Quite a few Republican members that are very concerned that the opportunity to pass what many would consider to be the most conservative border package in a generation, if they just allow that to go by the wayside because of presidential politics, would be a massive mistake.
And it's not just that group of Republicans who aren't necessarily fans of Donald Trump who voted to impeach him.
Even some of his closest supporters and allies have said that this is an opportunity that needs to be seized.
Among them, Lindsey Graham, who I spoke to yesterday on this topic, and has said that he's talked to Donald Trump about why this package is necessary.
And it would be good for him even if he were to win the presidential election, because it would give him a set of tools that the executive branch currently doesn't have.
So there is no doubt an existential crisis happening within the Republican Party.
It's certainly happening on the Senate side.
It's happening even more on the House side, where there are Republican members who would be inclined under any new.
normal political environment to support a package like this, not just because of the border components, Katie, but also because of the foreign aid to Israel and Ukraine, but just are afraid to do so because of the political backlash that Donald Trump brings and the fact that he is on the record now and very vocal about the idea that unless they get everything, they should just walk away and take nothing.

So, Charlie, um... The case may be aware of the fact that she got five million, so it's the punitive damages number is the one that is one that I'm really interested in hearing.

Did Ms.
Carroll prove by preponderance of the evidence that Eugene Carroll suffered more than nominal damages as a result of Trump's publication of the misstatements or the defamation on June 21st and June 22nd, 2019?
The foreperson is a woman.
I should note there are only two women on this jury.
And we still don't have an answer.
I'm waiting to hear what's going on in the courtroom.
But Katie, I'm sorry, Alicia and Katie, I want to note for you guys as we're waiting.
Remember, this jury is anonymous and Kaplan has urged them to be anonymous not only with us, as he has implemented procedures to ensure their anonymity, but also with each other to not even use their real names.
So when the foreperson signs this verdict, She will not do that.
I'm sorry, we do have a verdict.
EJ Carroll did suffer more than nominal damages as a result of Mr. Trump's publication of these two June 2019 statements.
The first amount for compensatory damages for her emotional pain and anguish is $7.3 million.
The amount for the compensatory damages for the reputation repair program is $11 million.
We're now moving on to the questions about whether Trump acted with malice.
Remember, the questions have to be answered in the affirmative to get to a question of punitive damages.
We are still waiting for that answer.
As you wait for those answers.
Mr. Trump acted with malice.
I'm sorry, Mr. Trump acted with malice in making the first of those statements.
That's the June 21st, 2019 statement at 5.17 p.m.
in which he denied it for the first time.
And similarly, we are waiting to hear whether and making that yes.
And June 22nd, 2019, he did also act maliciously or out of hatred or ill will in defaming her on that day.
And here comes the punitive damages award of $65 million, Alicia.
So $65 million in punitives, $11 million in the reputation repair program.
And $7.3 million in reputation, I'm sorry, in the emotional harm for a total of $83.3 million.
That's a high eight-figure award.
I had predicted we'd be high eight figures or early $100 million.
Certainly less money, I think, that E.G.
Carroll's lawyers had hoped.
But $83.3 million is nothing to...
So Republicans, if they don't do this, the border is still a crisis.
The president goes, the former president goes out and says, look at the border.
It's so terrible.
President Biden's doing nothing.
Is that argument then undercut?
Absolutely, it's undercut.
And by the way, Senators Ronny Tillis and Graham are absolutely right.
Republicans need to act on this.
By failing to act on it for these naked, cynical, political reasons, they've just handed Democrats the issue.
Right now, Joe Biden is being blamed for the border mayhem.
Now Republicans are going to walk away from the deal that gets significant immigration and asylum reform.
Well, they will now own this border chaos.
So I think it's terrible.
And further, This is also going to impact the ability to fund Iran, Ukraine, and Israel.
If that does not happen, Republicans could own the failure of Ukraine in its war against Russia.
Just as Joe Biden was justifiably blamed for the Afghanistan fiasco, Republicans will be blamed for what happens in Ukraine that empowers Vladimir Putin.
So the politics of this are not good for the GOP.
It's all being driven by a rumpling of the GOP, particularly in the House, that will not vote for any compromise deal.
They don't want to support Ukraine.
And frankly, what's happened is that that group has been given voice.
They are allowed to prevail, even though their opinion is a minority of the whole Congress.
Can you explain, leave the politics aside, can you explain why this deal is so significant?
What this deal would do?
And why this is the opportunity to pass it?
Well, we haven't seen text yet, Katie, but it appears they're going to make some significant changes to the asylum process, which is being abused.
Most of these people who are showing up at the border are economic migrants.
They're desperately poor.
They need a better living condition, but they're not legitimate asylum cases.
And I think that asylum reform is something that the GOP has been clamoring for.
So they need to take this opportunity to get it done.
It's not like as if Donald Trump, if he becomes president next year, that he'll be able to get a better deal.
So the issue really becomes for Republicans, why wouldn't you take a significant win?
Even if it's not everything you want, why not take it and celebrate that?
They can still go criticize Joe Biden if they like, but he hasn't done enough.
But right now they're putting themselves in such a horrible position because the substance of what's being advanced Really is what the GOP has been asking.
It's also what the American public has been asking for.
Reform at the border.
Because what's currently happening is not tenable.
I also want to point out to our viewers that the New York Attorney General in the civil fraud case across the street is asking for disgorgement of $370 million.
They award him, I'm sorry, if they award the Attorney General $370 million over there, and he also has to pay $83.3 million to Eugene Carroll, that will wipe out the $400 million in cash that Trump has proclaimed he has, and many people doubt he has that much liquidity.
What Trump is really dreading is a judgment in this case And the AG's case that would wipe out his cash, that would force him to liquidate assets to be able to pay both of those judgments.
That would really put the lie to his proclamations of endless wealth, Alicia.
That total, let's talk about it, Katie, $83.3 million.
What does that sum say to you?
It's the punitive damages that speaks the most.
So we know that Ms.
Carroll's expert, Professor Humphreys, who not only testified in E. Jean Carroll's first trial, but also testified in the Rudy Giuliani defamation trial that was brought by Ruby Freeman and Shea Moss.
This expert testified that in order to repair and to basically compensate E. Jean Carroll, the amount would go anywhere from $7.3 to $12 million.
That's why we heard Robbie Kaplan get up in closing hours.

Somebody must be coordinating this because we now know that the White House counsel met with the boyfriend of Fawnee down there in Georgia.
The White House Counsel's Office seems to be a part of much of this.

You know, it's interesting the decision that came out of the Supreme Court.
They talked about the fact that Biden could take down concertina wire, razor wire.
Texas will put it back up.
I think there'll be other legal challenges, but I'm proud of the fact that this state and 25 other governors are standing and declaring and protecting our state sovereignty.
Texas and those 13 original colonies would have never signed the treaty that formed the first Constitution of the United States if they didn't think that their right to protect themselves and defend their own people was protected.
So what Joe Biden is doing is threatening our state's sovereignty, and if he does federalize the Texas National Guard, That'll be unprecedented.
That is actually activating a federal guard and telling them to stand down and not protect the United States.
I don't think we've ever had soldiers activated and told that they were being activated so that they would not protect and defend the United States of America.
So we're in unprecedented times and I'm incredibly proud of the men and women that are here on this border today making sure that they're trying to slow down this invasion.
