159 years ago, today, just a couple hundred yards from the War Room, on the East Steps of the Capitol, President Abraham Lincoln gave his historic Second Inaugural Address.
He would be dead, what, six weeks later, to be assassinated.
A hundred yards from here is the Supreme Court.
Historic day today.
Nine to zilch.
And they're not handling it well.
They're already melting down.
But we have other things we have to focus on because, as we told you, it's either lawfare or steal it.
The numbers last week from Morning Consult slash Bloomberg, from Siena slash New York Times, and from CBS News.
Absolutely blow out numbers and they know it and this Thursday is going to be another fiasco with them with Biden's hapless State of the Union address.
Raheem Kassam, I want to go back because this is one of the reasons of the illegal alien invasion and get them on the voter rolls all that but they gunned deck this years ago when they fought us tooth and nail about getting counting of illegal aliens in the census that would apportion a congressional seat, sir.

And at the time, you know, like you said in the last hour, so many people on the political right, even on the mugger right, had their heads firmly, well, I will say because it's a family show, in the sand, but they certainly had their heads somewhere else on this issue and did not understand fully the implications, did not even perhaps understand minutely.
The implications of allowing illegal immigrants to be counted in the census and therefore, right, it doesn't seem like a long jump but for some reason a lot of people can do this, therefore diluting the power of the ordinary Americans vote in all of these redistricting places.
Why do you think they were so hot on it?
Why do you think they're banging on it about it now?
And why do you think we're now starting to hear, by the way, long-term listeners of this show will remember, The warning siren that we put up, the Transition Integrity Project, we told you how they were going to steal it.
I am telling you right now, mark this down today.

If they win the House, they will refuse to certify Donald J. Trump as the President of the United States.
They are signaling that.
They are saying that.
We must take them at their word.
You want to talk about the pathology that is going on here?
Let me read you Keith Olbermann's tweet this morning, right, when the Supreme Court decision came down.
He says the Supreme Court has betrayed democracy.
Its members, including Jackson Kagan and Sotomayor, have proved themselves inept at reading comprehension and collectively the court, he writes, has shown itself to be corrupt and illegitimate.
It must be dissolved.
Remember, this is the side for years and years who talked to you about the importance of institutions, about how Trump was going to bring all these things down, and the second The second, the millisecond, the split second after they don't get their way in something, they are willing to tear it all down.
These are the stakes.
These are the pathological people you're dealing with.
And like I said in the last hour, if John Eastman gets sued for his novel theory, then these people who lost their case at the Supreme Court today need to face the same sanctions, the same disbarment, and the same parading through the streets that they have foist upon the mugger right for the last several years.
That is a fact.

Remember, what also Oberman's signaling, we gotta get Mike Leon about this.
They were adamant the other night on MSNBC, they're talking about they gotta expand the court to like 30 people.
This is another aspect of this.
This is why these House seats, this fight in the House, is only slightly less important.
then actually may be equal now to the presidency.
They've said this.
This was in Politico last week.
They have stated, Jamie Raskin and these guys, they will not certify Trump because their committee, the J6 committee, considers Trump an insurrectionist.
Let's bring in Jeff Clark for a second.
I want to go back to Stephen Miller.
And Stephen K. Bannon fought this one from day one in the census.
I mean, this was another knife fight behind the scenes that people don't realize.
And Rahim, you're 100% correct.
There were so many voices in President Trump saying, oh, don't do this, this is nativist, this is xenophobic, this is racist.
And President Trump, no.
This is we're not going to dilute.
We're not going to dilute American citizens.
But Jeff Clark, you know, the you know, all the machinations about this and how basically we we ended up in the Northern District of California with a ruling against us.
And this is also why you need Mike Davis and Jeff Clark and these other hammers in the Whitaker and these other hammers, either the White House Counsel's Office or over at Justice.
When this happens, tell us tell us how the tee up And this is what signal not noise means to you, because there are things that happen that don't come to fruition until years later.
Walk us through what happened on this illegal aliens counted into these congressional districts.

Sure, Steve.
So here's the quick story.
So in 2019, Trump issued Executive Order 13880, which basically excluded the illegal aliens from the census count.
So then massive litigation was filed in the Northern District of California against that action and related actions.
And, you know, in the proximate term, it was fought out in terms of a deadline of when the census stopped because it had been temporarily extended due to COVID.
So the issue was assigned to this judge, Lucy Koh, in the Northern District of California in Oakland.
Now she's on the Ninth Circuit, I think, as a reward for what she did.
She held us up massively.
You know, I've never seen such a result-oriented attempt to just keep kicking the can down the road, extending TROs and the like.
We finally got it teed up to go to the Ninth Circuit and the Ninth Circuit refused to reverse what she had done.
So then we went to the Supreme Court and it took until, so she was very good at running out the clock, until January 18th, 2021.
To get that basically, you know, put on hold so that numbers could be finalized.
And so, you know, wasn't enough time.
Then Biden comes in on January 20th, signs an executive order 13986 that reverses the Trump executive order and the rest is history.
So we have a census that does include the illegals.

This is why, when we have Alex deGrasse Tyson here, as War Room Posse knows, this is why these redistricting fights, they're still before us, are all important, right?
Another time to the ramparts.
Jeff, give me your sense of 9-0.
I mean, you and Mike Davis first, and then you.
said, look, if you look at the Constitution, look what's happening, it should be nine to nothing. But I don't think even I never thought it'd be nine to nothing. I think you even had not on the law, but just on the makeup. Give us your sense of what they said this morning.
How important is it? And how do we get to nine to nothing?

So since I managed to get through the three opinions that were issued here, one per curiam for the full court, one for Justice Amy Coney Barrett, a concurrence, and then a concurrence in the judgment only by the three liberal justices.
I can tell you that story is slightly more complicated.
So all of the justices agreed unanimously that the doctrine of federalism barred Colorado from interfering in who gets on the ballot for a federal presidential election.
So that's tremendous.
And it's great that the chief managed to fight to a spot where we got nine votes on that.
But from there, things split basically into a conservative camp of five, the liberal camp of three, so Sotomayor, Kagan, and Ketanji Brown-Jackson, and then Amy Coney Barrett trying to stay above the fray.
And so the latter four justices, the liberals plus Amy Coney Barrett, they argued that the only issue that should be decided is that issue of federalism doctrine.
And what they objected to was that the majority went on to reach the question of Section 5 of the 14th Amendment and say that unless there's specific legislation that meets specific tests, that you can't even do federal enforcement to prevent someone from holding federal office under Section 3, the so-called insurrection clause.
So, you know, that might be somewhat technical for people, but I think I can simplify it by saying, so what's at stake there?
Why are they fighting about that and saying that the majority of five went too far in closing down that theory?
And they did that essentially by enacting into Supreme Court law the Salmon Chase circuit riding decision we talked about on several of your prior shows.
Which the three liberal justices strongly objected to.
They were very hopping mad about that.
Why do they care?
They care because they want to leave open the prospect, not that states would keep Trump off the ballot, but that if Trump makes a return to the White House, and he has officials who are also said to have participated in the January 6th insurrection, that then Enforcement actions could be, or defenses could be brought by criminal defendants, or maybe declaratory judgment actions, saying that those officials, or maybe even the president himself, doesn't have the authority to sit in office.
Those would be filed in federal court.
And they want to leave open the prospect that that could essentially, I think, hamstring a second Trump administration, like they used Russiagate to hamstring the first Trump administration.
And the five justice conservative majority was having none of that.
They shut all of that down.

So, hold on.
I want to go back to this again.
Just hit rewind.
What are the liberal justices arguing and trying to lay a predicate for?
jeffrey clark
So, think of it this way.
Think about state enforcement of Section 3 of the 14th Amendment, and then contrast it with federal enforcement of Section 3 of the 14th Amendment, okay?
So, all nine justices agreed that state enforcement of Section 3 of the 14th Amendment is essentially contrary to our federalist system.
The powers between the federal government and the state government were rebalanced in the 14th Amendment, and additional powers were given to the federal government to sort of make sure that the states couldn't run roughshod over constitutional rights.
Okay?
Everybody's down with that.
But then the issue is, what about federal enforcement of Section 3 of the 14th Amendment?
And the five-justice majority shuts that down and basically says, look, you have to have It would have to allow you to ascertain particular people who were disqualified from office.
And they say, you know, that's not been done.
Ergo, there can't be federal enforcement.
There would have to be a new targeted statute like that.
for proportionality and congruence.

And the three-justice liberal majority says that that was going too far.
They didn't need to say that.
They shouldn't have reached that question.
I think because they wanted to leave those questions open so there could be a rash of federal litigation trying to hamstring the second Trump administration if that occurs.

What do you mean bring criminal charges against the president and his staff?
How would that work?
jeffrey clark
So it would work much like in Griffith's case.
So that's why they were at great pains to To say it was unnecessary to affirm Salmon Chase's approach to the 14th Amendment.
What happened in that case was there was a Confederate, former Confederate judge.
He presides over a criminal trial and the criminal defendant says, well, you have to vacate my conviction because I was convicted by a Confederate and he was an insurrectionist and he can't hold federal office.
So ergo, my conviction is void.
So they want to see if that kind of litigation could take off.
In 2025 plus, if there's a new Trump administration and the five justice conservative majority to their credit, they just slammed the door on that, Steve.

Was the 14th Amendment, that was the reason, because it came after the Civil War.
That, quote-unquote, you're rebalancing.
Is that the reason, or one of the main reasons, they felt they couldn't bring to trial for treason, rebellion, or insurrection Jefferson Davis or the other high command of the Confederate government?
jeffrey clark
Well, I think there were some, you know, particular developments in connection with him and You know, there's a lot of history behind that.
But I think the way for the war on Posse to understand it is this.
The federal government is supreme, right?
That was the starting position in the Supremacy Clause.
But after the 14th Amendment, its powers over the states to prevent violations of equal protection and due process and several other things, especially along with the other Reconstruction Amendments, the 13th and the 15th, you know, gave more power to the federal government.
So to have Colorado Jeff, hang on one second.
you know, potentially create a patchwork of who can be on the federal presidential ballot.
The Supreme Court said, no, no, no, that's totally contrary to the 14th amendment. The 14th amendment is about federal power over state power. It's not about state power.

It's the law of the land.
We have to accept it.
Whether it produces results that are pro-democracy or that will ultimately be harmful to democracy is almost beside the point.
It is the law of the land, an open question, Jose, and I think one we'll be discussing in the weeks to come.
is what happens if Donald Trump is convicted of not insurrection because he's not charged with it but an insurrection-like charge that involved him trying to use force to overturn the results of a presidential election. Does that equal Congress acting because they passed the criminal laws that Donald Trump was then convicted under? I think the answer is likely to be no.
So that means we will have to await some new action, some new legislation by Congress to decide.
They just said it right there.
Buried lead.
It's one thing, folks, for us to win it.

I want to just make a programming note here, and I want to say this, and I know we come back on 5 to 7, but for our audience, if you want to bathe yourself in their fear, anxiety, angst, from 5 o'clock you got Nicole Wallace, Ari Melbourne at 6, Joanne Reed at 7, Chris Hayes at 8, Rachel Maddow does her Monday show at 9, you're going to see just unmitigated, complete total meltdown,
Throwing the toys out of the pram on MSNBC because already we can tell they're losing it because they understand they got a body blow today.

Yes, Steve, absolutely.
In that lineup of shows, you're going to need buckets and buckets, maybe even tubs and tubs full of tears from MSNBC and CNN.
Look, here's the last comment I'll make about this in terms of what the three liberal judges complained about.
You'll probably remember during the period when we're behind the veil of ignorance of what the Supreme Court was going to say in this case.
All we heard constantly was this refrain from Judge Ludig and Lawrence Tribe and others of the 14th Amendment is self-executing.
The 14th Amendment is self-executing.
Anyone and his brother can declare that President Trump is an insurrectionist.
Keep them off the ballot, keep others off the ballot, etc.
Well, the five-justice majority here rejected that theory soundly.
And they are saying that Section 5 of the 14th Amendment actually requires very specific action to enforce Section 3 of the 14th Amendment.
And it has to be true enforcement legislation that is proportional and congruent.
And that, you know, led the three justice liberal majority here to shed a lot of tears, Steve.
And so I think you're going to see that the Judge Ludix of the world, the tribes of the world, they're going to be on complaining about the fact that the Supreme Court has somehow made Section 3 of the 14th Amendment, you know, as not self-executing and therefore, you know, that it shouldn't have been made, you know, to require specific legislation.
It should have been just treated like the rest of the 14th Amendment.
That's what they're going to say.

Well, no, here's the argument, because they're not going to argue the law.
Now it's going to be the Supreme Court's illegitimate, because you have these Trump judges on it, justices on it.
It's gone full MAGA.
It's illegitimate.
They've got to take the House, one, to stop Trump from actually taking office.
They can't beat him at the polls, but they can stop him, as Rahim dug up the very lead, from actually taking the office, certifying the election.
Right.
And that's the way they're going to block him.
Also, they would then, you know, having the majority try to pass a bunch of stuff to thwart Trump.
This is their plan.
Their plan is now going to shift to the House.
They have no intention.
Oh, and also increase the court.
Remember, they want to take the court from nine to like 20 justices.
This fight's just on.
These people are never going to stop.
They are never going to stop.
They're going to figure out every different angle, kick up dust, and try to go.

And, you know, you're obviously far more adept at predicting what their themes are going to be, but we know they've teed up this whole idea of democracies on the ballot.
That's what we're going to hear from, you know, the Nicole Wallaces of the world and Ari Melber, etc., although he is a lawyer.
He's going to do some of the law.
But then their guests, their talking heads, the so-called journal lawfare people, trademarked, as I've started to call them, they're going to talk about this issue.
They're going to say the 14th Amendment should have been declared self-executing, and there's no need to reach that issue in this case.
And so the conservatives, they purport to be fans of judicial restraint, and there's a lot of crying.
Uh, in the separate opinion by the liberal justices about that, but they don't really believe in it.
In reality, they just want to, uh, want their side to win.
That's, we're also going to hear that from the lawyers they put on.

She wrote that the court has settled a politically charged issue and this is what it was all about in the first place.

He is leading in every major Super Tuesday poll and it's going to be a very exciting week and it's going to be very interesting to see what President Trump has to say going off of this tremendous victory against lawfare in this country.

And this makes a pretty straightforward case that it is white, and particularly white male Christians, rurally, not in urban areas or suburban, non-college educated, I might add, that are the greatest threat to American democracy.
And if you read this nonsense, the way they go through it, it's actually laughable, but it's taking over the mindset of the left, because they understand they're losing, so they're gonna start striking out at people.
The interesting thing about the book, it's actually a roadmap.
If you read it, I think, the right way.
And if you look at the data they give, the right way.
I believe they've given us a tremendous gift.
It's like the book by, I think it was Tom Franks, What's the Matter with Kansas, that talked about the cultural issues of why people in working class people voted on cultural issues with the Republicans at the time.
It kind of gave a roadmap about the economics.
It's one of the books that we use to work through the rise of the populist nationalist movement, the Trump movement, the MAGA movement in this country.
In this book right here, the irony is that they've actually given us a roadmap to consolidate power even more.
Remember, in Europe right now, and we're going to have more of this with Ben Harnwell, Later in the week as we get through our elections here, but in Europe, they're going after the farmers like nobody's business.
From Greece to Spain, to Denmark, to Holland, now to Britain, they're going after the farmers.
Germany, it's insane of how they're trying to shut down the farmers.
I had a moment to talk to people in Texas associated with the Agriculture Secretary, Sid Miller.
The same thing's happening in Texas.
They're coming after, the Biden regime is coming after, under the auspices of climate change, the cult of climate change, the pagan theology, medieval theology of Gaia, right, this pagan religion, the cult of climate change.
You know, the cult of climate change is about as wacky As in the French Revolution, towards the end of the Terror, I shouldn't say the end of the Terror, at the time they didn't know it was going to end, but during the Terror, as it was ramping up, Robespierre realized that the Revolution was so atheistic, and it had taken away religion from the people, and it made such an absurd case that he needed to come up with something as a sob to the people, so they came up with a cult of the Supreme Being.
And he actually, right there next to the river in Paris, they had this field, and on the field, I think they called it the Field of Mars, they had a celebration that he came up with, and they built a mountain, I don't know, it was a hundred feet high, and they had like a hundred Vestal Virgins.
It was called the Cult of the Supreme Being.
And that's when people that were on the Committee of Public Safety, which was where the terror was run from, they kind of looked at each other and said, this guy has lost his mind.
I mean, this guy is going to be quite dangerous.
And it wasn't too long, I think it was a week later, he was shot and then guillotined.
And so ended the terror.
I think Thermidor ended at that time because of how crazy he had gotten, how off track he had gotten.
That's what's happening to the cult of climate change.
It's all throughout this book too.
The cult of climate change.
These people that are, and they are our enemies, they've identified us as the enemy.
So therefore they must be enemies, right?
They are, they've left the rational world.

But they had a whole Republican establishment in the house and they had almost all the senators except for a small handful.
And most importantly, they had the foreigner, they had Murdoch, who sent an email out to his team, we're going to make Trump a non-person.
That was people on the right, center right and right.
The left was all in and none of them, none of them, none of them could ever imagine what's going to happen on Tuesday night.
It was inconceivable.
Not in like the Cartesian universe.
And it's happened for one simple reason.
Your spirit and your willpower, your spirit and your willpower gave President Trump, I think, the understanding that the people were with him.
He knew that he had won 2020 and he knew that it had been stolen.
Those are incontrovertible facts.
But it's one thing to know it and one thing to think through, what am I going to do about that?
And another to think, are people with me?
And this audience, and John Fredericks, and Real America's Voice, and those that stood up and stood in the breach then, and particularly when we went to CPAC about 60 days later, and saw that overwhelming crowd that supported CPAC in Orlando, understood that not only were we with him, but that we would go to the ends of the earth to make sure that he returned to the White House To set things right.
That's what this is about.
It's the greatest tragedy that's ever happened in this country.
And look what's happening in the four years of the elections have consequences.
Stolen elections have catastrophic consequences.
And you know who realizes this?
It's obviously this audience.
You've been there from the beginning.
You have been believers from the beginning.
You understand what empirical fact is.
What is most stunning about those Three polls when you look at the crosstabs is that a broad section of the American people who have not been with us before are now doing what we started the show with with President Lincoln.
The most important thing is to see it.
Right?
What's that great quote?

And President Lincoln knew that.

And they would have made him feel better.
The stories wouldn't have been so bad.
He'd been kind of called a statesman later, gotten a big book deal, all that.
He didn't go that route.
He did not go that route.
That was so important about this incredibly powerful speech in Richmond, my hometown, the other night at the 6 o'clock.
In particular, the last 15 minutes.
I think people have clipped it.
We're going to try to play it at the 6 o'clock show.
Maybe if not tonight, maybe the next couple of nights.
Because in that, where he gave that speech, It's not that far away.
It's not that far away from where General Washington, the great statue of General Washington, is there at the Capitol in Richmond.
Right there.
Magnificent statue of General Washington commemorating General Washington and his impact on the Commonwealth of Virginia.
And it's not too far where Lincoln Where Lincoln came and walked, Lincoln had to see it.
Lincoln had to see Richmond.
It was very dangerous, but he went down and saw Richmond after it had burned.
He needed to see it.
And it had the great, this was the great, he was surrounded by slaves who were coming up to him, Father Abraham.
Near that point, where both the statue and Lincoln walked, President Trump, in Richmond, gave that magnificent speech on Saturday.
And that is what President Trump, it's General Washington, President Lincoln, and President Trump.
The reason MSNBC is going to be tearing their hair out tonight, and gnashing their teeth, and the conch shells on the forehead, and the bleeding, and all that, and their hair on fire, is that they think they're better than Trump.
They think they're better than you.
They think you're just trash.
You're just white, rural rage.
You are a threat to American democracy.
It's not subtle anymore.
It's not so.
You read the book.
If you're a white Christian, particularly white Christian male, you are dangerous.
You should be locked up.
Forget being othered.
You're a danger.
You're a threat to American democracy.
And President Trump, what they hate the most is that this era is going to be known as the age of Trump.
