They did.
It did not go well at all for the challengers to Donald Trump, and that's to put it mildly.
I've seen hundreds of oral arguments at the Supreme Court.
You often can't tell where the justices are leaning.
This one you could, and for good reason.
I mean, when you're doing a Supreme Court argument, Your job's not only to answer the justices' questions, but to state the affirmative case for why you should win.
These lawyers never did that.
They made this case on technical and like a gotcha in the Constitution instead of, you know, making the basic point.
But this is a centerpiece of our Constitution, forged after the Civil War, after all that bloodshed, for a simple reason.
Our founders coming together and saying, No more insurrectionists.
It's too dangerous to have people who give aid and comfort to the enemy.
And there was just such little discussion of that.
And instead, it was all on the other side, like the interchanges, Alicia, you were showing about 50 states and, you know, we should only let one state shouldn't be able to decide the whole.
There were five great answers to that.
They're all in the front of the court briefs, but we heard none of it.
And so It was a really dismal showing, unfortunately, for the challengers to Donald Trump.
Yeah, Katie, for those who remember what happened in 2016 involving former Secretary of State Hillary Clinton, the Democratic nominee at the time for president, of course we remember there were no charges, but a pretty damning report from the Attorney General at the time, James Comey,
The initial top lines we're reading of this report find a similar situation, that there are no charges recommended here against the president, but some damning details, including the statement that he willfully retained documents after leaving office.
I think the point that you highlighted about how the special counsel and his team found their interviews with the president, in which he, as it was put, his memory was significantly limited, are certainly going to be weaponized by the president's opponents.
We also see an interesting moment as part of the investigation in which the president's ghostwriter, this is of course the former president, former vice president at the time, as he was working on his book after leaving office, had recordings of President Biden, the former vice president at the time, talking about having obtained, having uncovered classified documents in his possession at the time.
So that is a significant moment that comes back from 2017, according to the special counsel report here.
So let's just step back and underscore the most important fact, which is we're just reading this report as it's being made public at this moment.
There's going to be a lot of details.
We understand it's a 400 page document.
And so these are just literally the top lines that we're reading at this moment.
The House Judiciary Committee Republicans are already out accusing a double standard of the Justice Department here for not bringing charges against the President, as we also, of course, see President Biden's likely opponent in the general election, former President Trump, with a different investigation here into his handling of classified documents. One thing that we also understand to be true from this report is that there is a very clear distinction being made between the ways in which
former Vice President Biden handled classified documents and how President Biden worked with the Justice Department during that investigation, very cooperatively.
Retention of documents.
It's crucial because I think it's getting a little bit lost here.
This report clearly says, and this was surprising to me, I did not expect to see this, that President Biden willfully retained and disclosed classified information.
That is a felony.
But then the report goes on to say, but we don't think we could win a prosecution in this case for various reasons, including Mr. Biden's memory lapses and the fact that he's an elderly, well-intentioned man.
That is a deeply significant finding, and it's in two respects.
One, They found that Mr. Biden was on tape speaking to his ghostwriter back in 2017 saying the words, I found all the classified stuff downstairs.
This was when he was living in a home in Virginia after he had left the vice presidency working on a memoir.
And they also found that he disclosed classified information to the ghostwriter throughout that process.
Now they're not, it's not clear whether he remembered that.
And that was crucial in terms of their findings about whether that could be prosecutable.
Because those, by the way, were the same documents, they believe, that were found by the FBI in Mr. Biden's home in Delaware, in the garage.
And they were highly classified.
There was information about the Afghanistan war, but willfully retained.
And then secondly, the report says that Mr. Biden had notebooks that were sort of a combination of personal diaries and observations, but that included highly classified information.
That he knew it was classified, that he took them home anyway.
This is very similar to what happened with former CIA Director David Petraeus, remember, who was prosecuted because he had notebooks and diaries that included classified information that he turned over to a woman that was working on a book about him.
Now, again, the Her report also puts a lot of this into context and says, first of all, very different from the Trump situation, as you've already covered.
But also, there is a history of presidents taking home classified information.
And it talks about Ronald Reagan having notebooks that may have had classified material in them.
So that, I would say, is a mitigating factor for Mr. Biden.
But nonetheless, here's a man who had been dealing with classified information for decades, his entire career as a public servant on the Foreign Relations Committee, and likewise, and treated it in what appears to be a cavalier manner.
And not by accident, not by carelessness, but according to this report, willfully, Katie.
Those racist.

I mean, they're saying you could have 8-1, 9-0, and Justice Brown was asking his tough questions, agreeing with Kavanaugh, and Kagan was probably the one that was going after the guy the most of not getting to the arguments.

The liberal justices were all over this, were they not?

The other attorney, Mr. Murray, he completely fell apart.
He had no answers to any of the justices.
And why?
Because their argument, the Cruz argument, is corrupt, it is empty, and it is un-American.

A bombshell drop from Merrick Garland's DOJ today, and I can't even begin to describe what is in print here.

Boris, this is a scandal because clearly they say this guy broke the law, number of felonies.
This is Biden.
They would prosecute except for the fact That he's like an elderly old man with the beginning stages of dementia.
That's the reason they're not prosecuting him for felonies and doing criminal referrals.
That his mind is too far gone, sir.

Well, Steve, it seems not just like beginning stages of dementia.
It seems like they were saying that there was a significant memory loss.
And if Biden is not well enough to answer questions from his own DOJ, how is he well enough to deal with China and Russia and Iran and the wars that he's caused all over the country?
That's the key question that we have to be asking ourselves.
And then as to the underlying issue, it's clear that, as President Trump has stated strongly, that we don't have a true system of justice in this country, a two-tier system of justice, and that there's a selective prosecution.
President Trump did everything right.
He did everything by the book under the Presidential Records Act, while Joe Biden has violated law after law after law, and yet he's not charged.
Even David Petraeus, the CIA director, was charged with giving classified information to his ghostwriter.
I do the same thing.
I'm a selective prosecution.

Hopefully that decision will echo 9-0, as you talked about.
But there was never a basis for Colorado or any other state to disqualify President Trump because he never committed insurrection, was never charged with insurrection, was never convicted of insurrection, even by Merrick Garland's rigged DOJ.
And that was a point the court noted out repeatedly.
And the states have no authority under the 14th Amendment to bind a federal mandate It was pretty brutal.

But let me tell you, there is a massively explosive document that's just been released by DOJ.
Their formal report is not declassified materials.
It's not retaining one person for the felonies.
It's something far deeper.
You have an individual that is not capable of being the Commander-in-Chief of the United States, and this must be dealt with immediately.
This must be dealt with immediately.
The House should be convening a panel and committee tomorrow.

It's saying he didn't remember when he was vice president, didn't remember when his son died, he didn't remember anything.
He says we're not going to prosecute because no jury would find a guy guilty who had this bad a memory.

Joe Biden is getting the Hillary Clinton treatment.
The Department of Justice yet again created a new legal standard to exonerate a political proponent of their liking and to make sure and go out of their way that they continue the illegal prosecution of Donald Trump.
Let's just hit the high marks on this 100 or 350 page report.
40 years of illegally possessing classified documents in over three separate locations Which included a hundred plus classified documents.
That's the case.
And then the Department of Justice told us he intentionally took every one of these documents and recordings.
That's the standard under the law that they used to charge President Trump.
Intentionally took these documents.
And Joe Biden repeatedly goes in there and says, I did this before I was president, but all these other presidents did it.
He doesn't have presidential privilege like Donald Trump has.
And that's the case.
And they came in there and bent over backwards.
Steve, I want to focus on the appendix.
Go to the appendix where they outline 150 documents that were classified.
I just want to read you one.
The heading, the classification heading of one.
Top secret with no foreign code word attachments.
What does that mean in layman's terms?
That is the highest classification the United States possesses.
Code word documents and attachments.
This guy was running around in his Corvette or his beach house or wherever he was in the UPenn offices with top secret SCI code word human intelligence source documents.
The special counsel went out of his way to say that the intelligence discussed human source reporting.
And remember how they were quick to tell us that President Trump jeopardized human sources and human reporting downgrades.
And at the end of it all, They come up with a new standard like Comey did for Clinton.
He's too old.
And so, we wouldn't win at jury trial.
As a former National Security Prosecutor, that's not how you man up at the Department of Justice.

Comes across as a general old man with no memory.
He has dementia.
This report essentially says he has dementia.
He could not remember when he was Vice President of the United States.
He could remember within years of when his son died.

And this is not just him shuffling it off, trying to get away in a deposition.
He has dementia and this report says that.

Remember, this incident, his interview with the special counsel happened on October 8th and 9th.
What happened, Steve, on October 7th?
Israel was attacked.
A war was launched by Iranian mercenaries into our ally and friends in Israel.
And Joe Biden put out a statement saying there was no important mission to him at that time than protecting Israel and preventing war.
What was he doing in reality?
He sat for a two-day deposition with the special counsel talking about his cognitive decline.
He lied as the commander-in-chief during wartime to the American people, and today he puts out a statement, today, that says he was so cooperative with the DOJ, which is what special counsel Herr went out of his way to talk about, as if that somehow exonerates you from criminal liability.
When I was a federal public defender, that was never a legal excuse to get out of criminal culpability.
So, which is it?
You're Commander-in-Chief and you're starting new wars and that's your priority?
Or you're taking time as Commander-in-Chief to spend 48 hours doing depositions in a special council hearing talking about how you can't remember the name of your own kid and when he died?
This is the type of leadership that's in the White House.

So we were out there today in front of the Supreme Court, and the Democrats were very well organized.
I was really shocked to see that there weren't a lot of Republican lawmakers there organizing in support of President Trump, but you know who was there was Rose City Antifa, and they all happened to have very large banners that said, Remove Trump.
They also had a matching sign, so clearly somebody's funding them, somebody's paying for them.
And there's a video right after news broke that, you know, the Supreme Court really was scrutinizing the arguments made by Crewe and the Colorado Supreme Court much in favor of President Trump.
Zachary Antifa started to become more aggressive and violent outside of the Supreme Court.
And I posted the video.
You have it there and you can play it for your viewers.
You can actually see these people blocking traffic with their banner, Capitol Police standing right next to them on their bikes, not doing anything to shut them down.
And in a previous video I posted from this morning, there were a couple Trump supporters who were being harassed and shoved by these Antifa protesters who were carrying... Laura, do we still have you?

You also had other of your investigators or your reporters there, they confronted the Secretary of State of Colorado, who was quite arrogant in her interviews afterwards.
Your people asked her pretty straightforward questions about the funding of Soros, paying for her trips, all that.
What was that about, and what were her answers?

Yeah, so Secretary of State Jenna Griswold from Colorado was there and you can check the FEC reports.
It's well known that she took money from Soros and several of his children as well.
And so we just asked her point blank, did Soros pay for your trip and how much money did Soros pay you to remove Trump from the ballot?
As I exclusively reported and was interviewed on your show in October and November of last year, Steve, the group that pushed this lawsuit forward is a group called CREW.
They were there today.
They're the group that initially funded this lawsuit.
The executive director and one of the co-founders, Melanie Sloan, is literally on video saying that their largest donor is Soros.
I just broke this story today.
It's very disturbing.
Moments ago, before coming on your show, Steve, Uh, this guy, Noah Bookbinder, who is the president of Crew, who was there at the Supreme Court today representing Crew, we actually confronted him on video.
I'll be posting that in the next hour or so.
Did you know that he is actually working with DHS and Alejandro Mayorkas?
In 2022, Alejandro Mayorkas appointed Noah Bookbinder to serve on the DHS advisory committee.
So this guy who is literally working and orchestrating the lawsuits to get President Trump removed is an appointee by Alejandro Mayorkas at the Homeland Security Advisory Council.
So in other words, Joe Biden's administration under the DHS and under Mayorkas' watch is directing the assault on our elections to remove President Trump, which means, you know, these House Republicans who failed to impeach Mayorkas this week, it just got even worse for them because not only are they not stopping the invasion of our country, but they're stopping Mayorkas from using his political operatives and appointees within DHS to interfere in our elections.

And he said he spent the weekend with his national security team.
I pulled the dates on the calendar.
On October 8th and 9th, he spent 48 hours with special counsel Herr, buried in a room, not being able to remember when he was vice president, one day after the conflict started.
This man cannot be responsible for the nuclear codes.
It's not a political question.
It's a legal question.
The chain of command has been broken.
He has committed a crime and Maybe even worse off than that, he has jeopardized American national security and allowed wars to continue on his watch and five dead American soldiers now to boot.

They're doing everything they can to stop Trump, and it's backfiring.

Yeah, so Robert Herr's report shows that there is clear evidence that Biden violated the Espionage Act by retaining these classified records that he was not allowed to retain.
He shared these classified records with his ghostwriter, probably others, but this Robert Herr says that he's not competent to stand trial.
He's not mentally competent.
To stand trial.
Well, how the hell can you serve as the president of the United States, the commander in chief, the most powerful person on the planet, if you're not competent to stand trial?
This is a constitutional crisis.
You know, Biden's cabinet, they should convene under the 25th amendments and make sure that he's competent.
He's clearly not competent.
The problem, what's so terrifying is that the alternative might be worse with Vice President Kamala Harris.

I have been through the hundreds of pages this afternoon that has come out from the special counsel, and I've got to tell you, this is about as bad, I think, for Joe Biden as they were trailing in advance, right?
They trailed, they put out some lines, they put out some statements of what they were expecting.
And I think this is on the particularly the worst end of the spectrum as far as they were concerned.
You've got to get into the detail on this, I'm speaking directly to the audience here, to recognize just how deep the rot is now set and recognize just how badly the country is being run and being let down by this.
You know, we said the day of in 2020, when we knew the cheat was in the regime, right, from day one, we refused to call it an administration, and rightly so.
So let's look at the detail on this.

We've gone through line by line what exactly we're seeing here.
The predominant thing here that the American public will see is that there is a circumstance where the special counselor said that this man, Joe Biden, willfully, willfully continued to take documents from when he was a vice president.
He had documents from when he was a senator, and kept them amongst, quote, household detritus.

It took his ghostwriter of his book to find these packages and say, hey, I think you might have some national security documents down here.
At that point in time, remember, there still was no owning up.
There was still no resubmission of these documents.
There wasn't a position where Joe Biden said, oh, my goodness, how could this have happened?

That did not happen.
And that is a critical part of this.

Yeah, look, I really think that people have to go and see some of these critical details for themselves.
But I'll give you two things that really, truly stood out here amongst all of this.
So we know that the special counsel said that he willfully kept these documents.
We know where they were found.
We know how they were stored, unsecured, not under the protection of Secret Service like you had at Mar-a-Lago.
And the two things that really jump out at me here is, number one, in the report they say he actually may have leaned on some of these documents for one of his books that got released, I think it was 2017, which means that he's not just kept these documents, he's profited off these documents.
That is a critical part of this.
And secondarily to this is that evidence was deleted after the special counsel was instructed to go through this.
Specifically, Joe Biden's ghostwriter deleted audio recordings of Joe Biden, which had, quote, significant evidentiary value.
Now, the special counsel has said, and this is the takeaway line, the special counsel has said that they will not pursue a prosecution of Joe Biden in this circumstance because, number one, he is too doddery, too old, his memory is shot, he'd be too sympathetic for a jury, and number two, the underlying, the undertone of all of that is that a jury wouldn't try and convict somebody like that anyway.
Well, I think that tells you everything you need to know.
Everything we've heard over the last several years of nobody being above the law.
How many times have you heard that?
No one's above the law.
No one's above the law.
In this circumstance, today, in America, the special counsel decided that Joe Biden is, in fact, above the law.
It is an absolute disgrace.
It is a travesty.
And this is something that should not be heard the end of for as long as I live, quite frankly.
And people need to put their shoulder to the wheel in making sure that this does not go away between now and November.
