Twenty-five minutes into the hour, it might be time to put away the legalistic things, which is part of our job. | |
We've reported it out, and I explained what the cert is, and I read it, and we talked about the calendar. | ||
But we invited you on tonight as someone who knows the law but is not necessarily limited by some of the, shall we say, B.S. | ||
And so I was curious what you think the Supreme Court is actually doing. | ||
Not what it's saying it's doing, not what might feature elegant prose at the end of the day in the ruling, but what do you think it's actually doing? | ||
They're trying to make Trump win. | ||
The whole point of this ruling is for Trump to win. | ||
Ari, remember how, let's say, all of 2022, I came on your program and I screamed and I tore my hair out over how Merrick Garland was moving too slowly to hold Trump accountable before the next election? | ||
This is why, because you have to understand what the Supreme Court is really about. | ||
I know you like to give your viewers context, so have this on for some context about what the Supreme Court is really up to. | ||
Trump was kicked off of the Colorado ballot around December 20th last year. | ||
The Supreme Court spooled up that case and heard that hearing within 45 days on February 8th. | ||
Trump appealed his immunity, Judge Chutkan's immunity ruling, also in the middle of December. | ||
Andrew Weissman just pointed out, Jack Smith asked the Supreme Court to hear the case on December 14th. | ||
By the time we get to April 22nd, it will be 130 days! | ||
Since they were asked to hear the appeal. | ||
So it's 45 days when a ruling could hurt Trump, but 130 days when a ruling, when the delay can help Trump. | ||
That is the essence of this Supreme Court. | ||
And every single Democrat who is not on board for expanding the Supreme Court and reducing the power of these Republican theocrats in robes is in some way complicit in today's failure. | ||

I'm Chris Hayes. | ||
Today, the right-wing dominated Supreme Court gave Donald Trump a gift. | ||
The biggest possible gift anyone could give him. | ||
The biggest possible gift they have given him yet. | ||
Remember, Donald Trump, of course, participated in a violent coup to overthrow democracy. | ||
The first president to set himself squarely against a constitutional order in history. | ||
He rallied his supporters to storm the Capitol and steal an election he lost. | ||
And he was indicted by our Justice Department, representative of us, the people, on four federal felony counts by a grand jury for his role in that insurrection. | ||
Well today, in a single page order released at 5 o'clock, the court agreed to consider Trump's manifestly weak claim that he is immune from prosecution for the January 6th insurrection because he was acting in some senses in his official capacity as president. | ||
But the order itself is not the story here. | ||
It's the timing. | ||
It all comes back to the timing. | ||
Let's remember. | ||
The court case, the trial of Donald Trump over his effort to subvert the Constitutional Republic, was originally set to begin days from now in March. | ||
All that is on hold because the Supreme Court wants to hear oral arguments for Trump's immunity claims, ready for this? | ||
Seven weeks from now. | ||
April 22nd, 2024, making it a real possibility, a likelihood in fact, that Donald Trump will not face a trial for the crime of attempting to overthrow the American Republic, will not face a jury of his peers, until after the next election in which he is the likely Republican candidate. | ||
I want to be crystal clear here about the importance and significance of today's news, because I think a lot of the reporting has missed this. | ||
What happened today? | ||
This one-page order looks anodyne, right? | ||
It is an unmistakable sign from the MAGA majority of the Trump-created court that they are with him. | ||
That they are going to use their power to make sure he does not face trial in an election year for attempting to end American democracy. | ||
The court could have just affirmed the U.S. | ||
District Court's ruling that no, a president does not have absolute immunity. | ||
But that was not the decision tonight. | ||
And while hearing the case does not mean that ultimately they will rule in Trump's favor, the highest hoard in the land just gave Trump something that he has been aggressively fighting for. | ||
Time. | ||
The oral arguments in the case have been set for the week of April 22nd, nearly two months from now. | ||
Why so much time? | ||
And after that, even in a best case scenario, it will be a few weeks before a decision comes down. | ||
That is the best case, considering we know that there are at least some of the Supreme Court justices who don't agree with the earlier rulings. | ||
Otherwise, they would not be hearing the case. | ||
And if the court does decide to affirm the earlier ruling, as they should, and hand the case back to District Court Judge Tanya Chutkin, she would need a few months to get the case back on track and reach a trial. | ||
And that would take us through the summer and easily past July when the Republican National Convention is scheduled, when Donald Trump is expected to become the party's nominee. | ||
And at that point, what will the DOJ and Attorney General Merrick Garland decide to do? | ||
Will they move forward with the trial that would have to get underway during the heat of the general election? | ||
Or would they allow Trump to yet again evade accountability before the presidential election? | ||
And then on February 6th, they came out with a unanimous decision against Trump. | ||
He is citizen Trump. | ||
He is not above the law. | ||
The decision seemed carefully tailored to give the Supreme Court an easy choice to simply refuse to take up the case, to let the lower court ruling stand. | ||
But if the Supreme Court wanted to take up the case and wanted to do it in an expedited fashion, and let's be clear when I say the Supreme Court, the conservative majority of the court is what we're talking about here, they could have done it the day after they got the petition this month. | ||
That day. | ||
What did they do? | ||
No. | ||
They burned two and a half weeks for no reason. | ||
They weren't producing any paper. | ||
They weren't writing any dissents or arguments. | ||
It's one page. | ||
There it is. | ||
They sat around for two weeks, and then they issued this one-page order today saying they were going to take this up, they were going to schedule arguments for seven weeks from now. | ||
That is considerably longer than the expedited review of the 14th Amendment case against Trump in Colorado. | ||
The one where he's challenging his right to be on the ballot, right? | ||
Now in that case, where what loomed over everyone was Donald Trump not being on the ballot, the Supreme Court wanted to expedite quickly. | ||
Right? | ||
They wanted to get that one done. | ||
That ruling's going to come out before Colorado's primary next Tuesday. | ||
They move quickly there. | ||
But here, what the MAGA majority is telling us, with this audacious order today, is that the fix is in. | ||
In some ways, for what it represents about the court, I think it's a hundred times worse than Bush v. Gore. | ||
It doesn't matter really what they rule on the merits. | ||
They all know that. | ||
We all know that. | ||
Everyone knows the score here. | ||
No one should be under any illusions that any player in this drama is confused about what is happening and has happened. | ||
Delay is all that matters. | ||
The pacing is all that matters. | ||
No one needs to wonder anymore whether this right-wing court will audaciously, flagrantly, in front of the whole nation, use their power to run the clock out, so that Donald Trump faces no legal accountability, so that his guilt or innocence | ||
cannot be definitively proven to us, the voters, who I believe have a right to know whether the man is guilty or innocent, so that he can return to power without us having that knowledge and dismiss these cases from his position as, and I quote him here, I quote him here, dictator on day one. | ||
This is the primal scream of a dying regime. | ||

And first, let me just say, talking about the border, I mean, God bless President Trump, we're going down to the actual spot in the border where we need to address the actual concerns, whereas the president, current president, President Biden, is going down to the Rio Grande Valley to do a photo op because he knows the numbers aren't going to be bad there and he can hide behind Uh, whatever they're going to do to put gloss and spin over it. | ||
President Trump's been on this from the beginning. | ||
His great team when he was there, whether it was Mark Morgan or Tom Homan or Chad Boyle or Steve Miller, everybody, they were all going to do the job that we need to do to secure the border, which brings me to the funding problem. | ||
Where we've got right now, Republicans hold in their hand what we have fought last year for, even though they weren't as good as they should have been, even though we tore it apart, we have caps in place. | ||
We could actually limit the bureaucracy that that war will give you. | ||
We could cut $70 billion out of it. | ||
We could go after the IRS. | ||
We could go after the DOJ. | ||
We could target the Department of Homeland Security for what they're doing to the American people. | ||
We could go after that bureaucracy and the EPA, but we're not going to do it. | ||
Instead of cutting $70 billion by literally just passing Nancy Pelosi's spending levels from a year ago, we would trigger the cash. | ||

Instead, they're working on, we're going to do a CR today for a couple of weeks, To buy time to next week advance one of too many bus bills that will be the negotiated levels between Mike Johnson and Chuck Schumer, which will end up being effectively a $30 billion increase over Nancy Pelosi's spending levels, and they will maintain the federal bureaucracy at their current levels. | ||
We will keep funding all of these agencies that are at war with the American people. | ||
We've not seen the policy riders yet. | ||
We've not seen the wins. | ||
And by the way, the reason we're doing that Is because the Republican leadership today and the rank-and-file, at least certain blocks of them, they want to fund Ukraine. | ||
They want to increase defense spending. | ||
They are not as concerned about cutting non-defense discretionary spending while they run around talking about what we need to do for Ukraine rather than focusing on our border. | ||
So meanwhile, a 22-year-old nurse gets killed in Athens. | ||
A two-year-old boy or a little kid gets killed here in DC area. | ||
A teenager gets raped in Louisiana all by people released by the Biden administration against the law, and we're going to keep funding that, and we're not going to pressure material change. | ||

Some of my Republican colleagues are mad at me because I'm calling it out, and they say, Chip, you know, quit calling. | ||

It took three years for us to get to impeaching Mayorkas. | ||
I put out a request in July of 21 to impeach him and it took us three years to get there. | ||
I made the case, made the case for the Texas border plan, which was the foundation for H.R. | ||
2, which, by the way, was coordinated with a lot of those great Trump assets like Stephen Miller and others. | ||
And we got good legislation. | ||
Now they're all talking about it. | ||

Now, they don't want to use the leverage of a potential shutdown because they're afraid of it. | ||
They're listening to pollsters saying they'll lose if we, you know, run the risk of a shutdown. | ||
And they are too committed to wanting to fund Ukraine and they're too committed to the defense industrial complex to risk it in order to secure the border. | ||
Literally one guy went to the mic today, this morning, at our Republican conference meeting, one of our colleagues, and said, anybody who thinks that we, just because Biden is abusing the border, That we should therefore not give money to Ukraine is insane. | ||
That was a word-for-word quote by one of my colleagues this morning. | ||
That's what we're dealing with. | ||
Congressman, what is the call to action for this audience? | ||
They're up on the trigger. | ||
What is your recommendation? | ||
They're looking to you for leadership. | ||
So what should we do? | ||

Well, I mean, right now, this week, we're going to oppose the CR. | |
We want to drive the number of votes against that up. | ||
We want to drive the number of votes by Republicans against this ridiculous spending package up. | ||
I don't know if we can kill it, but I'd like it to be not a majority of Republicans that support this so that we can actually campaign this fall on doing the right thing, notwithstanding the bad decisions the leadership's making on it. | ||
And importantly, let's make sure that we demand that notwithstanding all of this, that it is an absolute kill shot if they are not going to secure the border of the United States before they're giving more money to Ukraine. And that we still have not gotten to, so we've made to make sure clear number one, hold the line on spending. | ||
Right now, I'm going to demand that we stand up for a CR that will trigger the caps, go into a shutdown if you need to, and enforce border I'd give up on some of the spending if we got, you know, H.R. | ||
2 or got, you know, key provisions to force Biden to stop letting people into our country. | ||
But we've got to stand up on those two fronts. | ||
So call your folks, let them know, don't do what we're doing right now. | ||
