[00:02:04] Just here to watch a child kidnap and government sanctioned. [00:02:08] You're violating our policy right now. [00:02:10] Policy? [00:02:10] It's called the First Amendment? [00:02:11] No, sir. [00:02:12] No, sir. [00:02:12] We have a policy here at Brackenridge, and you are required to sign them. [00:02:16] Violate my civil rights. [00:02:17] Let's do it. [00:02:18] See, because I got $300,000. [00:02:19] These poor people don't. [00:02:21] I want you all in court. [00:02:22] I've seen you. [00:02:23] I've been to these courts where you kidnap these kids a hundred times. [00:02:26] This isn't America. [00:02:27] We have nothing to do with any of that. [00:02:29] You're following orders. [00:02:30] Sir, all I'm telling you is I have a policy that I have to follow. [00:02:33] And in order to follow that policy. [00:02:35] And we've already gotten eight tapes out of here, just so you know. [00:02:38] It's fine. [00:02:39] That's okay. [00:02:39] It's good. [00:02:40] For right now, that's what you need. [00:02:41] What are you doing, sir? [00:02:43] Listening to you. [00:02:44] You sure seem aggressive kidnapping children. [00:02:46] Excuse me, sir. [00:02:48] We would ask that you cooperate with us. [00:02:51] We know you're racketeering and getting children for the federal government. [00:02:55] It's funny when you do all this, isn't it? [00:02:57] You can cooperate, you can leave, and I will have you escorted. [00:03:00] You'll have me escorted? [00:03:01] I will have you escorted. [00:03:01] For what? [00:03:02] I've been called here by this family. [00:03:03] You're causing a disruption to this facility and our patients. [00:03:07] You're causing a disruption. [00:03:08] You're causing a disruption right now to this facility and our patients. [00:03:12] I'm asking you politely to follow my policy. [00:03:15] I'm going to talk now. [00:03:16] No, sir. [00:03:16] I will have you know. [00:03:17] I will have you know that... [00:03:19] We understand this family has to leave before police were here with no warrants, no nothing, and that you're now engaging in false arrest. [00:03:25] Sir, nobody is under arrest. [00:03:27] That family has to leave and has been kidnapped in your hospital. [00:03:30] Sir. [00:03:31] On the record. [00:03:31] We've got witnesses. [00:03:32] This is a great case. [00:03:33] I have nothing to do with it. [00:03:35] Hear about Massachusetts, the big cases they just lost? [00:03:38] Excuse me. [00:03:39] One more time. [00:03:41] One more time. [00:03:44] Well, you can go ahead. [00:03:46] I was called here by a family. [00:03:49] Come in here. [00:03:51] He's alright. [00:03:52] This family called me here. [00:03:54] There you go. [00:03:54] There's the family calling me. [00:03:55] Okay. [00:03:57] Oh, call me the mother, but that's okay. [00:03:59] You notice. [00:04:00] No one's been arrested, but it's color of law. [00:04:02] Civil rights violation. [00:04:04] Color of law. [00:04:05] Let me understand something. [00:04:06] RICO statute. [00:04:07] Visitor or no visitor, if you cause a disruption, you will be asked to leave, and I will have you escorted. [00:04:13] You're the one raising your voice. [00:04:13] You're the one raising your voice. [00:04:14] I'm telling you firmly right now. [00:04:16] Right now. [00:04:17] Okay? [00:04:18] Go ahead. [00:04:18] If you're... [00:04:19] An invited guest, you can see that person as long as you do not create a ruckus or disrupt any of the other persons in this facility. [00:04:27] Sir, do you understand? [00:04:29] You're racketeering. [00:04:30] Sir, do you understand? [00:04:31] I understand there's a racketeering move going here. [00:04:33] We're going to stop your racketeering. [00:04:34] You understand. [00:04:35] Absolutely. [00:04:36] Alex Jones is on the case. [00:04:37] I've ignored this CPS. You're running to me. [00:04:40] You're going to jail, buddy. [00:04:41] Officer just assaulted me to get a... [00:04:43] Good tactic. [00:04:44] Good tactic. [00:04:46] Good move, sir. [00:04:47] I know it's Russian. [00:04:48] Yeah. [00:04:49] Let's just calm down. [00:04:50] Good job on that camera shot on that. [00:04:51] Good. [00:04:52] Calm down. [00:04:52] Officer, you just assaulted me for the process. [00:04:56] Good move. [00:04:57] Classical cop tactic. [00:04:58] Do we need to get APD out? [00:04:59] I think you may need to. [00:05:00] We all want him to leave. [00:05:01] This man is your security. [00:05:02] Let's put him off property. [00:05:03] I would like more police here. [00:05:05] I was just assaulted by the false charges. [00:05:07] Take him off property. [00:05:08] I was just assaulted. [00:05:09] Take him off property. [00:05:11] I was just assaulted by a sheriff's deputy. [00:05:14] Good. [00:05:14] Mike, come get footage of this, please. [00:05:16] You'll need to follow this. [00:05:17] Good. [00:05:17] For the record, come down to it. [00:05:19] They're going to try to block you off while they get this tape. [00:05:21] Good. [00:05:22] We've got the other tapes. [00:05:27] You guys, man, I am leaving this country. [00:05:30] God, this country's gone. [00:05:31] All right. [00:05:34] Anything else that you want to do, that's okay. [00:05:37] God, I am. [00:05:38] boy I can't wait. [00:05:47] You can do it in here. [00:05:49] We have it all on tape. [00:05:50] And that old cop trying to assault us. [00:05:54] Oh, this is... [00:06:00] I'll watch out. [00:06:01] We'll get your kids in this hospital. [00:06:06] Robert, to the left and then to the right again. [00:06:12] Yeah, go cover it, Mike. [00:06:14] Kidnappers. [00:06:15] To the right, sir. [00:06:16] Sanctioned government, sanctioned kidnapping in this building. [00:06:22] Boy. [00:06:24] You're going to be a star, buddy. [00:06:25] Thank you. [00:06:28] Thank you. [00:06:29] You like taking people's kids? [00:06:35] You're sick. [00:06:36] God, you people are sick. [00:06:38] I was in the court on that case. [00:06:40] That little woman did nothing. [00:06:41] Just as she was ignorant and poor, they took her kid, the adoption racket, and you people sit here and smile about it. [00:06:47] God, this country's sick. [00:06:49] Mike, can we get all this? [00:06:51] What's Robert with me? [00:06:52] Good. [00:06:53] There it is. [00:06:54] It's fixed. [00:06:54] Yeah. [00:06:54] Is that what it was? [00:06:55] I guarantee they won't let me back. [00:06:57] What you're talking about was the New World Order that I got in my mind more about talking about. [00:07:03] I mean, the police day was amazing. [00:07:05] It drove me crazy. [00:07:05] I had to cut everything. [00:07:07] No good deed goes unpunished. [00:07:21] That's funny. [00:07:25] I go out here to try to save this kid from getting grabbed by the CPS. I run in, I think about the child, and there's the meter maid, handing out tickets. [00:07:37] I mean, only in America, folks. [00:07:40] Only in America. [00:07:44] Rotten cesspool of the universe, America. [00:07:48] How's it going? [00:07:50] Man, I ran in there for 10 minutes. [00:07:52] I bet you just gave me one of them babies. [00:07:56] Hey, but just doing your job, huh? [00:08:00] All part of the free country! [00:08:02] Meter Maid's already been there. [00:08:12] Then he's gonna hit the next one. [00:08:16] Hey, I thought he just got a ticket. [00:08:19] But no, he gets another one. [00:08:21] Yeah, well, escape. [00:08:28] You only got a few seconds here. [00:08:29] Run while you can, man. [00:08:31] Inside the hospital, they're grabbing kids. [00:08:33] Outside, they're getting tickets. [00:08:37] It's all part of being fed upon. [00:08:41] There's my truck way down there. [00:08:42] No doubt it's got a meter made all over it. [00:08:45] Well, that's just America. [00:08:47] Boy, you get a suntan on a day like this. [00:08:57] The hospital is the prison camp, just like with eugenics or Nazi Germany. [00:09:02] They find that people have a lot more tyranny if it's with the witch doctors. [00:09:07] And there you have it. [00:09:10] Oh! [00:09:12] You got your one, huh? [00:09:13] Ran in to fight for the country. [00:09:15] This is what I get. [00:09:16] So grabbing a child, other arm of government hits me and hits me hard. [00:09:21] ...away from you, right? [00:09:22] Right. [00:09:23] There's no reason at all. [00:09:24] And let's make it clear to the audience that the CPS is outside the door right now. [00:09:28] Yes. [00:09:29] The CPS worker, and I've already talked to her, told her that I was involved with this situation. [00:09:34] She's going to call the supervisor back and... [00:09:36] And we should know in about 10 minutes whether they're going to take the baby or not. [00:09:40] You want your baby, your husband wants your baby, and you do not want them to take it, right? [00:09:45] Right. [00:09:46] It's your God-given right to have your baby with you. [00:09:49] Yes, it is. [00:09:50] And I fear for her life if they take the baby. [00:09:55] This CPS case, Ruben that's here today, said that she didn't see that that was any problem as long as there was a roof over our kid's head. [00:10:04] And they took our kid last time because they said we didn't have proper housing. [00:10:11] And that's not right. [00:10:14] In this case, Rivers said that she thought that was proper housing. [00:10:17] But the last case, Rivers took our kid because they said it wasn't proper. [00:10:22] Yeah, but being poor is not a reason to take children. [00:10:25] This case worker here said that they shouldn't have took Holly because they were them. [00:10:29] They're not letting me out of my room now. [00:10:35] All right. [00:10:39] At risk, hold on. [00:10:40] You tell him, Robby. [00:10:41] Tell him, hold on, Alex. [00:10:42] Go ahead, tell him. [00:10:45] We were living in a motel and they said it wasn't proper housing. [00:10:49] But we've been in proper housing for almost two years now. [00:10:53] And now they're trying to say we're at risk of being homeless. [00:10:55] They want to take this baby away. [00:10:57] No, we're not at risk. [00:10:58] They went to get a guy named Dylan and I think that's the police. [00:11:01] I think it's probably the head of the police. [00:11:04] Oh, I didn't take my baby off. [00:11:06] Robin, keep, I mean, Robert, whatever you do, keep that going. [00:11:11] Yeah. [00:11:13] Come get me if they arrest me. [00:11:16] Yeah. [00:11:17] Well, I didn't do anything. [00:11:20] If they tell us to leave, we're going to have to leave. [00:11:21] To be mine. [00:11:21] Okay. [00:11:22] No, I'm not, but I'm... [00:11:23] But I'm asking security to come, because that's our program. [00:11:26] Okay. [00:11:26] All right. [00:11:27] It's making fun for her to be here. [00:11:29] Oh, we're okay. [00:11:30] Yeah, we're okay. [00:11:31] 10-12. [00:11:32] 10-12. [00:11:33] Oh, yeah. [00:11:34] Yeah, we're always coming on. [00:11:36] 10-12 last night. [00:11:37] Okay. [00:11:37] Thank you. [00:11:39] And CPS removed. [00:11:42] We'll cut our physical today. [00:11:45] They've got paperwork they've taken. [00:11:46] She's been lying a long time. [00:11:48] She's not taking her. [00:11:50] I have to, and I need you to sign her. [00:11:52] I'm not signing her. [00:11:54] There is no physical neglect. [00:11:56] You guys ain't got proof. [00:11:58] You guys don't have some paperwork. [00:12:00] We're not taking her. [00:12:03] This is an emergency removal. [00:12:04] Okay, signed by who? [00:12:06] It's an emergency removal that is good for 24 hours until I see the judge tomorrow. [00:12:12] Okay, who is it signed by? [00:12:14] It's just information to the family that we are removing the child. [00:12:18] Okay, but it's public information. [00:12:19] Who is it signed by? [00:12:20] It's not signed by anybody. [00:12:22] It's not signed by anybody. [00:12:24] Okay, we still have a right. [00:12:26] We legally have a right. [00:12:29] And I legally have the right to keep my baby in my chair. [00:12:33] They said that she could leave, and they were on their way out the door. [00:12:36] Who said she could leave? [00:12:37] The hospital. [00:12:38] Okay. [00:12:39] Not with the baby. [00:12:40] Yes, with the baby. [00:12:42] Without the baby. [00:12:42] She can leave. [00:12:44] Anybody else who's in here wants to leave, she can leave, but not the baby. [00:12:47] The baby's staying here. [00:12:48] No, the baby's not. [00:12:49] The baby's not even supposed to be discharged until tomorrow. [00:12:52] Well, you all took my kid last time on the second day. [00:12:55] Now, what are you saying to that for? [00:12:57] Well, the child is going to stay here. [00:12:59] No, she's not. [00:13:01] Unless you get a court order. [00:13:02] Until you get a court order. [00:13:03] We have legal rights. [00:13:05] Go get a court order. [00:13:07] Hold on, hold on. [00:13:09] Let's be calm here. [00:13:10] Let's be calm. [00:13:11] She's a nice woman, you're a nice woman, and he's a nice man, I hope. [00:13:15] Is it... [00:13:16] Who is backing up the papers? [00:13:20] Judge Meir and Judge McGowan. [00:13:22] Okay, Judge Meir. [00:13:23] Will or has? [00:13:25] That's what I'm concerned about. [00:13:26] Will. [00:13:27] Will. [00:13:27] I mean, we have 24 hours from the date that we remove the child. [00:13:32] Okay, but she's not doing anything. [00:13:34] We have documented that this woman has taken care of her baby. [00:13:38] She's fed her baby on time. [00:13:39] And there's no neglect here. [00:13:42] Physical, doesn't it? [00:13:44] Oh, God. [00:13:44] Physical? [00:13:45] Oh, my God. [00:13:46] Just based on history. [00:13:48] I really am shocked to be American at this time. [00:13:55] I'm very shocked. [00:13:56] I was calling my family. [00:14:00] Come in here and be, you know, he's all right. [00:14:04] Law. [00:14:04] Civil rights violation. [00:14:06] Color of law. [00:14:06] Let me understand something. [00:14:08] Whether it's a visitor or no visitor, if you cause a disruption, you will be asked to leave, and I will have you escort. [00:14:14] You're the one raising your voice. [00:14:15] I'm telling you firmly right now. [00:14:17] Right now. [00:14:19] Okay? [00:14:19] Go ahead. [00:14:20] If you're an invited guest, you can see that person as long as you do not create a ruckus or disrupt any of the other persons in this facility. [00:14:29] Sir, do you understand? [00:14:31] You're racketeering. [00:14:32] Sir, do you understand? [00:14:33] I understand there's a racketeering move going here. [00:14:35] We're going to stop your racketeering. [00:14:36] You understand? [00:14:37] Absolutely. [00:14:38] Alex Jones is on the case. [00:14:39] I've ignored this CPS. You're running to me. [00:14:41] You're going to jail. [00:14:42] Officer just assaulted me to get a... [00:14:44] Good tactic. [00:14:46] Good tactic. [00:14:48] Good move, sir. [00:14:49] I know it's rushing. [00:14:50] Let's just calm down. [00:14:52] Good job on that camera shot on that. [00:14:53] Good. [00:14:54] Officer, you just assaulted me for the... [00:14:57] Process. [00:14:57] Good move. [00:14:58] Classic old cop tactic. [00:15:00] Do we need to get APD out? [00:15:01] I think you may need to. [00:15:02] We all want him to leave. [00:15:03] This man is your security. [00:15:04] Let's put him off property. [00:15:05] I would like more police here. [00:15:06] I was just assaulted. [00:15:08] I'd like to fall charges. [00:15:09] Take him off property. [00:15:10] I was just assaulted. [00:15:11] Take him off property. [00:15:13] That's right. [00:15:14] There's no... [00:15:16] The senator said there's no court order. [00:15:17] There's no... [00:15:18] The senator said it. [00:15:20] I'm going to film on the way out of here because I'm not going to be assaulted like my friend was. [00:15:24] I'm not going to be assaulted. [00:15:26] That was the senator right there. [00:15:28] That was the senator's office? [00:15:29] Yeah. [00:15:30] Could you let me go out first? [00:15:33] Because I don't want anything ugly with that baby. [00:15:36] I don't either. [00:15:36] Believe me. [00:15:37] Why don't you let me go out first and just sort of... [00:15:39] If you walk into white, just five minutes or so and let me go out. [00:15:42] Well, that's what we've been doing all afternoon. [00:15:47] Look, if the police touch me, it's a civil rights lawsuit, Title 42. They know me at... [00:15:52] Travis County, and they know that it's wrong. [00:15:55] I haven't done anything. [00:15:56] I've been very nice to everybody. [00:15:57] I'm very well established in this community. [00:16:02] But see, you're not allowing me to help you with this. [00:16:06] I'm not doing anything. [00:16:08] just I'm not doing anything. [00:16:10] Senator just said I can go. [00:16:28] There's no nobody said the security guard has no authority. [00:16:33] I have custody of this child. [00:16:34] The senator just said I can go. [00:16:37] The senator said she could go. [00:16:39] I didn't. [00:16:41] What was the senator's name that Desi said? [00:16:44] Hello? [00:16:45] Yeah, oh my god. [00:16:48] Stay with me on the phone, Carrie, please. [00:16:50] They're trying to follow the CPS and now the police are coming. [00:16:58] No. [00:16:59] Sir, there's no warrant. [00:17:01] I just checked it out. [00:17:02] I just checked it out. [00:18:31] Let's go. [00:18:34] The media's on their way over here. [00:18:36] I hope Channel 24 and everybody else is on their way over here. [00:18:42] There's a private room here, but we... [00:18:44] They're taking us into a private room. [00:18:51] Yes. [00:18:54] Well, now they're keeping me out. [00:18:55] They're keeping me out now. [00:18:57] Sir, we're going to remind you one more time you're causing a ruckus. [00:19:02] I'm not. [00:19:03] No, I'm not causing a ruckus. [00:19:06] I got proof right here on the phone. [00:19:14] I am telling you as a facility representative, you can cooperate. [00:19:19] Okay, I'll cooperate. [00:19:20] And you can keep the ruckus down or you can be escorted off the premises. [00:19:24] I'm not doing anything. [00:19:25] I'm not doing anything. [00:19:27] Oh my God, my civil rights are being violated. [00:19:29] Excuse me, sir. [00:19:30] If you have another outburst, you will be escorted off the premises. [00:19:33] Outburst? [00:19:34] I'm not doing anything. [00:19:36] Who are you for the record? [00:19:38] I am the director of risk management for this facility. [00:19:40] Okay, the director of risk management. [00:19:42] And if you cause another ruckus and another outburst, you will be removed from the facility. [00:19:45] I think that we didn't cause a ruckus, that we saw a bunch of police officers coming here. [00:19:50] Oh, I am not loud. [00:19:53] What is your name for the media here? [00:19:54] My name is Pam Valls. [00:19:55] For the American statesman. [00:19:56] That's fine. [00:19:57] That is fine. [00:19:58] If you create a ruckus, you will be removed. [00:20:00] But I haven't, though. [00:20:01] You have been very loud. [00:20:03] Oh, was I loud, ma'am? [00:20:05] Who was loud here? [00:20:07] Carrie? === When State Steps In (03:48) === [00:20:08] Who was loud here? [00:20:11] Yeah. [00:20:12] What is your name for the record, please? [00:20:14] Because I'm being told I have to have to follow the order. [00:20:16] Yeah, but it's for the record because it's being told. [00:20:19] Okay, now I'm being outnumbered here by the CPS and everything, so I'm sorry, Jay. [00:20:23] Well, Judy, the state says that Shirley Hauser and her husband don't deserve the chance to raise their two-day-old daughter. [00:20:31] The question tonight is, when the state steps in and takes a baby, is it kidnapping or protecting a child from danger? [00:20:38] That's the focus of our top story at 6. Shirley Hauser left the hospital with a birth certificate, but no baby. [00:20:55] This dramatic scene at Brackenridge Hospital unfolded Tuesday as Child Protective Services took custody of two-day-old Jocelyn Hauser. [00:21:06] It was recorded on home video by family friend and advocate Mike Hansen. [00:21:15] Much of the confrontation was over this notice of emergency removal from the Department of Protective and Regulatory Services. [00:21:21] It was not signed by a judge, but it declared baby Jocelyn would have a risk of physical neglect if she were released with her parents. [00:21:29] CPS maintains it has 24 hours to get a judge's signature. [00:21:33] A day later, still on pain medication from a cesarean section on Sunday, Hauser longs for her baby. [00:21:40] I'm on my desk. [00:21:42] I just stayed awake. [00:21:51] We felt it was in the best interest of the baby that we take temporary conservatorship. [00:21:56] CPS spokesman Jeff Wool was at the hospital for much of the confrontation. [00:22:00] All I want is a chance, a chance to prove what I can do. [00:22:08] But I know I can do this. [00:22:12] But all I want is a chance. [00:22:15] Now the law allows CPS to remove children without permission from a judge in certain emergency situations. [00:22:22] Today, a Travis County judge signed a court order giving the state temporary custody of Jocelyn. [00:22:27] There will be another hearing within 14 days. [00:22:30] And Judy, this is not that uncommon. [00:22:32] The state removes an average of 42 children a month here in Travis County. [00:22:35] Thank you, Clara. [00:22:37] In news this morning, a Central Texas mother claims Child Protective Services has gone too far. [00:22:42] The state agency removed a two-day-old girl from a mother's arms because they say she was considered an unfit parent. [00:22:48] As KV's Ryan Korsgaard reports, the agency says they believe the infant would be physically neglected if the parents had taken her home. [00:22:58] This is not the home video Shirley Hauser had hoped for. [00:23:05] A home video camera rolled as Child Protective Services took custody of Hauser's two-day-old daughter. [00:23:16] They took my son from the hospital and I feel her pain. [00:23:24] Ramona Harris does not have custody of four of her children. [00:23:28] She claims it's because the state believes the children are at risk in her care. [00:23:37] She keeps a video camera by the front door in case the state tries to take the one child she does have custody of. [00:23:43] She left Texas to give birth without fear of having her newborn taken away. [00:23:54] She's afraid they will take her five-week-old son.
