Look, I mean, as a national security prosecutor from back in the day and public defender, I filed lots of these and I challenged lots of these. | ||
And to break it down really is when you challenge a search warrant, you're saying, Hey, you came into my home or my car or my apartment in violation of the Fourth Amendment of the Constitution, which governs searches and seizures. | ||
Now, warrants have to typically lay out what you're looking for and where you're going to find them, not just go to this field and take everything. | ||
That is an expansive, overly broad, usually unconstitutional warrant. | ||
I haven't read through the memo entirely because it just came out, or the pleading from Trump's attorneys, but that's generally what they're looking for. | ||
The other thing you basically generally try to get into is in these very unique situations involving national security and seizures of these types of documents, you need someone... | ||
First of all, a magistrate judge is like a JV guy. | ||
He doesn't really serve as, not really, he's not a lifetime appointed judge confirmed by the Senate. | ||
You could become a magistrate judge, literally. | ||
All you have to be is a lawyer, and the judges in that district choose you for a six-year term. | ||
Right? | ||
The district court judges, the real guys, choose you. | ||
And so the fact that this case is still with him, putting aside whether or not he should recuse, is offensive because it has to do with the President of the United States. | ||
It should go to an immediate district court judge overnight. | ||
And any decision this JV guy makes will always be appealed to the district court judge. | ||
I'm not saying magistrates don't serve a useful purpose or an important part of the judicial system. | ||
But when you're talking about the President of the United States as your target, you go to the major leagues. | ||
You don't sit down there in the minors while you screw things up royally. | ||
And America continues to lose faith in the FBI and DOJ. | ||
But apparently that's what's happening. | ||
So we'll see what he says. | ||
have zero, zero faith that he will do anything to overturn this warrant because he will do a frank search, frank's hearing, and look at the Yes! | ||

We're not going to get much from this magistrate, and his days are probably numbered in the sense that it will eventually all go to the district court judge where it should be. | ||

I mean, anybody that actually thinks this guy is going to send out, the affidavit is out of their mind. | ||
He has no interest in doing that. | ||
He's putting on a charade by saying, oh, you guys go ahead and do your redactions, and then come back to me. | ||

You made our jaw drop last night on Levin, an incredible, incredible hit, and we encourage everyone to go watch it. | ||
But you talked about who actually packages up the GSA, actually packaging up the documents and shipping them to Trump. | ||
Can you unpack that metaphorically and literally for us? | ||
Yeah, the Government Services Administration is an entire agency who does many things. | ||
One of which is moving presidents in and out of the White House during a presidential transition. | ||
And they have publicly said that they were the ones who handled some of the boxes and moved them around. | ||
It's not like Trump sat there and packed documents into boxes and was like, oh, I want this key thing. | ||
But that's important because people are going to be like, well, Hillary actually possessed classified information. | ||
Not that this stuff was, but let's say it is for argument's sake. | ||
She actually hit send and receive and said, do something with this. | ||
That's physical possession of it. | ||
And the Department of Justice defined that to be not criminal. | ||
So by their very own definition of the statute, if Trump never handled a single piece of paper, what are you going to charge him with? | ||
Nothing. | ||
They're going to try to go after him for taking things that don't belong to him, basically. | ||
I'm like, good luck charging a former president of the United States with taking stuff from the White House. | ||
And then, oh, by the way, go back and charge Obama, Bush, Clinton, Carter, and everybody else that took stuff from the White House that didn't belong to them. | ||
It's a total, total ruse to get a search warrant, and the DOJ has monstrously overplayed its hand because it's run by corrupt criminal gangsters who think that they exist to execute some sort of jurisprudence that doesn't exist. | ||

Yeah, look, as the lead investigator in Russiagate, Devin and I have always said we only got out 60% of the documents we wanted to get out that should have been declassified to the American bubble. | ||

So yeah, President Trump issued a sweeping declassification statements and other orders along the way, which he can unilaterally do, and that's the law. | ||
