How do you feel about the FBI's search of Mar-a-Lago? | |
From what you understand so far, from what Merrick Garland said yesterday, do you think it's justified? | ||
Well, you know, I'm going to do something that too many of my colleagues are not doing, which is I'm going to wait for a single fact to come out on why they decided to do what they did. | ||
But two things are very clear, even though my Republican colleagues are trying to muddy the waters here. | ||
Number one, the President is not above the law. | ||
If the President broke the law, or if he retained classified documents that are out there creating a vulnerability to the national security of the United States, The FBI will have done the right thing. | ||
You don't get exempted from, you know, legal process just because you're a big shot in this country. | ||
We're all equal before the law. | ||
But what we need to do right now is to wait for the facts to come out. | ||
Why a United States senator or why the Republican leader of the House Republicans would jump to the conclusion that this was unfairly done? | ||
There's only one answer to that question, Katie, which is that you're trying, once again, to lick the boots of Donald Trump. | ||
And in this case, I get pretty animated about it because people will die if they keep whipping up and encouraging violence. | ||
And in fact, somebody did die. | ||
A 42 year old gave up his life yesterday because he was motivated by lies, told by people who know that they are lying. | ||

2018 and just six weeks ago magistrate judge Bruce Reinhart recused from President Trump's lawsuit against Hillary Clinton So if he had a conflict six weeks ago, what the hell changed in the last six weeks to sign off on this Merrick Garland? | ||
unprecedented illegal raid of a former president in his offices so there's there is an obvious constitutional problem where there was a Biased judge signing off on this this unprecedented home rate. That's the first legal problem The second legal problem is this is that President Trump was the president of the United States? | ||
He was the commander-in-chief and the Supreme Court has made very clear including Back in 1987, in a case called Department of the Navy versus Egan, that the president has inherent power as the president, as the commander in chief, to classify and declassify anything he wants in any manner he wants, regardless of any statute or regulation. | ||
So it could never be an espionage act violation or a regulation violation for President Trump to declassify any record he wants and he can do it in any way he wants by sending These records out of the White House tomorrow. Given where we are, how do we go forward? | ||
We talked about, Steve, the presidents have inherent constitutional and statutory authority to classify and declassify anything they want. | ||
They can do it any way they want to do it. | ||
President Trump doesn't need to label it. | ||
He doesn't need to report it. | ||
He doesn't need to tell anyone. | ||
He can do it. | ||
Through his actions you can wave a magic wand and that is the law. | ||
It's very clear from this 1987 Supreme Court case Department of Navy versus versus Egan that these statutes that these regulations the Espionage Act any other statute or regulation that deals with classified materials does not apply Apply to the President of the United States. | ||
It applies to everyone else except for the President of the United States because the President of the United States is the Commander-in-Chief and he has the inherent authority regardless of the statute. | ||
We saw this in 2012 when President Barack Obama leaned over with a hot mic with the Russian President, our enemy, and said that Obama would have more flexibility to deal with him after the 2020 presidential election. | ||
That is highly classified The most classified information you can give to an enemy, and no one called for President Obama's prosecution under the Espionage Act because they can't. | ||
He's the President of the United States, so even though it's classified, he has the ability to declassify it, right? | ||
And as a matter of law, President Trump, no president, can be charged with... But Mike, here's what I don't understand. | ||
They're bad guys? | ||
But they're not dumb lawyers, and they got a ton of them over there. | ||
If what you're saying is fact and law, what did Ray, what did Murano, the number two at DOJ, that evil one, and Merrick Garland think? | ||
I'm sure Ron Klain, the chief of staff, asked a couple of questions, and the magistrate. | ||
It's so blatantly obvious the way you lay it out. | ||
Why did they not know that, or they thought they could just power through this? | ||
I think that they, I guarantee you that Attorney General Merrick Garland did not go to the Office of Legal Counsel, OLC, the executive branches, general counsel, and get an opinion on this because the Office of Legal Counsel would have opined exactly what I just said, that the president has inherent constitutional authority to classify Anything for any reason, any time, no matter what the statutes and the regulations say. | ||
So he didn't go get this opinion before he went to his hand-picked, Trump-deranged judge, magistrate judge, Bruce Reiner, down in Palm Beach to get this unprecedented, unnecessary, and unlawful warrant. | ||
And the question that needs to be asked is, why didn't Attorney General Merrick Garland go to OLC? | ||
Why didn't he get an opinion on this before he did something Of this magnitude, this unprecedented home raid of a former president over a document dispute. | ||
Because at the end of the day, these are not classified records. | ||
At the end of the day, this is a document dispute over the Presidential Records Act between the office of the former president with his staff, with his secure facilities, and then the bureaucrats of the National Archives. | ||
This is not a crime. | ||
The Biden Justice Department, Attorney General Merrick Garland are trying to cook this up This non-crime into a crime so they can go after Trump and try to take him out. | ||
If you were advising the senior Republicans right now, what would you have them demand that they see as far as background, paperwork, OLC opinions, people to come forward to testify, which should happen immediately? | ||
What would you recommend they see? | ||
Well, I mean, I would send letters. | ||
The problem is, is we have to wait till January until the Republicans take over the House and likely the Senate. | ||
And then we need to set up a select committee on this like they've done with the January 6th commission. | ||
And then we don't have to worry about executive privilege and 250 years of norms in this country because we have this select commission like the January 6th. | ||
that have set all these precedents. We can get all these OLC opinions. We can get this grand jury material, all norms are out the door. We can get this just like the Trump deranged Democrats and Cheney and Kinzinger on the January 6th commission have done. So they've made their bet here and now Republicans need to earn power and you learn how to use that power. | ||
In your professional opinion, is this impeachable for Merrick Garland and Chris Wray? | ||
absolutely 100% impeachable. | ||
This is part of a dangerous pattern over the last 18 months where they have disregarded the law, disregarded all norms to go after Trump, whether it's President Trump himself, as we're seeing now, whether it's his senior advisors, where they've eviscerated 250 years of constitutional executive privilege to go after the White House Chief of Staff, Mark Meadows, to go after you as a senior advisor to President Trump, to go after Peter Navarro as the trade director | ||
to President Trump, to go after Pat Cipollone as the counsel to President Trump. | ||
They've actually, and then they've used, they politicized the Justice Department to weaponize it to go after every Trump supporter. | ||
They're trying to, they tried to lump together everyone on January 6th. | ||
Between the one, the lumping together every grandma and goofball who were, who were there versus people who are trespassing versus people who are violent. | ||
