Enacted during the height of the pandemic, it allows border officials to deny asylum seekers entry into the United States due to public health concerns. | ||
It was set to expire last Wednesday before Chief Justice John Roberts issued a stay on the expiration pending a final decision. | ||
The Biden administration has asked Chief Justice Roberts to rule against the challenge issued by GOP-led states to keep Title 42 in place, arguing the public health rationale is no longer valid. | ||
Meanwhile, the developing situation at the border is being described by some as a crisis, with multiple border towns and cities overwhelmed by the influx of migrants. | ||
In El Paso, Texas alone, as many as 5,000 migrants per day are anticipated to enter. | ||
Title 42 put in place by the Trump administration during the height of the pandemic. | ||
The Biden White House does want it to end, but not quite yet. | ||
There's a suggestion they weren't ready. | ||
They pushed for this stay, which we'll get an answer potentially as soon as today for its future. | ||
Senior White House aides acknowledged to me That it's going to be very difficult at the border for at least a few weeks after this lifts. | ||
When you look at these images from El Paso, what does it make you think? | ||

You know, there's the moral side, moral and ethical side of this, and there's the political side of this. | |
The political side is pretty easy. | ||
The White House needs to message this issue better. | ||
particularly with regards to Latino community, Latino voters. | ||
If they don't get this right, it's going to have a political impact, I think, in interesting and serious ways. | ||
Morally and ethically, we have to get this issue right. | ||
I mean, remember the coal street? I mean, there was a coal spell in El Paso. | ||
These folks were experiencing extraordinarily difficult weather and then there is a sense in which our immigration policy oftentimes feels so cruel because it's so patchwork. | ||

Tonight could be the night when the Supreme Court, and I think they just, it's not that Biden's not ready. | ||

They're just processing illegal aliens into the country because they want their votes. | ||

I think Roberts just wanted to get through Christmas. | ||

The December 21 date was, you know, offered by the Biden administration. | ||
Nobody knows why they picked four days before Christmas where thousands of contractors and federal workers would have to work double time. | ||

So I do think that this thing was all sort of like mish-moshed legally to push it past the holidays. | ||
So, uh, I do believe 42 is going to go away, uh, if not tonight or tomorrow, but you know, very soon it's going to go away. | ||
But in any case, the new numbers are out, uh, border apprehensions and they were title 42-ing the lowest number ever since Trump put it in. | ||
At 31% of people that cross the border, they've been reducing and reducing and reducing the number anyway. | ||
So it's down to a rump title 42 as it is. | ||
When that finally goes away, spigots will all be on wide open. | ||
And just like you said, Stephen is, you know, the system is in place to bring everybody in and make sure they all get to a city near you, to your city. | ||
That'll be happening right, it's already happening right now. | ||
What's, as we see the, as we see the, by the way, the video there on the screen right now you can see is absolutely horrendous. | ||
What's happening in El Paso right now shows you, because Title 42 has essentially been That bandage has been ripped off the wound down in El Paso, correct? | ||
We're seeing orders. | ||
You've got to understand something. | ||
And this is for all the big talk of Abbott and the guys in Texas. | ||
They're just walking in. | ||
You know, we built the wall. | ||
Our wall went all the way from the Rio Grande Right, where the Rio Grande stops being the border, all the way where it goes in the, you know, it's 2,000 miles to the Pacific Ocean. | ||
That first mile, or two-thirds of a mile, whatever, is straight up that mountain. | ||
We built the wall. | ||
We built that wall right there. | ||
They said it couldn't be built. | ||
Army Corps of Engineers. | ||
We built it to stop the cartels. | ||
There's a fence down at the bottom that literally gets you to the Rio Grande River. | ||
Okay? | ||
They've taken the gate, and they've, and this is the officials. | ||
The Biden officials have actually put a big chain and opened the gate and chained the gate. | ||
So the wall still works somewhat from the cartel smuggling the kids in up top, but the rest of it just coming in where they've opened and they've chained it open so you can't close it. | ||
This is how thought through it is. | ||
But Title 42 is essentially gone in El Paso. | ||
Am I correct when I see these images? | ||

The people who previously were subject to Title 42 in Juarez, that would be the Hondurans, the Salvadorans, the Guatemalans, typically, those people now are just coming over anyway. | ||
And those are the ones we're seeing on the streets and the buses, completely illegal. | ||
They haven't been processed, most of them yet. | ||
They still have their shoelaces. | ||
That's how you can tell that they haven't been processed. | ||
Uh, so those people have just said screw title 42, whether it's in place or not deal with us. | ||
Uh, but what you're not seeing is a crisis of runners in that, in that sector. | ||
Uh, just in the last three weeks alone, I have, uh, sources down there telling me that, uh, that they estimate 30,000 runners in the last three weeks. | ||
Uh, further down the line, they're cutting through the fence, uh, the older fence, the Bush era fence. | ||
Because there are no Border Patrol agents anywhere to be found. | ||
They're all gone processing. | ||
So you can see by helicopter and by Texas DPS, you can see them just pouring through these holes that they cut in the old fence, just pouring through and running through a bonsai, rushing. | ||
It's truly catastrophic in the El Paso sector, but we're starting to hear very similar stories in Tijuana. | ||
Uh, over across from California and in other places too. | ||
And so you're going to start to see more of, of just this kind of crazy bonsai rush in the next couple of days here. | ||
And then it's just on, the spigots will be on. | ||
To let people know this is not, um, Steve Bannon lighting his hair on fire, the boardroom audience, you know, running around, uh, the Biden administration, uh, he can't make this up. | ||
On Friday night, the night before the Christmas weekend, on the eve of Christmas Eve, we had a Friday night dump late. | ||
What did they do on Friday night, Todd Bensman? | ||
And this shows you how purely evil they are and how afraid of these numbers they are for the American people to actually understand what's going on. | ||
What did they do on Friday night, sir? | ||
First of all, the monthly release of apprehension data happens on the 15th. | ||
That's just the day that they've been doing it for two years. | ||
Uh, except for two times, they delayed it. | ||
Uh, the first time was past the midterm election balloting. | ||
They didn't want those out then, so they pushed it to until it was over and then they, they released, uh, the, you know, the numbers. | ||
And then, uh, here they pushed it right to Christmas Eve, uh, on purpose. | ||
This is classic, you know, public relations stunt, uh, kind of stuff. | ||
Uh, you know, send bad news out just before the big weekend, the big holiday weekend, save it for that. | ||
So they did that. | ||
And there's a good reason. | ||
It's because the numbers were again, 206,000 apprehensions, uh, at the border. | ||
Uh, the numbers are like 412,000 for just the first, the last two months, October and November. | ||
That number is greater than entire years. | ||
past, going all the way back to like 2000. | ||
That's how big those numbers are, so of course they're gonna, you know, put it out there at a time when nobody's watching. | ||
And give me that one more time. | ||
October and November. | ||
Remember folks, also, November had the greatest budget deficit In the history of this country, $250 billion with imploding tax revenues, $250 billion. | ||
In that month, in October, November, what was the total number and compared to other years? | ||
How does it compare? | ||
Well, just those two months alone exceeds the total annual apprehension numbers You know, for 2011, 2012, 2013, 2004, you know, that's a, you know, more than we typically have in an annual, in a bad year that we used to consider bad, uh, coming through just in like two months and you ain't seen nothing yet. | ||
Uh, and also, you know, I'm not counting the gotaways. | ||
You have to tack on another 150,000 gotaways on those two months. | ||
We're looking at 70,000 gotaways. | ||
In each of those months that we know of. | ||
Remember, I told you we just in the last three weeks have had 30,000 in the El Paso sector alone in three weeks. | ||
Just do some math for me. | ||
Of the 400,000 that came across, right, and had a touch, how many of the 400,000 were released into this country, sir, approximately? | ||
Approximately 70% of them. | ||
You have to say it's about 70% of those people. | ||
Let's say 300,000 of that and 150,000 gotaways got away. | ||
That's almost 500,000 roughly, and I'm rounding up a tad, 500,000 illegal aliens in the country. | ||
got away, he's got away, that's four, almost 500,000, roughly, and I'm rounding up a tad, 500,000 illegal aliens in the country. About 300,000 with cell phones and food stamp cards and all that, and processed into a city near you. And the other 150,000 just in and wandering around, right? | ||
Yeah, or they're in Mexico just waiting. | ||
There are thousands and thousands. | ||
Every shelter on the Mexican border is filled right now. | ||
With people waiting. | ||
Actually, they're going to wait. | ||
Some of people are going to wait for Title 42 to disappear. | ||
Of that 450,000, though, that we figure, what percentage of that would be unaccompanied minors? | ||
Roughly 10%? | ||
Is it 10% or is it more? | ||

I mean, they don't necessarily have to be unaccompanied anymore. | ||
The unaccompanied minor crisis was from a time when The administration was still doing about 60% Title 42, and the other 40% were accompanied minors, but now it kind of doesn't matter. | ||

Peter, I fully believe that the border is going to be one of the issues of the 2024 election. | ||
There's no two ways about it, because the contrast, again, is so clear. | ||

What does that tell you? | ||
That President Trump, for the first time in a long time in our history, actually secured our border, actually wanted to protect our country, and that Biden and his team are doing the opposite. | ||

There's no other explanation for destroying any protection of the border whatsoever. | ||
So I think the border, the economy, and election integrity are going to be the top three issues. | ||

We need more immigration, more illegal immigration at the southern border, because it's the low-skill folks in the country that are really driving the price of a McDonald's up another ten cents. | ||

Back when I asked Chip, one of the reasons I'm banned from Twitter is my comments on Chris Wright, that you needed what was called a church commission like they had in the 70s because of the assassination of Kennedy, everything that was going on throughout the war with the FBI and the CIA, and also because of the intelligence failures of Vietnam. | ||
We've got to be blunt. | ||
Just the basic intelligence failures in Vietnam. | ||
And I'm not talking about the paramilitary CIA who fought so bravely. | ||
I'm talking about the basic central core of the apparatus got so many things wrong even then. | ||
And they were, FBI and CIA were out of control. | ||
So the church commissioner, I was very quickly seconded by Darren Beattie of Revolver. | ||
And people looked at Darren as one of the smartest guys in our movement. | ||
And we both advocated for a long time, you need a church commissioner. | ||
Well, in today's, I've got it up as one of the lead stories of my getter. | ||
The lead story in The Hill talks about time running out for McCarthy. | ||
And you have to understand, there's a couple of huge things going on here. | ||
One is this fight for the speakership. | ||
The other is the fight for the head of the RNC. | ||
The other is, quite frankly, already about the debt ceiling. | ||
Because they understand we have the absolute leverage with the death sentence. | ||
So three massive things that are being fought over non-stop. | ||
In this article it mentions that McCarthy may have already agreed to a church commission to specifically investigate the FBI and the CIA in broad public hearings, some classified but some unclassified, to get to the bottom of the whole, this rogue element, deep state of the administrative state. | ||
And that Chip Roy, the great Chip Roy, would actually be the head of it. | ||
Also, over the weekend, your boy Elon Musk, I had to go up, I call him the Gimp, right? | ||
Because he's putting out tweets, he says, oh, there's a couple of bad people in the FBI. | ||

Well, first of all, I'm so pleased to hear that, you know, you've been calling for it, I've been calling for it, a church-style committee to conduct a full, thorough, and public Um, review, investigation, and expose of the abuses within the intelligence community. | ||
It's absolutely long overdue. | ||
And now, you know, we're hearing Kevin McCarthy is paying, if not paying lip service, maybe even stronger than lip service, which is great. | ||
Even if it's McCarthy, if he goes in the right direction, I'd say that's great. | ||
And Chip Roy would be an excellent candidate for that. | ||
We're hearing, uh, David Sachs, uh, who's, Played a role in this sort of new Twitter, also vocalized the need for a church committee, and the individual that you call Elon Musk, actually, for what it's worth, seconded the need for something like that. | ||
And so maybe if we actually do have a real church-style hearing, Elon can update his ridiculous understanding that, oh, there are only a few bad apples in the FBI. | ||
Unfortunately, I mean, I think a lot of people want to believe that, but I think deep down in our bones, even Elon... But I need you to explain this to people, because Sax is a brilliant guy, clearly. | ||
There are very, very good people At the FBI, many of them, the rank and file, just like there's the CIA. | ||
That's not what we're talking about. | ||
We're talking about there's a, we have a major systemic problem. | ||
And the problem is, is these now have become, they are so much out of control on the domestic side that would make the people back in the 1970s heads blow up. | ||
Right? | ||
I mean, there are so much, go ahead, go ahead. | ||
There are a lot of things to be said for this. | ||
Yes. | ||
You know, there are, There are good ones, you know, as Trump famously said in another context, some, I assume, are good people. | ||
And that applies to the intelligence community as well. | ||
But the rot is indeed systemic. | ||
And, you know, one of the reasons, you know, I have faith that there are some good people in there too, which is why I've been calling for the RNC to actually put up some money for a whistleblowers fund to provide support and encouragement for the good people actually within these agencies to come out and help to expose the rot. | ||
I guess the RNC would rather spend the money on yoga pants and other things, but maybe they'll take me up on this suggestion at some point. | ||
You're absolutely right. | ||
There are some questions, though. | ||
If we're going to do a church-style committee, we have to understand the committee for what it was historically, what made it effective to the degree to which it is effective, to extent those circumstances apply today. | ||
Just to give you a quick example, and actually Revolver News is doing an extensive study on the church committee and lessons that we can learn for a new version, but just to give some points in relation to that. | ||
So the church committee exposed all of these wrongdoings on the part of the intelligence community. | ||
And partly as a result of that expose, so much of the dark stuff that used to be in-house within these agencies was sort of outsourced to these cut-out organizations and NGOs and so forth. | ||
And so, in the updated version of the Church Committee, we need to have a comprehensive approach that actually encompasses the intelligence community's workarounds that they've implemented since the last church committee that understands that a lot of the dirty stuff is still happening in-house, but so much more of it is now outsourced to these NGOs and cut-out institutions and these sort of disinformation | ||
organizations that are effectively government-run but formally have some kind of distance, so they couldn't be targeted directly in the same way that the intel community was in the church committee. | ||
