Let's dive right into the breaking news in a potentially groundbreaking shift in American constitutional law.
The Supreme Court appears poised to strike down the landmark Roe v. Wade decision.
According to a leaked draft opinion published last night by Politico, a majority of the Supreme Court is prepared To overturn the right to abortion, the leak of the 98-page document is unprecedented in the court's modern history.
The draft opinion was reportedly authored by Justice Samuel Alito and circulated in February.
Alito writes in part this, Roe was egregiously wrong from the start.
Its reasoning was exceptionally weak and the decision has had damaging consequences.
It is time to heed the Constitution and return the issue of abortion to the people's elected representatives.
NBC News has not obtained or been able to independently verify the authenticity of the document, and the Supreme Court has declined to comment.
The final opinion is expected in late June or early July.
Joe, so many different moving parts here, but overall, what does this story mean for the Supreme Court?

I mean, for the Supreme Court, in a word, illegitimacy.
You know, the Court's always been guided by the law, but it's also been keenly aware that as the only unelected branch of American government, they needed to not appear to be openly contemptuous of public opinion.
That would be especially true today, given the GOP's might-makes-right approach to the sacking of Merrick Garland's nomination or the elevation of Donald Trump's final pick.
One more thing.
Look at this picture, Mika, from Madeleine Albright's funeral.
The five Democratic politicians on the front row won the most votes in the presidential elections of 1992, 1996, 2000, 2008, 2012, 2016, and 2020.
And yet, a half century of constitutional rights supported by over 70% of Americans.
Let me underline that again because people lying to you on other channels will never say this.
Over 70% of Americans support that constitutional right.
Don't be swept away.
Well, the president's not in this picture.
The presidents who were outvoted in each one of those elections over the last three decades.
Now, Americans will rightly conclude that their voices and their votes no longer matter.
So what are the implications for the court?
For the law and for American democracy.
Let's bring in historian John Meacham and also former acting U.S.
Solicitor General Neil Cotillard.
John, let me begin with you.
And as Kissinger said, I think, during Vietnam, perception is reality.
Obviously, the perception for 70 percent of Americans waking up this morning.
Is going to be most likely that this is an illegitimate decision by an illegitimate court.

Well, the crisis of trust in institutions has just become universal in a way that is pretty much the nightmare scenario if you believe in the ultimate efficacy of the constitutional order to produce a more perfect union, right?
To protect the Jeffersonian assertion of equality, to protect the rule of law for all of its imperfections, the system has been worth defending.
For 250 years.
Right now, if this draft decision, if the court were to go this far, you will have, as you were just saying, an extraordinary number of Americans believing that the system in fact cannot, is not capable of delivering justice, is not capable of reflecting the popular will even through the constitutional prism.
And I think that You know, one of the great questions of the era, the great question of the era is, are you and I, are we in this decade, are we up to democracy?
Are we commensurate to the task?
And I'm worried that we're entering the darkest period of that test, because if you have any reservations about the system's capacity to deliver justice, they have just been affirmed.

But as Joe points out, poll after poll shows this is about a 30% position that the Supreme Court has taken.
It doesn't obviously operate on polls, it operates on whether or not they believe this Roe vs. Wade should be upheld, whether it's legal.
You've slept on this, you've read through most of the opinion, or the draft opinion.
What is your first blush reaction, first to the substance of it, and second to this leak?

Honestly, I want to cry.
You know, I want to cry in so many different ways, but just to start with the substance of this decision, this is as full-throated and muscular a decision as could ever be envisioned.
And yes, after the oral argument, I think we all predicted Roe v. Wade was on thin ice.
I think many thought it would be another year.
I mean, for the last three years, I've been saying, given once Justice Barrett got on the court, Roe's days are numbered.
But to see it in print, obviously it's only a draft opinion, but it sure looks like a real opinion.
I mean, this is hard.
This is not, it doesn't look like it's a deep fake or anything like that.
He uses all of Justice Alito's kind of signature moves.
And so it really does feel legitimate.
And what it means, just on abortion first, is that states can now pass laws with no rape or incest exception whatsoever prohibiting abortion.
And those are now constitutional.
The Supreme Court will not stand in their way.
Congress can pass such a law outlawing abortion in the 50 states.
The Supreme Court will not stand in its way.
So that's on abortion.
And then the reasoning of this decision.
Is so, as I say, muscular, it could reach other rights as well, including the right of marriage equality, which is just recognized by the Supreme Court a few years ago.
I mean, this is an opinion that Robert Bork would have written.
This is not an opinion that most justices who have lived in our lifetimes would have written.
And Robert Bork, of course, was rejected for the court because of these views.

Yes, last night, 2 May, is going to go down from people in politics of where you were when you first heard the leak.

Yeah, Steve, it's a carnival atmosphere here at the Supreme Court.
It was a little slow going a few hours ago, but now those competing protesters that you hear... Anthony, why don't you swing over and show us what they're doing over here.
We've got the pro and anti-abortion protesters are sort of going at each other.
You know, we're just sort of waiting to see how big this thing gets.
I haven't seen any lawmakers around or any prominent leaders, but right now it's like it's almost spontaneous.
People just showing up to say, hey, what's going on?
It's really kind of a shock, like you were saying.
I mean, I saw the headline last night, and I couldn't believe it.
It's been almost 50 years that this decision has put this curse on our country, and it's really remarkable if the Supreme Court actually goes through with it, Steve.

Neil, last night they only had about 500 to 1,000 total outside, but it did get violent after a while.
As the two competing groups became personal.
What's the sense of the crowd right now?
Are they just protesting and doing the chanting like it normally happens?
Or do you think there's any possibility this thing could edge into some sort of violence?

Yeah, I haven't seen any black-clad Antifa yet.
Or, you know, I saw, say, the violence that we saw during Kavanaugh and Gorsuch.
And I would tell you that the violence we saw last night on the pro-abortion side, I think that's just out of sheer frustration because they have lost control of the narrative and they've lost control of the Supreme Court that they've literally controlled for probably 60 or 70 years, Steve.

Neil, there's discussion about there's bus, they're going to be busing in Planned Parenthood and other groups are getting revved up here, maybe even some of the right-to-life groups.
What are you hearing about additional protests that it would expand to the size of like the Kavanaugh protest?
Because right now it looks fairly small given what we've seen before in front of the court.
What are you hearing about other resources being put to this to bus people in this afternoon?

Well, I think the first thing, Steve, is that when the German media outlet Politico, when they leaked this last night, they weren't working or coordinating with other groups.
You and I have both seen these demonstrations of the Supreme Court, especially when the left is doing it, and they show up with the boxes of signs and posters, everything already delivered.
They have the buses lined up.
I haven't seen any of that yet.
And so, you know, they're fired up.
It's just that it takes them a while to get their troops here.
I am absolutely convinced that this crowd will continue to build because this is such a significant and almost traumatic decision that the Supreme Court is going to deliver if they go through with it, Steve.

Last night in the crowd, it was about two-thirds pro-abortion, about one-third pro-life.
Is the breakdown now 50-50?
Or as you just see it, rule of thumb, is it still two-thirds, one-third?

Yeah, I think right now you'd have to say that the anti-abortion side is really showing up.
I would say it's two-thirds pro-life and one-third pro-abortion.
There's one group here, they're basically Catholics for abortion.
They're really the only pro-abortion side that's here.
I haven't really seen any students for choice or Planned Parenthood yet.
It makes me wonder how the left is going to react to this.
You know, have they just given up the ghost?
I'm hoping that we see a fulsome and robust debate here.
You know?

Mike, I want to bring in the former Solicitor General of the United States there on Morning Joe.
The buried lead, I want everybody in this audience to understand this.
The very lead is full-throated in muscular decision.
So I said this on the John Frederick Radio Network earlier.
I need everybody in the War Room posse.
I need Captain Bannon and the team right here to get the political article up last night.
Everybody should read the political article because it's going to be historic.
Because they got this leak, but it clicks through to the 98-page decision.
Everybody in the audience, don't read articles about it, don't take Father Frank's word for it, or Mike Davis's, or Steve Bannon, Neil McCabe, anybody we're going to have on the Great Leisure, we're going to have a lot of people talking about this.
You need to read this, and you need to think about it, and you need to read it again.
It's one of the most important documents that have ever come out of the Supreme Court.
It's the first opinion ever to be leaked, and we're going to talk about the politics of that.
But the former Solicitor General, who said he cried all night, so he's not a fan of this, a full-throated and muscular decision.
Ladies and gentlemen, this was a power move.
I mean, and I want to bring in Father Frank and Mike.
Mike, you first, and I'll bring in Father Frank.
How unusual is it Of what happened last night as an institution to have this draft opinion, which is circulating among the other justice, leaked to the media, sir?

So I clerk for Justice Gorsuch.
I serve as the chief counsel for nominations on the Senate Judiciary Committee with oversight over the federal judiciary.
I have never heard of a draft opinion leaking from the Supreme Court ever.
This is probably the first time that this has happened, likely the first time this has happened.
This is a very dangerous precedent to set.
It's very dangerous to judicial independence.
It's very dangerous to the safety of judges, to these justices with this court pending on this monumental case.
You have a lot of radical people out there who have a lot on the line with the abortion industry.
You just, you cannot have opinions leak like this.
So the, the Supreme Court needs to get to the bottom of this.
The, there is a, there's an officer at the Supreme Court who's called the marshal of the Supreme Court and the marshal is responsible for all law enforcement, including running the, uh, the Supreme Court police force.
The Supreme Court actually has its own police force.
They need to get to the bottom of this immediately.
If they have to deputize federal agents to assist this internal investigation, so be it.
Uh, but they need to get to the bottom of this.
And if they find out if and when they find out who leaked this, they need to refer this to the Justice Department for obstruction of justice charges.

Uh, and by the way, real quickly, should Senate judiciary hold a hearing immediately about this and what happened here, sir?

I want to be careful on that, and the reason is that the Democrats control the Senate Judiciary Committee, and I think they're going to try to politicize this, right?

Okay, last night was a fracas outside the Supreme Court in the early morning hours.
It started right as soon as this was leaked to Politico.
And I want to thank, by the way, the authorities got up there and they surrounded the Supreme Court with fences put up, barricades were put up immediately.
So, good on the Capitol Police and others that were up there.
It didn't get as serious as it could have gotten, let's say that.
But both sides went at it, and I want to correct Neil McKay for a second.
It was that the right-to-life folks gave as good as they got.
Let's put it that way.
There was no backing down.
But this is serious, and you've got to be very careful.
And I think today, they've really got to make sure that both sides can protest to the heart's extent.
This is obviously an incredibly emotional issue, and people got the right to protest in this country.
So one of the, you know, the freedom of assembly is a basic right.
People have the right to do that.
They have a right to protest, but they ought to make sure people are up there to make sure this doesn't turn violent, which it very easily could, given the emotions.
Also, given the age, a lot of young people, last night were young people.
They're very emotional, and they're not holding back.
And that's both sides, so I don't want to pretend that the right-to-lifers are, like I said, they gave as good as they got last night.
I want to bring in Father Frank Pavone, a priest for life.
He's dedicated his life to this issue.
We've had him on for many times to talk about this full-throated and muscular decision.
Father Frank, you're probably the top expert in the Catholic Church about this.
Was that a full-throated and muscular decision that Justice Alito allegedly has drafted here, sir?
father frank pavone
It very much was, Steve.
I have it here, and it is really a great articulation of the arguments that were made to the court in this whole Dobbs case.
For example, he starts out by pointing out that Roe v. Wade's asserted right to an abortion is nowhere in the Constitution.
Now, the other side will say, well, there are a lot of rights that are not actually mentioned in the Constitution, but there's still constitutional rights.
Then Alito goes into the fact that in those cases they have to be rooted in the history and traditions of the country.
And he does a stellar job in this opinion, this draft, of going through the history.
From the colonial days, in fact he starts with the common law.
Over in England, the colonial days, the 19th century codification of common law norms, including the protection of the unborn.
And then he destroys the myth in Roe v. Wade that says, oh, these laws weren't passed to protect the unborn child.
They were passed because of Victorian views of sexuality.
And he says, no, court decisions and legislatures make it clear it was to protect the unborn child.
And then he says, where in the history Then he goes to the 14th Amendment and says, you know, the other side says, oh, this is a liberty interest in the 14th Amendment.
And he says, when the 14th Amendment was adopted, three-quarters of the states were protecting the unborn throughout pregnancy.
And abortion was nowhere considered some kind of constitutional right.
So he says, where in the history of the country?
Of its judicial decisions, of its laws, where is this so-called constitutional right to abortion?
And he says, nowhere.
There is zero, zero evidence of it.
So he starts by going right to the heart of Roe and showing how untethered it is from the Constitution.
Then he goes further.

I just want to tell you one thing.
This just doesn't overturn Roe.
Judge Alito, with his massive intellectual firepower, destroys Roe's, the concept of Roe, the legality of Roe, all of it root and branch.
Is that not correct, Father Proven?
father frank pavone
That is, that's exactly what I've been saying, Steve, since last night.
And the point is, too, that the, you know, Roe has a discredited history.
Cyril Means was the attorney for NARAL, which at that time was the National Association for the Repeal of Abortion Laws.
He's the source they use for the history and his views were unprecedented and since then have been debunked.
Roe's history is garbage and Alito goes into that very, very clearly.
Then we have the further destruction of this Roe and Casey framework.
Now Casey, as many of our viewers will know, came down in 1992 and was, many thought at that time it might reverse Roe, but it did not.
And yet at the same time it wasn't a ringing endorsement of Roe either.
It partially dismantled it.
But it gave us a new standard called undue burden.
And if our viewers don't know what that means, you're in good company.
Because nobody knows what it means.
It's undefined.
And it's inherently subjective.
Undue.
What is undue?
What is a burden?
Because the court has been saying for now since Casey, well you can't, the states can't pass a law, a pro-life law protecting the unborn if it poses an undue burden to women getting an abortion.
What does that mean?
What does that even mean?
And Alito goes into the fact that you cannot Tell what it means.
And that's why it has led to conflicting decisions both at the level of the Supreme Court and at the level of the lower courts.
There's a bundle of contradictions.
And so this draft opinion says it is time to overrule both Roe and Casey because the court is not giving us any constitutionally grounded guidance on what is constitutional or not when it comes to abortion.
Let the legislators decide what he concludes.

One thing I want to make sure our audience understands, because you don't have the left smearing this.
This is not shutting it down.
It's saying, in the structure of our republic, where this belongs is back to the people at a state level.
And each state should deal with it as they're going to deal with it.
Is that essentially the heart of his argument in sending it back to the state legislatures?
father frank pavone
Right, that's exactly what it is, Steve.
You know, he points out that some states, you know, in this, he takes a broad view and says, look, we know that this is a contentious issue.
We know that people are trying, people and the courts and the legislatures, are trying to balance the interests of the life that is indisputably in the womb and the freedom that people indisputably have.
He points out That the decision of the courts regarding abortion is talking about a unique action.
This is not about freedom.
If abortion is rooted in some kind of general freedom, Alito says here, that proves too much, because then you can talk about the freedom to, you know, ingest yourself with all kinds of drugs, or prostitution, or any kind of freedom.
He says, no, no, no, that proves too much.
Abortion is a unique act, and both Roe and Casey acknowledge that.
It's a unique act because it ends a life.
So it's not just an exercise of freedom, it's an ending of a life.
Therefore, you have to balance interests here between freedom and life.
The challenge Alito puts here to Roe and Casey is this.
Where and how do they get the idea that it is the court that is best positioned to balance those interests?
Instead of the American people Working through their elected representatives, having hearings, battling it out in the legislatures, having amendments, passing laws, revising laws, repealing laws if necessary.
That's the arena where this has got to be worked out.
So Steve, the court, because the other side is going to try to convince us of this right now, the court is not imposing a solution to the abortion debate.
The court is saying the place where the solution has to be found is not here with us.
It's with you, the people.
And this, Steve, reminds me of what, as we know so well, what President Trump said when he first took office at his inauguration.
He said, this is not just about the transfer of power from one party to another.
It's the transfer of power from Washington to the people.
This draft decision is explicitly saying that this is a transfer of power from the courts to the people and through their elected representatives.

Well, Steve, you know, I was weaned on hardball Chicago machine politics and this smacks of a preemptive strike by the Marxist left.
And frankly, they're always two steps ahead of us.
This is the last attack on the last enduring institution of our beloved republic.
And it's the oldest Alinsky tactic, which is to seize the narrative.
And that's what they're doing by this illegal leak.
By this theft of a Supreme Court decision.
And you know, the left has successfully undermined all of the institutions of this great country.
Elections, the education system, the military, the rule of law, the criminal justice system, women's sports and churches.

And we have to recognize that they are trying to corrupt the process.
But interestingly, isn't it, the timing of this decision?
Kamala Harris is going to be addressing EMILY's List, the pro-abortion funders, tonight.
And so I guess they finally have found a job for our vice president.
And she's going to be banging the drumbeat of abortion in Roe versus Wade.

And by the way, you'll recall that Chief Justice John Roberts presided over the impeachment of Trump.
And you remember he would not allow the naming of the leaker in the Trump impeachment case.
And so, additionally, I would say the FBI that has blown the Hunter laptop investigation, that has blown the Olympic investigation of the women's gymnastics team, where at least 70 additional women were abused because they did not properly investigate that case.
I would say, certainly, the U.S.
Marshal's Office, which runs the Supreme Court, has some of the best polygraphers I'm in law enforcement.
They should be in charge of this investigation.
They know the Supreme Court.
This is their bailiwick.
And I think politically, this is what they're up to.

Colonel, first off, your assessment as governor, give us your assessment of Judge Alito's draft ruling, which would really send power back to the state legislatures, which you're part of in Pennsylvania to make decisions here about abortion, sir.

It would happen in 73 when it became a federal decision and a federal issue, I think was not constitutional.
So this is writing the ship and instantly 18 states that when this is adjudicated and finally, you know, the last votes are in June or whatever comes out, this will put the power back in the hands of all 50 states and 18 of those states already have legislation to limit or restrict abortion greatly, which Pennsylvania is one of them.

Well, you know, and I've been upfront with this, Steve.
As a new senator three years ago, one of my first pieces of legislation, if not my first piece of legislation, was introducing the heartbeat bill together with Representative Stephanie Borowitz in the House, mirror legislation.
And we had a big announcement rally for that back three years ago, and that's been our push.
But as far as how this plays out politically, it's really kind of hard on my rivals since I'm the most pro-life guy out there and actually have legislation to back it up in the voting record to prove it.
Uh, right now they're trying to distract by, you know, calling me names and, you know, fake conservative.
I mean, just, it's, it's, Steve, I gotta tell you what, uh, spending my life in the United States Army for 30 years, and, and, you know, you were in the United States Navy.
We do act with, with a bit of integrity, or try to anyway.
There's just a code of conduct in politics.
It's all gone.
And I'm really sick and tired of these politics and these politicians willing to lie to get a vote.
This is hurting them.
They're running a lot of nasty ads, but now it's focusing back on the issue here of life.
And it's funny, in 1776 in Philadelphia, when we declared our independence from that king, it was all about life, liberty, and the pursuit of happiness.
So we're back to basics here and things that matter.

I was explaining this to a reporter from the AP this morning.
The Supreme Court is like the Vatican, but for U.S.

There is this unspoken agreement and this unspoken trust between the justices.
It doesn't matter if you're far left or far right.
You have to be able to trust confidentiality, and that these opinions don't get leaked out of the press, because you have to work together to get to some common ground.
There's just so much betrayal here.
These justices don't know which clerks to trust.
They don't know which justices to trust.
It's absolutely chaotic.
And ultimately, Steve, I think that the reason they did this was to increase their chances of winning in the midterms.
One thing that's not getting covered in the press right now is that just yesterday Planned Parenthood and the abortion movement announced that they would be spending $150 million in the midterm on abortion rights.

And that happens the same day that this is leaked?

This has been going on by the Marxists left for many decades.
So it didn't originate last night with this outrageous and unprecedented leak.
It's been going on a very long time.
And what everybody needs to understand is, you know, this is not the Democratic Party of Bill Clinton, JFK, and even FDR.
This is now a party of Marxist revolutionaries.
And they have done this long march through our institutions In order to destroy us from within.
You'll recall, Steve, that in the 1930s, it began as a KGB operation to try to overthrow the United States from without.
And when they realized, when America's enemies from abroad realized that our Constitution and our country were so durable that that was going to be impossible, they changed their tactics and they began like termites to eat our institutions from within to the point now where so many of them are on the precipice of collapsing.
What you saw last night with this leak was engineered.
It's completely orchestrated in order to engineer this political agenda going into the midterms.
We saw this now because they want to mobilize all of the left's armies to burn the country down again, just as they did prior to the 2020 election.
They're looking for another pretext.
They found one here with the abortion issue.
