibited from doing it. | ||
So we want to clear the decks. | ||
We want to have a requirement nationwide, have a standard nationwide. | ||
It's totally constitutional. | ||
There's not a federalism concern here because we have the authority as Congress to set the terms of our elections. | ||
So we can do that. | ||
We should do that. | ||
We should require citizenship. | ||
I hope the House will vote on this. | ||

Last week, we passed a bill that was D.C.-focused to prohibit D.C. | ||
from allowing illegals or non-citizens to vote in elections in DC and state and local elections. | ||

Make sure you let all your members know that they need to support that bill. | ||

It's just not going to move the needle at all. | ||
And I think the biggest data point is, you know, look back at what happened in March | ||
of 2023 when those indictments came out. | ||
And then all of a sudden, Trump is just absolutely crushing it in the GOP primary race. | ||
And I think that's when his national numbers went up too. | ||
I think, you know, Americans like a fair fight. | ||
They don't like cheaters. | ||
As we know from all of our polling on election integrity, one of the few pollsters out there that does it, Americans just hate the idea of, you know, a fraudulent democracy, so to speak. | ||
Mark, I don't want you to give the numbers yet, but you're in the field on a couple of other huge polls. | ||
