It's Wednesday, 5 April, on the year of our Lord, 2022.
You're here for the second hour of the morning edition of War Room.
We'll be back from 5 to 7 at night.
We've got a lot going on in all these shows.
They were really jammed in this hour.
But we've got Jeffrey Clark.
Remember, Jeffrey Clark was a senior member of the Justice Department overseeing things like the environment.
He's been such a critical part of sorting out this disaster in East Palestine, Ohio.
I think because of Jeffrey Clark's Coming on this show, that's why you have the Inspector General of EPA now doing an independent review and investigation on exactly EPA's role in that, which is what we need also, I believe, because of his efforts in going to East Palestine.
With Real America's Voice and John Fredericks and Ed Henry and Karen and everybody doing the shows out there for a couple days is one of the reasons the Justice Department is now bringing forward a suit against Norfolk Southern.
So Jeffrey Clark has had a lot of results from his actions.
We had Kash Patel on Former General Counsel of the House Intelligence Committee, Jeff, and also Chief of Staff over at the Pentagon, and I think was working with Grinnell at DNI. He said that the committees of jurisdiction in the Capitol, in the House, have to take action on this, and they have to get involved in this, and they have to do it immediately.
Do you agree with that, sir?

Yes. I absolutely agree with that, Steve.
And look, part of the hesitation could be, you know, what Bragg has thrown up through his general counsel against the inquiries that have come in from Jim Jordan.
Namely what they've said is like, look, you know, I'm Alvin Bragg.
I'm an independent local prosecutor wielding New York power.
You're in Congress.
You know, you can't inquire into what I'm doing with state power.
That's not how our federalism system works.
Well, you know, I think that Alvin Bragg and his general counsel have to go back to law school because they're missing some basic points.
First, there's federal funding involved.
And whenever there's federal funding involved, you're voluntarily tying yourself in to inquiries about how you're spending that money.
Second, there's 14th Amendment power here because After the 14th Amendment, states have to observe due process and equal protection, and they're ignoring President Trump's equal protection rights.
This is a complete selective prosecution.
As Professor Dershowitz pointed out, it's the kind of prosecution that has never been brought before, and as I pointed out, it's There's never been a prosecution against the president at all in our 235-year history of the entire republic.
And so in light of that, Congress also has a special power under the 14th Amendment, Steve, which I don't think is widely known.
Under Section 5 of the 14th Amendment, Congress has the power to issue new It's remedial legislation that explains how to fix problems with the 14th Amendment when they come up.
And so Congress clearly has the power to consider legislation to fix wayward prosecutors like Alvin Bragg who are trying to intrude into the federal sphere.
So Jim Jordan in judiciary, in James Comer, in oversight, and any committee of jurisdiction has clear power for funding, for spending clause reasons, and for reasons of the 14th Amendment, especially Section 5, to inquire into Alvin Bragg the subpoenas should be flying.
And there's just no legal basis for him to resist that, which is why at the end of a letter that came in back to Jordan, there was this tentative kind of, you know, tepid thing of, oh, well, hey, you know, if you disagree, negotiate with us and maybe we'll come to some kind of resolution.
That's an indication of weakness.
They know that if they really get their hand forced that they're going to have to come in and testify and provide documents.

Okay, this is also going to get into the Wisconsin discussion when Caroline Wren joins us.
What I've been advocating and President Trump's been doing, putting out these policy videos, because my point is, leave the personalities aside.
And yesterday you saw Trump, I think, as the Viking, right?
He wasn't, oh, he looked terrible, he looked pensive.
No. He went in exactly how you should hold yourself as a man in facing that incredible injustice.
He looked like a Viking chieftain.
And I think it came out great.
And then with the speech last night, which I thought was terrific.
But these policy differences, leave the person outside, the policy differences are stark.
It's one of the reasons we're getting to Wisconsin about the old Republican Party and the old thinking versus MAGA. And here you have a clear differentiation of Ron DeSantis for years was an acolyte of Paul Ryan.
And the question's got to be, have you really left that behind?
Because quite frankly, when you see a lot of things, and I've watched all the speeches, you don't quite, besides the woke thing of going to Disney and some of the corporations and the backing of the parental rights movement, you don't quite see that he's made that transition to populist nationalism, the true, the guts of it, the really tough stuff about it that has made President Trump the head of this movement in a historic force in the United States and throughout the world.
Mark Mitchell, Rasmussen, your thoughts on where we stand right now with President Trump in the polling?

He's doing great.
He is now the most electable he's been since the fall of 2021.
And also a stunning turnaround in just a few weeks.
So we asked 1,000 likely voters if the 2024 presidential election were between President Joe Biden and former President Donald Trump, who would you vote for?
And Trump now beats Biden 47 % to 40%.
Seven-point lead, which is the highest lead he's had since November 2021, and the highest absolute percentage of the vote, 47%, since September of 2021.
And that's, of course, when the Afghanistan crisis was going on, and we were leaving all these military vehicles over there, and Marines were getting blown up.
So we were all...
We were discussing a poll about Biden and Trump we did back in February, and that was the first time that we actually had Trump losing to Biden, and we had Biden at 45%, Trump at 42%.
And I think part of that was the timing was really bad for Trump.
It was not too long after the November 2022 midterm underperformance, and not too long after his backing of Kevin McCarthy, which I don't think was a very popular call.
And that was the only time we had Trump losing since 2020.
But now, just weeks later, a 10-point swing, a complete turnaround.
And his numbers are looking better than they've been in the longest time.
So it's just incredible.

What do you attribute this big, the big spread, the 47-40 and also the 10-point swing?

What do you attribute it to? In that period of time, a few things happened.
Trump had a very well-timed trip to Ohio.
Trump started campaigning, and this indictment hit.
And we do have some data to support that the indictment was not popular.
But what we can get into after the break is the demographics where Trump has changed since February, and it's really interesting to see.

I do think an inflection point, I think you guys have nailed something, was the trip.
I keep saying this, but now you're mathematically showing it.
The trip to East Palestine that no other politician can make.
Only Trump can make that. You still haven't had Biden go, Kamala Harris go.
You haven't had any of his opponents in the primary go.
Only Trump can do this because it speaks to Trump.
As the voice of the voiceless, of the forgotten man and woman in this country, and I'm telling you, because I got sick as a dog after just two days in East Palestine.
I mean, this was a week ago when I got back here.
Remember, I didn't make Thursday's show, and people understand.
I don't take days off, right?
I do not take days off.
I was down hard from East Palestine, Ohio.
Mark Mitchell, what do you got for us?

The American people know that.
We polled, and they do not think the water in Ohio is safe.
And we also polled and they thought that this Manhattan DA indictment was a political stunt, vengeance against Trump.
And sure enough, we said ahead of the indictment that it was a bad move for Democrats to make.
And the comparison of the demographics between the last time we asked the Trump versus Biden question and today should just be soul crushing to the left.
The top five Demographics, two of them are self-identified liberals and Democrats.
Had the biggest change between February and today in Trump's favor on the 2024 question.
Liberals had a stunning 26-point swing since February.
Democrats, a 19-point swing.
Hispanic voters, 18%.
It was a cross-the-board change.
Republicans are 15 % more in Trump's favor too.
But the top of the list, liberals and Democrats, I mean, we saw it coming.

What do you mean in his favor?
Explain that. Maybe I didn't hear it correctly.

Give me that again. In February, we asked if you would vote for Joe Biden or Donald Trump for 2024.
Among Democrats, Joe Biden was leading by 72 points.
Today, he leads by only 53 points in 19-point swing.
Self-identified liberals at 26-point swing.
So, whatever's happened in the last few weeks has made Donald Trump a lot more appealing to both Democrats Liberals, Hispanic voters, low-income, blue-collar voters.

It has to be the economy and what's happening in this Ukraine war.
It's the Third World War.
People are waking up to the fact.
I'm going to have more time talking about the economy and capital markets tonight, but it's a collapse.
I'm going to add the other element we've been talking about only at the war room is the commercial real estate market.
We're going to have a collapse.
We're heading towards a collapse.
It's the reason people are looking at gold as a hedge.
The math here is pretty simple.
That's, I think, your shift.
I think it's because people understand the underlying economy and the uncertainty.
Look, as much as you hate Trump, people hate Trump and hate the sound of his voice, and you hear it all the time, Trump this, Trump that, he tweets that, he does these true socials.
Hey, he gave you four years of peace and prosperity, and you ain't got that now, and you ain't about to get it back until he gets back in.
Full frickin' stop.
Nothing else to be said.
Mark, what about the primary?
Give me the thing, because that's where I've been, the DeSantis situation with Social Security and others.
And he's had these two big speeches at the Reagan library with that magnificent setting there on the side with the Air Force One and the jets and all that.
Then he went to the Air Museum in Long Island.
These are two places to step up and give me your vision.
You back it up with your understanding.
It's just all I get is this kind of woke.
I'm going after Disney and I'm going to support the parents, which is important.
Don't get me wrong, but dude, you're not looking to be governor of America.
You're looking to be president of the United States and commander in chief.
Your thoughts on the primary?

The last time we polled on DeSantis versus Trump, the numbers were really decisive and we decided that we'd probably sit it out for a little bit until more people enter the race.
The truth was when we compared Trump versus DeSantis back in the fall, the lead was a lot narrower than it was just recently.
Trump wins 52 % to 24 % among Republicans and throwing Nikki Haley into the mix actually siphoned off more votes from DeSantis and Trump gained votes.
So to me, unless something major changes, it's pretty clear what's going to happen in the Republican primary.
Now we have some numbers for the very first time we tested DeSantis versus Biden.
We'd never done that before.
And what's interesting is I don't think the national stage is really paying attention to him yet.
So he actually has a larger lead.
He has a nine point, sorry, eight point lead against Biden, which is a point wider than Trump's.
But here's the thing.
His total magnitude of the vote is one point less, 46%.
And that's really meaningful because the truth is, though some other candidates Are going to break towards Biden mostly.
But what's really makes me think that his numbers will drastically change when he's exposed to the national theater is the demographic advantages compared to Trump.
And the ones he has in his favor just do not look like they're ones that are going to stick around.
The very top of the list is Biden somewhat disapproves.
And those people, I don't know, they're basically normies or people that do what the news tells them to.
They're not a very – there's not a lot of strong will in that demographic.
And he has a 27-point advantage over Trump in there.
But then he has high-income earners, black voters, 18 to 39-year-olds.
That's where he does better than Trump, and I just don't see that those are going to hold up the test of time.
Now, where Trump has an advantage over DeSantis, and you talked about this before the break, it's people who are struggling.
It's low-income earners.
It's people with high school degrees.
It's Biden strongly disapproves, of course, and middle-aged voters, 40 to 64-year-olds, and of course, here's the one that counts, Republicans.
Trump has a four-point advantage over DeSantis among Republicans.
You know, things can always change, but...

When are you going to go back in the field and get the impact of what's happened in the last 24 hours?
You're going to do it this weekend? I mean, when can we get you back on?
Do you think that you'll start to get a sense of the impact of the substance and the optics of what's transpired over the last 48 hours?
mark mitchell
Well, we're still waiting to see how Biden approval pans out.
That's a rolling average and it's been all over the place.
He had two really bad overnight prints, the lowest we had for a long time, 42 percent.
But then he had last night just an incredible spike driven entirely by Democrats.
So a lot of Democrats really are applauding what happened here with the whole get Trump thing.
But these numbers here that I'm telling you with Trump beating Biden by seven points, these were mostly conducted after everybody knew that Trump was going to get indicted.
So we'll have to see.
There were certainly some theatrics yesterday that are going to have an impact on American public opinion.
Not sure what questions we're going to ask about it yet.
We would be absolutely happy to take suggestions.

These were Americans telling us that just as many people knew somebody that died of the vaccine as died from COVID. So people should check that out as well.

We don't need any more people putting out tweets and look what the Democrats do.
We understand. These are not Democrats.
It's not your father's Democratic Party.
These are American Bolsheviks.
And they treat it just like Stalin treated the legal system or just like Hitler treats the legal system.
You have to go on offense about it.

Is it going to mean anything if we don't have a place like Arizona and Wisconsin sorted out, ma'am?

And that morning we started getting reports from all of the illegal migrants that were coming up that they had all been robbed.
Many of the women were being raped.
And so we continued on that path and we ended up, Centerfront, our escorts, ended up having to engage with those guys.
Actually, at the moment that they engaged with them, they had another female that they were undressing, about to rape and who knows what else.
So this is what's going on in the Darien Gap every single day.
And we were out there covering it and we have, I mean, there's so much more footage beyond that, what the left has invited, the open borders left has invited into America, but also to the people that are dealing with this down here in Panama.

Why is it so important to understand what's going on there to then understand what's happening in our cities?

Why has Ben Burquam and Oscar Blue Ramirez done so much great reporting from the Rio Grande Valley and from Yuma and from Tijuana?
Why are you guys down thousands of miles down in Central America?
The Darien Gap is what connects Latin America or South America to Central America.

Well, it's a microcosm of what's going on in America.
It's basically a barometer for what we should expect to come.
So as you're down here, it's kind of like Andrew Breitbart used to say, politics is downstream of culture.
This is the same thing. So the borders are downstream from the Darien.
Everything that comes to our southern border goes through the Darien, a vast majority of it.
Some people are bypassing it now, flying directly into Nicaragua and Mexico.
But it's still a very good barometer for what we can expect coming on the United States side.

So one helicopter was Ben.
Being taken back to Panama City, and the other one to Panama, and the other one was me riding with the other two criminals.
We arrived over here, and the whole purpose, you know, from Barbeque Juan and myself, is to show how the massive flow that is coming.
There's no other way, better way, to go in reverse and to go the inverse route.
And that way, you know, look what we encountered.
We encountered these criminals that they were actually, you know, raping and abusing women.
So the whole purpose was to show how the massive amount of people that they're continuing, continuing, The number is just incredible what they're saying to us in different shelters.
