Lawmakers have tried, repeatedly, and failed, repeatedly, to clinch any kind of wide-ranging agreement on what has become the most intractable issue in U.S.
politics.
In the last 20 years alone, major efforts have reached the precipice of passage.
In 2005, in 2013, in 2018, each time they went up in flames, victim to hard right fury over provisions Democrats viewed as essential in any deal.
And that's what makes this moment, and the current negotiations underway between a bipartisan group of senators, so incredibly unique.
Do you feel like where Democrats are on the policy, the willingness to make deals on specific issues has shifted dramatically over the course of the last several months because of the issues at the border you're talking about?
Yeah, I think it has shifted dramatically and it should have shifted dramatically because of what's happened at the border.
That's Democratic Senator Michael Bennett, a player, a key player in past talks, acknowledging just how far Democrats have moved on the policy.
They have dropped key priorities like a pathway to citizenship or protections for undocumented immigrants brought to the U.S.
as children.
It's the same question I posed to Democratic Senator Chris Coons.
Yes, I think there's a willingness to reconsider the initial screening standard for asylum, for example, because so many people are now using the asylum process, who ultimately, years later, after a court review, will be deemed ineligible for asylum.
That's one of the biggest changes in recent years.

In Washington, of course, the big question is whether the Republicans are going to stab.
You keep stabbing Ukraine in the back, stabbing Israel in the back, and calling for open borders until Donald Trump is the president of the United States.
The lead editorial in the Wall Street Journal talks about a GOP border reckoning where it says, Says giving up on the border a security bill would be a self-inflicted GOP wound.
President Biden would claim with cause that Republicans want border chaos as an election issue rather than solving the problem.
The House funded negotiations before Christmas on the theory that Ukraine could hang on until February without a fresh weapons infusion.
Now another month has passed.
The U.S.
is careening into a moment of growing dangers around the world.
Both a tighter border and a vote for a stable Europe are in American interest.
Better to act now than fail and live with the consequences.
You know, they're just saying outright what a lot of Republicans were saying on the Hill yesterday, which is This is reckless.
You've got Donald Trump saying, let fentanyl flood across the border and kill Americans over the next year.
Let illegal immigrants keep flooding over the border.

There's nothing about that that we know of in this package.
They will never get this again.
And yet they are about to snatch defeat out of the jaws of victory in a way that is just deeply unserious and deeply disturbing and bad for the country.
As long as Donald Trump is the cult leader of the Republican Party, this is where we're going to be.

Between them, they have 250 years of federal law enforcement expertise.

And they sent a letter to Mike Johnson and Chuck Schumer and to the Homeland Intelligence Committees in both chambers saying, We don't want to lie to you.

Yeah, listen, there's a constitutional crisis on the horizon.
This is not a normal federal legal dispute.
This is, as Governor Abbott said in his statement, this is now a constitutional issue over the right of a state to defend itself when its federal government ceased to defend the state.
And that is the argument they're going to make.
When the injunction went before the Supreme Court, it was a legal issue involving a law, involving a temporary injunction.
Greg Abbott and Ken Paxton, who was on my show last night, they tend to elevate this now to the constitutional argument that the Supreme Court cannot allow Texas to be unable to defend itself in this invasion.
And this letter that comes from the FBI, former experts, it's going to become evidence number one in the case.
It wasn't coordinated with them.
It happened completely separate of the legal dispute.
But it provides the exact argument that Texas needs to go to Supreme Court and say we can't protect ourselves.
The FBI's best experts say this is an invasion.
The federal government sits there with a blank stare on its face every day and lets five, ten, twelve thousand people a day invade our country.
You have to let us invoke the constitutional clauses that allow us to defend our border.
And I believe that that's where this is headed.
This will be one of the most important Supreme Court cases, not only in our lifetime, probably in the history of the United States.

This is in that league because Texas is tired.

So China has to be privy and sanction this.

So, yeah, this is going to be not only one of the most important Supreme Court decisions in our lifetime, I think it's going to be in the history of the country.
Back about a decade ago, remember, Arizona v.
U.S., the Supreme Court sided with the Obama administration saying states can't try to enforce federal law.
That was a legal issue, and a lot of people felt that was a bad ruling.
But this is not going to be on can we enforce a federal law.
This is we are invoking the clause in the Constitution that allows a state to defend itself in the absence of federal assistance.
And that's going to take it to really one of the most historic arguments we've seen before our court in any generation of Americans.

Six, eight months ago, I broke the story of the NARA letter, the National Archives letter, in which we saw the White House directed NARA to sick the FBI on Donald Trump over the classified documents.
They told them to send the documents over, which would trigger a criminal preliminary inquiry, which eventually led to the raid and the indictment.
Now we know from the billing records of Fannie Willis's special prosecutor, potentially her officer, Paramore, that they had two meetings at the White House, one in Washington, one in Georgia.
We put an open records request in demanding all contacts that reference the White House as part of the Trump Fulton County DA investigation.
They did not respond in the statutory time frame.
We filed a complaint with the Attorney General of Georgia and we will be suing in the next few days.
to compel the release of those documents.

Yesterday in a court hearing, there is two communications that Fannie Willis is now acknowledging came to her office from the White House.
So we know there's direct correspondence from the White House.
Now what we want, not only are those two letters, but all the emails saying, why are we meeting with the White House?
