The supervisors, it was kind of strange.
It was limited, I don't know, limited attendance, limited audience, a lot of heat in there, but it took an hour and they wrapped up.

Others at 5%, others at 10%.
So that was 0.2%.
Point three was the missing database, okay?
The missing database called, what, Tally and Process, I believe was the name of the database?

The audit, of course, doesn't, but the County Board of Supervisors, they got a blue checkmark.

So a Twitter storm from that with no responses.
No responses whatsoever.
A statement from Greg Sellers, who's the Chair of the Maricopa County Board of Supervisors literally saying, we are tired, this is dangerous.
More hyperbole, no responses.
And now, they were asked to come to a hearing tomorrow.

So she had to do that, written by Chris Hayes and edited by Rachel Maddow.
So that's out there.
And then they were invited to a hearing tomorrow, supposed to show up, saying, no, we're going to have our own.
So they had this hearing session today at 1 o'clock local, 4 o'clock eastern, the result of which is still no answers on the missing ballots, no answers on the missing, removed ballots.
Erased.
Misplaced.
Database.
But, of course, a 13-page letter from the Maricopa County Board of Supervisors asking to end the audit.

What does that say to me?
It says to me that this, again, is like Tyson versus, you know, versus fill-in-the-blank and they're throwing in the towel.

Advice would be let's pick apart the facts Okay, where are they wrong on the facts look at Karen fans letter and where is she wrong on the facts is there been compliance?
Where she says there's non-compliance are they wrong about the badges the letter was so exact so exact They pointed in the attachments not just the boxes exactly Steve not just the boxes, but the batches Yes, they're reviewing 2.1 million ballots. They were going so granular as to 200 ballot batches So, look at the batches.
Is she wrong?
And then look at the... You can't say you're wrong about the database being removed if you can't point out where the database is.
Right?
If I left here and stole this microphone, and then you called me and you said, Boris, where's the microphone?
And I was like, no, I don't have it.
You'll go, where is it?
The whole thing is nonsensical.

Here's what you can tell, because none of them, when CBS, Norah Donald, did their piece the other day, they don't want to talk anything that's in fans' letter.
They want to say, oh, they're doing UV light, they're looking for bamboos and ballots, these are a bunch of screwballs, they got the carnival outside, the place is called the madhouse.
They want to try to smear it.
They don't want to deal with the facts.
Here's what they have to understand.

But here's what is clear, is they're not showing up to the press conference.

Do you think they say, hey, you're not going to have a choice.

I think results tally and reporting was the exact name of the database, by the way.
I think here's what they're doing by pushing back so hard, too.
If there are Republicans in the Senate who may be not as stringent, who may have been saying, well, do we really need this?
This level of pushback and also this level of disrespect to the power of the state Senate is only going to cause For those other Republicans, not Karen Fann, not Sonny Berle, but other Republicans, to say, hey, you can't treat us like this.
And you know, elected officials, especially those with subpoena power, guard that power very dearly.
They're not going to allow themselves to be disrespected.
So this was a smart move by Senate President Karen Fann.
Not do a subpoena right away.
Send a letter.
Ask for them to come.
And now they're saying no?
They're sending 13-page screeds and a Twitter storm instead of providing results?

Karen Phan put this out, one thing is to get ahead of the Justice Department trying to shut this down so she could show the world exactly what we found to date.
So if the Justice Department tries to come in here, get a TRO, and shut this thing down for a while, at least the word's gotten out there of how bad this is.

Again, I cannot overstate enough How big of a deal the facts, the accusations in this letter are, and the fact that now almost a week later there's no responses.
And I've been looking for it.
I even tweeted at the Maricopa County Board of Supervisors.
I said, hey, hello, fine.
You want to go on that homonym attacks against the auditors and all that, fine.
Have a good time.
But show us the answers.
Where's the answers?
And there are none.

This is the lesson.
This is the signal, not the noise.
When the deplorables get an official venue to adjudicate something, we win.
You know why?
We have the facts on our side.
All this other stuff is just noise.

You saw this because Nora O'Donnell's people don't want to address what's in the President of the Senate's letter.
They want to talk about bamboo, they want to talk about ultraviolet lights, they want to talk about markers, okay?
We're talking about reality.
This is why in Georgia, in Michigan, all that, and also, I might add, the 1-6 Commission.

We need that for another day.
1-6, we want to just focus on 1-6 because remember they say the big lie that drove it was what happened on November 3rd.
That gives us the venue of the United States Congress to adjudicate all this.
That's why it should have happened in the impeachment trial.
Lindsey Graham shouldn't have talked him out of that, right?
All we need All the deplorables need, once you get official venues to adjudicate, good things happen.
You know why?
The deplorables are fair, they're honest, they're hardworking, and those patriots, remember, the madhouse out there, the convention center, is the new Concord Bridge.
Those patriots, and that is a grind, as you know, you've got a team around there, Boris, that is not romantic.
What they're doing day in and day out is a grind.
It's very detailed work.
But these patriots are showing the world exactly what happened on November 3rd and the days thereafter, and the establishment out there cannot handle it.

It was no help and no assistance at all of just getting to the bottom of what happened.

So after the election closes, uh, we've discovered that built into the system is the ability for someone to reopen the election, um, put more ballots into the tabulator, basically what we call ballot stuffing.
Um, and then re-tabulate, print out a new, uh, tabulator tape, but backdate that tape, uh, to November 3rd.
Um, and, uh, walk out, basically walk out the door with anyone knowing they were back in that tabulator.
Um, and we see that through some of the remnants that are left in the forensic audit or forensic images that we got.

So Matt, here's the question.
Assume Dominion are not morons.
Why would they be so adamant?
Particularly in your case, because they're sitting there going, hey, it's not hooked up to the internet, it doesn't cross county lines, it can't get to the Secretary of State of Michigan, this has all got to come about in the way we say it.
Why would they be that adamant and actually have a machine that you're now alleging you could actually, through some sort of engineering, Or just some sort of process change that somebody could do could actually change an election after it happened.
How can you have that wide a gap between the bid and the ask?

Well, what we find is that because these elected officials have no control over their own election, we found out on Friday that the Secretary of State, she responded to some of our discovery requests.
She admitted that she has no control over the source code, which state law requires that she keep an escrow.
And she also admitted that she has no idea how any of these machines work or operate or how they function.
So you have a company like Dominion that's able to set up this system where it convinces these states to sign these onerous contracts Essentially turning over control of the state elections to Dominion, and then if you want to find anything out about the election, you want to audit the election, they send you to the Election Commission, which, where they actually have people put in place that are former employees of Dominion.
And that's what they're, that's some of the problems they're running into out in Arizona, is the people who they say are certified to run the election are actually these former Dominion people.

Is this one of the issues that there's just never been this detail, a drill down on these things?
And so you're seeing these glaring, the best case you put on is incompetence, the worst case you put on is malfeasance.
Is that because the spotlight's never been turned on?
Really when they say they do audits before it's these process audits and it's not really getting in down to the details that in Arizona you're getting into and that you're getting into Antrim County.
Is that why these things seem so appear so egregious because nobody's really ever taken the time or had the authority to go in and actually look at it?

We're the only case that ever got a forensic image But yeah, no one's ever had an interest within our elected body.
These legislators, they don't know what they're doing when they sign bills appropriating the monies to bring these machines in because none of them understand these machines.
They just bring in a company like Dominion or ES&S or Hart and just put this into the system, make people vote on these systems, and they have no idea how they work.
So this is the first time you see people actually getting into the source code, and that's what we're doing.
We've got the forensic images.
So we can do a deep dive into understanding how these machines really work.
And they never expected anything like this to happen.
And I tell you right now, these people are shocked at what we're doing and what we're discovering.

Of course, they're saying the whole time you're a bunch of amateurs, you don't have qualified people, all that, but doesn't it raise now, over the weekend when I saw this on Today, aren't we at the level in Michigan that we have to do what the Patriots in Arizona have done?
Aren't we at a point that we've got to say, hey look, Matt DeParne and these guys, you've got to be a full timeout, what we need is a full forensic hand audit In Michigan, with the canvassing, the machines, and the physical ballots, just like there is in Arizona.
Is that the point, Matt DiPerno, that you think you've taken this now to?
That now the Republicans in the state legislature, to make sure that we get to the bottom of November 3rd, have to take that action now?

The most important thing, I think, was the Senate leaked to the Arizona Republic, picked it up, I think AZ Central is what the website is, that after reviewing what they've seen, they want to go back and look at all the elections.
Mitch McConnell ought to walk up to the sticks today and say, hey, guess what?
With Joe Manchin, say, timeout.
There's nothing else.
We're not dealing with any more budgets.
We're not dealing with statehood of this.
We're not dealing with H.R.

The folks in Georgia, you got two down there that I happen to believe, upon full review, only a full and fair review, that the two senators won in the first round.
But Mark Kelly now, if what we're seeing right here, and you go back and look at Navarro's analysis, pre-machine, I'm just talking about on the old-fashioned steel, Mark Kelly's Senatorship, I think that's got to be under review, and the Senate put the shot across the bow of Maricopa County, I think on Friday or Saturday, saying it's so bad that we're thinking about reviewing every election.

This election was decided in Arizona, decided, okay, they're telling us we ought to believe that Joe Biden won by less than 10,000 votes.
So Maricopa is the central county where they were supposed to do their best work.

And Bob, I gotta tell you, There's no greater American I've ever met than Rudy Giuliani, okay?
And to see what the federal government, and particularly the Southern District of New York, the scams they're running.
But today, the article in the New York Times, the article in Bloomberg, this redacted, I guess, letter that's in the federal courts with you.
But the essence of it, about going on and getting Rudy's, hacking into his cloud, getting these warrants to go look at the stuff from when he started representing President Trump.
And to say that the reason they had to do it, they thought Rudy was going to destroy evidence and intimidate witnesses.
Intimidate witnesses.
Rudy Giuliani.
Bob, you're his lawyer.
Tell us what happened today and what are these guys... And by the way, you spent many years in the Southern District.
You were the senior, I think, deputy head of the criminal division.
You had a revered track record down there, as Rudy did also.
I don't know.
It must break your heart to see what's happening today to that group, because this is disgusting.
Sir, what happened today?
And please tell me, did they really say that they feared that Rudy Giuliani would intimidate witnesses?

Absolutely.
And that's stunning.
This all goes back to 2019, when the U.S.
Attorney's Office obtained a covert warrant, they called it, of Rudy Giuliani's iCloud account.
They did the same thing to Victoria Tenzing.
They got her iCloud account.
And her Google account.
And then they kept that information from us for 18 months.
And the reason they kept that information from us was they got a non-disclosure order that said they convinced the judge that both Rudy Giuliani and Victoria Tenzing, a well-known attorney in Washington, D.C.
and a former Justice Department official, if they became aware that the Southern District had applied for that warrant, That they were concerned that Rudy Giuliani and Victoria Tenzing might tamper with or destroy evidence or tamper with witnesses.
I mean, that kind of an allegation is just ridiculous on its face.
Particularly when you consider that at that same time period in 2019, because of the fact that the Southern District was leaking information to the media saying that Rudy Giuliani was under investigation, we got tired of that.
So we contacted them and said, listen, Uh, we have no reason to believe that you're actually conducting an investigation of anything.
But if you are, if you're getting misled by people talking to you, and you want to get to the truth of the matter, Rudy Giuliani will not hide behind the Fifth Amendment.
He will answer any question you have about any subject except for privileged matters, which they as lawyers understood we couldn't talk about.
But anything else, we would answer the questions.
All they had to do is tell us what the subject matter was.
Why would we do that?
We didn't know that there really was an investigation of anything.
And if so, there's a lot of aspects to Rudy Giuliani's life that theoretically they could be looking at.
All we wanted to know was, tell us the subject matter.
We'll answer your questions.
They essentially gave us what I call the Heisman maneuver.
They gave us the stiff arm.
They said, we'd be happy to listen to anything you have to say, Bob.
But we're not going to tell you the subject matter.
My response was, that's ridiculous.
If you want to get to the truth, just tell me what you want to get to the truth about.
Because otherwise, you're wasting my time and yours.
What am I going to do?
Come in and talk about Rudy Giuliani's high school career?
You're not interested in that.
And I'm not interested in wasting my time.
So if you want to get to the truth, I said there's no downside here for you.
If we come in, if Rudy Giuliani comes in and tells you a fib, Then you have a real crime.
You have a violation of Title 18, Section 1001, false statements to a federal official.
Not this silly crime of a FARA violation, which 99 times out of 100 is handled civilly, where they say, we've noticed, Mr. Giuliani, that you're representing X, Y, and Z.
And this is the FARA unit of the Department of Justice, and they send you a form.
We think you need to register.
Please fill out the form.
It's a notice provision.
And certainly everybody in America was aware of what Rudy Giuliani was doing, defending the then President of the United States, Donald Trump.
And all of this happens right before the House votes the first impeachment article.
So that's a very important time in the life of Rudy Giuliani and Donald Trump.
And that's the time that they chose to seek out his iCloud account.
Now, just because we're careful about this, I kept on mentioning to the Southern District of New York, because I dealt with them with other clients, including yourself, and on March the 2nd of this year, about two months ago, I said to one of the prosecutors, listen, I just want to make sure we're still getting killed in the press on these, what I think are phony rumors.
So if you have any questions to ask Rudy Giuliani about anything, we're not going to hide behind the fifth amendment.
We will answer all those questions.
Just tell us what the subject matter is.
They gave us the same answer again two months ago, but what they did is they replied in an email saying, uh, Rudy Giuliani is the subject of a grand jury investigation.
Now that means he's not a target.
Two months ago, after having gone through all of the stuff in his iCloud account, and having done whatever it is they were doing for the last year and a half, their conclusion was Rudy Giuliani is simply a subject, and that term means Just anybody that comes within the four corners of their investigation.
It does not imply that you're guilty of anything.
For example, the telephone company is a subject of virtually every investigation in the Southern District of New York because telephones, communications devices are used.
Does that mean they think the telephone company did anything wrong?
Absolutely not.
Rudy Giuliani is in that category.
He's not a target, he's a subject.
I didn't even ask that question, they volunteered it.
I have the email right here, in which they state it.
I don't know whether you can see that on the screen, but it says, Mr. Giuliani, there is an ongoing grand jury investigation and Mr. Giuliani falls within the quote, subject category as defined by the Department of Justice United States Attorney's Manual.
Let me turn to that for a second.
The U.S.
Attorney's Manual is basically a guide that tells all U.S.
attorneys throughout the country how to act.
And when it comes to obtaining information from lawyers, it's very clear.
It says that U.S.
attorneys are directed to take the least intrusive route to obtaining the information.
The least intrusive route would have been what they normally do, which is to send a subpoena, deuces taken.
That's a subpoena that calls for documents or things to the lawyer.
And that serves two functions.
Not only does it acquire the information, but it puts the receiving side on notice that you can't tamper with that information.
So this claim that Rudy Giuliani in 2019 might tamper with evidence is ridiculous because the evidence was being held by Apple, not by Rudy Giuliani, not by Victoria Tenzing.
I don't even know how you would tamper with evidence that's being held and controlled By Apple.
But yet they put that claim in.
So that leads us to believe that whatever is in that affidavit contains a false statement that Rudy Giuliani might tamper with or destroy evidence.
Really?
The Mayor of the City of New York?
The former United States Attorney for the Southern District of New York?
The Associate Attorney General of the United States?
He's the type of person that would tamper with evidence?
And here's further proof.
If he was going to tamper with evidence, would I be volunteering his cooperation for the last year and a half?
If he was going to tamper with evidence, wouldn't we have done something in November of 2020 or again in January of 2021 when the media reported to us that the Southern District of New York went to Maine Justice and sought permission to get a search warrant to seize Rudy Giuliani's electronic devices.
That's exactly what they did.
In April, when they came to his home at 6.30 in the morning, they were only looking for his electronic devices.
So we were tipped off about that by the media in November of 2020 and again in January of 2021.
If Rudy Giuliani was the type of person that wanted to tamper with evidence or destroy evidence, he could have done it then because he wasn't under subpoena.

But of course he didn't because he's an innocent man.
He's done nothing wrong.
Further proof of that is on the day that the FBI came into his apartment with seven FBI agents at 630 in the morning looking for his electronic devices.
Hunter Biden's hard drive was in Rudy Giuliani's apartment.
Two copies of it in what's called an external hard drive, which is essentially just a black metal box about three inches by four inches that has a cord coming out of it so you can plug it into a computer and then view what's ever on there.
Those agents were told that those two external hard drives are Hunter Biden's, copies of Hunter Biden's hard drive.
The agents, without looking at the material, because they didn't plug it into any computer, simply accepted Rudy Giuliani's word.
Why is that important?
Because that's the same guy that the Department of Justice in an affidavit in 2019 said was likely to tamper with evidence. If that was true, then it was true in 2021. And the agents should not have taken Rudy Giuliani's word that that was Hunter Biden's hard drive, two copies of it. But they did. That tells you that the agents believed Rudy Giuliani and didn't believe that he was the type of person that would attempt to destroy
evidence. That's just nuts.

I just want to make sure that people understand this, is that when they went to this iCloud with this warrant, the time they wanted to go back to virtually coincides with the day back in 2018, the day that Rudy Giuliani was announced as he started working for Donald Trump.

In fact, there's a sentence in my letter, even though there were some redactions, There's a sentence in my letter that says, not coincidentally, they started this investigation on May 1st, 2018, which was the date that Rudy Giuliani began representing Donald Trump.
If you believe in coincidences, I don't.
Not with smart people like this.
These people in the Southern District are very bright.
And frankly, I've had a lot of respect for that office for a lot of years.
But I'm sitting here, scratching my head, trying to figure out, why did they do this the hard way?
The easy way, as he told them, if you have any questions, all you have to do is ask me.
In case they missed my presentation that I made to them in emails and directly on the telephone, right around that time, in November of 2019, Chris Cuomo, who is not exactly a friend of Rudy Giuliani's or Donald Trump, Was doing a show and he tried to get us on the show.
I didn't go on the show, but I issued a statement and that statement said and they put it up on the screen for the national television audience.
And I'm going to show it to you now.

He had a white male airman come to him and said, Yeah, I want to leave the Air Force because I just didn't know there'd be so many identity politics.
The next week, a black female airman came to him and said, I want to leave the Air Force because I didn't know that I was an outsider in my own country until the Air Force has taught me that way.
I have a cadet that I've known as family since before he was born.
He came up to my cabin in the mountains in Colorado and said, you know, General B, the worst place in the world to be as a white male Christian is the United States Air Force Academy.
And that's nothing against the soup.
I hope we have time to come back and circle back on him because We're blessed, at least at the Air Force Academy, to have a superintendent listen because we've engaged with him a lot and he's been listening.
But as a 74 grad of the Academy, to hear somebody say the worst place in the world to be is White Mill Creek, you know, we have, I just saw a lieutenant that I sponsored for four years.
I said, how come you never told me about this stuff?
He said, you know, it was so insidious.
But now I look back on it, the culture was changing underneath my feet and I didn't know it.
A West Point cadet I was asked to speak to over over Christmas break to try to get him to stay, you know, telling me about stories about their teacher taking them out.
You know, Beauregard Way needs to change its name.
Lee Barracks needs to change its name.
These are all racist history.
So I mean, they're striking right at the heart of military cohesiveness, trying to draw a line between us.
