What does it look like today now with just hours to go before that deadline?

Well, Will, you're right. The numbers are rising, and they are going to get higher.
But right now, you wouldn't know it from where I'm standing.
I'm here outside Sacred Heart Church in downtown El Paso, where usually we've seen hundreds of migrants camping out.
In fact, there were more here yesterday when I was speaking to you.
But you can see now a lot of this sidewalk has been cleared.
We understand that overnight...
Immigration authorities came through here and moved a lot of these migrants out.
They had made sure that they were processed at facilities.
A lot of them had come through and hadn't been processed or accounted for.
But what happens after that is they start releasing them.
So some of those migrants may be coming back here today.
That was something that happened yesterday.
A lot of the shelters were cleared out and then said the very same people were coming back to them after they'd been processed.
But it's part of a strategy here to try to clear more space, get more people through the system before that expected surge.
10.59 here tonight, Title 42 will lift, meaning that anyone who crosses the border can claim asylum.
Still, the rules are higher.
They've raised the bar. If they pass through a country on their way here where they could have claimed asylum, like Mexico, and they didn't, they'd be deemed ineligible.
They will be rapidly expedited for removal and deportation, but the processing will take longer, and that's what has Border Patrol I talked to the Border Patrol Chief Raul Ortiz yesterday who said if the numbers get to 13 or 14,000, they're worried they won't have the detention space and the capacity to move migrants around to try to ease up that tension.
In fact, we reported yesterday about a Border Patrol plan to start releasing migrants if they get pushed too far over capacity.
They're already over capacity now.
We'll start releasing migrants without court dates and without alternatives to detention, which is a way of tracking migrants as they move around this country.
On the other hand, they're also doing some measures to try to stop the numbers from getting too high.
They've sent troops down to the border.
They're actually putting families now on a detention program, a geo-locating program that would Tell them where the head of the household is as they move around the country, putting families who cross on a curfew.
That's something we haven't heard of before.
I mentioned the troops they've moved out of the border.
They're also trying to expand an app so that people can apply legally for appointments to come here and build processing centers in other countries so that people can apply where they live rather than making that dangerous journey to the border.
All part of a comprehensive strategy to try to make it easier to apply for legal pathways where these migrants are from and keeping them from ending up here on the streets of El Paso and other border towns.

We wanted to start in New Hampshire and go through this historic event last night.
But there is work in front of us today.
And quite frankly, this was the issue on which Donald Trump rose to the presidency in 2015 and 16.
I have Attorney General Ken Paxton on.
Attorney General Paxton, we could have played so much more violence and things are happening on the southern border.
And right there, NBC News is telling you with all the lies and the spin that this illegitimate regime in Washington is just processing these people through, barely processing them, and just send them into the heart of the country, not just throughout the great state of Texas, but in the heart of America.
Can you give us an update, sir?

Yeah, I mean, it's pretty obvious that they've planned this.
They've been doing this for two years.
They've been dismantling Our immigration law, and not just ignoring it, but doing the opposite of what Congress directed the administration to do, and this is eliminate pretty much all of our immigration laws and just tell the cartels, bring as many people as you can, and we'll take care of it.
That's the message. So we have two ways to fight this.

One is obviously through legal channels.
I'd like you to walk through what Texas is doing.
And then other is just operational.
Because I think everybody now is focused on the Lone Star State that's just being overwhelmed from B-Ville You know, all the way to El Paso, the Rio Grande Valley, South Texas, everywhere in between.
So walk us through, what are you doing to fight this with your powers of attorney general?
And then on the operational side, what else is there to do to repel this invasion, sir?

Yeah, so the legislature gives me lawyers, so that's where I get to fight.
I have a few police officers, but not many.
So we have 16 border lawsuits related to immigration.
And the one that I think is key, I mean, obviously we have one on the wall trying to force them to spend money that was appropriated by Congress to build the wall, and they refused to do it.
So we're in court over that.
The main thing that they're using is the Remain in Mexico, eliminating the Remain in Mexico, which is this asylum program where people walk up and say the magic word, asylum, and then the Biden administration has adopted the approach.
Instead of detaining them or sending them back to the country that they came from, They just process them or let them go, or they transport them around the country.
That's a violation of federal law, and that's the main way that they're getting around our immigration laws.
So that's our main battle right now, is can we get the courts to enforce what Congress has passed?

Well, where do you stand in that?
Can you give our audience, like, what's the process?
Where do you stand? Because here's why.
People understand, particularly on this show, we've had reporters from Real America's Voice in the Darien Gap for two and a half years.
CNN's just found it. We've had it all the way up.
With these caravans, we've done reporting on the cartel.
Heck, I built the wall, a mile of the wall in El Paso that goes up that mountain, and the three miles is really on the Rio Grande River, not inland, but on the Rio Grande River.
So this audience is very at speed, but part of this is to show the powerlessness of the good guys.
And so where do you stand with those suits, and what probability do you think that the court action is going to alleviate this?

I think our best shot is the one I talked about, the Remain in Mexico, because that is the primary way they're getting around the immigration laws.
The reality is we have a president that is trying to increase illegal immigration.
There's no doubt about it.
It's still going to happen no matter what lawsuits we win.
They're going to keep trying to find ways around what we're doing.
And, of course, we have this very bad decision that Justice Kennedy and Justice Roberts joined in.
It was Obama versus the US versus Arizona, where the Supreme Court said that states cannot pass their own immigration laws that conflict with federal law.
So therefore, under that scenario, the feds can pass laws, then not enforce them, and then sue us for enforcing laws that they're not enforcing.
So that's another law I'd love to see us challenged.
Right now, we've got something going through the legislature.
I don't know whether they're going to pass it.
The Senate's already passed it.
I don't know if the House will pass it. If they do, it gives us a good chance of fighting that because we're putting in place things that I think we'll get sued over, which is exactly what I want.

Governor Abbott's gone on TV and Fox the last couple days saying he's got this strike force he sent down.
We have seen some footage. We're going to have Todd Benzman on here in a second.
We have seen some footage of Texas, looks like DPS, telling people they can't come out of the river and they've got to go back.
But Ken Cuccinelli, who's been involved basically at the state level, you know that, saying that that's all phony.
That's not really happening. Can you tell our audience what exactly is the state of Texas?
Let's leave the federal government out.
have planned this, are exacerbating it, and want it to happen.
But the great state of Texas, really the backbone of the conservative movement in this nation, what are the officials and what are you advising Abbott that he can do?
And even if you guys got to get locked up, what do you think should be done, sir?

Look, I think what he's doing right now is exactly right.
I think, my understanding, I'm not there today, but sending people back that are crossing the border illegally.
The main problem we have, though, is most people come, cartels know they can bring most people to the border agents.
When that happens, we can't, there's nowhere for us to intercede.
We're dealing with people that are not going to the border agents and trying to stop them from coming in or arresting them for violating our laws.
But when most of the people are being, the cartels know exactly what to do because the Biden administration has told them, just bring them to us.
And that is very difficult for us to intercede with because Then we'd have to have a conflict with Border Patrol, who unfortunately are being told not to do their jobs.
They're being told to process these people as opposed to keeping them out.
Can Texas officials...

Actually intercede and let the federal government take you to court and at least let's get this into a court somewhere and argue this out so the American people can see what the federal government's actually arguing.
They're stopping the states from protecting their own system.
Because right now, you just saw in the MSNBC, they're just letting these people...
This is not asylum. These people don't have the eligibility for asylum.
And then they're just letting them go in the street.
It's totally lawless. Can you step up, intercede, and let the federal government take Abbott, let them take Paxton, let them take you guys to court, and let's get into a court and argue that so the whole nation can see the phoniness of this, sir?

The challenge, again, is what they're doing with Border Patrol.
If the cartels directly bring them to Border Patrol and then Border Patrol transports them, that's hard to intercede.
I think the place that we can intercede is where that's not happening, in the lower percentage of cases.
There's still plenty of people that we can stop, we can turn around, we can challenge the federal government on what they're doing.
I'm absolutely all for it.
I'd love to defend that.

How do you think the next couple of days, in your mind, how's the next couple of days play out?

Look, I mean, everybody knows that this thing is going away, Title 42.
They've done it for a long time.
The cartels have been planning for it, and they're going to try to get as many people across the border as fast as they can because they make a lot of money every time they transport someone.
And in addition, as Border Patrol becomes more busy and their resources are overrun, it allows the cartels to transport more drugs and other bad things across the border because there's no one there stopping it.

Do you have a Tiger team?
Do you have, and I understand you have limited resources, but do you have a Tiger team that's focused on the cartels and the ability to cut off their bank accounts, to start to roll them up and start to have mass arrests of not just cartel members, but it's an open secret they're working with.
Members of law enforcement in certain parts of the Rio Grande Valley.
There are people on the cartel's payroll.
Is it time now to drop the hammer on the cartel?
If you can't take the federal government on as hard as you want to, can you take the paramilitary terrorist organizations that are the cartels?

Unfortunately, our state law doesn't allow me to do any type of criminal work.
You still do election fraud.
That's a whole other topic that you and I have talked about before, that I'm trying to fight to get that back.
But the reality is right now there's no authority for me.
It's got to be district attorneys, and they typically haven't been very strong in Texas in dealing with this issue or many other issues.
That's why I'm right now fighting to get authority to do things like human trafficking and election fraud and other things.
Whether I get that, we'll find out in the next couple of weeks when the legislature makes the final determination.

So last night is as much of a just a Trainwreck as last night was, they've got to be celebrating in the Biden White House this morning because McLaughlin's right.
If people are seeing Trump, if they're seeing the worst side of Trump, if they're seeing him in prime time, that ends up, in the general election at least, helping Joe Biden, doesn't it?

Yeah, it absolutely plays into the strategy that Biden people have, right?
Because as you say, Biden is not doing well.
John Lemire rightly said, you know, he has all these issues that we see in the polls with voters and so forth.
If the question is, do you want Joe Biden to be president for another four years, the answer for many Americans is no.
But what the Biden people want to do is say that's not the question.
Remember, the president says this all the time.
Don't compare me to the almighty.
Compare me to the alternative. That's what he wants to do for 2024.
And the alternative is Donald Trump, a rematch of 2020 that And the playbook, as John said, is there to be seen.
They want this to be a choice.
They want people to see what a Trump return to the White House would mean.
And I think what we saw last night was not just all the different ways Trump is challenging truth and norms and telegraphing what he would do in a second term.
I think he's reminding us that he, in a second term, would have a whole lot more latitude and freedom to do these things.
Because he wouldn't have to be worrying about another election.
He certainly wouldn't be worrying about impeachment.
He would be in office with a different coterie of people who would not be trying to steer or resist his more outrageous or outlandish ideas the way he did early on in his first term.
He would be a much more...
You know, unleashed version of himself, as you saw last night.
And with that unleashed version is somebody who would, in fact, you know, not back up the Ukrainians the same way as other Republicans and Democrats have been doing this last year.
A president who would accrue to himself all sorts of power that he asserts are his to wield, even though that's not what the Constitution or the law might say.
A president who might return to the family separation policy at the border as he talked about.
All of these different things that he told us last night he would do, he would have a freer hand to do if he wins again.
That's what Biden's folks want Americans to understand.

An audience that mocked and ridiculed a woman who a jury of her peers, Donald Trump's peers, found had been sexually assaulted.
Those Americans there last night turned that into a punchline.

On January the 6th, beaten up over and over again.
Calling a cop, a thug, who actually was trying to stop people from the House floor from being killed.

This is why the nation looks to both Iowa and New Hampshire, and historically, even before Iowa came on in the 70s, New Hampshire, to curate, to separate the wheat from the chaff.
And you saw it last night, and for the state of New Hampshire, for the MAGA and Republicans of the whole state, You were the stars.
And that includes a command performance by a president of the United States and a real president.

This is why, just to connect some dots here so you understand how this is rolling, this is why Schwarzman bailed yesterday on DeSantis.
He leaked to Bloomberg, I'm out, of DeSantis.
DeSantis had hit you when you want to be an aspire to be commander in chief and president United States, you have to walk into a situation and you have to command the room.
You have to be able to step into a decision and command it.
You have to have a certain presence.

And so I stayed up until midnight writing this.
I'm really proud of it. And what it details is exactly what you just laid out.
The leftist meltdown led by Congresswoman AOC last night on Twitter, but echoed across CNN. That post-town hall panel on CNN was just like a funeral procession.
And the reason why is, I think, twofold.
Number one, what we saw last night was major 2016 energy.
And they realize that Donald Trump could in fact be the next president as well as being a former president.
And that drives them absolutely insane, which brings me to my second point.
They cannot believe that this man is still standing.
They have thrown the kitchen sink at him now for eight years.
Starting with the Russia hoax, going through his presidency, the two fake impeachments, the rigged 2020 election, January 6th, the classified documents case, the New York indictment, all these other investigations.
They cannot fathom that this man is still standing because any other human being would have crumbled long past now.
So they can't believe that he is still here and not just that.
That he is the leading Republican candidate for president by far.
In fact, I ended my piece by quoting John King who was on the CNN panel last night.
And he was saying that, you know, Donald Trump does in fact have a plausible path to winning reelection.
Yeah. And it's driving them absolutely mental.

And the citizens of New Hampshire should be very proud of the attendees last night.
Those questions were sharp.
They were focused. And each of them I think took basically under 30 seconds.
A couple went on, but basically under 30 seconds, to the point.
And I believe outside of maybe something on the debt ceiling, those were the only questions of substance last night.
They asked about the vital issues of the day, and not just the vital issues of the day, but the vital issues that we've got to get our hands around as a country in order to make sure that...
That we save this republic.
Donald Trump had a command performance.
Donald Trump was a force of nature.
Donald Trump put the fear of God into the apparatus.
The stars, I think, were the audience.
MAGA. And what happened and what you did is just incredible.
Absolutely incredible. And here's the thing.
When our staff put that together, all the questions from the audience and Trump's answers were a total of 12 minutes, roughly.
About 12 minutes.
About 12. Think about that.
And especially an hour and a half.
It was cut short. Now, they're saying, oh, we have planned this.
I said they gave her the mercy rule.
You guys have been to enough Little League games or girls softball games.
When you see that happen, the team so far ahead.
I mean, she had a standing eight count earlier in the evening.
But all the snarky questions, and quite frankly, we're not there to see a moderator or host debate the president of the United States.
So that was embarrassing for her.
She was overhead. There was no, obviously, and the left knew that.
They went after her in full meltdown.
But they pivoted and called MAGA, cult members, that this is members of a cult, these are American citizens.
And go back. In fact, we'll clean that up a little bit.
I want to play that later. Those questions were exactly on point.
And here's what their fear is.
You heard it. Trump is not only not defeated.
Trump is not only going to kowtow and bend the knee to the apparatus and to what they want.
