The Supreme Court announced one or more opinions will be released at 10 a.m.
As per usual practice, we don't know which one.
But the court also almost always issues decisions on days when justices are scheduled to take the bench.
And this time, the judges, justices rather, will not be doing that.
They're not scheduled to return to the courtroom until March 15th, raising speculation that a ruling on the Colorado case will be handed down.
And there is an urgency.
Colorado is among the more than dozen states.
During arguments last month, the Supreme Court appeared skeptical of Colorado's effort to kick former President Trump off its primary ballot.
They questioned how a ruling in its favor would not lead to an unimaginable situation for the country.
The Colorado court was the first to invoke Article 3 of the 14th Amendment, barring former officeholders who engage in insurrection from holding public office again.
Maine and Illinois also joined Colorado in removing Trump from their primary ballots, but the decision has been stayed pending an appeal.

You have to be a natural-born American citizen.
If you are under the age of 35, you can't be president.
If you haven't lived in America for the last, I think, 15 years, funny little clause in there, but you can't be president, right?
You have to be living in America.

Now, after the Civil War, they decided to put in there a little, you know, a teeny little caveat that's like, if you engage in insurrection, if you fought a war, if you took up...

And then fought a war to destroy America and the American government, then you also can't be president.
But you'd have to be found guilty of that.
You would have had to have literally held arms in the Civil War standing against the federal government, right?
So not commenting on the wisdom of that amendment or how that could or couldn't be interpreted, that's the rule, right?

I mean, obviously, that's a great point.
There's an enormous amount of Congress that engaged in direct insurrection.

That was, like, of course, remarkably and profoundly different than what happened on January 6th, and also different on what happened with, like, the BLM riots and so on.

They concur in the judgment, but they say they don't think the court should have gone to all these additional questions that they did.
They said it was enough, and Justice Barrett said in her concurrence, too, just to get to the bottom line that states cannot do this.
It's not in their purview to do it.
But the dissent...
Again, not dissenters, the concurrence that comes from Justices Sotomayor, Kagan and Jackson takes a different path.
They think the court goes too far.
They say this, by resolving all these extra questions, the majority attempts to insulate all alleged insurrectionists from future challenges to their holding federal office.
So they feel like...
The court went too far.
You try to go as narrowly as possible.
Again, they agree with the overall decision, but think that the court is trying to give too much cover to future candidates who may face this scenario, and they just don't think the court...

Such a massive revelation there from Andy McCarthy, who is a expert on said issues here, a legal expert and a writer and an editor on legal issues decided by the court, saying that if so Trump wins in 2024, Congress can try to do like a backdoor trial of Donald Trump and again try and convict him.
And the Supreme Court now like shuts the door on that has now devastatingly destroyed that option for Dems.

And when we step back and look at the national landscape on this, here we have a 9-0 ruling from the Supreme Court.
Slightly different bases, as Joan pointed out, but a 9-0 ruling reversing what Colorado did.
And even before that...
There were dozens of these challenges, somewhere between 20 and 30, depending on which you count or don't count.
And the success rate was very low for these 14th Amendment challengers.
They really only ever got any traction in those three states.
But this has been rejected by state courts, by federal courts, by trial courts, by, as Dana mentioned, by state-level secretaries of state.
Brad Raffensperger, the guy on the other end of that phone call.
From Trump, I need you to find 11,780 votes.
He rejected it.
So there is a very broad consensus on, again, not on whether Trump committed insurrection or not, but on the legal grounds for these 14th Amendment challenges.

This is 100% the decision that was expected after the oral argument, which went so poorly for those who were trying to defend the Colorado decision to kick Donald Trump off the ballot.
What the decision says, and it's unanimous on this point, is that there isn't any way that this 14th Amendment provision has been implemented by, for example, congressional legislation.
There's some debate among the majority of the court and Justice Sotomayor, Kagan, and Jackson, as well as Justice Barrett, about what Congress or someone else, some other government entity needs to do.
But the bottom line is it is the sweeping victory.

And Donald Trump, they are trying to say that he does not have immunity, that Donald Trump can be put on trial for acts that he did as president of the United States.

So can we put on trial Bill Clinton for everything that happened with Jeffrey Epstein?

But it's also not just like what MSNBC said, Neil Kochel, who was the acting Solicitor General under Obama.
It wasn't just after the oral arguments that people knew this.
All of the right-minded people in this country, all of the fair Americans sitting at home, knew that this would be the result of this case as a legal matter when we got into this thing.
And the sad reality is that it takes this entire process of going through the state of Colorado courts all the way up to the Supreme Court to finally get a decision that is unanimous, 9-0, that says states can't disqualify candidates for federal office under the 14th Amendment.
That's a power that's reserved exclusively for Congress.
Now, just think about what that means.
How did we get to a place as a country where we have to go all the way up to the Supreme Court to correct something that's so radical, so harebrained, and just so wild?
Look, what I view this as is as a legal matter and as a practical matter.
The left likes to take legal theories that are basically the equivalent of a square peg.
And they find these round holes.
And they just keep trying to hammer that damn peg into those holes.
And they keep doing it and doing it and doing it.

They inflict all kinds of damage.
And they do all kinds of harm in the process.
It's never going to fit there.

Yeah, look, so Congress would have to pass specific legislation to enforce the Section 3 of the 14th Amendment.
And so they've done so in the past, historically, 100 and something years ago, 150 years ago, they've done that.
They can't do anything with the 14th Amendment with respect to him engaging in an insurrection, which he didn't.
But of course, for those members of Congress who would bring those arguments, who would do these procedural motions, refuse to certify electors or whatever the case may be, we've all seen the shenanigans over the years.
They're not going to be able to do so on the basis that Donald Trump engaged in insurrection, because that is something that Congress would have to separately...
Pass through both chambers a new law that says that these types of things happen to folks who are not eligible for the presidency under the 14th Amendment Section 3. So it's honestly, it's a good, it's some good insurance.
It is good insofar as it should shine a clear light and clear away things in other parts of the country, like the state of Illinois.
A court there just last week issued a decision.
That was similar to the Colorado decision and said he could be on the ballot there.
These cases are in other states as well.
So this should clear a lot of things.
It should.
That's a key word.
Should.
Will the radical left continue to try other harebrained and wacky legal theories to try to harm Donald Trump and keep him off the ballots?
Absolutely.
That's what they do.
But at least this one is resolved 9-0.

As Americans, in your intro to this bit and talking about the Third Amendment, right, and the quartering of soldiers in people's houses, we as Americans, we forget about history.
We forget about why we set this country up the way that we did and why Congress created things like the Department of Justice and the FBI.
And it damn sure wasn't to go after grannies protesting outside of abortion clinics.
All across the country.
That is not what the purpose of the Department of Justice was for the FBI.
The Department of Justice was set up to help combat and enforce the rule of law in a federal system.
In the 1800s, the Attorney General predates the creation of the Department of Justice, but DOJ was created in the 1800s, and it was created at a time when you had rule of law deficiencies across the country in different jurisdictions, territories, states, whatever the case may be, and you want to ensure that you're able to apply consequences to criminal acts across state lines and that you're able to defend the interests of the United States.
And so what you have to do as a Department of Justice is you have to focus on your core mission.
And you have to focus on things like violent crime and rule of law and going after people who are actually terrorizing American citizens all across this country and cities all across this country.
If you actually focus on the things that Congress wanted you to focus on, things like the border, things like prosecuting illegal immigration, folks coming across the border illegally, going after a major crime that's ruining.
Major cities in the United States, even going after things like interstate retail theft rings, all of this stuff, there's money behind it.
These are things that ruin this country.
These are things that ruin the fabric of our society.
And if you are focused on tackling those things, you can address all of the other issues because, folks, there's only so many hours in a day.
And so if you as a prosecutor or you as an FBI agent...
Or if you as any other person in the Department of Justice are talking about going after someone who's protesting outside of an abortion clinic or someone who peacefully protested on January 6th, and you think that there's a legal basis to do so, well, you damn well better make sure that all of the crimes in your city are solved and that all of the murders in your city are solved and that all of the street gangs and the cartels and the drugs that are flowing into this country are solved.
Then, and only then, can you even think to talk about those other issues.
And guess what?
Those issues, most of those cases, are examples of abuses of power, violations of constitutional rights, like the ability to protest and petition the government.
The list goes on and on.
There is so much to be done in the future for whomever the next conservative president is.

It's in response to this latest Supreme Court ruling, and we really have zero expectation they are going to do so.
Biden's reelection campaign, though, is highly likely to put out some kind of a response to today's ruling.

Now, the reason I say this is because back on December 20th, that's the day after Colorado first issued this ruling, kicking Trump off the ballot, effectively, Karine Jean-Pierre was asked about the issue and to weigh in from the podium, and she said very clearly.
Clearly to reporters there that day that Hatch Act considerations prevent the White House from commenting on this or any other presidential reelection campaign matters.
The president himself has been asked about this.
Most recently, back at the end of January, he told a reporter that he was fine with President Trump, former President Trump, staying on the ballot inside in Colorado personally.
But you've got to keep in mind, Bill, the president's reelection campaign is built around this message of trying to save democracy.
And the president himself personally has depicted the former president as a direct threat to democracy many times over now.
Most recently, when he traveled to the state of Pennsylvania for his campaign swing, he delivered that primetime address to the nation in which he proceeded to depict the former president as a direct threat to democracy.

They have turned the judicial system on its head because they truly believe they're saving the country.
But what they're really doing is destroying the country.
And so these people got to be stopped.
I think Donald Trump is the person to do that.

Stop the foolishness.
The only body who's going to say that somebody can't be on a ballot is Congress.

It's about how they look at what the EPA decides to do.
It's how they look at banking regulations.
It's how they look at energies, thinking that, oh, no, wind turbines and solar panels, they're going to solve everything.
But when you actually look into the details, you realize that solar panels are dirtier than natural gas.
Wind turbines have killed more people than nuclear power plants have.
And so this is the problem for the insane left.
These are the people who would say that you've got to support the Palestinians above all else, even though it was Hamas who was elected by the Palestinians in Gaza that perpetrated one of the greatest atrocities in the modern era, definitely in the last hundred years.
And so this is the stuff that you're dealing with with these people.
So they've got to be defeated.
You can't reason with them.
You've got to be defeated.

We saw sort of the rally cry this weekend from Donald Trump talking about Lakin Riley, speaking of sort of the horrors that are homegrown or home imported into our nation.
Obviously, the death of the nursing student just north in Georgia.
This is horrific.
Donald Trump using this as a rally cry to say these policies are insane.
And now Lakin's family.
Sort of getting into it and saying, our daughter should be here right now.
These are policies that killed our daughter.
That's a powerful message, obviously, and a story that's happening around the country.
How do you see that progressing as we head into the November election?
People seem to be waking up right now.
And more importantly, Byron, every single morning, there's some new horrible bit of news we got to cover with a criminal alien that comes in and devastates the life of an American.

Well, first, look, to Lake and Riley's family and to the family of everybody else who's been lost, we usually talk about senseless violence.
This doesn't need to actually happen.
If the federal government led by Joe Biden and the radical Democrats actually followed the law, we wouldn't even be here.
So my heart and my prayers definitely goes out to them because this all could have been avoided.
But you're dealing with people in Joe Biden, in these nutty Democrats.
Who truly believe this is the best thing for our country, and it's a flat-out lie.
I think that this issue of immigration is here to stay.
It's not going to go anywhere.
It's the number one issue in our country.
It has surpassed the economy.
And usually the economy is always the number one issue.
It is now border security and immigration.
Because people, no matter what your politics are, are looking at the situation and saying, they're saying something real simple.
They're like, look, we care.
We want people to have an opportunity at the best life ever, but you cannot flood our streets with illegal immigrants.
You just can't do it.
We don't have the capacity.
And now when we find out that in Venezuela, the knucklehead leader down there is empty in his prisons, and some of these people are ending up in the streets of New York, the streets of Georgia, the streets of Chicago, etc., it's only going to lead to more of these tragedies.
We have to have a major change in leadership.
We're going to have to deport a lot of people, send them back to their countries, whether Venezuela or any other country wants them or not, they're getting dropped back because that's the type of consistent, dedicated leadership you got to have in a country if America is truly going to live up to all of its ideals, all of its ability, and our people can thrive.

Calm some of the nerves in the audience because we regularly cover how Paul Ryan promised to build the wall and didn't get it done.
How Mitch McConnell said they'd be there for Trump and didn't get it done.
And Donald Trump was handed a Republican Congress and a Republican Senate and we couldn't even get the wall because it was too expensive, right?
Still hundreds of billions of dollars to Ukraine to protect their border.
Nothing for our own.
And so many people saying, like, how do we get a Congress that...
When Donald Trump comes back in the office, how do we get a Congress that actually stands aside Trump and delivers?
Because, as you just said, deporting a bunch of people, that's going to be one hell of a fight.

Well, let me just tell you, there's some things I'm not going to say right now, Benny.
But the conversations internally in the House and even in the Senate are, what are we going to do when Donald Trump comes back?
And I think what definitely happened back in 2016, 2017, is they weren't prepared.
To do the job in that Congress.
We're making sure that does not happen again because, to be blunt, I think we got one shot at this.
We have one opportunity to make sure that we get our country back on track in every way possible.
It's not just immigration and border security.
It's our financial system.
It's sound money.
It's cutting spending.
It's foreign policy.
We have a lot of work to do in a short amount of time.
We got one moment in time to get it right, and I think that we're marshalling all of those resources on the Hill to be prepared for the 47th President of the United States.

I think that's one.
Two, you know, for my colleagues on Capitol Hill, it's great to have majorities, but you got to do something with them.
If you don't do something with a majority, in my opinion, you don't deserve to keep a majority.
And so that's the pressure that I put on my colleagues and a lot of other members are putting on because we don't just want to run for office and be members of the House or members of the Senate and have a cool pen and go give speeches.
We actually want to get something done.
And so I think that that's going to be the mission ahead for Speaker Johnson or whoever the next Senate majority leader is going to be, because I think we're going to take the Senate as well.
The mission is going to be about getting the job done, not about worrying about the Sunday shows or worrying about, you know, some cocktail party in D.C. It's about getting a job done for the American people.

And what he always tries to do is make the best decision based upon all the information available to him.
That's what you need in the leader.
But he's locked in and focused.
He wants to get rid of Joe Biden like everybody else does.
And then it's about what are we going to do and how are we going to get the job done really in the first six to eight months of the 47th presidency.

That's his mindset.
That's where he is.

And there seems to be sort of a very like below the surface, like this guy's going to win.
There's nothing we can do to stop it.
And now it's time to, like, try and kneecap him again.
Do you see that sort of metastasizing right now in Washington, D.C.?
Do you see sort of, like, depression on the Democrat side that they have properly failed?
And how do you prevent them from pulling a Russiagate 2.0?

They're not at their happiest, which is a good thing for America.
But, look, what we've got to be able to do, and let's be very clear, We have to use every tool at our disposal to make sure that they don't try to stonewall.

We've got to make sure none of that occurs.
Or limit it, really, to the best of our abilities.
So it's going to mean that we're going to have to take some tough stances.
And that's fine.

And we can't be worried about apologizing for it or worried about being blamed for it.
Because the left never apologizes.
They're never worried about blame.
They're full speed ahead every single time.

And I think if that's kind of the mindset that we have out of the next Senate leadership for Republicans, combined with that in the House, we're going to accomplish a lot.
And the country is going to be changed in a dramatic way for it.

And it seems like there's some pretty interesting moves, Rand Paul.
People are beginning to drop that name as somebody who would wish to be a leader.

Rick Scott, a great senator from Florida, obviously, someone that you know and work with, joined the show last week to talk about it.
He was singing, oh man, I've never seen him so happy.

So how's that shaping up?

That obviously is hugely consequential for what the House does in D.C. Well, look, I think what's really going to shape this is that the Senate Republicans haven't had new leadership in 15 years.
So it's going to be an entire new way to look at Senate Republicans.
I think that the additions you've had over the last several cycles, Katie Britt, Tommy Tuberville, obviously Rick Scott came in a couple of years ago, J.D. Vance, hopefully we get Bernie Moreno, support Bernie Moreno.
If you're in Ohio, get out and vote for Bernie Moreno.
Get Bernie Moreno in the Senate.
You have a whole new crop of guys, different new mindsets in the Senate that's going to have to be reflected in the leadership.
And so, you know, I'm excited to see what comes.
I think it's going to be a really good thing for the Republican Party overall because, look, Mitch McConnell, you know, there are things I disagreed with him on.
You know, there are things that he did a good job on.
I'll give him credit for that.
But we need a conservative leader.
In the Senate.
We need somebody who's going to be mission-minded and agenda-minded at all times.
And I think that that kind of leadership is going to bode well for the Senate.
It'll actually make the job easier in the House, and it'll actually help President Trump be able to accomplish the agenda.
What I'm going to tell you is, I think it's going to be a wild ride for the Senate.
They haven't done this in a long time.
But what I'm really counting on and hoping on is that you have about 25 to 30 really Tough, strong, America first members of the Senate that they hold the line to make sure that the leadership reflects their values, their interests, and what's going to be best for the country.

Final thing, because I have asked you before, final thing, because I have asked you before, Friday was a nightmare day for Fannie Willis.
You've come on this program to talk about Fannie Willis before.
Your takeaway thoughts, things are not looking good.

Man, the judge just needs to do the right thing and remove her from the case.
Like, what she's done is unethical, and then she got caught in it.
She lied to the court.
She's got to go.
It's that simple.
And so I think that's what the judge is going to do.
He's going to remove her, going to remove, obviously, Nathan Wade.
He's gone.
I think that goes without saying.
Then the question is really going to become, does the rest of the Fulton County office want to do this?
Because I don't really think they do.
I think this was Fannie Willis' deal to try to put herself in position to try to run for governor or whatever she wanted to do in Georgia.
I mean, she was going to lose anyway.
That's what she's trying to do.
So I think that's what's going to happen.
We'll see in a couple of weeks.
I think that's what the judge said.
He's going to come back in a couple of weeks and give his ruling.
But that Rico case should have never been brought.

Some of the rhetoric of your position, I don't think it is your position, but some of the rhetoric of your position seems to suggest, unless the states can do this, no one can prevent insurrectionists from holding federal office.
But obviously, Congress has enacted statutes, including one still in effect, Section 2383 of Title 18 prohibits insurrection.
It's a federal criminal statute.
And if you're convicted of that, you are, it says, shall be disqualified from holding any office.
And so there is a federal statute on the books, but President Trump has not been charged with that.
So what are we to make of that?

And any day, actually, you can go and legally enter the United States Capitol.
You walk through into the visitor center.
I know this because I lived in Washington, D.C., worked at the United States Capitol.
You walk through the visitor center, you go through a little metal detector, and you go, oh, I'm in the Capitol.
That's how it works.
You contact your congressman, you go take tours.
You know, and many people maybe don't know that, but Congress is like a public building.
It is open to the public.
Like, I think every day of the year.
And so these are the clips that you see of the little grannies with their little flags as they walk up and down the hallways peacefully, fist bump the cops.
That's the second group of people.
It's a large preponderance of people who are being treated as political prisoners, who did literally nothing wrong.
They showed up.
It's the kind of thing that has Nancy Pelosi screaming, trespassing at the Capitol, I'm waiting for it.
The final group of people are all the federal agents who are in the crowd.
And we know that there are hundreds of federal agents in the crowd that they were pushing and agitating the members of the crowd to behave in a manner that they knew was going to be treated and prosecuted in a criminal way.
And those people deserve to stand trial themselves.
That's entrapment.
You're not allowed to do that.
But we know one thing for sure, that all of those groups of people Above all of them is Donald Trump, who's the only person that really actively tried to stop January 6th, shockingly.
Kash Patel tells us time and time again that Donald Trump authorized the use of 20,000 National Guard troops to stand guard at the Capitol to ensure that no shenanigans went down.
Donald Trump knew about this.
Nancy Pelosi said no!
Leave the Capitol grounds wide open.
And Nancy Pelosi is the one who actually allowed this to happen.
That's a matter of fact.
In fact, Stephen Sund, the Capitol Hill police chief, has said this many, many times.

She refused to secure the building.
It's actually her job to do that.
And so if you're looking at somebody who actually should be prosecuted for what happened on January 6th, you should start with Nancy Pelosi who was in charge of security of the building.

For its unanimous decision today, it was a very important decision.
We're very well crafted.
I think it will go a long way toward bringing our country together, which our country needs.
And they worked long, they worked hard, and frankly, they worked very quickly on something that will be spoken about 100 years from now and 200 years from now.
Extremely important.
Essentially, you cannot take somebody out of a race because an opponent would like to have it that way.
And it has nothing to do with the fact that it's the leading candidate, whether it was the leading candidate or a candidate that was well down on the totem pole.
You cannot take somebody out of a race.
The voters can take the person out of the race very quickly.
But a court shouldn't be doing that, and the Supreme Court saw that very well.
And I really do believe that will be a unifying factor, because while most states were thrilled to have me, there were some that...
It didn't.
And they didn't want that for political reasons.
They didn't want that because of poll numbers, because the poll numbers are very good.
We're beating President Biden in almost every poll.
New York Times came out yesterday with a very big poll for us.
So they didn't like that.
And you can't do that.
You can't do what they tried to do.
And hopefully Colorado, as an example, will unify.
I know there's tremendous support.
They brought our support up very strong in Colorado because people in Colorado thought that was a terrible thing that they did.
And while we're on the subject, and another thing that will be coming up very soon will be immunity for a president.
And not immunity for me, but for any president.
If a president doesn't have full immunity, you really don't have a president because nobody that is serving in that office will have the courage to make In many cases, what would be the right decision or it could be the wrong decision.
It could be in some cases the wrong decision, but they have to make decisions and they have to make them free of all terror that can be rained upon them when they leave office or even before they leave office.
And some decisions are very tough.
I can tell you that as a president that some decisions to make are very tough.
I took out ISIS and I took out some very big People from the standpoint of a different part of the world, two of the leading terrorists, probably the two leading terrorists ever that we've ever seen in this world.
And those are big decisions.
I don't want to be prosecuted for it.
Another president wouldn't want to be prosecuted for it.
It had a tremendously positive impact.
It stopped everything cold.
And sometimes you have to make, they were tough decisions, sometimes you have to make decisions like that.
When you make a decision, you don't want to have your opposing party or opponent or even somebody that just thinks you're wrong bring a criminal suit against you or any kind of a suit when you leave office.
I have that right now at a level that nobody's ever seen before.
I have rogue prosecutors and I have rogue judges.
I have judges that are out of control.
And it's a very unfair thing for me, but serving perhaps as a sample.
To others of what should not be happening.
When you make good decisions, and in my case, the economy was great.
We didn't go into any wars.
We totally defeated ISIS.
We provided the largest tax cuts in history.
We provided the largest regulation cuts in history.
But think of it, no wars.
We beat ISIS 100% of the caliphate.
And there were no wars.
We did a job that was great, but maybe I wouldn't have done that.
The caliphate defeating them was very powerful.
It was going to take four years.
It took me four months.
But it was a very strong dictum that I gave.
I said, get them.
Defeat them.
End it.
We were fighting for 20 years against ISIS, and we did it very quickly.
I don't want to be prosecuted.
In that case, it worked out very well.
There will be some things that perhaps don't work out so well, but I don't want to be prosecuted.
I'm prosecuted because I decided to do something that is very much for the good of the country and actually for the good of the world.
The president shouldn't have that on his mind, and he has to have a free and clear mind when he makes very big decisions.
Or it's going to be nothing more than a ceremonial post.
You'll be president, it'll be a wonderful thing, and you won't do anything because you don't want to be hit by your opponent or hit by somebody else because who wants...
To leave office and go through what I've gone through.
I'm being prosecuted by Biden, my opponent, because every one of these things, whether it's Fannie Willis or Bragg, these are local and state, but they're in total coordination with the White House.
You can't do that.
It shouldn't be done.
I mean, a thing like that, in the case of the DA's office, they put one of the top people, maybe the second person, in the...
Manhattan DA's office to get Trump.
They had a Hillary Clinton lawyer leave the law firm, very prestigious, big law firm, leave the law firm to go into the DA's office to get Trump, Pomerantz, Mr. Pomerantz.
So he goes in to become a prosecutor, work for the Democrat Party and Hillary Clinton, goes in to prosecute Donald Trump at a local level.
In total coordination with the Department of Justice, meaning Biden.
And then you have the Fannie Willis, or as she would say, Fannie, Fannie, F-A-N-I, Fannie.
And she hired somebody who knew the person long before this horrible prosecution took place.
And she went out and she paid him an unbelievable amount of money, more money than he ever had dreamt possible.
Much more money than other people that are...
They'd do that for a living.
He never did it at all, had no experience in it at all.
And they had obviously a conflict.
We don't have to go into that.
But they were able to get a lot of money because it was a high profile person.
Me, I'm a very high profile person.
So they were able to pay him close to a million dollars when he was not equipped to do the job.
And she's not equipped to do the job.
And that case should end immediately.
That case is so conflicted nobody's ever seen anything like it.
And then you have deranged Jack Smith, who's a Trump-hater and represents all the Trump-haters.
And he's going wild.
He's just a wild man.
He's been overturned unanimously by the Supreme Court.
Went after other people over the years.
He's had great failure.
But he's mean, he's nasty, he's unfair.
And the judges on these cases, they're all Trump-haters.
Other than we have maybe one or two that I think can be fair.
But you look at New York, what's happened.
I mean, these people have...
Tremendous hatred.
You can't do this to a president.
And again, I'm not talking about me.
I'm talking about in the future.
A president has to be free.
A president has to be, if the president does a good job, I did.
Some people would say a great job.
But if the president does a good job, a president should be free and clear and, frankly, celebrated for having done a good job.
Not indicted four times.
And not gone after on a civil basis and not demanded to pay hundreds of millions of dollars in fines on something that was absolutely perfect, where there were no victims, where the financial statements were absolutely flawless, where you have disclaimer clauses.
I mean, nobody's ever had a thing like this.
I wasn't given a jury.
And I had a clubhouse judge just come up with this number on a perfect loan.
And very conservative financial statements.
But even at that, if you look, the disclaimer says don't rely on the financial statements in any way, shape or form.
Go out and do your own work.
The bank in question had the most sophisticated lawyers in the world, frankly.
A very top, one of the top law firms anywhere in the country.
And they can defend themselves.
What guys like Bragg and Letitia James and Fani.
And deranged Jack Smith.
What they should be doing is fighting violent crime.
And that would lead me to the end.
I will say that President Biden, number one, stop weaponization.
Fight your fight yourself.
Don't use prosecutors and judges to go after your opponent to try and damage your opponent so you can win an election.
Our country is much bigger than that.
The other thing I say to President Biden, close the borders now.
This is not sustainable for our country.
It's not sustainable for our cities.
Our country is under siege.
This is a violent thing that you've done.
And many people are dying.
Many, many people are dying.
They die on the trip up.
They die going through the border.
And they die in our country.
But many of the people coming up are from prisons and jails, from mental institutions and insane asylums.
Many are terrorists.
You see it.
Many, many are terrorists.
And I believe the real number that we have right now is probably closer to 15 million people.
And by the time the term ends, I believe the president's term ends, I believe you'll be at close to 20 million people.
That's almost larger than any state in the Union.
Our country, it is not sustainable.
Many of these people are tough.
Many of these people are bad.
They come from some of the roughest countries in the world and some of the roughest prisons.
We have prisons in the Congo, in Africa, coming.
We have people coming from all parts of the Middle East.
They're coming from Yemen, and yet you are bombing Yemen.
You have to stop.
You have to close the border.
You have absolute authorization.
You don't need Congress.
I had the safest border in the history of our country.
And I didn't use Congress for it.
And then I built hundreds of miles of wall.
And the reason I built it and how I built it was I considered it an invasion of our country.
And I took the money from the military.
And the Army Corps of Engineers did it with me.
And we did a great job.
And we had the safest border we've ever had, and now we have the most unsafe border anywhere in the world at any time.
There's never been a border like this in any country, anywhere in the world.
They would have fought with sticks and stones to stop the horrible situation that's occurring.
Our people can't stand it, and the people coming in really can't stand it because they're dying.
Many are dying on the trip up, and they're dying in the country.
And also, many of the people are criminals.
And they're doing tremendous harm.
I call it migrant crime.
It's migrant crime.
It's a new category of crime.
They're hurting our country horribly.
And we've become a laughingstock all over the world.
So I say respectfully to President Biden, you have the authorization right now.
I did it.
I didn't go to Congress and say, do I have the right to close?
I fought Congress on it.
Close the borders.
You can do it right now.
You have everything.
Use my policies.
My policies were great.
Everybody said it.
Use my policies.
So just to finish, I have great respect for the Supreme Court, and I want to just thank them for working so quickly and so diligently and so brilliantly.
And again, this is a unifying factor.
Everybody now is together, and they can go after me.
As a politician, they can go after me with votes, but they're not going to go after me with that kind of lawsuit that takes somebody out of a race who's leading in this case, but even if the person wasn't leading.

They see how life was back under a Trump administration.
Do you think that's the key to pull some of these independent voters into this next election, seeing that legal cases are unfair, they have no merit, and also the poll numbers and their life reports?

It's such an interesting question, because historically, a thing like what I've been going through would have hurt a political party or a political candidate terrifically.
You wouldn't even run.
You wouldn't be able to run.
You'd get out if this has happened.
Over many years, many times.
In this case, the polls show that I'm much more popular than I was before weaponization.
It's been weaponized like it's never been.
This is for third world countries.
This isn't for us.
Biden ought to drop all of these things.
And frankly, he may do better if he does, because people would say, wow, that was very reasonable.
Look, they're all the state, the city and the federal.
They're all coordinated.

That Texas passed through their House and their Senate that said that Texas has the right, in fact, the obligation to deport criminal aliens that are entering their state illegally is now going to take effect March 5th.
Tomorrow, ladies and gentlemen, federal appeals court granted the temporary stay of the lower court's decision to block the enforcement of Texas controversial immigration law, paving the way to go into effect this week.

If the Supreme Court does not intervene, last week a federal judge in Austin, Texas, blocked the state government's implementation of Senate Bill 4, which would allow the state enforcement authorities to arrest and detain people if they suspect they are entering the country illegally.
Judge David Allen Ezra wrote in the Thursday decision to halt the law that if allowed to proceed, It would open the door for each state passing their own version of immigration laws.
Texas appealed the ruling.
Republican Governor Abbott said, we will not back down our fight to protect our state and our nation, President Biden's border crisis.
And now the Fifth Circuit of Appeals has granted a stay of the decision, put the ruling on hold, allowing for the Biden administration to try and go to the Supreme Court.

We end today with a perfect encapsulation of what is to come from one of our favorites, what I call our in-house attorney here on the program, Mike Davis.
Mike Davis saying the 9-0 Supreme Court decision reversing the Colorado Supreme Court was a major blow to the Democrats' lawfare and election interference against Trump, and it's just starting.
And aside here, the Supreme Court effectively ruling that Donald Trump didn't commit an insurrection today.
Like, that's, like, read between the lines.
Like, between the lines is that the entire insurrection narrative now completely, is completely blown out.
Done.
Remember, the Supreme Court will likely reverse the obstruction convictions of many January 6th defendants by the end of June.
That will lead to probably the largest class action lawsuit in American history, hopefully, against the federal government by people who were wrongfully detained and treated as political prisoners.
Because of the Biden Justice Department intentionally misapplied and weaponized a post-Enron obstruction statute aimed at corporate fraud to destroy political enemies.
That's half of Jack Smith's bogus January 6th case against Trump.
By the end of June, the court will likely hold the president and any president is immune from criminal prosecution for his official acts, just as federal judges and members of Congress.
Then remand the case to the D.C. Obama judge, Tanya Chutkin.
To hold an evidentiary hearing, she will likely have to determine what Jack Smith alleges Trump did in his official capacity.
That decision is subject to immediate appeal.
There is very little chance that D.C. Obama Judge Tanya Chutkin and Jack Smith can railroad Trump before a D.C. jury and convict him before November 5th, 2024.
80% of Jack Smith's cases will be gone before the trial even begins.
The other 20% will be reversed on appeal.
Because it's not a crime to object to a presidential election.
It's specifically allowed by the Electoral Account Act and the First Amendment.
This is why Democrats like Al Gore, John Kerry, and Hillary Clinton aren't in prison for objecting to Republican wins.
Jack Smith is used to getting reversed unanimously by the Supreme Court as he brings bogus political charges against likely Republican presidential contenders such as the Supreme Court's unanimous 2016 reversal of Jack Smith's conviction of former But it was too late.
Jack Smith destroyed his political life.
Then, Mike Davis saying, we will prevail.
