Yeah, the jury is expected to continue its deliberations at 9 a.m. this morning after no verdict was reached yesterday.
Now, the first son did not testify in his own defense, despite earlier indications from his attorney that he might.
He was joined by more than a dozen family members as the defense and prosecution presented their closing arguments.
Before deliberations began, the prosecution presented an alleged text message exchange sent by Hunter to a since-convicted drug dealer and a potential blow to the defense.
The text sent on October 11th.
It's unclear if Hunter ever met up with that drug dealer, but Harvard Law Professor Emeritus Alan Dershowitz says the evidence against Hunter is clear.

The best thing that could possibly happen to Donald Trump is if Hunter Biden gets acquitted.
Because the evidence against Hunter Biden is so much, so much more compelling.
The legal issue is so much more compelling than anything against Donald Trump.
And it will prove beyond any doubt that this is all about where the trial was conducted.
That if you're Trump and you're tried in New York, it's automatic guilt.

The new report claims taxpayers could be on the hook for as much as $345,000 to cover First Lady Jill Biden's 3,600-mile round-trip flight to Hunter's trial from France to Delaware last week while the president was overseas.
The report also saying it costs nearly $1,400 per hour to operate the First Lady's government plane.
Jill Biden has only missed one day of that trial.

But unfortunately, the realities are that inside of Wilmington, Delaware, where the jury pool is all pulled from, where these crimes were committed, it is like a little fiefdom for the Bidens.

Like a tinpot dictatorship for the Bidens, where the Bidens have been the preeminent political authority and the gift givers of offices and properties and grants and favors and political retribution for so long.
That we think that this jury pool is doomed.

They haven't even been deliberating for 24 hours.
This was really quick.
Hunter Biden is not at the courthouse, according to our most recent updates.

When anything occurs, apparently this was only a three-hour deliberation.
I only said 24 hours because they did begin deliberation yesterday morning.
But apparently the actual stop clock, they don't deliberate throughout the evening, the actual stop clock on the deliberations were only three hours.
So what does that tell you?
I mean, listen.
Again, I am a consummate, glass-half-full, silver-lining optimist.
I have to tell you, if they've reached a conclusion, there's something in me that says if they reach a conclusion this quickly, then maybe they did find him guilty.
A quick jury return is often an indicator of a unanimous jury on something.
And so once again, everything is just pure speculation at this point.

I have got to tell you that a quick jury did a three-hour deliberation on this question.
I would assume that is not a good deal for Hunter Biden.
The jury was pretty quick in the Trump trial.
It was a lot longer than three hours.
It was more like nine hours.
But everybody said that was really fast.
And that that would effectively point to a, you know, that was really fast.
And the pundits, legal experts, were saying, hey, listen, listen, that's a bad sign for Donald Trump, for the accused.
And we had to report that at the time.
And it turned out that that was a guilty verdict.
So what does this mean?
Does this mean that this is a bad sign for Hunter Biden?
Yes.
Based on that measure, based on what we know about this, yes, it means it's a bad sign for Hunter Biden if the jury is so quick.
Well, it definitely doesn't mean a hung jury because there's absolutely no way if the jury has reached a verdict that it's a hung jury, right?
So many were assuming that this would mean a hung jury.
So you have the one lady whose aunt got a job at the DMV because of Joe Biden, right?
And she refuses to convict.
She refuses!
So she fights tooth and nail, the rest of the jurors, all the way through to the end of the week, and they come back and they say, you know what?
Here you go.
We can't come to a decision.
That's called a hung jury.
If the verdict has been reached, that means it's not that.
Every expert was saying it would be that, including this program.
Again, we assume that that would be the tactic here.
And the tactic of the Biden family, which is a mafia family, has been to travel to the court and to intimidate the jurors.
To stand there as little phalanx and stare down at Jill Biden in her little shower curtain dresses from Bed Bath& Beyond, plastic dresses, standing there glaring.
Down at the jury and to bring forward like the intimidation of the Biden family to get one of those jurors, right?
Whose auntie got a job at the DMV to get one of those jurors effectively to give you a hung jury.

I did not have faith that this jury would get it right.
I have had been blackpilled.
By the corruption of the Bidens and the corruption of this family and the lack of responsibility that ever befalls our ruling classes in this nation.

I believed that once more, Hunter Biden, as he has ever, all the way back to being 18 years old and getting his first arrest for cocaine on the Jersey Shore.
18-year-old Hunter Biden with a bag of cocaine, powder all up his nose, getting booked into prison.
As a young man, Joe Biden, who was a freshman senator at the time, muscled into that police station, told them to delete or shred the mugshots of his son, used his political power to jailbird, spring his kid out of jail, and you never heard of it.
There's a single record available of that arrest.
A single record.
That happened when Hunter Biden was 18. Throughout Hunter Biden's autobiography, he writes of his continued and perpetual drug use as he moved into Georgetown as a Nepo baby.
He didn't have the academics to get into Georgetown.
His senator father, who was a very young senator in the 1970s, late 70s, early 80s, his senator father used his muscle.
And his political, his intimidation to get Hunter everything in life.
He's the definition of a Nepo baby.
Hunter Biden writes in his books that it was when he was at Georgetown that he got addicted to crack.
You're talking early 20s.
Hunter Biden then blew and destroyed every single opportunity, destroyed families and marriages that he was in.
He destroyed opportunities that his father got him in the Navy by blaming black guys from Africa.
For giving him crack-laced cigarettes, I kid you not.

Hunter Biden was kicked out of the Navy because he had too much crack in his system.

At the same time, he is spending millions, not thousands, millions of dollars on his fiendish drug habit and hookers.
Hunter Biden siring children out of wedlock and refusing to claim them.
Hunter Biden getting his dead brother's widow that he banged addicted to coke and crack.
And then what happened?
Hunter Biden...
Illegally purchased a firearm.
Lied on his federal NICS form, which is the background check, the National Firearms Background Check.

Hunter Biden lied about these and then in a fit of pique and rage.

Hunter Biden went searching for the gun and then blamed two Mexicans on it.
Again, you can say, Benny, how dare you?
Like, say that.
Why would you make something like that up?
It's in the police report.
Hunter Biden said, look at those Mexicans.
They're probably illegal.
They're maybe the ones who stashed the gun here.

Yeah, but sir, the gun is licensed to you and registered to you, and there's footage of you searching for the gun after your dead brother's widow threw it in the trash can.
Nothing happened.
Nothing happened to Hunter Biden.
And so, my takeaway from this is that we're going to win.

Because now, suddenly, for the first time, In history, there's a consequence to a Biden.
There's a crack in the facade, in the armor.
The armor has now failed.
Hunter Biden had the Secret Service go to the gun store in order to steal the documentation that he bought the gun.

If it was the government who furnished all of the evidence to lock up Joe Biden's child, what more do they have on Joe Biden?
What does it say about the protection mechanisms that Joe Biden has allegedly purchased inside of the actual federal government?
Those are gone is what it means.

And that things have gotten so bad now that this is a warning sign.

On October 12th, 2018, Hunter Biden walked into StarQuest Shooters and Survival Supply, federally licensed firearm dealer in Wilmington, Delaware, and answered no to question 11E on the ATF form 4473, a federal background check.
Certifying that he was not doing drugs.

You can see Hunter Biden's own hand.
You can see Hunter Biden's own signature on this form.
And you can see him answering no to are you addicted, unlawfully addicted, to any depressants, stimulants, narcotic drugs, or any other controlled substances that is lying on a federal form.
Ladies and gentlemen, that is enough to get you in big trouble.
But if you lie on gun forms, don't ever lie on federal forms, but if you lie on gun forms, then you have another thing coming.
Because then you're lying in order to get this, and this is the firearm that was purchased.
By attesting no, the drug user addict question on the federal firearms paperwork, Hunter Biden was able to buy a Colt Cobra.38 special revolver.
Here is the actual firearm.
Hunter Biden paid almost $1,000 for this, $886, along with a couple of accoutrements.
Hunter Biden purchased 25 rounds of ammunition, which were missing when the gun was eventually recovered.
Where'd it go?
Nobody knows.
A speed loader, an accessory that enables rapid loading, and a semi-automatic air pistol, which can also do some damage.
Hunter Biden's ex-lover, Haley Biden, the widow of late brother Beau Biden, whom he introduced the crack cocaine, found the gun inside of Hunter's unlocked Ford Raptor truck while cleaning out his car on October 23rd, 2018, 11 days after the gun sale.
Really important thing, don't ever leave your firearms unlocked in your vehicles.
Many people travel with firearms in their vehicles, totally fine.
Maybe you're one of them.
But do not leave it so that, like, a bum who rummages through your car Or somebody who is a child or somebody who maybe has no ill intent but is just like a curious kid could find that firearm.
This is deeply, deeply bad behavior by Hunter Biden to leave the firearm unlocked in the vehicle.
According to Haley's testimony at the trial, she additionally found remnants of crack cocaine and drug paraphernalia strewn about the vehicle, the Ford Raptor, with the firearm.

They were focused, they were disciplined, and they methodically...
It took apart each of these defenses in front of the jury.
And when you pursue a nullification strategy, it can go too far sometimes.
It can make the jury feel like they're being treated as chumps.

And, you know, commenting on this case is not going to do Joe Biden any good, other than if he's looking for sympathy.
But I want to say one thing that I think is very important, and that is that the fact that Jill Biden wasn't there, the fact that the whole family or not everyone was aware that the verdict was coming back, really tells me that they were kind of, you know, thinking that maybe this show of force in terms of the Biden family being front row,
staring down the jury would intimidate the jury because anyone who understands the criminal law, and that's most of the people that you've been talking to in the last few minutes, knows that this case was an open and shut case.
And I think that they're even leaving recognizing the significance of this is indicative of the fact that they thought, well, maybe we'll get away with it.

No, this jury and this judge, they were not going to waste any time.
And the judge didn't even say, should we wait for anybody?

And it was notable yesterday that at the beginning of the prosecutors, a closing argument, they pointed to the gallery where the first lady has been sitting and said, those people, they don't matter.
What matters here is the evidence.
And here, the jury believes that the prosecution proved beyond a reasonable.
was proving that Hunter Biden knowingly lied throughout the course of this process, that he was aware of the fact that he was either using or addicted to drugs.
And they pointed yesterday to the fact that shortly before he purchased this gun that he had been recently in rehab.
So prosecutors said, look, if he hadn't just been to rehab, maybe we could buy the idea that he wasn't aware of the fact that he had a problem with substance abuse.

We've been tracking very closely on my daily legal lawfare show, America on Trial with Josh Amersla.
I've been all over this case.
You know, Benny, a lot of our fellow conservatives have been, I think, quickly dismissing this case, saying it's kind of a show trial.
It's no big deal.
And, you know, they're obviously correct to an extent.
I mean, the special counsel, David Weiss, decided not to pursue charges for Hunter Biden's obvious blatant foreign influence peddling Burisma, $83,000 a month, Ukraine.
The infamous text to the Chinese guy, you know, the big guy.
So they chose to let that go.
Fair enough.

But, Benny, the reason why I have been paying very close attention to this trial and the reason that I am relieved and, yes, I have to say I'm a little bit surprised by the fact that there was a guilty verdict today, but as a lawyer, as a former federal law clerk, by the way, on the U.S. Court of Appeals for the Fifth Circuit who actually worked, our court worked on gun cases just like this, Hunter Biden was...
Absolutely dead to rights.
This was not a close call at all.
You know, I followed the trial closely day in and day out.
The Hunter Biden legal defense, Benny, was comical.
They were basically saying, oh, you know what?
He was like a drug addict in like September of 2018.
And then, oh, by the way, yeah, he had like another relapse like a few days after the gun.
But no, take our word for it.
At the exact day in October 2018 where he purchased the gun, he was not a user of a controlled substance as the relevant statute 18 U.S. Code 922 defines it.
Give me a break.
Give me a freaking break.
So the reason that I've been paying close attention to this is because he is so comically dead to rights on these charges that this was actually going to be a last dying gasp to see if our justice system had any life left in it.
And, you know, I have to say I'm a little bit surprised, but here we are talking about it.

So I couldn't agree with you more.
I think that oftentimes our movement is one that can't take a W. And can't accept a win and is perpetually screeching and screaming about what should have happened in some grandiose strategy.
But there is no grandiose strategy.
You must win small battles to win a major war.
And you have to win these little incremental battles are important.
Like having a piece of the armor ripped off.
Finding a Biden guilty on these charges is a good thing.
This is the first time a Biden's been found guilty on these charges, and it has happened in their backyard in a city where every person from the bum on the street to the mayor owes the Bidens a favor.
They were able to return a guilty on all counts verdict, and that really says something.

I mean, look, these are jurors from Wilmington, Delaware.
Wilmington is where the Biden-Harris campaign is located.
That's a big deal.
I mean, that is a big deal that a jury of one's peers just found the most famous family in the entire state of Delaware guilty.
Admittedly, again, it's not the FARA stuff.
It's not Ukraine, China.
But still.
The guy blatantly lied on an ATF background check form.
I'm a gun owner.
Everyone who's ever bought a gun knows exactly what we're talking about here.
You check that box.
It's a very well-known thing.
The dude blatantly lied, and he's going to pay some...
You know, some to be determined price for it.
So it's a good win.
You know, again, as a lawyer myself, as someone who clerked on a federal court of appeals, as someone who still speaks to law schools all across the country, this makes me happy.
This is a good day because it restores some faith for me in the justice system.
Is everything perfect out there?
No.
I'm not going to pretend like it's better than it is.
Obviously, the lawfare against Donald Trump is disgusting.
A lot of good people on our side, everyone from Steve Bannon to my friend John Eastman, they're getting prosecuted, sent to jail.
It's all disgusting.
But as you said, Benny, a lot of folks on our side, Can't take a win.
This is a win right now, and we should take it.

Yeah, so can you talk me through what sentencing looks like?
The 25-year number keeps being thrown around.
Is that unlikely?
I know that the federal government does not sniff at gun charges and takes it quite seriously.

Yeah, so guns, drugs, I mean, these are some of the most common federal prosecutions out there.
No doubt about it.
I mean, this is kind of a bread-and-butter federal prosecutor's case right here.
So 25 years, that is the maximum under the sentencing guidelines for these three felony counts.
Is he going to get it as a first-time offender?
I mean, massive air quotes there because the guy's been on the wrong side of the law for many decades, but as a first-time actually sentenced and convicted offender?
Look, he's probably not going to get the full 25 years.
That's typically not how it works.
The real question is, is he going to get any time, or is he just going to get a slap on the wrist and just get a home confinement, probation, mandatory drug treatment, rehab kind of thing?
And I will be very let down if it is the latter.
I think that we on the right, but we more generally on the side that is pro-rule of law, that wants to see the law actually apply to everyone, no matter what your ideology, no matter what your wealth, your social class, your connections, this, that.
We should be rooting for prison time here.
We're not going to get 25 years.
That would be great, obviously.
We're not going to get it.
But we have to see something here.
And then the question, obviously, is if there is some meaningful prison time, call it 6 to 12 months or more than that, or ideally more than that, of course, is Joe Biden going to pardon?
Well, I don't think he can before the election at a bare minimum, but don't be surprised if he does so the day after the election, Benny.

So a pocket pardon maybe on his way out of office or something like that.

Who's also a federal prosecutor who's been on the program talking about the enormous number of gun crimes and violations that he's brought and how slam dunk they are from a federal perspective.
How the judges don't even bat an eye.
On a gun charge, the judges that he's worked with just give you whatever you ask for.
Because people take this stuff very, very seriously when you're lying on your federal NICS forms.
And so I guess they're...
They are in a very tough position here because Joe Biden has made it a tentpole issue to go after gun criminals, right?
Every other weekend, Josh, there's like a new gun criminals gun event at the White House to demonize legal law-abiding gun owners.
And now Joe Biden's only surviving son is a convicted gun criminal.
It puts them in a weird spot, right?

Yeah, it really does.
And it's actually even weirder than that.
And I'll explain to you why.
So the Hunter Biden legal defense was a little bit shambolic and all over the map because they probably knew deep down that their client was completely guilty of all these charges.
So what they mainly tried to do was to impeach the credibility of the government's witnesses.
So that would be, for example, Beau Biden's widow.
That was then Hunter Biden's girlfriend.
Then they tried to impeach the credibility of the stripper who said that she saw Hunter Biden doing crack every 20 minutes.
And then they just tried to sow some evidentiary seeds of doubt and say, no, he actually was sober around that time.
But when they couldn't do the witness impeaching or the fact doubt sowing, then they relied on an interesting legal theory that essentially goes as follows, which is that the statutes with which Hunter Biden was being prosecuted were unconstitutional, either facially or at least as applied here.
And what that means is that it's unconstitutional.
Because the Second Amendment prohibits it.
They were actually ironically taking like an NRA-style Second Amendment absolutist argument, which is deeply, deeply ironic and quite humorous for anyone who knows anything whatsoever about the history of Joe Biden's career as a longtime senator from Delaware, where he was one of the loudest proponents of gun control in the entire U.S. Senate.
So the whole thing is kind of dripping rich with irony, frankly.

So yeah, how do you possibly argue that?
I mean, perhaps I'm naive on this.
But it does seem like there is no argument and that Joe Biden would suffer some real immense political backlash for pardoning his kid here.
Again, maybe I'm naive.

So I think he can't do it.
I think you're right.
I do not think that he can pardon his son, at least before the election.
I mean, I'm so cynical that I not only...
I anticipate, but I fully expect that he will pardon Hunter on his way out the door, or if he's re-elected, basically the day after, too.
I mean, once he is no longer up to the voters, when there's no more electoral accountability, he'll probably go ahead and pardon him.
But right now, he can't do it.
Look, Benny, he's struggling as it is to retain black and other racial minority voters in his coalition.
A lot of them are trickling off the Trump.
You know, how do you think a black or Hispanic person who has like a cousin or a good friend in jail, how are they going to feel when they see the president pardon his son, but their family member or friend is rotting behind a jail cell?

It's not going to be a So, what happens in a Trump...
Let's say that you get a real attorney general in there and a real special counsel appointed to look into these real crimes.
And we saw sort of the astonishing gymnastics and aerobics that the court system was able to go through in order to increase the statute of limitations with Donald Trump in New York.
If you had a real special prosecutor, what could still be on the menu?
For going after Hunter Biden in a, again, January 20th, 2025, Trump administration.

So it's going to depend on exactly what charges you go for, obviously.
But, I mean, FARA is kind of the big one here.
So this is Foreign Agents Registration Act.
It seems to many of us that Hunter Biden was clearly acting as some sort of Ukrainian agent, for instance, when he was taking eighty three thousand dollars a month from Burisma while he was simultaneously orchestrating meetings between Burisma and his his father, who was the vice president United States.
So, you know, come January twenty twenty five, that's going to get up on 10 years.
years.
I'm not entirely positive off the top of my head what the FARA statute of limitations is.
It's probably right around 10 to 15 years or something like that.
So hopefully that's not off the books.
You would need Congress to then statutorily amend the statute of limitations, which Probably is not going to happen, to be honest with you.
So you might be, I mean, the nature of prosecution is that the more time you wait, you know, the fewer options you are going to have.
But having said that, you're going to have options here.
I mean, there's going to be some laws that are going to pop up there, and that would be a very, very good, wise use of the prosecutorial resources for a day one Trump administration.
Look, Benny, I want to get us back to a neutral enforcement of the rule of law in this country to the extent that it ever existed at all, but it definitely used to be a lot better than it is now.
And you have to do some mutually assured destruction to get us back to this point.
And I know that you understand that, but you're going to have to bloody up some noses just to get us back to that neutral playing field.
And there is no nose that is more ripe for being bloodied, frankly, than Hunter Biden and his foreign influence peddling.

Yeah, because it's quite clear that that nose has been doing a lot of work following the evidence of this case.
And so finally here, Josh, just a real quick takeaway.
What does this mean?
For the fragility of the actual Biden regime.
I, again, we found this verdict out live as soon as we started the show.
My jaw was on the ground and I had to pick it up off the ground.
I was quite shocked.
And I was shocked because if you're following this trial as close as you have, you realize that the government really, really put their shoulder into this one.
Brought forward the laptop.
The FBI said we have 18,000 pages of data that have been taken from the laptop to be used at any time against this family.
This to me, the three, the three dimensional, four dimensional chess here, it seems like there are forces at play that are either sending warning signs to the Bidens like get the hell out of the I guess I'll leave that to your legal pontification.

Look, so the base...
Level reading as to what just happened is what I said earlier, which is that this is a very good day.
Take the W. It's a great day for the justice system.
Again, it's not perfect.
I mean, it is still horribly off balance, and we're going to have to try to work on that over the mid to long term.
But for now, let's take the win.
This is a good vindication that there is still some legitimacy left in the entire system, which is a good thing if you're a conservative.
It's a good thing if you're pro-rule of law.
It's a good thing if you're pro-constitution.
The slightly darker, more cynical twist as to what happened today and as to what has probably happened with this whole trial in the first place is that the prosecutorial apparatus, the deep state, whatever you want to call it, they're trying to basically get the Democratic Party and the Biden regime to throw this prodigal son, Hunter Biden out as a useful sacrificial lamb to try to then bamboozle conservatives into thinking that things are actually better than they are.
That's a little too far down the rabbit hole for me, to be honest with you, because as you said, the federal prosecutors did want to whip out the laptop at trial here.
They repeatedly said no one is above the law.
I mean, they said and did all the right things, and they got their unanimous guilty conviction.
So I'm not quite, quite, quite cynical enough to go that full dark route, but it is lingering in the back of my mind, I guess I will say.

Yeah, no, I think you're exactly right.
It's one of those things where you go, okay, well, I'll take the win and, you know, let's move forward.
But I don't want to pretend like this is justice.
Certainly there's an aspect of justice that was done here.
Hunter Biden was guilty of what he was accused of, which was lying on his form when he purchased this gun.
He checked the box saying he was not addicted or not using any drugs.
And in fact, he was...
So that's a win.
That's great.
But what about all of the FARA violations?
What about all of the foreign dealing?
What about all of the money and the potential bribery pay-to-play schemes that the Biden family was using?
I don't want to forget about that.
Yes, I want to take the win and say, great, you know, some element of justice was done, but let's not pretend like...
He's off the hook.
And if you remember from early in the case, they were actually trying to give him a plea deal where he could never be charged with all of the other crimes he's committed, which are substantially more significant than what we're seeing here.
So I'm not trying to be too zealous in this, but it's a good result, but I don't think we're done yet.

I mean, I like going on offense.
This very much is like a clue game where the most obvious game of clue, like the crack cocaine's on the gun.
Like the crack's on the gun.
The federal government presented the evidence.
You can see the crack on the gun.
We have the photos.
We put it up on the show.
So, yeah, it's like the most obvious game of clue.
And they got it right.
I just never thought that I'd see a member of the ruling class and a member of the Biden family.
Especially in a Wilmington courthouse, face a guilty verdict, a unanimous guilty verdict.

Yeah, I think there's a couple things potentially going on.
And of course, I don't know.
I wasn't a juror, so I don't know what they were thinking or how they were deliberating.
But one, I think, to your point, the evidence was so overwhelming that I don't think...
Anybody who wanted or was willing to do mental gymnastics to pretend like Hunter Biden wasn't guilty and that this is somehow a sympathy case for an addict, the evidence was so overwhelming, you could not make those leaps.
You couldn't make those jumps to say, you know what, let's let him off on this one.
The other aspect I heard another commenter say on this that I thought was very interesting was maybe the jury.
Just is aware of what's going on and was like, you know, if we don't convict him, all hell is going to break loose because everybody can see how biased the justice system has become that maybe they're just like, we have to convict him.
And could you imagine if they actually came back and acquitted?
If they gave Hunter Biden an acquittal?
I mean...
Like, heads would explode.
So, you know, I don't know what happened in the jury room.
I think there's probably—it's probably somewhere in between that.
But he was guilty, and they came to the right verdict, and I'm grateful for it.

So your former boss, Donald Trump, has a statement out from the official campaign account.
Hunter Biden has a statement out.
The statements are— Quite different, but the statement from the campaign account effectively matching what you said earlier that there needs to be real accountability for the real crimes here, which is you were acting on behalf of Ukraine and Kazakhstan and Russia and China, and you weren't declaring that, and then you were acting against the United States by...
I mean, one of the deals was selling off our natural resources to China, trying to sell an LNG port in Houston and give all of our natural gas to our geopolitical enemy in China.
I mean, this was just one of the many schemes.
The $3 million from the mayor of Moscow's wife and so on and so forth.
And so I guess my question to you is, from a legal perspective, what accountability can still happen?
Could a special counsel be appointed on January 20, 2025, when Donald Trump is sworn into office?
christina bobb
Well, sure.
I think there's a lot of evidence out there that there are very significant indicators that the Biden family was committing significant crimes collaborating with our adversaries, collaborating with China, with Russia, with Kazakhstan, with Ukraine, with all of that.
And to the extent that they want to claim some sort of statute of limitations, I think there's plenty of statute of limitations arguments.
One, depending on the crime that...
You don't pick a crime and then try to investigate to match the crime.
You have to just investigate and see what comes out.
We don't know exactly what would come out.
We can't really get into any statute of limitations issues until we know what the evidence actually points to.
And then to the extent that there is a statute of limitations issue, I think the fact that the Bidens were in control of the Department of Justice, they're not going to prosecute themselves.
So I think there's a very reasonable possibility to try to toll any potential statute of limitations.
And I wouldn't be surprised if some of the crimes are egregious enough that you don't need to worry about the statute of limitations.

That's very interesting, especially coming from you, because you've served in such a capacity for the president as somebody who's been on his legal defense and represented presumably in a second Trump administration.
Perhaps you'd be there at the DOJ looking into these things.
Can you talk me through your last comment there?
Because you just said maybe there is no statute of limitations.
Can you unpack that for us?
christina bobb
Sure.
Well, and I can't speak for Donald Trump.
I don't know what he's going to do and what he's going to appoint and try to investigate.
But as far as Americans that are concerned and say, hey, we want...
Hunter Biden and whoever was selling information to our adversaries who want them held accountable, I think they should be investigated.
And I think you need either a special counsel or, imagine that, just the Department of Justice doing their job investigating into foreign dealings.
I think there needs to be an investigation into what occurred.
And then as that investigation unfolds, then you figure out, you know, what you want to do with it.
And Donald Trump, when he's back in office, he can appoint whoever he wants and handle...
I want to be careful about it because I'm not in any way trying to say, they prosecuted us, let's go prosecute them.
I think that's a very slippery slope that I want to be very careful with and not charge forward with that.
But we do have to come...
Come up with some way that people are held accountable.
Because for far too long, conservatives have said, oh, shucks, we don't hold our political opponents accountable, so we're going to keep letting everybody get away with everything.
And before you know it, you have record-setting indictments, you have record-setting criminal convictions on both sides, whether it's the first son or the leading candidate on the Republican side.
It descends into chaos.
And so we have to get back to justice.
We have to get back to accountability.
However Donald Trump chooses to facilitate that, I fully support him.
At the bare minimum, I think we need investigations into all of these foreign dealings.
What actually happened?
The fact that the Department of Justice has had Hunter Biden's laptop since 2019.
They knew the contents.
They knew that it was real.
They had 51 intelligence officials who lied to the American public for the purpose of swaying the outcome of the 2020 election, which, based on polling in, say, December of 2020, said, had the public known that the laptop was real, they would have voted differently.
And that alone changed the outcome of the election.
So all of what has happened in the last four years, the chaos that has descended on this nation is directly tied to all of this.
And it all needs to be investigated.

I, you bring up such a great point, Christina.
It's such a profound point.
Like the use of the special counsel, if you look back at like The issue was shot dead forever.
You should be okay with a special counsel investigation into the Clinton Foundation, into Jeffrey Epstein, into the Bidens.
If you are innocent, then you have nothing to hide, as President Trump would regularly say.
And three years, I know it was a big pain in the ass, but the special counsel, Right.
Yeah, sure.
Appoint every special counselor is.
Let's find the answers, right?
If you're innocent, you have nothing to hide.

And certainly you want to make sure that if you're appointing a special counsel or doing investigation, the point is to investigate.
The point is not to target a person and say, what crime can we say this person committed?
Which is what they've done to Donald Trump and say, we want to investigate how Donald Trump colluded with Russia.

What you need to do is look at the facts and say, okay, we have information that money from China ended up in Joe Biden's bank account and that, you know, there's money from Kazakhstan that ended up in Hunter Biden's control and possession with his business partner, Devon Archer and Bob Alinsky and all of this stuff.
Just investigate the information.
And then when you come to the conclusion, that's when you figure out.
It's not appointing a special counsel to investigate Joe Biden.
It's appointing a special counsel to investigate illegal foreign dealings within the United States government.
We all know the conclusion will likely be Joe Biden, but you can't start with that premise.

So the president will face off in days with Joe Biden on a debate stage.
I know this is putting you on the spot here, but how would you advise him to talk about this issue of Hunter Biden?
He has brought it up on a stage with Joe Biden before Hunter Biden.

I cannot in any way try to advise Donald Trump on this.
He is the master at this.
He has the most amazing instincts and he handles this so well.
I think the statement that they put out really is threading that needle and is hitting the point that needs to be hit, which is, that's great.
We got the win.
It's great that the jury held Hunter Biden accountable, but this isn't what he needs to be held accountable for.
And I think that's the vein that he needs to go down as far as how he does that.
Donald Trump is the master of this.
That's why they don't like him.
They don't like his mean tweets.
They don't like the fact that he's very...
He's crafty and he's funny and he comes up with funny things on the fly and they don't like that.
And I anticipate that he'll do that on the debate stage.
It'll be great.

I mean, I have no idea why they're letting Joe Biden do it unless they have something planned.
Like Donald Trump's going to run circles around him, but it'll be fun for us.

Well, his trial team in New York, I'm sure, has a strategy.
I think they want to confine him in some way.
I don't know that they will end up doing that.
But you can see what they want to do by hearing the liberal pundits in these mainstream media that are like, oh, Donald Trump in jail.
They get so excited about it.

Bizarre thing.
They come up with the craziest dreams and schemes that they want to happen and talk about him on television, and then none of them ever actually materialize.
So I think they want to confine him in some way, but I don't think they will.

But if they do try to do that...
You know, the $400 million that Donald Trump has raised in the last few days will look like pennies compared to what happens.
The convention in Milwaukee will be the biggest blowout convention that the RNC has ever seen.

I mean, at that point, it's just like...
It's just fun because you can see the government scrambling and it's just kind of fun to be the little guy when you see the government scrambling, right?
And I say that as far as like from a voter's perspective.
Voters want to be the one that's like, yeah, we're taking on the man, right?
Well, I mean, they're making it pretty clear that that's what's happening right now.
So I think anything they try to do to him will backfire massively.
So I think they should recognize that by this point.
They've only had about 10 years to figure that out.
So I don't think that they'll actually confine him or really do anything too substantial.
But if they do, it will only be a boost for Donald Trump.

I think they're going to do a lot of desperate things to try to scare us.

They want to scare you out of participating and being part of government and trying to hold your government leaders accountable.
And so I think they're going to try to make it scary because that's the only tactic that they really know how to use.
And for so long, we've fallen for it.
You know, we're going to see some things where they're going to try to make it dark.
But I absolutely believe Donald Trump is going to prevail.
I believe truth prevails.
I do not believe America is over.
I think we have our best days are ahead of us.
I truly, truly believe that, even though I'm looking down the barrel of nine felony indictments myself.
And I do believe that our best days are ahead of us.
But it takes all of us getting involved.
So I just want to.

Earlier today, Hunter Biden was convicted of two counts of lying on a form submitted to a federal firearms dealer about his addiction or use of crack cocaine and possessing a firearm while a user or addict.
There have been two overarching themes emphasized by the prosecution during trial.
This defendant's illegal choices and the rule of law.
First, while there has been much testimony about the defendant's abuse of drugs and alcohol, ultimately this case was not just about addiction, a disease that haunts families across the United States, including Hunter Biden's family.
This case was about the illegal choices defendant made while in the throes of addiction.
His choice to lie on a government forum when he bought a gun and the choice to then possess that gun.
It was these choices and the combination of guns and drugs that made his conduct dangerous.
Second, no one in this country is above the law.
Everyone must be accountable for their actions, even this defendant.
However, Hunter Biden should be no more accountable than any other citizen convicted of this same conduct.
The prosecution has been and will continue to be committed to this principle and to the principles of federal prosecution in carrying out its responsibilities.

Well, it's a necessary measure of accountability.
Is it sufficient?
No.
Is it the result of years of cover-up and corruption that ended with the Justice Department being dragged kicking and screaming into prosecuting this slam dunk of a case?
Yes.

About Hunter Biden's gun issue.
And they tried to cover it up for years, since 2018, six years.
And finally, there's justice for it.
And only because of, in my view, public disclosures by Judicial Watch through FOIA litigation, only through the diligence of this judge who asked not tough questions, but basic questions about a cover-up of a plea agreement.
And, you know, Hunter in many ways and the Biden regime politicos behind his defense are also responsible for this outcome.
Hunter can blame himself and he also can blame his father's political people who thought that they could get out of this serious issue by playing politics and appealing to the jury to ignore the evidence in front of their faces.
And the jury obviously wasn't buying it at all.

No, and I will be perfectly honest.
I apologize to the audience.
As soon as we were live, the verdict hit the second we went live.
And I apologize to the audience because my wife's family is from Delaware.
I thought that Wilmington, the cake was baked.
The wires, everything was wired in favor of a hung jury here, people holding out.
Joe Biden got my aunt a job at the DMV.
I'm never going to vote to convict any Biden.
And I found myself shocked today.
I wonder, your initial reaction, Tom?
tom fitton
Well, however problematic it was in terms of the process and the path to get to this verdict or to this prosecution, the prosecution in the end was by the book.
Hunter got a fair trial.
There was a competent, fair-minded judge handling the trial.
You may not have heard this yet, Benny, because you're on air.
Fox was able to talk to one of the jurors.
He said he lost two people in his family to addiction.
He was a gun owner.
His family was gun owners.
His brother-in-law supposedly had a gun.
And they took it seriously.
And Jill being in there trying to sway the jury didn't work.
They ignored the family members in the courtroom.
So there's a little sliver of justice here.
And it's the first step.
In what ought to be a long path to accountability.
Obviously, President Biden should be facing accountability for other issues related to Biden family corruption.
But Hunter himself has a trial in September.
And there are credible allegations by the House that both Hunter and Joe's brother committed perjury and made false statements to Congress that have to be grappled with by this Justice Department.
And if this Justice Department doesn't do it, doesn't grapple with it, Then it will be up to the next administration, assuming there is a different administration next term, and Trump's administration will be able to prosecute Hunter on these perjury issues.
So it's, as I go back to the beginning, it's a necessary step, still not sufficient, still no impeachment of Joe, still no serious criminal investigation of Joe, and the credibility of Hunter obviously is shut.
Given the fact he's been found through a credible court process, unlike Trump, he did get a fair trial, and he's been found guilty of pretty serious felonies.
And I'm a Second Amendment guy, and I'm somewhat skeptical of some of the laws at issue here.
But I tell you, Benny, when you see his handling of that gun, and the evidence that was, I don't know if it was presented directly to the jury, but we've seen the pictures of him handling that gun.
You can see why that law is in place.
Hunter is lucky.
No one was killed as a result of his criminal activity.

Yes.
It does seem like the simplest...
I mean, I guess you can...
I guess, you know, the standards have been lowered.
So low.
But if you look through the evidence in this trial, this is like the easiest game of clue ever.
They have the coke on the gun.
We saw the photos.
The photos are now public.
You can see the white powder on the gun, the FBI at Quantico, saying, yeah, it's cocaine.
It's on the firearm.
And it's on the gun pouch.
And here's the photos to prove it.
And the Hunter Biden laptop's real.
I mean, it's the easiest game to do.

And they've had that laptop since December of 2019, at least, right?
It's been confirmed.
December of 2019.
They went immediately to the store when the gun was disposed of by Haley, according to Politico.
We got the Secret Service documents, and Politico was asking questions, and the Secret Service's response was, internally, did someone call in a favor?
So they all knew about Hunter.
Everyone knows about Hunter.
And this is a frustrating thing.
Everyone knows in this city, and I don't mean everyone literally, but generally speaking.
Hunter is a known quantity.
Joe obviously is a known quantity.
I mean, heck, does anyone think he became a criminal just because he became vice president?
That he wasn't engaged in this racketeering when he was senator?
These reputations preceded them all.
And by the way, while they were protecting Hunter, this FBI and DOJ, they're harassing Trump like never done before in American history.

So I certainly wouldn't ascribe the better angels to our federal government here.
I'm simply taking a W at face value and wars are fought and won over small battles and small victories that add up to big victories.
And I guess the big victory here would be an actual real special counsel investigation run by a real independent DOJ in a second Trump term into what would be the line here?
The FARA violations is what I'm seeing a lot of.
I mean, it's one of the true crimes.
tom fitton
This is, to me, kind of basic RICO racketeering operations that were taking place.
Farah is kind of like the paperwork version of the foreign influence peddling, right?
That's kind of where that may come to a head.
Of course, Farah, though, typically is only enforced against Republicans.
It's rarely ever, had rarely ever been enforced criminally, I think once or twice.
And then Trump came along and it became the go-to statue to harass Trump world with.
And so the question is, why hasn't it been applied to not only Hunter, but, you know, when there's a conspiracy, right, that's a crime, right?
And, you know, under the theory of law, under the new rules, even the suppression of this story.
Was that election interference?

Of course.
Yes.
And the guy who did it is the Secretary of State right now.

So every time Joe Biden made a comment saying Hunter did nothing wrong, was that a crime?
Well, that is, it would be under Boss Bragg's analysis of the law.

Joe Biden went on a debate stage and through his fake teeth said that the laptop isn't his son's.
And the federal government brought it forward, not just brought it forward, but the FBI said they have 18,000 different, 18,000 pages of data stored against the laptop, presumably.

And that might be the second biggest story from, obviously, the verdict, is the confirmation through this court process.
That the laptop is valid and has been verified by the government.
And that all those who suggested otherwise obviously knew better, but were trying to suppress the story and help rig an election in 2020.
And I believe you can rig elections, as Bragg has noted, by suppressing information about a candidate.

And that's now dead to rights, and that's precisely...
That's precisely what was organized, and everybody who organized it, not a single one of them has been punished.
How do you fix a system like that, Tom?
tom fitton
Well, to the degree any of those individuals have security clearances, I think they've behaved in a way that would warrant removal of their security clearances by the next honest administration.
In the least!
And I'll go back to the basics here.
If President Trump's re-elected, One might say arguably for the third time.
Then he should appoint directly a special counsel, not through the Justice Department directly, a special counsel to investigate the grand conspiracy against him and other innocent Americans here in Washington, D.C. and across several states to deprive him and others of their civil rights under the color of law.
That special counsel should be down there with you down there in Florida.
That's where he should be based and be given the resources of the federal government to do a serious independent investigation of this conspiracy against Trump.
And the ordinary course should be pursued against Joe and Hunter for the criminality evidently that's been covered up to date.

I believe that that would do so much to bring forward the actual evidence, which is the point of a special counsel, right?
You know, you deign to say it, but the special counsel exonerating Donald Trump and Russiagate, you could argue that that's a good thing, right?
You're exonerated.
It's done.

And I hope that that is utilized effusively in the second administration.
Special counsels can and should be appointed to look at Epstein and Clinton's, Clinton Foundation.
It would be wonderful to see.

Well, the rules against statute of limitations have been thrown out the window, too.
That's right.
In the end, Benny, you kind of point to the issue.
It's not so much putting people, quote, in jail.
It's about reassuring the public that justice is being fairly administered.
That when there's a serious allegation of criminality, that it's pursued.
Unless there's serious allegations of criminality, it's not going to result.
So in that case, Trump should have been protected from Mueller, and indeed he found nothing.
But in case after case, we have a serious allegation of criminality by the protected class here in D.C., and it hasn't been pursued.
And Joe Biden is Exhibit A. Yes.

You saw that with the documents.
The exact same thing, but far worse, of course, because he was never president.
Many more locations with classified documents.
And you could argue far less security because they're inside of institutes that are funded by the Communist Chinese.
And nothing.

Well, that's dangerous talk.
According to Attorney General Garland, he wrote an op-ed today in the Washington Post.
I don't know if you noticed it.
He saw the gag order, by the way, of President Trump, his Justice Department, a federal court gag order telling Trump not to criticize him and the FBI for raiding his home.
And he said all such talk is, quote, dangerous and must be stopped.
So he's willing to go to court to stop you from talking, Benny, so watch your back.

Well, the point is, it's not just rhetoric.
I mean, he's asking for the court to shut down Trump's free speech.
So when he says things must be stopped, we should understand that to mean that he wants the government to shut us down.

Final question for you, Tom, here is sort of like an esoteric one, which is, Is there any regaining faith inside of these institutions?
I mean, you can't run a country when nobody trusts the institutions.
You can't have an NFL game when everybody assumes the outcomes are rigged and knows that everything's been already fixed, prefixed.
And you can't have a Justice Department when people see...
People who are paying attention really see the way that the Justice Department has been operating the last couple of years have lost all faith.
And can it be fixed?
You know, is there a writing of the ship here or is that ship sailed?
tom fitton
Well, the Justice Department is, you know, when we're talking about accountability, Justice Department hasn't faced accountability for their misconduct.
You know, if a local prosecutor did what the Justice Department was doing to harass Trump, they'd be facing...
The criminal allegations, think of that prosecutor who went after those Duke students who were falsely accused of rape.
He was held accountable to that prosecutor in the end.
And so when I talk about a special prosecutor, they have to investigate the investigators.
And I think the best, I don't know if it's the best way, a key way to right the ship at the Justice Department is to ensure that there is an accountability for the abuses that have gone on.
Through outside investigators, criminal investigators, examining the politicization and the weaponization of those agencies to try to jail the political opponents of the Democratic Party.
