Well, you know what is so striking about the opinion, which is relatively short when you consider all the other opinions that have been handed down in Trump cases, You realize he reached the same point that so many of us have reached and realized a long time ago, that he is not an ordinary defendant.
And oh, guess what?
We can no longer treat him as such.
We're going to have to bring the weight of this court against this particular defendant because he is prone to misbehave deliberately.
And so what was fascinating was just watching all the light bulbs go on as you're reading this and thinking to yourself, well, y'all didn't see this coming.
Y'all didn't know this about this man.
How many times did it take for him to actually break the gag orders that were already in place?
I mean, you watch the man who got handed down an $83 million judgment against him in the E. Jean Carroll case, and what did he do literally after that decision came down?
He went out and went after her again.
And what did they do?
They dragged his behind back in court and got another $5 million judgment out of him.
So the reality of it is, this is what he does.
And it is good to see the system, Nicole, finally catch up to.
This is his behavior.
This is how he's going to act.
And so now the question is, in light of what Judge Bershon handed down last evening, the clock is ticking.
When does he break that particular gag order?
We'll see.
He's going to find a way to do it.
And the system ultimately is going to say, you know what?

Mike, a couple things.
Number one, right there, this afternoon, they're all cackling.
The full weight of the system has been brought down on Trump.
This is what MSNBC is saying on the trial of the century that's going to take place two weeks from yesterday in New York.
And I'm here to announce that Mike Davis will be our special correspondent there giving us his brilliant insights in acerbic humor.
Mike Davis, is the whole weight of the system, what is going on with this gag order?
Now he's protecting himself, his daughter.
What in the hell is happening here?

Yes, you have this Manhattan Democrat Judge Mershon who donated to Biden in 2020 and another anti-Trump organization is presiding over this case brought by Soros-funded Manhattan DA Alvin Bragg for the non-felony of a businessman settling a nuisance claim.
And this legal theory that they're using in this case was passed over by the prior Manhattan DA, the Federal Election Commission, the Manhattan U.S.
attorney and Alvin Bragg himself, until Matthew Colangelo got sent from a senior political post in the Biden Justice Department to bring this, to resurrect the zombie case, to bring this first indictment ever against a former president who happens to be the leading presidential candidate.
Like you said, this trial starting in less than two weeks on April 15th.
And this judge, Trump learned, has this adult daughter who is a Democrat political operative, a Democrat political consultant.
So you have the judge donating to Biden and another anti-Trump group and his adult daughter making money doing political consultant work, including for Kamala Harris, the DNC, and many others.
And President Trump raises the very legitimate concern that this judge, where Sean's daughter, his adult daughter, as Julie Kelly says, she's not some five-year-old girl who Trump's picking on.
She's an adult daughter and she could be making money off of this unprecedented criminal trial of a former president.
The first criminal trial of a former president ever who happens to be the leading presidential candidate, Trump raises this issue.
This judge just says, oh, we're not going to talk about this.
And then President Trump goes on truth, and they expanded this gag order.
Remember that if there's anyone on the planet who must have the constitutional right to speak out against the judge, The prosecutor, their staffs, the witness, the witnesses, the process, it is a criminal defendant.

But normally, I just want to make sure, because I'm not a lawyer, you are.
In normal trials, you don't have the defendant talking about the judge or talking about the prosecutor.
Isn't that all within the confines of the courtroom?
And it's what's presented?
Or do they have the right to actually go out And talk about this on the outside and go to the media or go to the sticks and give them the old what for.
Is that legitimate?
Forget Trump for a second.
Is that legitimate in any criminal trial?

Absolutely.
A criminal defendant has the absolute constitutional right under the First Amendment to speak out against the judge, the prosecutor, their staffs, the witnesses, the process.
Now, he can't threaten them.
And if he physically threatens them, then he could be charged with obstruction of justice or witness tampering or related crimes.
But what the Democrats are doing here is they're bringing this unprecedented lawfare and election interference against Trump for these non-crimes in four different jurisdictions, New York, D.C., Atlanta, the Southern District of Florida.
They brought these bogus civil lawsuits against Trump for non-fraud and non-defamation.
The statute of limitations had passed, and Gene Carroll still managed to get a judge to whack Trump with a nearly $100 million fine.
This is lawfare and election interference.
And what they're trying to do is interfere in the election.
And if Trump speaks out against this, Hang on a second.
First Amendment right to do, they're trying to put these illegal, unconstitutional gag orders on him.
Those are illegal prior restraints on President Trump's constitutional rights, including his right to free speech.
It also affects President Trump's Sixth Amendment rights.

Does he have the right, does any defendant have the right to sit there and try to delegitimize the process by saying that this is rigged, that they've got a daughter that's an operative and they've got Alvin Bragg who's taking source money or any kind of charge?

Forget the appropriateness or whether inappropriate or appropriate.
The law that we have, does he have a first, does a defendant have a First Amendment right to go outside, to go to the sticks, or to go on social media and say that to try to delegitimize the process?

100% absolutely, and it's not until really what they started with Roger Stone.
These Democrat prosecutors and judges started with Roger Stone, where they put an illegal, unconstitutional gag order on him, and they're doing the same thing to Trump.
Remember, the Constitution is a shield that protects us from the government.
The First Amendment protects our right to free speech, so the government can't take that away from us.
The Sixth Amendment protects criminal defendants' right to a fair, public, and speedy trial.
It doesn't protect the government to a fair, public, and speedy trial because the government doesn't have a right to a fair, public, and speedy trial.
That belongs to the defendants.
These gag orders that judges enter, the whole purpose of these gag orders is to protect criminal defendants, to make sure that there's not extrajudicial statements made that could taint the jury pool and take away the criminal defendant's right to a fair, public, and speedy trial.
And that's why you saw with this D.C.
U.S. District Court Judge Reggie Walton, when he went on CNN on Thursday.

You know, it's rare that we get to hear from a sitting federal judge, but obviously this is a gravely important issue.

I wonder what made you speak out tonight and speak publicly.
Well, you know, I am concerned because, like I say, we have had judges who've lost their lives or family members have lost their lives as a result of individuals who have been litigants in their courtroom.
And I think it's important, in order to preserve our democracy, that we maintain the rule of law.
And the rule of law can only be maintained if we have independent judicial officers who are able to do their job and ensure Uh, that the laws are in fact enforced and that the laws are, you know, applied equally to everybody who appears in our courthouse.
And I think it's important that as judges we speak out and, you know, say things in reference to things that conceivably are going to impact on the process.
Because if we don't have a viable court system that's able to function efficiently, then we have tyranny.
And I don't think that would be good for the future of our country and the future of democracy in our country.

Okay, Mike Davis, how extraordinary—Caitlin Collins, wow, this is pretty unusual.
How extraordinary.
Has that ever happened before?
A federal judge, a sitting federal judge comes on and starts talking about ongoing trials and defendants?

This is unprecedented.
I can't think of another instance where a federal judge, any judge, let alone a federal judge, has had such horrific judgments that he would go on CNN in front of 500,000 viewers and make these clearly inappropriate, highly prejudicial, defamatory comments about any criminal defendant with a pending criminal case.
He's essentially saying that because President Trump is raising evidence that Judge Mershawn and his adult daughter are biased, they have a potential conflict of interest on this criminal trial that starts in two weeks, that this Judge Reggie Wallace is moonlighting on CNN last Thursday night and going on there and saying that Trump is essentially threatening violence
against Judge Mershawn and his adult daughter simply because a criminal defendant raised evidence of potential bias in their criminal proceedings.
I can't think of anything more dangerous in a democracy that Reggie Walton thinks he's upholding than a federal judge doing what he did last Thursday, right?
This is unbelievably prejudicial.
President Trump has four criminal cases going on right now, so that means that this Reggie Walton, who went on CNN in front of 500,000 viewers, and this clip has since gotten—this 10-minute interview has since gotten millions of views.
This has absolutely tainted President Trump's jury pool in D.C., in New York, in Atlanta, down in the Southern District of Florida.
This is inexcusable, what he has done.
And it is shocking to me that a federal judge has deluded himself into thinking that it's appropriate to take off your judicial robe and climb into the political arena and to climb into the political arena and throw a punch against a criminal defendant going through the process merely because that criminal defendant doesn't think the referee is going to be fair.
This is inexcusable what this judge has done and that's why the article 3 project filed a judicial- Hang on, hang on, hang on, hang on, hang on.

District Court Judge Reggie Walton for his highly inappropriate, unethical, highly prejudicial CNN interview he did last Thursday, where he essentially accused President Trump of inciting violence against a judge and his adult daughter for President Trump merely raising potential bias by this judge and his adult daughter because his adult daughter is a political consultant who's on
the Democrats payroll and has been on the payroll for many years, including Kamala Harris and the DNC. And President Trump is simply saying, if Judge Bershon's daughter is making money off of President Trump's criminal trial because it affects the election, Judge Bershon should recuse from this case and have another judge step up.
And this D.C.
U.S.
District Court judge Reggie Walton thought it was his turn to moonlight on CNN last Thursday, and he went on and did this unbelievably prejudicial interview for nearly 10 minutes.
So the Article 3 Project filed a judicial misconduct complaint today under Canon 3A6 of the Code of Conduct for United States Judges, which states the following, it's pretty simple, quotes, a judge should not make public comments on the merits of a matter pending or impending in any courts.
Judge Reggie Walton did this.
It was unprecedented.
It was prejudicial.
It showed incredibly bad judgment on his part.
And it's highly prejudicial to President Trump, who has to face a jury trial in less than two weeks in New York and three other juries in D.C., Atlanta and Florida.

He'd be removed from the bench for this or just sanctioned.

He is a senior judge.
The Chief Justice of the United States can remove him from his cases.
He has lifetime tenure.
He has pay protection.
The only way you can remove them is through impeachment and removal.
But here's the deal.
Even if this Democrat, this Obama-controlled D.C.
Circuit, which has become a rat's nest, these D.C.
federal judges think it's their job to take off their judicial robes and climb into the political arena and punch criminal defendants because they don't like their political views.
This must stop.
And this is this is a pattern by the D.C. District Court.
Beryl Howell went out and did a speech before, and Elise Stefanik filed a judicial complaint against Judge Beryl Howell.
And now the Article 3 project is filing this judicial complaint against Reggie Walton.
These judges need to understand that if they take off their judicial robes and climb into the political arena and throw political punches, they're going to get political punches in return.
And that's what the Article 3 project has done.
And now this judge is going to have to spend his time and money responding to this complaint.

What is his even venue and avenue?
Because this is a state court.

So this goes up through the New York appellate courts, including to the New York Court of Appeals, which is their Supreme Court.
It could go to the U.S.
Supreme Court if the Democrat-controlled New York courts don't fix this.
Remember in D.C.
when they put these illegal, unconstitutional gag orders on President Trump with D.C.
Obama Judge Tanya Shutkin?
The D.C.
Circuit reversed her gag order and limited it.
It's still unconstitutional, but they limited the gag order.
With this, Judge Bershon He put a gag order that's even more broad than D.C.
Obama Judge Tanya Shuckins.
He's a total partisan political hack in a robe.
His daughter, his adult daughter, is a Democrat political consultant who could be making money off of this criminal trial.
She's certainly made money off of political campaigns in the past against President Trump.
And it's very fair for President Trump to raise this evidence of judicial bias or potential judicial bias.
And to respond by putting a gag order on a criminal defendant because he's raising questions, he's raising evidence about a judge's potential bias, is the most un-American thing I can think of.
And for a federal judge, this D.C.
federal judge Reggie Walton, one of Eric Holder's buddies, they say he's a Bush 43 judge, he was a compromise pick, he's one of Eric Holder's left wing buddies.
He's been terrible on January 6th defendants for him to think that he, the audacity of this judge, the arrogance of this guy, the delusion of this guy to think that he can take off his judicial robe and go moonlight as a legal critic on CNN for another judge's criminal trial.

And one guy said it to me like this.
He goes, do they have Mike Johnson's wife tied up somewhere and have a gun to her head?
What is wrong with Mike Johnson?
And everything you just explained, people can't even comprehend who he is and what he is doing, but I tell you, I'll put it to you like this.
I think he's been promoted to be the senior partner at the firm, and you know what that means.
He is not working for Republicans.

Let me give everyone a little brief history lesson.
September 28, 2023, the last time the House held a vote on Ukraine funding was on the $300 million that I had forced out of the Department of Defense bill.
And they took it out of the bill and we had a separate floor vote on sending $300 million, only $300 million to Ukraine.
117 Republicans voted no.
That was the majority of the vote.
Only 101 Republicans voted yes.
That has been the last time we've had a vote for it.
So for Mike Johnson, to actually think that his Republican conference supports sending $60 billion to Ukraine.
He is a damn fool, Steve. And he's a liar.

The last vote, which was, I mean, we're, here we are, April 2nd, 2024.
The last vote was September 28th, 2023.
This is, you know, not that long ago.
The last vote we had on funding for Ukraine, $300 million.
The majority of the majority voted no to sending that money.
And yes, we are not supposed to, it's not specifically in our rules, but we are not, he is not supposed to go against the majority of the majority.
That's a House tradition.
It should not be broken by a Republican speaker.
Secondly, Steve, let's ramp it up a little further.
Recent polling in February came out and showed that 70% of Americans are against funding Ukraine.
70% of Americans specifically want a peace agreement in Ukraine.
So not only is Speaker Mike Johnson, our Republican Speaker of the House, going against the majority of the majority of his conference, but he's also going against the will of 70% of Americans.
That's not just Republicans.
That's all Americans.

You've taken some action and dropped a, it's not, you know, it's not the highest level, but you dropped a motion to vacate to kind of sit there and simmer over this recess.

They do not want him to be Speaker of the House.
They are fed up.
This is the whole reason why we elected Donald Trump to be President.

I mean, this really is a referendum.

So everybody I've talked to in my district, people I've talked to across the country, they totally agree that he needs to be vacated.
But here's what they're worried about.
They're worried about us losing the majority.

I don't want to lose the majority.
I will never do anything to cause us to lose the majority and Joaquin Jeffries become Speaker.
But let's be realistic.
The only way that happens Is this a Republican in our conference votes for Joaquin Jeffries?
And are you going to tell me Don Bacon or Fitzpatrick or one of these other moderates are going to actually vote for Joaquin Jeffries?
No, they're not going to.
This is an election year.
Those guys have to have Republican voters in their district to get re-elected.
And even in a really tight district, a Biden district that a Republican represents, They are not going to vote for Joaquin Jeffries to be Speaker of the House.
That would be a betrayal that would cause them to lose their re-election.
It's just not going to happen.
The only way Joaquin Jeffries becomes Speaker of the House is if Mike Johnson keeps doing what he's doing and more Republicans leave.
That is simple math.
The more Republicans leave, the more Democrats have the control.

There's a snowstorm going on right now.
They're expecting, I think, around six inches of snow, so I'm gonna I pray and hope that I can make it to Mar-a-Lago tomorrow night for Terry Lake's fundraiser, but it's not looking so great right about now, and the plane ride over here was quite bumpy, and they were out there for a very long time.
I'm talking several hours, three, four hours, all bundled up, snow pelting at their faces.
So the resilience of his supporters is truly amazing to see, and no matter where I go, whether it's extreme heat or extreme snow, you know, people show up to see President Trump, and it's really inspiring to see.
