This is the primal scream of a dying regime.
unidentified
|
Pray for our enemies, because we're going medieval on these people.
I got a free shot of all these networks lying about the people.
The people have had a belly full of it.
I know you don't like hearing that.
I know you try to do everything in the world to stop that, but you're not going to stop it.
It's going to happen. | ||
And where do people like that go to share the big lie?
MAGA media. I wish in my soul, I wish that any of these people had a conscience.
unidentified
|
Ask yourself, what is my task and what is my purpose?
If that answer is to save my country, this country will be saved.
unidentified
|
War Room, here's your host, Stephen K. Bannon.
Are no longer fit to work for the people.
For this betrayal of the public's trust, I call on Congressman George Santos to resign.
And that is where we begin today with some of our most favorite reporters and friends.
The co-founder of Punchbowl News, Jake Sherman, is back.
Also joining us again, Charlie Sykes, editor-at-large of The Bulwark.
And our friend Eddie Gladys here, chair of the Department of African American Studies.
unidentified
|
Whoa, whoa, whoa, whoa, whoa, whoa, whoa. My favorite, Nicole Wallace.
It's Wednesday, 11 January, Year of the Lord, 2023.
Nicole, the talented Mr.

|
Santos can't be the lead, baby.
Come on, let's go to Haley. Haley Jackson, she has a nose for news.
Let's go with Haley Jackson. I got Kash Patel, and I have Boris Epstein.
I got Rudy Giuliani. | ||
I got Mike Davis. Nothing but hitters on this.
Let's play the real cold open.
What's the real news of this afternoon?
unidentified
|
Play it. We're Lee, Mike Memolee doing that reporting too.
Carol, let me go to you, because there are some questions.
Again, as NBC News is reporting, you and the team, that at least one additional batch of classified documents has been found in a separate location from this other office.
There are some things that are not clear, as you and Ken and Mike note in the story, including the classification level, how many documents there are, the precise location of the additional documents, when they were found, and if there is a continuation of a search for any other classified docs from the Obama era, right? Yeah, that's right, Hallie.
One of the things that we know is that the aides to the president have been conducting a search at various locations, anywhere that he might have had documents from his time as serving as vice president, to go through those, to sift through all of those boxes, to figure out if there's anything else there.
They really want to get their arms around the sort of scope of this issue and to hand over anything else that might be classified that is in among the now presidents.
Okay. Okay. | ||
Since we took the House, we're going to get to all the investigations.
Folks, every day is Christmas Day.
Every day is going to be Christmas Day.
You're going to have a new gift to open.
They're so corrupt. And do you think it's random that all of a sudden they're finding this?
They're finding all this just randomly.
They've got the FDA at 6 o'clock.
We're going to have Malone and Naomi Wolf to walk you through all the FDA lies.
And now they find out Moderna.
They're sad and angry that they had disappointed, very disappointed that we didn't have all the documents.
And now they've got this. I got Cash, and Cash called it yesterday.
To the T, he says, hey, Steve, I think they're going to have a lot more that show up.
Boris, we were going to start this afternoon with a magnificent video the president put out this morning, about four minutes long, as the cold opened. But it's kind of been overcome by events since.
They found an additional batch of documents.
You see the long faces? Remember when they were in Mar-a-Lago, they were all foaming at the mouth?
He's got classified documents.
Here, it's like they're at their uncle's funeral.
Right? It's got the long face, the knitted brow.
Boris, tell me what's going on here, brother.
Steve, honored to be with you.
honored to be with the posse. What's going on is exactly what we said was going on, which is when are all of the mansions of Joe Biden going to be raided?
And as President Trump said, potentially even the White House.
The question is this. | ||
Now it's true. You know it's going to grow from there.
This decrepit, hopeless person, Whose crime family, the Biden crime family, has been sucking the blood out of America for decades.
Didn't just take, you know, a document here.
He took intelligence memos on Ukraine, on Iran, who knows what else.
And as we effectively broke here on air yesterday, this was information that's marked TS, Top Secret STI, Special Compartmented Information.
That is about as sensitive as it gets.
And again, let's be clear.
Let's go to the videotape. President Trump is governed and subject to the PRA, the Presidential Records Act.
President Trump followed the PRA to a T, followed all rules and regulations to a T, did everything absolutely correctly.
Full stop. Then you have the raid.
You've got to break it into his home of Mar-a-Lago.
And then you've got, you know, the GOJ claiming, oh, well, you know, there may be this page there, this page here.
Even they didn't claim to find full documents.
With Biden as Vice President, he's subject to the Federal Records Act, the FRA, which, unlike the PRA, has a criminal enforcement mechanism.
It also does not allow for declassification.
Vice President, President Trump, had the power to declassify completely, totally, and by fiat.
So those huge points are vital to remember.
As people are digesting these news, and the bottom line is this, from everything we know now and more is coming out, we know for a fact that President Trump did everything right, did everything by the book, did everything absolutely legally, and we now know from all the information that it fully appears that Joe Biden committed yet another crime, in addition to the crimes committed by him and his family, in addition to the crimes committed by his kid Hunter Biden,
everything that's on that laptop, From the lurid crimes to the national crimes to the treason, it is absolutely abhorrent.
So what we know is the DOJ now has got a problem because they know for a fact, they realize completely that President Trump did nothing wrong.
But now they've got to figure out how they wiggle out of the fact that Joe Biden, under the Federal Records Act, did not commit crimes here by taking these highly sensitive members.
I know you've got to bounce.
Let me ask this way. | ||
Should a special counsel be ordered by Merrick Garland this afternoon?
Well, here's the big question.
If they knew, and they tell us they didn't know until November 2nd.
I don't believe that for a minute.
I don't believe that. But even if that's the truth, if they only knew on November 2nd, how do you appoint a special counsel on November 18th?
Into the box of hoax with President Trump and didn't appoint one in terms of the crimes again committed by Joe Biden, his and his family.
And now, very much including these documents.
And again, it's not just despair.
Don't think of it as disparate pieces of paper here and there.
These are full-on intel briefings.
This is not a joke. | ||
It is a big deal. | ||
And yes, at least a special counsel has to be appointed right now.
And we'll see where that goes, but I will tell you that it is a difficult day within the politicized, weaponized Department of Justice, in quotes.
The crimes here are horrendous because of the scale of the classifications and the compartment in nature, also where they were left in places that had been moved multiple times.
We know that. They've lied about that.
unidentified
|
And also they're telling us that three lawyers packed up a box.
Since when does anybody have three lawyers packing up their documents?
That doesn't make any sense. None of this makes sense.
The only thing they've done is they've found more, and you better believe they're going to be finding more and more after that.
I'm going to get cash in here in a second.
But also the fact that the Chinese Communist Party pays for the office space and has the UPenn.
They've given the money to UPenn.
So they've got the CCP all over it.
But I think here, as horrific as Biden's crimes are, and they are major felonies, I think the cover-up is going to be – it's going to stun the American people.
So just don't – it's zero probability some guy found this on a couple days before the midterms.
Zero. Zero. | ||
Less than zero. Boris, I know you're jammed.
And by the way, Comer announced today the Biden crime family gets center stage in, I think, public hearings on the first week of February.
Little Jamie Raskin has already been out.
They're in full meltdown.
Little Jamie is sitting there.
You know, his hair's on fire.
This is the worst thing. This is what the Republicans want to do.
Well, no. We're going to do a lot of other things, but yes, we're going to do this also.
And we don't care if you don't like it, if Morning Mika's got the nasty face and the knitted brow.
It's coming, baby. Boris, what's your social media?
What's the morning newsletter you put out?
How do people get to it? It's coming because American people demanded, Steve.
And yes, you're right. The suspicious activity reports demanded by James Comer today and Twitter being hauled into Congress as well.
on the rigging and stealing of the 2020 election.
Steve, honor to be with you.
Honor to be with the posse. Always signal that noise for the war room posse.
Look for a lot more to come on this debacle for Joe Biden and the weaponized, targeted DOJ. My information, the website's borrscp.com.

Stay strong, God bless, and I'll talk to you tomorrow.
By the way, what Boris was mentioning is basically Comer asked for the bank records.
What the FBI and the intelligence community were getting illegally on Cash and Nunez and Derek Harvey to try to prove – to try to use something against them as they were going after the Russiagate.
Cash, this is why I love having you come on, and people – I've got to understand this is why President Trump depends upon you so much and why Devin Nunez – And I was down in the Star Chamber, you remember, I think for 22 hours they had me in the Star Chamber.
And Kash Patel is the coolest in the most intense fire.
That's when you need Kash Patel.
Kash Patel is cool, calm, and collected in the most heated situations with Shifty Shift and Swalwell.
They can't do that now, Kash, because their security clearance is going to be stripped.
Bye-bye. No more of those guys.
Kash, you said something yesterday when you were on here.
You said, hey... There's a lot more coming.
Don't think this is it. What did you mean by that?
And how did the day actually show that Kash Patel's right, as always, and everybody else is wrong?
Great to be on The War Room, Steven.
Thanks so much. And let's stitch this thing together.
And you are the master of setting the tempo.
You have said repeatedly, now is not the time to go buck wild and celebrate.
Now is not the time to go ass over tea kettle.
And we talked about it yesterday.
There's so much more to come.
As our friend Comer is following the money like we did with Russiagate.
Look what happened and how this investigation unfolded.
These government gangsters knew in November of 2022 and before that, That Joe Biden had classified information.
A little-known article in the Washington Post right after the midterms by the favorite fake news mafia warriors put out that the investigators for the Donald Trump investigation of Mar-a-Lago classified docs had determined that President Trump won't be charged because it was, quote, ego and desire.
The Washington Post never writes a puff piece in favor of President Trump.
Why did they do that? They were setting the stage down the road because they knew Joe Biden was being investigated for classified documents, so this Department of Justice can come out with a ruse and say, look, we handled both matters equally.
Well, both matters are wholly unequivalent.
And let me talk about the people, the government gangsters, that I say that there's no coincidence ever in government.
Do you know who was head of Eastern European affairs in the office of vice president where these classified documents came from?
Charmella. Eric Charmella was head of the Ukraine-Russian desk in the office of the vice president.
Stop. Stop. You don't mean, you don't mean, you're not, you're not talking, you're not talking about the whistleblower, right? You couldn't possibly be the first impeachment whistleblower.
Watermelon Head's sidekick and his later pal Vinman were in the office of the vice president.
Now, Steve, as I say in my new book, Government Gangsters, there are no coincidences.
Remember, Charmella was the guy who rigged the firing of the Ukrainian prosecutor with Joe Biden as vice president.
The receipts, as you say, the emails have been put out by the fake news media.
Thanks for doing that, by the way, with Charmella's name on him, where he documents the transactions going back and forth between Joe Biden and the State Department and the Ukraine.
It's unbelievable. So fast forward.
And by the way, do you know where Charmella is right now?
He is a deputy at the Office of the Director of National Intelligence under Avril Lavigne.
Do you think these people don't stay in these positions to masquerade as government gangsters and deep state actors and then say they're doing America's work?
This is why I said Joe Biden's days about classified documents are just beginning.
And here's the leverage point.
Here's the scary thing. Let's get down to reality.
Our enemies now have, the CCP, Russia, and the Ukraine, have immense leverage over the Biden family and what's in these documents.
Because do you think, for one reason, they don't know that Joe took these documents and the contents of them?
Joe Biden is now commander-in-chief, his son needed to be prosecuted a long time ago, and now our White House is compromised by our number one enemy, the CCP, because these documents, as has been leaked to the media, Speak directly to our most sensitive compartment of information, our most intelligence, our sensitive intelligence in the world as it relates to the CCP and the Ukraine.
It is not a coincidence these government gangsters act in concert, and I said yesterday on your show, they better be raiding every single place of business that Joe Biden ever sat in, and this Congress better be subpoenaing every single government gangster on it.
Cash, hang over a second.
We want to hold you through the next block.
We have Cash Patel who gave a called shot yesterday.
This is going to be stunning.
A scandal like no other.
The Biden classified documents and who paid for them.
unidentified
|
Next in the war. Here's your host, Stephen K. Mann.
Okay, we're back, and we're making this up as we go along.
We've got a lot going on. We're juggling a lot of balls.
I want to, is it George Santos?
Santos is, George Santos just tweeted, Kinzinger has called for George Santos to resign immediately from Congress.
And Santos just tweeted out, and if we can put it up, that right there, thank you Real America's Voice, the team in Denver.
Santos just tweeted, go on CNN and cry about it.
The talented Mr. Santos.
Here's the thing. How can MSNBC lead with the Santos story?
Look, the Santos story's got issues, and they're going to figure them out, and it's a story.
Don't get me wrong. But you've got the Commander-in-Chief, the illegitimate, I might add, Commander-in-Chief. Now with a massive scandal in his hand, unlike any other, because this is when he was VP. He had no ability to declassify this.
Plus, in Mar-a-Lago, it's Trump in the Secret Service, in the University of Pennsylvania, these other locations, he's got taking CCP money.
They're walking in and out all the time.
You got the Chinese Communist Party.
You know, Santos' story is kind of, Santos is like Zelig meets Forrest Gump, meets the talented Mr.
Ripley, right? Who knows?
Today's the star of the volleyball team.
Who knows? Is he any more pathological than the Bidens?
The Bidens, every time they open their mouth, they lie.
The mayor's coming on here in a second.
He's calling the Biden, first time in May, he says it's the Biden crime family.
I've known them forever. They're total crux.
They're like Irish mafia. He said they're total complete crooks.
He said the brother's the worst. Joe's the dolt that they monetize.
He says the brother's the brains of the operation.
You got Hunter who's drinking what the client's drinking or snorting what the client's snorting.
I've got Cash who called this, and obviously it's very serious.
It gets back to Ukraine.
It gets back to geopolitics.
It gets back to what individuals are in what government's payroll.
But I've got to go to – and I had a clip from yesterday.
By the way, on this show yesterday, we had Cash Patel tell us, tell this audience, and that's why I'm so proud of this show.
He says, hey, you ain't seen nothing yet.
They're going to be coming up from everywhere.
There are a lot more documents, and the players – you wait until you see who the players are.
That was a cold shot by Kash Patel yesterday.
Mike Davis on the show yesterday and said, hey, we need a special counsel like immediately because this is not the only thing that's going to happen immediately.
OK, let's I want to play that from Davis.
I want to bring Mike Davis in. You have the attorney general who appointed a special counsel for President Trump, but won't appoint a special counsel for his own boss, President Biden.
There is a much clearer case.
There's a much clearer conflict of interest.
for Merrick Garland investigating Biden than Merrick Garland investigating Trump.
This U.S. attorney that was appointed, they say it was a Trump U.S. attorney, this was actually a hand-picked attorney by Dick Durbin in Illinois.
He was one of two U.S. attorneys who Biden capped.
That tells you all you need to know about this guy.
And so Merrick Garland must appoint a special counsel, and President Biden is already putting political pressure On Garland, he came out in a statement and said, review which I hope will be over soon.
That is improper legal pressure on Attorney General Merrick Garland and the Biden Justice Department.
That's their boss saying, get this over with quickly.
Sweep it under the rug. There must be a special counsel.
Cash brings up a good point, Mike Davis.
He said, hey, they appointed the special counsel on the 18th.
They knew for at least 16 days, and I think you're going to find out they knew a lot longer since the second best.
They knew it back. I think they knew it back before Mar-a-Lago, and we'll talk about why Mar-a-Lago happened.
He's in a jam. He has to not only appoint a special counsel, doesn't he have to make the argument to the American people?
Why didn't they bring this up when he appointed the first special counsel, the special counsel on President Trump, Mike Davis? Well, if you know, if we find out that they knew that Biden had these documents and going after Trump was a There's going to be some big political problems for Attorney General Merrick Garland and maybe some impeachment problems.
What we're finding out today, not only did we have these documents at 101 Constitution Avenue in Biden's fake professor office at the University of Pennsylvania, now we have a second location, right?
And we're hearing Biden comes out and makes this public statement that you just played where he's putting pressure, political and legal pressure, on Attorney General Merrick Garland to sweep this under the rug.
And the White House is putting out statements that Biden will not cooperate with the intel assessment.
Think about that. | ||
Biden would know who had access to these records at 101 Constitution Avenue, his pen office. Biden would know who had access to the classified records that he illegally stole and took to that second location.
Are there other locations? Who had access to these locations?
The Democrat chairman and Republican vice chairman of the Senate Intelligence Committee called on the Director of National Intelligence to perform an intel assessment on this, and President Biden needs to cooperate.
He needs to put our national security ahead of his personal political interest here.
What can Congress do? | ||
I mean, what pressure can be put on them?
Look, it's insane for them, and the political damage is going to be horrific.
But what pressure can the House put on them or the Senate to force them to put a special counsel on this, a special prosecutor? Well, if you're the House Judiciary Committee, if you're Jim Jordan, you immediately call in Attorney General Merrick Garland to the House Judiciary Committee and you hold a hearing.
You grill him publicly and ask him why we have two systems of justice here.
Why do we have a special counsel appointed for President Trump who had the clear constitutional power as commander-in-chief and the clear statutory power under the Presidential Records Act to take his presidential records with him when he left office.
And he took them, it doesn't matter whether classified or non-classified, he took them to a secure facility at the office of former president.
Again, Secret Service protected, federally funded office space, federally funded secure office space, federally funded staff. Federally funded Secret Service protection and contrast that with Biden, who has these classified records that he stole.
He had no right to take them. He wasn't the president.
He stole these government records, classified government records, clear violation of the Espionage Act, clear violation of government The same allegations that they're bogusly looking at for President Trump, who had the right to have these as the president, they're not going to pursue a special counsel here.
They're going to appoint This Durbin picked U.S. Attorney in Illinois to sweep this under the rug.
It can't happen. So Jim Jordan, as the House Judiciary Chairman, should put pressure on the Attorney General.
You need to have the intel committees put pressure On the DNI, this is a huge scandal with massive national security implications because, as we've talked about, President Biden is clearly compromised by taking money from China and Ukraine and probably other countries all around the world.
He's compromised and he's putting our national security at risk.
Boy, CNN's got a special over the weekend about how America's mayor is no longer America's mayor.
But I seem to remember...
Hang on for a second. Let me think about this for a second.
I seem to remember there was a guy that told the nation all about this a couple of years ago.
Oh, yeah, that was Rudy Giuliani.
Yeah, that's right. I remember. Now I remember the mayor, who's dead right on all of it.
Mike Davis, you're a man who's coming a little hot.
You're right here, you're coming a little hot.
But you choose your words judiciously as any clerk for Associate Justice Gorsuch should.
A couple times today you've used the word stole, that Joe Biden stole these documents.
No one's ever accused President Trump of stealing the documents.
There's a whole thing about the Archives and the Records Act and all of that.
Maybe storage, but not stole.
What do you mean? | ||
What do you mean? | ||
Tell the audience what you mean by Joe Biden stole these classified documents, sir.
Well, actually, they are investigating President Trump for theft of government records, which is nonsense, because the Presidential Records Act applies to him, not the general government document statute.
Because he's the president, then-former Vice President Joe Biden did not have the same privileges as Vice President as presidents do.
Vice Presidents, like anyone else, cannot take government records.
They can't take presidential records when they leave office, and they certainly can't take classified records.
The President can take his presidential records when he leaves office, whether they're classified or not.
No one else can, and so that's the issue.
Vice President Joe Biden absolutely stole government records.
He absolutely stole classified records when he left office by the mere fact that they are in his possession.
He moved them at least once before he left office on January 20th, 2017. He moved them again when he moved into this The Biden Pen Office at 101 Constitution Avenue in Washington, D.C. in February of 2018 apparently has other stolen classified records at another location.
The FBI needs to do a raid of his homes and offices to gather all these records like they did with President Trump.
Mike Davis, what's your social media and how do people get to your website where you're doing all your work?
Sure, it's article3project.org, article3project.org, at article3project, at article3project on Getter, Twitter, Truth, and my personal is at MRDDMIA, at MRDDMIA, and thank you, Steve.
Thank you, brother. Appreciate it.
And thanks for being so on the ball on this.
Cash, I've only got a minute.
I want to hold you through, too, while Rudy's here.
Real quickly, you're a former prosecutor.
You were the chief counsel, senior counsel to the Intelligence Committee.
Is Mike Davis right? | ||
Is Joe Biden, is he really, is it stealing these documents, these highly classified documents, he has no prerogatives like a former president does?
He's absolutely right. I've said this for years now, and this case proves it.
A sitting president is the only sole arbiter of the classification authority system in the United States government.
You know who is not? A sitting vice president.
And that's directed by the Office of Director of National Intelligence and Federal Statute.
So it could not be more clear.
So we have just exonerated President Trump from half the farcical crimes that they've come up with, and at the same time convicted Joe Biden.
Okay, Cash, hang on for one second.
Cash may have the best time book in the history of the earth.
Government Gangsters is now on pre-sale.
Wow. Talk about the timing.
Government Gangsters. The author of that, Cash Patel, is going to stick with us.
We've got America's Mayor, Rudy Giuliani.
We're going to walk through who the players are, and we're going to go over what the mayor has told us for many years, in a moment in The War Room.
unidentified
|
Here's your host, Stephen K. Back.
them. | ||
you Okay. We've got the mayor, because the mayor probably knows more about this than any living individual, except for maybe Kash Patel, the author of Government Gangsters, the most timely book, I think, in the history of publishing.
Kash, just give me two minutes, because we're going to spend a lot more days and weeks on this, obviously, but in the breaking news of it, just to frame this and go back to the previous, because ladies and gentlemen, this is all part of a whole cloth.
There are things here that connect this.
Go ahead, Cash. As one of the themes in my book, Government Gangsters, there are no coincidences between these government gangsters.
And if your audience remembers, Eric Charmella, the architect, the fake whistleblower who walked into Adam Schiff's office and created the Ukraine impeachment hoax out of whole cloth and fabricated intelligence.
Do you know where he was working in 2016?
In the office of the Vice President of the United States, Joe Biden, handling East Eurasia matters.
That's Ukraine and Russia.
And it doesn't just stop there.
He then goes into the Trump administration and partners with Fiona Hill, another government gangster, at the White House covering the same topics to conjure up the Ukraine impeachment fiasco.
And if that weren't enough, he, Eric Charmella, is the same guy coordinating with the State Department, Back in 2016, 17, and 18.
And the emails are out there for the world to see about firing the Ukrainian prosecutor, which I know you and Rudy Giuliani are going to get into in a second.
But I want to fold this together with Susan Rice, Obama's National Security Advisor, currently in the Biden White House.
She is running the balls and strikes operation.
Look at where this leak today occurred from.
Ken Delanion, no friend of Donald Trump or the conservative or truthful reporting.
It was put there on purpose because I believe Susan Rice has been running the White House this entire time to kneecap Joe Biden and his son at the same time, and this achieves that.
They will prevent Joe Biden from running and exonerate Hunter Biden and enter them into the sidelines of history and have whatever candidate they actually want.
Do you think it's a coincidence that two weeks before Joe Biden was set to announce his presidency re-election campaign, this breaks. No coincidences for these government gangsters.
There's no coincidences.
And by the way, this is the death knell for Biden's presidential run again.
You're absolutely correct. I want to go.
Cash, just hang on for a second.
I want to bring in Rudy. Rudy, if you can please do it for me, not for the other, but just do it for me, with as few Ukrainian names as you have to.
Because, no, seriously, when you get on a roll, I got to get my number two pencil on.
I can't keep up. But seriously, you...
went early on. | ||
In fact, before the impeachment, I remember it was back, I don't know, the spring or winter of 19.
I'm talking about a year. I'm talking about nine months before the perfect phone call.
Nine months before. Rudy went on, and John, you guys got lit up like nobody's business.
It was like, and that should have been a tell for us at the time.
Why did they lose it over Rudy talking about, which looked to me like a little obscure.
Go ahead. What happened?
For example, Cash mentioned Chiar Mello.
In January of 2016, Chiarmelo was Biden's representative on the National Security Council.
He broke into a meeting with four Ukrainian prosecutors.
They were there to talk about security, and he told them it was of utmost importance to dig up dirt on Paul Manafort.
He outlined for them over a series of the next month a whole phony dossier that was produced.
There are four witnesses in Ukraine.
That that ambassador was not allowing me to come to the United States.
Who are ready to, and a few have already testified under oath about this.
This is a very connected...
But hang on, hang on. I want people to understand.
This took place in the National Security Council's, the Kennedy rooms, underneath the White House, where the decisions are made.
You've seen it in all the TV shows.
That's where Carmelo was down with these four.
It was so classified. | ||
It was in a secure spot. | ||
And they're trying to talk about corruption.
I think, right, to get rid of the bad guys in the corruption.
And what Biden guys want to do is talk about, no, no, we got to get Manafort because he's already been named or he's about to be named the chairman of the Trump campaign, correct? Absolutely.
But now he's really, I mean, Biden's really in the jam.
The statute that he violated is much more serious than the one that really applies to President Trump, 18 U.S.A. Section 2071, which they'd like to apply to Trump.
But the Presidential Records Act really preempts any of the other laws.
I mean, it sets out the procedure for the president.
No president has ever been prosecuted under 21 U.S.C. 2071.
It applies to government employees like the vice president, like me, or Cash, when we were government employees.
Ha! And it's the one that carries disqualification from public office.
So should you convict him of concealing, I'm reading it now, removing or destroying any classified document, concealing or removing, he'll be fined under the title, he'll get three years in prison, and he'll never be able to hold a public office in the United States.
He'll also have to forfeit the one that he owed.
It would be the nature of an impeachment if he were convicted under that.
unidentified
|
So this is a very serious- I'm going to talk about special counsel.
There's a real question that applies to the president.
Because of the special act that was passed, the Presidential Records Act, most scholars believe that applies to the president and has preempted this.
And that's why no president's ever been prosecuted under this.
Several have been investigated, including Reagan and Clinton and Bush.
Almost everyone, actually.
This problem comes up a lot.
But this statute is meant for a vice president, not a president.
Under the Presidential Records Act, there is no criminal penalty.
And really that makes sense because it's so hard.
The president can declassify.
The vice president can.
Hang on a second because I want to get us up to date now because you've been like a prophet in the wilderness.
Rudy's been laying out things you're going to see that's all true.
And they said, oh, it's just Rudy being Rudy.
So in 16, while they're still in office, Trump has not even won the primary yet.
In 16, Carmella has this meeting with the four prosecutors.
They think they're there for a totally different topic.
And he then lets them know what they're there for.
We need to find dirt. They're shocked.
But then later, in 19—I think it was in January or February 19— I think you went on John Solomon's show.
You guys actually started talking about this nine months before the impeachment.
The entire impeachment Was driven off a perfect phone call and a whistleblower that shifty shift in them never...
By the way, that would be shifty shift in Swalwell who are no longer going to be in the intel committee because they're not going to have security clearances, right? They've been thrown off these committees, shifty shift in Swalwell.
But nine months beforehand, you laid out...
You identified all those guys and the mainstream media melted down.
Tell us what you told people in January, February of 19, nine months before...
They concocted this thing off the Zelensky phone call, Rudy Giuliani.
Well, I mean, first of all, I have to credit some sources in Ukraine for this as well, because they were picking this.
The reality is that once the Russian collusion hoax ran out of steam, which it should have almost on day one, I mean, they got a lot out of that.
They had to come up with something else.
They virtually just projected the conversation that Biden had with Poroshenko in which he bribed him and said, you don't get your billion unless you get rid of the prosecutor, not only to drop the case on Hunter, but to drop the case on the owner of the company who's worth $40 billion and was paying Joe the money through Hunter.
Money in an offshore account, and the FBI has never gone to interview the woman who has offered to show them the offshore account.
In fact, even though she was under danger of death, they haven't offered her protection, which is astounding, astounding as to how much you must be involved in this for the FBI. I mean, this is a massive government scandal unlike any we've ever seen before.
It's just going to keep opening up.
unidentified
|
Why do you say that? | |
Why do you say that? Because one thing is going to lead to another.
If this woman is brought over here, and if, God willing, she's still alive because Barr dealt with her in such an irresponsible way, she could be dead. She can identify, she claims, and so do several prosecutors in Ukraine, a few American politicians who also benefited from the corruption of Ukraine.
Despite the war and the horrible things that have happened and the sympathy you might have for the Ukrainian people, it's still one of the most corrupt countries in the world.
The people running it are massive.
All of them. | ||
Everything given to them.
It's impossible that that money we've given them, they haven't taken some of it, even though a war is going on.
It would be not in their nature.
Some of it? Some of it? | ||
I can tell you they usually take this one ridiculously high.
Rudy, before we go, I've got to ask you that compartmented top secret is as hot as it gets.
You've got to read this stuff in the skiff.
You can't come out of highly secured location, even to pull it out and read it.
Why would Biden have these documents?
There's no coincidences.
Why is the first one even the media is telling us?
They're compartmented documents, top secret, on Ukraine.
Why would you do that? | ||
Why would you pull Ukraine highly compartmented intelligence, which is normally sources, methods, how they get this information, sir?
At a time the New York Times was revealing his son's role in Burisma.
And saying he had been hired by this major crook in Ukraine, unbeknownst to the Obama administration, so he may want to get some documents about that.
Also, when they were shaking down China for money, he might have wanted some documents about that.
He was writing a book. | ||
Obviously, Joe doesn't write.
He has to give it to somebody else.
He's probably getting the documents to help with that.
There are a number of reasons.
Professor Turley has an excellent article today.
I think it's in the Post in which he outlines the four or five reasons that would constitute terrific circumstantial evidence at trial of intent.
Reasons having to do with making money, which I think is what the Bidens are all about.
They were in the business Their commodity was Joe Biden's office, and they sold it for millions of dollars.
Rudy Giuliani has been on this thing for four or five years, and he's been right about everything.
Everything. Called shots after called shots after called shots.
This is only going to get...
Now this is front burner.
Hear it now, ladies and gentlemen.
This is going to preclude Joe Biden running for re-election because it's going to get so nasty and so ugly.
Rudy, I know you're going to be doing your podcast and your radio show, your podcast where you go in-depth.
How do people get to all your content?
Because now more than ever, we're going to have to follow the mayor.
RudyGiulianiCS.com. You can get everything there.
When I do this, the reason I've been right is I put out documents.
I don't just say this. | ||
When I came to you with the hard drive, I didn't come to you just talk.
I came to you with a document, right?
The gigantic hard drive.
You had the receipts. | ||
Oh brother, did you have the receipts?
Rudy, you're a national treasure.
You are. You've saved this country so many times.
You are. And one system for all of us.
Rudy, thank you very much for being here.
America's mayor. Thank you.
God bless you. This is going to be a massive scandal.
And this is also going to fold into many of the investigations going on.
I'll bring Cortez in a moment.
Janet Yellen, I think, surprisingly, I think they're talking about her sticking around now as Treasury Secretary.
I think I understand why.
It's not her just wonderful performance.
It's probably the worst Secretary of Treasury in the history of the nation.
Comer's looking for the bank records.
Comer's coming for the activity reports.
Got to go to Treasury to get them.
The Bidens might want a friend there.
All next in the war room.

We've got stuff there. We've also got the breaking news on this FDA, the suppression of information about the vaccine, about the booster. So I've got Malone and Naomi Wolf.
Big breaking news, huge breaking news this afternoon.
Harmeet Dillon. Has been endorsed by Bernie Marcus.
Bernie Marcus is the most respected of all the donors in the Trump movement.
He has done more for President Trump than anybody.
He is a mensch and a great man.
This is very powerful. | ||
Bernie has given a lot of money to the RNC over the years.
He's come out and very specifically endorsed Harmeet Dillon.
So we're going to get to that tomorrow. We had Harmeet on today.
We'll get it back on tomorrow. But Bernie Marcus.
That may be a game changer.
Bernie Marcus, it's like a papal bull.
When Bernie Marcus puts something down, this would change the whole 16 campaigns.
Bernie Marcus came and supported President Trump, and that was able to give us the jet fuel that got us through those last hundred days.
Bernie Marcus, just an incredibly patriotic American, endorsing Harmeet Dillon for the head of the RNC today as one of the most significant donors to the conservative movement, Republican Party candidates, all of it.

Do it on a Giza sheet from MyPillow, as low as $29.99.
Get there today. MyPillow.com, promo code WARROOM. I'll tell you what, Steve, real quickly, Janet Yellen just announced Politico, bro.
Janet Yellen has been getting pounded.
The recession is coming on.
She's tired. She's a little older.
She's on – and there's no coincidences.
They announced – and you and I are looking at each other like, how did – Did she get re-upped?
And why would she want to be re-upped?
And today, Comer says he sent the notifications to Treasury.
He wants all the suspicious activity reports on everything related to the Biden crime family.
And he wants public hearings, I think, the 1st of February.
She's Secretary of Treasury.
She can block it. Janet Yellen, they can't have a confirmation.
You agree, Cortez, they couldn't have a confirmation hearing now?
No, 100 percent. | ||
Look, that's the reality, is they need a friend, an ally, a dependable Tony, and that's what Yellen will be for them, unfortunately, in Treasury, to try to obfuscate and to try to frustrate the efforts of Comer and the House Republicans to get the records that they need, that the American people deserve, because she's clearly not being kept around because of her effectiveness, OK? I don't think it's an exaggeration at all to say she is the worst Secretary of Treasury in the history of that office,
that very august office, right, which was started by Alexander Hamilton.
And over the decades and centuries of this country has really had some amazing men who helped to build the greatest economy in the history of the world.
She is the exact opposite of all of that.
She is somebody who has continually failed upward into really significant positions.
Where she does nothing but harm the American economy and most of all in this job as Secretary of the Treasury.
So it's clear to me that they need a political lackey in that position and that they pressured her, persuaded her somehow to stick around so that she can fulfill that role.
Let's play Steve Cortez's I want to talk about the situation in Chicago.
We've got a couple minutes. Let's play the cold open.
Given Joe Biden's border crisis, we Americans need to decide, are we going to prioritize our own citizens or illegal migrants?
Well, in the city of Chicago on the south side, which is largely black with significant poverty, citizen protests have erupted against Mayor Lori Lightfoot, who is paying for room and board for illegal migrants in struggling neighborhoods of the city instead of addressing the systemic problems that plague the Windy City.
Let's look at some of those problems in a chalk talk by the numbers.
From NYU School of Medicine, Chicago has the widest life expectancy gap in America.
In Streeterville, on the north side near Michigan Avenue, wealthy neighborhood of high-rises, average life expectancy gap.
90 years old. | ||
Just a few miles away on the south side.
Mostly black Englewood.
Only 60 years old. | ||
A 30 year gap in age. | ||
Only miles apart. | ||
This is a third world reality.
Patriots. We need to fix our own problems.
Prioritize American citizens before we worry about economic migrants from the rest of the world.
unidentified
|
Because I am concerned.
I live here. | ||
And we need to know what the plan is.
Woodlawn neighbors demanding answers from the city after they say a decision to shelter migrants in an old school was underhanded and unfair.
And now there are just hours until that first group of asylum seekers could move in.
Casey Cronus has the story.
Residents say they were blindsided by the announcement and feel there are other community issues that should be addressed first.
Steve Cortez, this is a crime against the good citizens of Chicago.
I just wish they would awaken to the fact that you got to vote this out, Cortez.
Right, 100%. But listen, but at least they're awakening now because they realize that within their neighborhood, very troubled, struggling neighborhood, and amidst the economic anxiety which dominates so much of their lives right now, Lori Lightfoot, the mayor of Chicago, the city of Chicago, is paying for room and board for illegal migrants—and I don't mean just a few, by the way. I'm talking about thousands—to be placed in their very neighborhood.
I mean, talk about a lack of priorities.
And so, thankfully, there is an awakening there.
There was a significant protest today.
I'm pleasantly surprised that it got local media coverage in Chicago.
And a lot of citizens, most of them Black Americans, are saying, wait a second.
Why are we prioritizing foreigners, economic migrants, who are coming to this country under the guise of being asylum seekers, who are abusing the generosity of the United States, and are being prioritized before American citizens, many of whom are struggling?
That story, of course, is hardly unique to Chicago.
Chicago might be the worst example of it, because there's so much deprivation in the city of Chicago.
But it's happening all over the United States.
We, as a people, have to decide What is our priority?
Does immigration exist to serve the interests of American citizens?
I mean, legal immigration, of course.
Illegal immigration should be an impossibility.
But quite the opposite is unfolding in our streets.
And thankfully, there's pushback in places like the South Side of Chicago.
Now, Steve, there's no MAGA rallies going on there, at least yet, okay?
Those people wouldn't call themselves deplorables.
They probably don't watch War Room.
Yet. But once again, when you put it in their faces and when you put illegal migrants and treat them better than American citizens are being treated in their very own neighborhoods, they're going to speak up. And you lied to them and covered up real quickly.
How did they get to you on social media, all your great content?
Please find me on the Twitter.
I'm at Cortez Steve, Cortez with an S. The next hour, Dr. Malone, Naomi Wolf, exactly what did the FDA do to suppress the information about the booster? |
