Well, Judy, the state says that Shirley Hauser and her husband don't deserve the chance to raise their two-day-old daughter.
The question tonight is, when the state steps in and takes a baby, is it kidnapping or protecting a child from danger?
That's the focus of our top story at 6. Shirley Hauser left the hospital with a birth certificate, but no baby.
This dramatic scene at Brackenridge Hospital unfolded Tuesday as Child Protective Services took custody of two-day-old Jocelyn Hauser.
It was recorded on home video by family friend and advocate Mike Hansen.
Much of the confrontation was over this notice of emergency removal from the Department of Protective and Regulatory Services.
It was not signed by a judge, but it declared baby Jocelyn would have a risk of physical neglect if she were released with her parents.
CPS maintains it has 24 hours to get a judge's signature.
A day later, still on pain medication from a cesarean section on Sunday, Hauser longs for her baby.

We felt it was in the best interest of the baby that we take temporary conservatorship.
CPS spokesman Jeff Wool was at the hospital for much of the confrontation.
All I want is a chance, a chance to prove what I can do.
But I know I can do this.

Now the law allows CPS to remove children without permission from a judge in certain emergency situations.
Today, a Travis County judge signed a court order giving the state temporary custody of Jocelyn.
There will be another hearing within 14 days.
And Judy, this is not that uncommon.
The state removes an average of 42 children a month here in Travis County.

In news this morning, a Central Texas mother claims Child Protective Services has gone too far.
The state agency removed a two-day-old girl from a mother's arms because they say she was considered an unfit parent.
As KV's Ryan Korsgaard reports, the agency says they believe the infant would be physically neglected if the parents had taken her home.
This is not the home video Shirley Hauser had hoped for.
A home video camera rolled as Child Protective Services took custody of Hauser's two-day-old daughter.
They took my son from the hospital and I feel her pain.
Ramona Harris does not have custody of four of her children.
She claims it's because the state believes the children are at risk in her care.
She keeps a video camera by the front door in case the state tries to take the one child she does have custody of.
She left Texas to give birth without fear of having her newborn taken away.
She's afraid they will take her five-week-old son.
